wednesday morning at 5:00. halfway there. taking a live look outside the beautiful city by the bay. san francisco, look at the lights gleaming. thanks for joining us. i'm laura garcia-cannon. >> i'm sam brock. we're seeing springaling, in some cases, a little more rain than on your drive to work. trying to wake up. >> yeah, let's take a look at the radar because us early risers in the south bay had to deal with rain this morning, and then elsewhere, you are just seeing some light rain rolling through that is out of the area now. looking at the radar, you can see where we're still seeing the showers coming down in san jose. and then as you head farther south, it gets heavier, and this is all moving off towards the east. looking at high temperatures today. after this moves out, we'll get

some sunshine and highs in the low 70s for livermore. we'll be up to 72 degrees. san francisco, 61. and 75 in santa rosa. mike, you still have lanes blocked on 101? >> we do, and also the effects of what you showed the green on the radar, that's where we show the green on the road weather index, indicating maybe slicker roadways, mist and drizzle at the last. we're showing slowing for 1. someone at the bottom of the screen, northbound, and speeds starting to back up. slowing just before you get to metcalf. just changed from yellow to green once again. now we're down totwo lanes blocked, two lanes open. northbound 101 at bernal road. an earlier crash left debris. we're tracking that into san jose out of morgan hill. looking over here toward the approach to the bay bridge, no delays for the east shore freeway. >> thank you very much. >> 5:01. breaking news to get to out of kabul, afghanistan, where we have learned at least 80 people are dead, more than 300 wounded in a suicide bombing that

detonated hundreds of yards away from the german embassy there in the diplomatic quarters of kabul in a packed part of town considered to be one of the safest in the city. employees were injured, although none of those were serious. most of the people killed in the attack were civilians. of that population, mainly women and children. this is a powerful blast, so much so it blew out windows of buildings a half mile away. the taliban issued a statement saying they had nothing to do with the attack. >> in the meantime, in paris, the ief the eiffel tower went dark at midnight in honor of the victims killed in the attack. the two car bombs killed at least 20 people and injured another 80. isis did claim responsibility for boat of those attacks. >> new this morning, some sort of overnight activity in san jose in the area of branm lane

east in san jose. not clear what it is connected to. it appears police officers were surrounding a car in a parking lot of the edenville branch library. once we have more information to report, we'll bring you an update. >> also new, dozens of jetblue passengers back on solid ground after a laptop battery caught fire. >> it actually did happen now onboard a plane headed for sfo from new york city. taking off from jfk. the emergency plane was diverted to grand rapids, michigan. reaction from some of the frightened passengers who finally did get back home. good morning, bob. >> reporter: good morning to you, sam and laura. shocking and scaryering according to one woman who was on the flight. to hear a flight attendant announce there's a possible fire in the back of the plane at row 25, it turns out the smoke was coming from a storage bin above

that row. when the crew member opened the bin, she found a burning backpack with a laptop inside. the faa blames the smoke and the possible fire on the computer's lithium battery. that flight was en route from jfk. it immediately diverted to another airport named for another president, gerald ford airport in grand rapids, michigan. the fire was put out before the plane landed. >> i kind of smelled it. i noticed that the stewardess was trying to -- she had maybe a storage bin, and she was trying to get the backpack. she was trying to put the fire out. you could see smoke and smell it. >> none of the 158 people onboard was hurt. the plane finally arrived here at sfo around midnight last night, a few hours late. reporting live here at sfo, bob redell, today in the bay. >> quite the frightening ordeal

there. bob, thank you very much. at 5:04, a follow-up now. >> let me tell you now about what's going on with the expansion of a ban now as we talk about laptop safety to include all flights from europe. that ban currently covers ten airports in the middle east and africa and requires laptops to be placed in the cargo hold. one report yesterday indicated the white house may be pulling back on this idea. but homeland security later responded, calling that report false. new this morning -- >> no, you take it. >> i will take this too. new this morning in the last couple hours, oakland city council making a major decision. they did vote to approve a nearly $1 million payout. all stemming from the sex abuse scandal that rocked opd. pete suratos is live with reaction on this late night decision. a lot of folks just learning about this as they're waking up. good morning. >> reporter: good morning to you, sam. like you mentioned, that vote just wrapping up a few hours ago

behind me at oakland city hall. the vote by city council was a unanimous one. >> all in favor, say aye. >> that's oakland city council voting unanimously, 7-1, in favor of a settlement with a teenager at the center of the sex abuse scandal. 19-year-old jasmine who will be paid $989,000 by the city as part of the settlement. she, the daughter of an oakland police dispatcher, accused multiple oakland police officers as well as officers at other law enforcement agencies of having sex with her when she was a minor. those allegations were brought to light in 2015, when an officer killed himself, leaving behind a note talking about her sexual encounters with officers. >> it is time to pay the settlement agreement, to let this young woman get on with her life and her healing, but also

