our temperatures will be going up. as you get ready to step out this morninger it's cloudy. look at the anderson reservoir near morgan hill. it is cloudy there, and our temperatures have starting out in the 50s, heading into the low 70s today. and livermore, san jose, palo alto, up to 72 degrees. 73 degrees in napa. concord, 75. and still in the upper 50s to low 60s along the coast and in san francisco. we are taking a look ahead to that warmer weather. i'll have a look at that coming up in about seven minutes. mike says there's a crash and a b.a.r.t. delay. >> that's right. first note, they are separate. the crash is not related to the b.a.r.t. delay. it does not involve b.a.r.t. at all. there's an equipment problem reported out of the lake merritt station, which by the way, reopened after the weekend maintenance work over there. that has created at least a ten-minute delay, and we're tracking this to see if any other problems happen there. on the roadways, we have a smooth drive, but i'll take you over to the tri-valley with the most dramatic change in the speed sensors. we have a lot of slowing now

southbound 680 from dublin in san ramon down across the interchange to stone ridge where there's a crash involving a motorcycle in the middle of the freeway. it sounds like the rider is able to walk around, and that's good news but we'll track this for the updates. back to you. >> thank you so much. 6:02 right now, and a safety warning as we head into the summer season and more people are heading to the beach. getting a look at new video showing the coast guard rescue. this is actually near santa cruz. again, another problem with people out on the water. today in the bay's pete suratos joining us live from oyster point in south san francisco this morning. pete, we're seeing a troubling trend developing here. good morning. >> good morning to you, sam. we have seen several of these water rescues in the past month by the coast guard, including one near the oyster point area where we're standing right now, but that latest one in santa cruz. let's show you some of the video. the coast guard using what looks to be helicopter for the air

rescue of a kite surfer. according to the coast guard, they received a report about the kite surfer around 4:00 p.m. yesterday. the crew members were eventually able to rescue the kite surfer who didn't suffer any major injuries. a few days before that in oyster point, a kite surfer and instructor were rescued near this area, but we're told from a coast guard member not too far from here, it because more towards san francisco airport where the person was rescued, and in this case, both individuals weren't wearing life jackets and had to hold on to a buoy during that rescue. with all this said, coast guard is reminding folks to be aware of your surroundings in the water, and if possible, travel with a group so someone can call for help if needed. we're live in south san francisco. >> thanks for the latest there, pete. breaking news this morning. nbc news confirming the white house communications director is resigning. a senior official says mike

dunke gave a letter of resignation on may 18th and agreed to stay through the overseas trip. he served for just three months with the trump administration. excuse me. sources say he didn't get along well with others in the white house. his last day has not been set yet. >> it is 6:04. oakland city council is considering a $1 million payout in a sex abuse case that rocked that city's police department. the oakland city attorney recommending that officials do go ahead and approve a nearly $1 payout for a claim filed. she told investigators she had sex with as many as 30 members of east bay law enforcement agencies, some of them when she was still a minor. the original claim sought $66 million in damage. >> 6:04, and happening today, big step forward in the sierra lamar murder case. this morning, prosecutors will get their chance to make closing arguments in the antolin garcia

torres murder trial. kris sanchez joins alive outside the hall of justice this morning. good morning. >> good morning, laura. there are two things that will not happen today. antolin garcia torres will not take the stand in his own defense, and we will not hear from the detective who was discredited in another case, and that testimony that put him under fire in this particular case. now, before the four-day break, jurors heard emotional testimony from antolin garcia torres' own mother who testified about the poverty and violence that were part of his early life. the judge only allowed some part of that kind of testimony. before that, the jury also heard from sierra lamar's parents, her sister and friends, who told them what life was like for them since garcia torres kidnapped and killed the 15-year-old. another thing that could be in play today, though, is an exchange of information. if garcia torres reveals where sierra lamar's body can be found, he could spare himself

from death row, but up to this point, his lawyers have maintained that he did not kidnap and kill her. the jury had a four-day break away from this courthouse, so hopefully they will come back refreshed and ready to listen to some more emotional testimony. it will be a tough day for them and a tough day for the family as well. in san jose, kris sanchez, today in the bay. >> kris, thank you very much. >> 6:06. a developing story out of iraq. we have learned at least 15 people have been killed after a car bomb exploded outside of a popular ice cream shop in central baghdad. this happened in the middle of ramadan as fast was being broken. 24 more people have been injured as well. isis has claimed for that attack. >> 6:06. new this morning, the railway station next to the manchester arena where 22 people were killed in last week's terror attack is back open. victoria station had been closed since monday's attack. the city's mayor was among those laying wreaths at the station.

