today, cool, and more clouds moving in and a slight chance of rain. we could use some showers, but we're not going to see a lot of that. here's a live look at san jose, starting out the morning with not much sunshine and temperatures that will be reaching into the mid 60s later today. up to 68 in napa and concord, and 60 degrees in san francisco. i'll have a look at the forecast as temperatures warm up. that's coming up in eight minutes, but mike is showing some slowing right now through the tri-valley. >> it's not unexpected and not very severe, but we'll show you because that's the only area where we see appreciable change. green for the most part everywhere except for the 84 cut through. there's 680 through pleasanton and the castro valley y, now seeing slowing because there are more cars there. very nice on the peninsula, but we'll show you palo alto. there's 101 northbound heading out of palo alto into san francisco. neither direction of the bay shore freeway has a problem in silicon valley to san francisco. >> it's 6:01.

it's another big day in the sierra lamar murder case. the penalty phase begins today in san jose. it's been one week since antolin garcia torres was convicted of kidnapping and murdering the morgan hill teenager. today in the bay's kris sanchez joins us live outside the hall of justice this morning to explain how the defense attorneys will try to spare garcia torres from the death penalty. good morning. >> good morning to you, laura. we can expect antolin garcia torres will likely never be a free man again. the question now is whether he'll spend the rest of his life on death row or whether he'll spend the of his life in prison. in this penalty phase, it's expected both sides will lean very heavily on emotions. his attorneys want the jury to consider his point up to this point, include the domestic violence and incest that happened in his home when he was a child, and the sabta clara county district attorney's office will talk about the impact sierra lamar's kidnapping and killing has had on her

family. >> this is no longer about guilt or innocence. this is now about emotion and the impact of this crime on sierra lamar's family. >> four documents were filed for today, including the district attorney's request for own separate psychological evaluation of tan olingarcia torres. the defense positi's oppositiont violates his right to remain silent, and the d.a.'s motion opposing a doctor's testimony regarding the impact of pesticides on antolin garcia torres, the final motion that was filed is the jury's instructions. that will get started at 8:30 this morning. if the jury of six men and six women is going to commit him to the death penalty, it has to be a unanimous decision. in san jose, kris sanchez, today in the bay. >> thank you very much for that update. >> 6:03 right now, and anothery morning car fire. this actually a van fire in

contra costa county. this happened after 1:00 in the morning on railroad avenue. we have been told the scene at this point has been cleared. according to our photographer who was there, there were no fire investigators that were called out this time around. remember, authorities over the weekend arrested a man they believe is behind a recent string of car arsons in contra costa county. >> happening today, lawyers representing the victims of the deadly ghost ship warehouse fire in oakland plan to file a new complaint with new allegations about the warehouse. >> bob redell joining us with what we can expect to find out in the complaint. bob, good morning. >> well, new allegations is what they're telling us they'll be announcing later this morning at superior court where the attorney representing the families of some of the victims who were killed in the ghost ship fire this past december, the attorney will be filing a new so-call master complaint against the owner of the warehouse that burned and killed 36 people and against the man

who had been leasing the property at the time. the court has appointed attorney mary alexander, a former national president of the association for american justice, to represent the families of ten victims who died in that fire. after she filed in court, she plans a noon news conference during which she'll announce new allegations pertaining to the fire. previous lawsuit filings have accused the owner and lease holder of being negligent and allowing the property to become a fire trap. during the december 2nd concert inside the warehouse, partygoers became trapped with very limited ways to get out. as i mentioned, 36 people died. no citations were ever issued against the property in spite of the fact there were a number of visits by the city of oakland and the oakland department. reporting live here in oakland, bob redell, today in the bay. >> thank you very much. 6:05 right now. developers this morning, i should say developing morning, atf agents are expected to join arson investigators looking into

what is now the second fire in ten months at the same construction site in emeryville. this time, investigators may have more to work with in cracking the case. the $35 million retail and housing project in san pablo and adeline street was scheduled to open in october, early saturday, it burned again like it did at this time last july. no cause for either fire, but industry folks believe it's arson. >> this will have a chilling impact on lenders lending, on insurers insuring, and we have the worst housing crisis in the 35 years i have been in business. >> we mentioned they might have new information this time to figure out what's going on in this case. investigators have something in their favor. developers installed surveillance cameras when they restarted the project. 6:06. a live look at washington, d.c. this morning. the white house is in crisis mode again. a new bombshell report from "the washington post" says president trump revealed highly classified information during a visit with russian officials.