for oakland to step up and change the culture in the police department, to change how we recruit and train our officers. >> a number of officers at police departments around the bay area have been connected to her. her lawyer is considering lawsuits against all of them. we're live in oakland. pete suratos for today in the bay. >> pete, thank you very much for that update there. let there be light, after months of debate and really contentious meetings, san marin high school is soon going to have stadium lights. the novato unified school board voted to approve what's considered to be a controversial $1.2 million plan. this happened last night. you see the applause there at the meeting. hundreds of people attended the packed meeting while students are excited to play a home game at night, opponents say friday night games will violate local noise ordinances. >> we're against it for environmental reasons. a lot of noise. >> playing under it is so much cooler than playing in the heat. >> so trustees hope that

managing night game scheduled and limiting hours is going to address some of the concerns from neighbors living by the high school. if all goes as planned, there will be lights by the fall of 2018. >> happening today, road crews begin months of storm repair work on a quarter-mile stretch of mt. hamilton road in san jose. it involved one-way traffic control. repairs are expected to continue through the end of october. good wednesday morning. it is 5:08. as you get ready to head out the door in fremont, we have cloudy skies and the roads may be a little wet after early morning light showers there. we're looking at already busy roads as you head out in fremont and temperatures that are going to start out in the upper 50s to lower 60s at 9:00. we're at 61 degrees. we're going to see those temperatures making it into the upper 60s by early afternoon. and reaching 72 degrees by 3:00. it's going to be a very nice day. after the morning clouds roll

out of here, we will get some clearing, looking at sunshine through the rest of the forecast. coming up in four minutes, i'll have a look at the temperature trend for san jose and also a look aedto the weekend. as we head over to mike, some slick roads in spots. >> that's right, and definitely a situation to watch out for. this is northbound 101. watch this video. we have this from just a few minutes ago at the crash scene of northbound 101. there you see, there's a crashed vehicle. one of them involved with the wet roadway and there's rain falling in the pictures. that indicates the conditions in the area as well. we still have two lanes blocked. a slower drive, we had a traffic break, and just two lanes closed, two lanes opened. slowing up to the 85 split. bernal is where the scene was shot. we saw the video there. monterey road may be an option or 101 itself because it does move, but you'll slow quite a witch approaching the split. the right half eastern portion

5:13. still soggy this morning as you head out on the roadway. thetismture trend for willow glen will be in the low 60s at 9:00. still some clouds hanging around, but sunshine later today to help dry things out. and our temperatures will still be cooler than average. we will be aurming up a few degrees as we head into the weekend. a look at that coming up at 5:18. >> over here, we have a slow drive. look at the top of the screen, 101, unusually slow. that's the travel time north from highway 85. approaching 85, we'll track that crash still blocking half the freeway. thank you very much, kari and mike. >> it's 5:15 right now. remembering the lives lost in a horrific crash in alameda.

today, grief counsellors will be on hand at two bay area schools as students cope with the loss of brianna ortega and simon sotela, both killed on memorial day. they were in a truck along with five other people when the accident happened. the memorial dedicated to the students, flowers, candles, stuffed animals taking over a corner in alameda near the crash site. >> everyone should take something out of this, you know what i mean? love yourselves and love those around you. and just do the right thing, man. >> five others in the truck survived, but they were injured. learning more information now about a brutal situation last week that we reported on out of san francisco. a community meeting now to discuss a deadly stabbing that happened in a popular burr heights park. a 33-year-old was found dead thursday night in bernal heights park with multiple stab wounds. police haven't release much detail other than that, but tonight's meeting is going to be

at 6:00 in the bernal heights center. >> san jose appears to be willing to cover the cost for block party permits when the fourth of july weekend rolls around. but it will reportedly come with a big catch. the catch, according to the mercury news, no fireworks. block party permits usually run $175. the city says it will waive the fee for the first 50 applicants this year, that is provided they agree not to use fireworks during their celebration. >> we all know this gets rather pricey. a victory right now for consumers who are fed up with paying too much money for printer ink. >> that darn printer ink. scott mcgrew, supreme court now weighing in. >> highest court in the land says you want to take your printer ink cartridges to one of those refill places, nobody is going to stop for you. decision counts for all ink cartridges. this is about lexmark printer cartridges. they said their patent protected cartridges even after they were sold. the company claimed they could

control what happened to the cartridges after bought them, including third parties from prohibiting gathering up and selling them. chief justice john roberts compared it to cars. carmakers can't tell you how to repair your car after you buy it. speaking of cars and patents, uber has fired the engineer in charge of its automated car program. the man suspected of stealing secrets from google. he refused to testify about it in court. uber said explain what happened or lose your job. well, he lost his job. uber is also expected to wrap up its investigation into sexual harassment and discrimination at the company some time this week. that investigation is being led by former u.s. attorney general eric holder. >> it's the last day of may. the nasdaq will extend its winning streak to seven months in a row by the end of today despite falling a few point on tuesday. dow lost 50.

