five years. will finally come to an end. juror in the sierra lamar murder case will announce a verdict in just a few hours at 9:00 a.m. >> kris sanchez joining us live outside the hall of justice in san pc with the major questions the jury faced ahead of making this decision. >> reporter: good morning to you, sam and laura. the biggest question of all is will this jury convict antolin garcia torres of murder? those there is no body. no body was ever found for sierra lamar. the court told us to be ready here at 9:00. we know that they have two courtrooms inside ready for the number of people who want to hear this verdict in person as it's read at 9:00 this morning. today, sierra lamar's family won't get more answers than they already have about what happened to sierra she left home for the bus stop five years ago, but the family may find the jury believes there iszv enough evidence against her accused killer even without her body. wh one of sierra lamar's best

friends, now a 20-year-old woman herself, says the verdict isn't the only thing she and the family want. >> there's still going to be that, like, lingering question of what happened to her. like, we get it, like, this could have happened and this possibly most likely did happen. >> prosecutors hung their case on sierra lamar's dna evidence found in his car and his dna found obher clothing. in garcia torres' defense, theo lawyers tried to make the claim the there is no body because the 15-year-old just ran away and is still alive somewhere. if the jury him not guilty, he can never be tried again for this crime, even if new evidence serviced. in the next half hour, we'll talk about what antolin garcia torres's lawyers told the jury about that evidence and why it shouldn't matter in this case. >> thank you very much. again, to reiterate, we're expecting the jury to reveal the verdict at 9:00 this morning.

we're going to break into our coverage to bring you the verdict live. coming up at 6:30, legalt o ant dean johnson will join us on set to provide insight into the case. >> new this morning, spirit airlines canceled a flight in florida and it leads to chaos. take a look.)rl >> yeah, as you see a brawl breaking out at the ft. lauderdale airport last night after passengers were pulled off a flight because there was no pilot on the plane to fly it. passengers rushing the ticket counter there to spirit employees. police were already waiting for them. that led to this mayhem. three people were arrested as a result. spirit, which has canceled 300 flights in the last few days, blames the pilots unit which is trying right now to get a new contract. spirit has filed a federal lawsuit against its pilots. >> united airlines is looking into an incident reported la investigator chris chmura

involving a customer having his ticket nbcanceled. >> stop, put it down now. >> that is a ticketing agent in new orleans telling the passenger not to film their interaction. he said it started when the agent told him it would cost him $300 to check a bulky bag that cost him $125 to check in the other direction. things got heated from there. things got heated from there avg at an airport is allowed. >> you do not have my permission to videotape. >> why? i want to know why. >> cancel the reservation. >> i want to know why? >> because you did not have my permission. >> the woman was incorrect. he doesn't have to have her permission to film. she's in a public area and he can film as much as he wants as long as he's in the public yare aand so is she. >> he said about a minute after ordering his trip canceled, the united agent started recording him. that agent eventually called police and he was forced to buy a one wayok ticket on another

airline. >> it is 6:05. happening today in the south bay, a major step forward for folks who rent homes and apartments in san jose. >> the city council will consider fast tracking a tenant protection ordinance. bob redell is live with the impact the ordinance could have on renters. good morning. >> good morning. today, the san jose city will decide whether or not to enactñ its just cause ordinance for renter. a new law that requires landlords to give specific cause, specific reasons had they're evicting a tenant. the reason the city might rush it into effect, ever since they approved it last month, there's been a number of landlords evicting tenants without cause. they the landlords are taking advantage of the system before the new rules go into effect. the foundation cites 13 no-cause evictions in the city of san jose over just the past three weeks including robert aguirre who has been living in this

condo in willow glen for the past two years. good because we have been paying rent on time in full every month. >> if the city council does not approve the emergency measure today, then the new just cause ordinance won't go into effect for at least another month andsp half. a group planned to rally in opposition of the ordiance. they argue it makes it difficult to remove problematic tenants and the eight most dangerous cities have these so-called ordinances in effect. the argument being those places are more dangerous because they guv dangerous people safe havens. reporting live outside san jose city, bob redell, today in the bay. >> thank you very much. >> 6:07. san francisco teachers already seeking a new labor deal. plan on rallying today ahead of a school board meeting. the unified school dist$'q is