he said the city pulled together through what has been our darkest week. 14 men have been arrested in connection with that attack. >> a man accused of stabbing and killing two good samaritans is expected in court to be formally charged. pleem arrested jeremy joseph christian after they say he stabbed and killed those men on a light rail train in portland. a third man was also injured. all three victims were trying to stand up for the right of two muslim women who were being targeted by that suspect, according to police, in a racist rant. >> 6:07. a los gatos school senior is defending his prom proposal that many are seeing as racist. the student spoketuse. he didn't want his identity shown. he said he used a personalized emoji known to a bit moji to ask a girl to the prom. when that didn't work, he showed up to her house in black face. he said his intentions were

were, as this fire erupted yesterday. the building itself has been used as a backdrop in movies like "the blues brothers" and tv shows like "prison break." luckily, no one was injured in the fire. >> all new this morning, if you have ever been sitting in the plane and thought, please let me get out of here, southwest airlines is going to try to help you out. they're going to see if two is better than one when it comes to off loadings. the the etwo weeks, the airline is going to test out letting people out in two places, in the front like normal and also at the plane's tail. now, the tests will be taking place in sacramento as well. southwest already uses the same procedure for its flights landing in burbank. >> 6:14. credit scores reached a record high this spring, while the number of americans deemed risky borrowers hit a record low. a report finds the worst financial setbacks, foreclosures and bankruptcies, are falling off credit records with more

some more comfortable weather as the day goes along. i want to show you what to expect. 55 degrees now and heading up to 72 degrees today. it may also be misty as you drive around for work or school. by this afternoon, there will be some clearing as our temperatures stay a little on the cool side. for the rest of the week, our temperatures will be climbing each day. getting you out the door with what to expect. it's 54 degrees and the peninsula looking live at palo alto and the tri-valley. 53 degrees. 49 degrees in the north bay, and today, the high temperatures reaching into the low 70s. for the peninsula, south bay, and tri-valley. three more microclimates showing the spread in temperatures from the north bay at degrees to 61 degrees in san francisco and the east bay at 63 degrees. if you're planning to hit some of the hiking trails in the east bay, it is going to be cludy during the morning. but there will be some clearing by 10:00. and then by 2:00, we're in the upper 60s with mostly sunny

skies. and keep in mind, it will be windy. if you're going to be hitting the roads during this short week, maybe you're heading to heavenly. i want to show you the forecast there, too. it will be in the mid 70s for today, but then tomorrow, a chance of some thunderstorms before some slightly cooler temperatures for the end of the week. we are going to be warming up, heading into the low 70s in san francisco for saturday and sunday. for the inland valleys, up to 86 degrees by the end of the weekend. so enjoy the cool and breezy weather we're starting out the work week with. heading over to mike, you may have to allow extra time to get to work. >> b.a.r.t. is reporting everyone on the system right now has a potential for some 15-minute delays. i know the website says ten minutes, but we're getting intercepting tweets out there. not intercepting, but they say 15 minute delays were just announced from the overhead system. we're going to go with that. some sort of equipment problem, so what contributed to the delay.

busy shopping center in the east bay. this is the third officer-involved shooting in the region just since sunday. today in the bay's bob redell joining us live from the scene in fremont with what led up to the latest incident and more from the people who witnessed it. good morning. >> reporter: good morning to you, sam. this shooting happened here in this shopping mall off mowry avenue in fremont. this cell phone video shot by a woman witness gives you a sense of what the scene was like after the police officer shot a man with a metal pipe. we know this man was in his 20s. still trying to find out who he is and what kind of condition he's in. it happened around 4:00 yesterday afternoon. a shopper in the area notified an officer who was on regular patrol this man was waving the pipe, threatening people. it was a metal pipe. the officer chased the man until he stopped running. police tell us that the officer was about ten feet away from the man. the man still holding this ten-inch pipe. police say there was then a confrontation. the officer opened fire.