president trump has been tweeting over the last couple hours. he said in part, quote, as president, i wanted to share with russias pertaining to terrorism and airline safety. he said it was for humanitarian reasons and he also wants russia to greatly step up their fight against isis and terrorism. >> within the past three hours, the russian foreign ministry spokeswoman denied a report from "the washington post." the post says the president disclosed information about a specific threat from isis and the information is so sensitive, details have been withheld from allies. >> the problem of a severe shortage of mid-level housing options in silicon valley is taking center stage at a panel discussion in the south bay. you might not realize but it comes as we're marking affordable housing week in the bay area and around the country. in response, a city that has been deing that very topic, mountain view, council members there will be hosting a panel

captured the moment of impact, creating a large fire ball. two crew members onboard were killed in the crash. there were no other passengers and no one on the ground, remarkably, was hurt. >> a follow-up and a break in the case. police say they have arrested leticia monea for vandalizing a san jose preschool. the damage was so bad, the school had to shut down for days afterwards. the transiate is facing burglary, felony vandalism and drug possession charges. here's a look at what the school looked like after the damage was done. police say she windows, trashed and ransacked the montmontessor. we brought you live breaking coverage two weeks ago when it happened. the repairs cost the school about $10,000. >> emergency crews risk their lives to keep us safe, often hiding the emotional pain caused by their high-stress jobs. >> we dive into an industry that has long failed to admit when workers are struggling. we're talking about

alto. we don't think that office will be affected. ford's ceo mark field was always quick to talk about job expansion when he was at the white house. layoffs, not so much. well, not even a world-malware attack can discourage wall street. nasdaq will open this morning at another record high. we often say the unrest at the white house might worry investors about whether they'll get their big tax cut, but even the talk of russians hasn't knocked wall street off its stride. security researchers say they have been able to link the wanna cry malware attack over the weekend to north korea. wanna cry shut down computers all over britain, hit particularly hard. the screen shows a ransom demand, your data has been encrypted and you can't get it back unless you pay. the head of disney said that company has been hacked and hackers stole a copy of a movie. we're pretty sure it's the latest version of "pirates of

system moving in, showing some clouds and also some light rain. this will have more of an impact to the era, bringing rain and snow. light snow at that, but we'll also have a chance of some light rain moving into the bay area today. and this is the way it pans out going hour by hour. we are mostly clear now, but look at how quickly these clouds roll in. by 9:00 or 10:00 this morning, it will be mostly cloudy. then we will at times see light rain moving in. we're not expecting a big coverage of showers. anywhere you see some green is where we might have a little rain moving throughout the day, even later on tonight for parts of the south and east bay, a couple sprinkles, not going to measure more than a few hundredths of an inch. and then the temperatures starting to warm up. this is a look at the warming trend. in the low 60s for san francisco for the next couple days. before you know it, 70s by the end of the week into the weekend, a lot of sunshine in the forecast. for the inland areas, we'll have

area. no problems for the dumbarton bridge, and a mild build on the east bay. no build on the peninsula as far as speed sensors are concerned. south bay and bay bridge toll plaza metering lights on. i'll check with the wazers and thecvh chp for the bridge. >> thank you, mike. >> happening today. voters passedçó new marijuana ls in california. now cities across the state and in the b11narea trying to figure out how to regulate mare wayna use. >> the walnut creek city council is holding a special meeting today to talk about the drug. pete suratos joins us live in walnut creek to explain how people feel about legalizing marijuana. good morning, pete. >> reporter: good morning to you, laura and sam. yes, the city council here in walnut creek will discuss during a special session later this afternoon on how best to implement prop 64, which passed overwhelmingly in the city of walnut creek this past november. this is after a month-long effort by city officials to see what residents feel about the issue today. part of the outreach effort, they put an online survey out