tried again if he's acquitted in this case, even if new evidence surfaces, including sierra lamar's body. a lot of testimony in the trial was difficult to hear.fá prosecutors told about the dna found in garcia torres's car and his dna found on her clothing. that was graphic testimony. his lawyers tried to convince the jury that evidence was tainted, that investigators were sloppy when they cleblthed it, and they also tried to convince the jury the 15-year-old is home. that's why there is no body. the jury deliberated for just a day and a half, without testimony from garcia torres himself. and lamar's best friend says only one thing would be better than a guilty verdict. >> i would rather him talk. honestly, anything toht help u find where she is exactly would be more, i guess, fulfilling or like a better end to it than a

guilty verdict, because that's not the end, right? >> the jury of six women and six men will read their verdict at 9:00 this morning here at the hall of justice. and in addition to the murder charges in the case of sierra lamar, garcia torres also faces three attempted kidnapping charges in the cases of three ñ years befor lamar disappeared. two courtrooms are set up inside. we'll have crews inside there and bring you the verdict as soon as itsxozmes down. we'll break in live right here after today in the bay. in san jose, kris sanchez, today in the bay. >> thank you. a lot of angles to the case. we have team cosage of the murder case. >> joining us live on set isçó r legal analyst, attorney dean johns a big day for the bay area. we have been waiting for this. the defense brought up the manner of cross contamination on the dna evidence found on garcia torres' car. they're saying that there was some contamination there.

is that enough of a defense? >> well, no, it certainly worked wellçó for o.j. simpson.q/+ñ yeah, cross contamination can be a good defense, but it's probably the weakest defense in this kind of case.t( what you really want to do is wrap a storyline around the prosecution's evidence and say, yeah, this is true, but it doesn't prove guilt. you don't have that alternative here. what you have to do is attack each piece of evidence on its own terms. and create a cloud of doubt around that. >> let me take the inverse of that question. how compel sg the dna evidence found on the trunk and the clothing? >> on the surface, it becomes very compelling. for example, you have a rope with the victim's hair found in the defendant's trunk. if you look at that just quickly, you say, geez, that'sra slam dunk for the prosecution. but if you look at it more closely, maybe not. because you can argue that=)ñ h was put onc later by accident, and if this rope was part of the

murder plan, it should have a lot of dna evidence on it, not just a hu)pr). coa double-edged sword. >> is it surprising the time that the jury is coming back at all? >> yeah, if i were the prosecutor in this case, i would not have slept a wink last night. usually, when%,'ñ jurors come b very quickly in a complex special circumstance murder case, it's an acquittal. again, o.j. simpson is a classic example. >> those are some of the early signs. if they find for a conviction here, whether it's a first degree murder or second degr-ea murder conviction, will it matter in terms of implication for capital punishment? >> absolutely. if it's second degree murder, the sentence is 25 to life. if it's first degreexd murder, plus at least one special circumstance, we proceed to the penalty phase and penalty is on the table. >> what about sierra lamar herself? her body never found. what if they are, could you explain possible double jeopardy, where he would never be tried again. >> hei/k could neverñno beúj tn

neighborhood off verda mes[/6 drive. ñ crews working on the power pole. you can finally see the pole down in this area, as crews try to work on it and clear this area up. li have been deenergized at this point. let's show you some of that video from earlier. we can report at 1:45 a.m. is when we started to see power outages in this area.m! now, the new information from pg&e is that itñr was a weather damaged tree that knocked down that power pole that i just showed you. splitting it in half, knocking out powernof lines in that area. in fact, chunks of that tree flying into nearby ñrbackyards. now, at the peak of the power outage, you had about 2800 people without power. the number now is a shade under 500 at 482 people without power. now, take yougo8 back out here walking towards the scene where the pole is still down. we're south of the middle school

the students were suspended. since then, the students have sued the district accusing administrators of violatingó6# their first amendment rights. tonight's meeting will not be addressing the dismciplining of the students but instead what kind of measures(pj will take e to make sure this doesn't happen again. >> school officials are expected to discuss the possibility of closing don lum elementary after the school expressed serious concerns about earthquake safety. it sits on soil that is at riv otpleatly collapsing during an ñ earthquake. the east bay times reports the school could be closed by the end of this year or next. we'll follow that story. also following a lighter commute overall. the south bay just kicking in for your build. as you would expect, and westbound highway 4 jammed up as well. a crash at harbor street affects the off ramp.