a witness tells us the man was shot threes. at least once in the shoulder, once in the stomach. >> he had his hands up. he mentioned love, and then he mentioned no, don't, or something. >> quickly unfolded within one to two minutes, was when all of this unfolded. >> reporter: fremont police tell us they did call for paramedics who then transported the man to the hospital. again, his condition is unknown. as is normal with officer-involved shooting, the alameda county district attorney's office will be conducting a separate investigation parallel to the one conducted by the fremont police department. this is the third officer-involved shooting this week. you had the one in fremont yesterday. on sunday, you had one in san jose. and another one yesterdayen vacaville. reporting live in fremont, bob redell, today in the bay. >> you mentioned that incident in vacaville. today, we could learn the name of the victim in the police shooting there. bob finishing his live shot.

as we get more information, we're waiting from vacaville police, that could come as soon as today. detectives are looking at body camera and dash camera footage as they try to figure out what specifically led up to the shooting. this happened early yesterday morning on nut tree road by the outlet there right off interstate 80. >> 6 clr 34. the investigation continues this morning at the dublin water park where a boy flew off one of the slides this weekend. a photographer with the east bay times shot this shocking video. you can see boy fly over the side of that slide. he skids across the pavement. he had only minor injuries. the wave water park is owned and operated by the city of dublin. it cost $43 million to build. a statement from the manufacturer white water reads in part, we are thankful the 10-year-old involved in the accident walked away without serious injury. we're working closely with a team at wave and both of their high-speed slides have been shut down pending a full investigation from the white water team.

>> it's 6:34 on your tuesday. students at three different san jose schools will have to live without heating and cooling for a little while longer. reporting that new heating and air conditioning systems will not be installed until next year. all of those are in the alum rock school district. the district is instead building a new multipurpose room at two schools with money from voter funded measures. the district's construction payments are being investigated right now. >> happening today, vulay leaders will consider a last-tich effort to get a cement plant built on the waterfront. the planning commission recently shut down the application. the company wants to build a large cement production facility. opponents have come out in force against that plan. they will today appeal to the city council. >> there is a warning right now about the water. harmful algae blooms are spreading through our waterways and covering up lakes and rivers. you see the green muck there. it can vary in color from green

to turquoise, black, sometimes even red. if you spot them, that's a sign, stay out of the water. toxins can be bad for kids and deadly for animals. marin county's new and improved civic center in san rafael opens today. the $6 million project adds bike lanes. landscaping and a round-about traffic circle. there's also a link to the new smart train station. >> and that is not far from the north san pedro off ramp which is moving well for highway 101 through san rafael. good stuff for the north bay, and most of the bay just starting to see the slowing. a build for the south bay. san mateo bridge, i showed you that, and hayward has build as well. on the same latitude over here, the dublin interchange, this continues to be a problem. the crash, southbound 680, involving a motorcycle, still has the motorcycle in the middle of the roadway. i'm the tow truck they need is right there at the dublin

interchange. southbound, you have to go down one more exit to stone ridge and hopefully quickly clear that. minor injuries, but we're seeing the build-up affect the 580 approach as well because folks are seeing the interchange. meerm, getting to the toll plaza, no major issues, but gloomy skies there. i forgot to mention, b.a.r.t. has delays coming through the oakland area. 10 to 15-minute delays because of some sort of equipment problems around the lake merritt station. >> good to know. >> all right, speed bump. thank you, mike. we just came off a holiday weekend. you were saying it's a short weekend for many. >> that's right. >> looking forward to the next one. >> already planning for the weekend, which is great. >> why not, because we're going to have slightly different weather. it's going to be cool today. only reaching into the 70s for the inlandies. this weekend, it will be about 10 to 15 degrees warmer. so how about that? 72 degrees inland for saturday's forecast. the bay will be at 77 degrees for the high. and the coast up to 69 degrees.

for sunday, not bad either. up to 71 along the coast. and the bay will be up to 80 degrees, and 85 degrees inland. there's a lot of sun in this forecast. and if you're checking out the shasty lake area, going farther to the north, it's going to be in the upper 80s for both saturday and sunday. 84 degrees on sunday with some sunshine. for yosemite, it's going to be a little cooler there. up to 68 degrees in parts of the sierra. saturday, 70 degrees, and 69 degrees with more sunshine there on sunday. if you want to go from the mountain areas, maybe to the beach or heading down to l.a., it will in the low 70s there. no issues. a lot of sunshine in that forecast. and keeping it closer to home, heading to santa cruz, it will be in the mid to upper 60s this weekend. right there along the coast, a little warmer for downtown santa cruz. but it will still be a very nice weekend to head out there,

