well. temperatures will be dropping today. we'll feel it? >> yes, we'll feel it a little today. it will still be warm this afternoon for a couple hours. i think this will be much more comfortable than the weather we had recently. so looking at what to expect as we get a live look outside at san jose, the sun rising. you can see the skies are clear. it's 60 degrees as you head out with a high today of 84 degrees, which is still well above where we should be, and looking at that temperature trend, we'll spend most of the morning and early afternoon in the 60s and 70s. so we'll talk more about that and what's ahead as the temperatures continue to dip. as we head over to mike, now you're tracking two delays? >> yeah, one is for the b.a.r.t. system, continuing as far as their report goes out of daly city, that's the abbreviation for that. they're doing track maintenance after the weekend derailment in the area. this is not causing a problem other than a minor delay right now. maintenance crews trying to

clear. meanwhile, the rest of the bay, the sensors moving well. a little debris in the south bay. tracking that for 101 and getting to the bay bridge, we take a live look out there, berkeley curve with that construction just about clear. one set of flashing lights, but a better flow to berkeley. >> thank you very much. >> we start with breaking news out of sunnyvale. firefighters on the scene of a structure fire on lake side drive and titan way near lawrence expressway. >> kris sanchez live at the scene for us. what can you tell us? >> reporter: we can tell you that this is still very much an active scene. we don't see flames. i'll step out of the way so you can see what's happening behind us. this is a building that is kind of a mixed commercial building. we see a nail salon there, also we see looks like a cafe. right now, you can see the firefighters using an aerial assault streaming water through the rooftop, and you see the smoke coming through the top of that building. i count one, two, three, four, five, six, seven, eight engines.
5:02 am
although just a few of them appear to be responding right now. two ladders, though, there in the distance. just a few moments ago, i did see a number of firefighters leaving the building and dragging the hoses out with them. often, that means the fire is knocked out and now they're just watching for hot spots. because it is an active fire, we don't have a lot of information right now. other than what we're seeing, but we are trying to see if we can free up a firefighter perhaps to give us some information. we'll work with sunnyvale to get information about the fire. this started about 3:22 this morning, and again, it's right at the top of the 5:00 hour, and we're still seeing smoke. this is going to be an active scene for a little while longer. only local traffic will be impacted, and because this is a commercial and industry area, i don't think there's going to be a lot of impact until folks start heading toward work. that will be later on. >> thanks for the latest there. >> now to breaking news.

5:09 am
from the site where the high school would be. which has been there for 15 years. we have never had an issue with the elementary school. our city is two miles wide and seven miles long and the jail sits in the center of the community, so there are homes near the jail, there are parks near the jail. >> the elementary school that the district is referring to is james doherty, which is about one mile away driving distance. dublin unified tells us in conjunction with the police department, it has researched crime data and discovered crime is relatively low in the area surrounding the jail. out of ten locations considered for location, it is affordable and the building is in place. the board will vote on whether or not to move forward with the purchase agreement. if the board votes yes, they'll have 120 days to make sure it's viable and suitable. >> 5:09 right now. a saratoga high school student

kari and mike. 5:43 right now. state lawmakers are in the process of pulling back on a law allowing people to carry guns in school zones. a few years ago, legislators approved an exemption allowing people to carry firearms on school campuses to insure safety for domestic violence survivors. now, lawmakers say the law is being exploited by other school workers. assembly members voted to revoke the exemption. it now moves to the state senate. >> we're talking about state legislation, a bill that stops landlords from threatening to call immigration authorities on their 10 nlts has been approved by california's assembly. that bill, sponsored by san francisco assemblyman david chu, regulates how landlords and private business owners act with federal immigration agents. >> 5:44. the president is headed to rome with a meeting with the pope. >> meanwhile, in washington, investigation into the white house grows. and scott mcgrew is watching all of it. >> air force one set to leave