there which 1600 people took part in. the numbers that stood out in the survey were that 60% were in favor of outdoor and indoor commercial marijuana cultivation. also, 62% favor reasonable regulations. and then also, another number that stood out there, 60% oppose banning stores that exclusively sell mare wayijuamarijuana, wal voted 61% in favor of prop 64, which legalizes the adult use recreational marijuana. i had a chance to speak to a city manager as well as a marijuana doctor about the results of the survey. >> 61% of the population did approve prop 64. generally, we're picking up we have the same support retail and commercial sale. >> there's definitely a pop that's looking to use marijuana medically, but do they want the dispensaries in their communities, do they want the plants grown in their communities? that's sort of a different

story. >> now, during tonight's meeting, the city council will vote to extend the moratorium on the commercial sale of marijuana as well as adding marijuana to the city's current smoking ban ord. that's something residents overingly support according to the survey they put out about a months ago. the special session will take place today behind me at city hall at around 4:00 p.m. pete suratos, today in the bay. >> thank you for the details there, pete. >> 6:33. just in to our newsroom morning, a man arrested for drug possession at a b.a.r.t. station in the east bay is now behind bars for murder. b.a.r.t. police arrested the man early this morning at the bay fair station in san leandro. investigators say the man lied about his name. after they ran his fingerprints, they discovered he was wanted in seattle for murder and failing to register as a sex offender. >> new this morning, a rash of recent bank robberies in antioch has many concerned this morning. we're learning about three

separate banks that have all been hit recently. starting on april 17th, followed by wells fargo on deer valley road on may 10th and the latest on lone tree way. at this point, police are only giving us details about the latest incident, say the suspect was masked and armed. so far, no arrests. >> friends and family say east bay high school senior shane mars elena was filled with grace and beauty. she was killed in a crash on mother's day in fremont. dozens of friends and family came out to honor her short life. the event was held at st. ann's catholic church in union city last night. she was in an early morning car crash on sunday, just hours after she attended her senior prom. her mother was driving the car and suffered major injuries. >> just coming home from prom. a night that was supposed to be fun, and then to enjoy mother's day with her mom and to have that change in an instant is

something that is heartbreaking. >> i try to talk it out with friends, but everybody has their own way of grieving. >> she attended logan high school in union city and was expected to graduate with honors next month. police are looking into whether drugs or alcohol played a role in that crash. antioch leaders right now are asking commuters to use b.a.r.t. stations to give them insight for an ongoing study they're doing. north concord antioch b.a.r.t. access study is looking into new pedestrian, bike, and car lanes in eastern contra costa county. b.a.r.t. right now is seeking feedback for its north concord and pittsburg bay point stations along with possible future stations as well. >> some construction going on to tell you about this morning. the new phifer canyon bridge is continuing to be built in big sur this morning after that wreckage during the recent winter storms. traffic will be impacted in the yare caw as crews deliver construction equipment and materials there. that bridge about 50 miles south

of monterey was heavily damaged in the winter storms. >> with a big rock concert tomorrow night at levi's stadium, there's also big concerns about transportation options. u2 will perform in a show scheduled to get under way at 6:30. it may finish late and vta is warning attendees right now there are no plans for expanded special event service before or after that show. but things may still change. tonight, santa clara council members will debate picking up costs cover last-minute additional vta service. >> also probably concerned because u2 sings about where the streets have no name, but they're all labeled around the bay. we're talking about no major concerns for the flow of traffic. the east shore freeway just starting to pick up the vol om. heading to the bay bridge with a smooth flow of traffic there. we have no delays for transit systems. the 10:00 a.m. through 3:00 p.m. service for pier 31, will be