6:49. >> and we're looking at slower speeds for the tri-valley. crash on 680 south of the dublin interchange, but also slowing for westbound 580. we'll track that and maybe give you a work around coming up. thank you very much. it is 6:43 right now. live pictures from oyster point in south san francisco where a kite surfer and instructor had to be rescued over the weekend. one of three water rescues over the long holiday weekend. the latest happened yesterday in santa cruz where the coast guard said you must be vigilant of your surroundings in the water. you never know when the conditions can kanj. you should also head out with groups if possible so someone can call for help if needed. >> right now, there is a deputy shortage at the san francisco county jail. the examiner is reporting the sheriff has decided to order 840 deputies to work mandatory overtime until september to try to compensate for that. the department has already spent 22% more in overtime this year than just compared to last. sheriff vicky hennessy said the

jail should be staffed right now by about 915 deputies. she planned on hiring more by next summer. >> 6:43. we could have a verdict in the trial of three santa clara county jail guards accused of beating an inmate to death. jurors will continue deliberating this morning. prosecutors say the 2015 death of michael tyree was an abuse of power by the three deputies. the defense the meantime is questioning much of the evidence in the case. the guards face life in prison if convicted. >> new details on a story we first you yesterday morning. an 82-year-old man chased down a suspected burglar who was beating up his wife, now she's speaking out. the 77-year-old said a woman attacked her with a stick in the back patio of her house sunday night. her husband quickly jumping to her aid to rescue her. >> i bend over for my shoes. i see somebody hit me. and i go, oh, my god. a second time, she goes two, one

after the other one. she doesn't give me a chance to get up. >> scary. violent. her husband ran after the woman, held her down until sheriff's deputies arrived. they arrested her. the 50-year-old for assault with a deadly weapon, attempted burglary, elder abuse, and a probation violation. christina was taken to the hospital, but thankfully she's back home and recovering this morning. >> the secretary treasurer of one of the largest teachers unions in the country will be in daly city today. loretta johnson will be leading a discussion on school discipline practices and equity in public education. the union says johnson's bay area visit is part of a push to create a fairer learning environment for students, families and teachers. >> follow-up for you. university of california will reportly pull the plug on reimbursing regents for dinner parties. they found janet napolitano's

office reimbursed regents more than $200,000 for swanky parties they say were held over the past five years. now, the uc going forward will not do that. it was regent who apparently suggested they pick up the tabs themselves. by the way, uc covers those costs through a private endowment and not through state or tuition funds. >> the former dictator of panama, manual noreyaga has died. he was removed when american troops invaded panama in 1989. he was later jailed in the u.s. on drug and money laundering charges. he was also trialed in france. he was 83 years old. >> more than just a little tension at the texas state capitol. lawmakers on the floor of the legislature almost came to a brawl. this is video of a scuffle during which you can see lawmakers gathered around, apparently making threats of violence against one another. this happened yesterday, the last day of the state's

legislative session. it started after republican representative said he had contacted i.c.e. agents as hundreds of people were protesting inside of the capitol. they were there to oppose the state's new law banning sanctuary cities. hispanic lawmakers say they heard the i.c.e. comment and got enraged. >> happening today, many calling a response by the u.s. to north korea. the u.s. will fire a ground base missile from vandenberg air force base. it's supposed to intercept a target flying over the pacific. the test comes amid heightened tensions with north korea. a shakeup at the white house. the director of communications is out, and a controversial past adviser is back in. >> yeah, scott mcgrew, a familiar face, corey lewandowski coming back to the white house. >> he is. a white house full of controversy, sam, unlikely lewandowski is going to make it less controversial. nbc news has confirmed he will be a top adviser.

lewandowski, you'll remember, was donald trump's campaign manager who stepped aside in a power struggle with paul manafort. lewandowski went on to become a cnn common taert. meanwhile,ications director mike doneke is stepping down. he's the boss of the more well known white house spokesman sean spicer. president trump tweeting russian officials must be laughing at the united states and how lame excuse for why the dems lost the election has taken over the fake news. he is of course referring to the investigation into the connections between his campaign and the kremlin, which is not news. the fbi, justice department special counsel, the senate, the how, have all launched investigations into those connections. remember, both the attorney general and the national security adviser at the time both got caught not telling truth about meetings with russians. while the trump administration has tried to court the kremlin, perhaps, other world leaders are