pressured comey, but new allegations say he tried the same thing with the director of national intelligence and the director of the nsa. both have said turn the president away. if this is true and several news agencies including nbc say it is, this is exactly one half of the evidence need to charge obstruction of justice. the other half is intent. and critics have that, too. according to notes from that meeting, the president told the russians in the oval office, he fired that, quote nutjob comey, to ease the pressure of the investigation into his campaign. and we all watched as the president linked the firing of james comey to the russian investigation voluntarily during an interview with nightly news anchor lester holt. this was so historic, so plainly worded, such a flabbergasting adof intent, "saturday night live" parodies it. >> your staff has been insisting all week you didn't fire him because of his russian investigation. >> no, i did.
5:47 am
>> wait, what? >> i fired him because of russia. i thought he's investigating russia. i don't like that. i should fire him. >> and you're just admitting that? >> uh-huh. >> but that's obstruction of justice. >> sure, okay. >> wait, so did i get him? is this all over? >> lots going on today. the president, as we said, on his way to rome. his budget hits the halls of congress this morning. we're watching it all for you. >> a lot to watch. thank you very much. >> 5:47 this morning. pretty incredible video of a massive landslide at big sur in monterey county. it changed the coastline. the area was closed off after several rock and mudslides over the winter but things got much worse over the weekend, completely wiping out a huge section of high way 1. the highway is closed to a half mile south of big sur. >> this as they're trying to rebuild the canyon phifer bridge

and the north bay will be up to 81 degrees. milder temperatures, so as you're getting ready for today, you're looking out the window in the closet, thinking how do i get ready? you do need still the sandals. it will be a very warm afternoon, especially for the valleys. but also some short sleeves. not really that much of a cool start, but we'll be putting on more layers as we go through the week, as the morning temperatures will be dropping and getting the kids ready for school, it will be a mild and clear start. especially for the inland areas away from the coast, and at recess, lots of sunshine. a very nice day. and feeling much more comfortable as we go into this afternoon. if you're wondering how we're doing as far as rain, we're still well above average with all of the rain that we had for the winter. water year still on track, well above average in santa rosa, 60 inches of rain. san jose still at 120% of average. which is just over 18 inches of rain. as we get a look at the seven-day forecast, we stay in

the low 60s over the next several days in san francisco inland valleys will go from 89 today to 75 heading by the end of the week. into the weekend. mike says there's an issue now for san francisco. >> yeah, getting into the san francisco area over the bay bridge. let's show you the speed sensors around the bay, and we're show agreally typical pattern, just getting started with mild slowing in the usual spots, for hayward and also for san jose, north 101. but across the bay bridge, i saw the slowing and then the reason came in on chp's report. there's a disabled bus there as you get toward harrison off the westbound direction of the bay bridge. so that may be an issue if you don't clear that quickly. sounded like bridge crews were going to take care of that. really quickly, and we'll track it. we'll also track the rest of the community using waze. you can compare your route. even though there's a backup at the bay bridge and a slow drive right now, you may be tempted to avoid it, that's the green line. looking at the purple line which is a much more direct route through the congestion, still saving you about a half hour. that's the wise choice.

>> here, stephen stock discovered that can make a huge difference. >> well, good morning. you know, we dug through immigration court outcomes compiled by the transactional records access clearing-house, or trac, at syracuse, and there we found that people who appear in u.s. immigration court with an attorney are five times more likely to prevail than those who do not have a lawyer. nowhere is that in more stark contrast and more apparent than here in san francisco in the case of u.s. navy veteran joaquin sotelo. when we caught up with him, he was days away from being deported despite a history of military service. only the last-minute intervention by a lawyer with san francisco's legal firm kept him here in the bay area and his case moving forward in u.s. immigration court. sotelo was more than of more than 300 veterans who face

deportation after committing a crime after leaving military service. in his case, he was able to reunite with his children who he hadn't seen in four years of legal back and forth. children he likely wouldn't have ever seen again on american soil if he had been deported. homeland security officials tell me they're merely enforcing existing laws by deporting these veterans who break the law after their service and a u.s. immigration court judge told me that judges' hands are tied in immigration court by these out dated laws that need to change. if you want to know more, see our full story tonight at 6:00. or go to our website, nbcbayarea.com/weinvestigate. back to you. >> if you have a tip for our investigative unit, give us a call, 888-996-tips or send us an e-mail. >> all right, news now. concerning o.j. simpson, he could be released if a july parole hearing goes his way. the former football star turned