>> moon over my hammy is what i'm thinking about. >> we're going to stick traditional, pigs in a blanket. maybe you want to be toasty. it's wet and rainy right now. >> especially for the south bay. clearing out elsewhere around the bay area as you get ready to head out. also mild temperatures. here's a live look outside at san jose where it's been very wet this morning. we had some slick spots on the roads. you may still have to turn on the windshield wipers as you get ready to head out the door, but the rain is moving out. we're seeing it well to the south of us, around san martin and morgan hill. we've measured the rainfall in a few hundredths of an inch. morgan hill getting the most at .04 this morning. that's probably all the rain we'll see this month where we haven't had any rain month long. as we go into today, we're going to be up to 68 des in oakland. 63 degrees in san francisco. and 78 degrees in concord.

a few will be slightly warmer than it was yesterday. but we do see those still lingering in san francisco, starting out this morning, and it's going to be in the upper 50s by 8:00. at noon time, 64 degrees. and it does stay cool and breezy throughout the day. a little bit of some sunshine peeking through. over the next several days, our temperatures stay in the 60s there. up to 65 degrees on friday. but then eventually hitting 70 degrees just one day in the forecast. that will be the warmest day. on sunday, for the inland areas, we'll go from the low to mid 70s today up to 80 degrees by the end of the week, and 82 degrees on sunday. looks like the temperature trend still goes up for the start of next week. and mike, you start us out with a crash now on the bay bridge. >> we don't like this trend, any activity that would impede your drive into san francisco. we're tracking the crash in san jose. the first update we have is westbound 80 as you commute into san francisco, a crash at

fremaunlt street, one of your first off ramps getting into the city. we see the slowing just popping up in the last five minutes. we'll expect a slower drive from treasure island. no metering lights yet, but they may turn them on five minutes early to slow traffic into the city. we'll track that closely. northbound 101 starting to jam up here. our photographer matt is trying to avoid this backup and said old monterey road is also jammed up getting to the area. let me show you what waze shows us. two lanes are blocked up there, right here at bernal, and that's jamming up the interchange. waze has mapped up two other routes toward bailey and san jose sxking at about a 20-mbt drive if you take highway 85 and 101 through the crash. if you take alternate roadways the surface streets are more crowded right now. if you choose to stay on the freeway, a wiser choice. we had wazers like jb kidd

5:24 on your wednesday. nine men have been arrested in an undercover prostitution operation in hayward. the men responded to an online ad and agreed to meet in a hayward motel for sex. they didn't realize the women they were planning to meet turned out to be an undercover police detective. also, authorities in the south bay talking about the results of a similar undercover operation. this took place four days ending last friday. san jose police say they ran a sting in the area of oak and south first street and officers

arrested 27 people. 21 of them were men who now face solicitation charges. six women have also been charged with engaging in prauitution. police say none of those arrested are believed to be victims of trafficking. >> police believe the man in this surveillance image is connected to a package theft. he stole a package sunday night around 10:30 around burlingame avenue and rollins road. if you know who he is, contact police. >> city of berkeley is talking about banning plastic straws. they discussed a proposal to do that last night. three city council members are supporting it. it would require restaurants and coffee shops to use bamboo or other straws that are biodegradable. americans use about half a billion straw s daly. >> have you been burned by your kids ordering stuff on amazon that they weren't suppose to. if you're an amazon customer and you have been burned, there could be money coming your way.

they decided amazon has to set up a refund process for unauthorized app purchases made by kids. they said they should have been notified by amazon through e-mail and consumers have until may 28th of next year to submit a request for a refund. amazon has made changes in how in-app purchases are made since they began probing the issue. parents being billed for purchases on devices they have not given the thumbs up on. >> have to put the parental controls on. 5:26 right now. >> coming up, it was all a hoax. a stunning twist in a san jose state student's bizarre kidnapping story that made national headlines. >> the jury that convicted antolin garcia torres will continue deliberating his punishment. i'll show you what lawyers want the six men and six women to consider as they make their decision.

>> not rain to wash away that spider. i'm laura garcia-cannon. let's get the forecast with kari. the rain is moving out, though, right? >> it is moving out. it's the only rain we had all month and it only gave us a few hundredths of an inch this morning. it is moving to the east and the rest of the day will be all dry. as you get ready to head out, it may still be slick spots out there and now 58 degrees in the south bay, 57 in the peninsula. the tri-valley, you see the clouds still with us and 55 there. 52 in the north bay. as we go into this afternoon, expect the highs to reach into the low 70s and the winds will be kicking up, too, in the peninsula looking at the san mateo bridge camera. it will be up to 72 there. and 68 degrees in the east bay, looking live at fremont. 74 in the north bay. and mike, now, those slick roads may have caused some issues, right? >> i'm not going to get into the insurance thing there. i'll tell you about the conditions, a situation where you're going to wand to watch the slowing and then ease off

because it may be slick out there, indeed. a crash in san jose and one in san francisco. update for san francisco, it sounds like all vehicles are now over on the left shoulder as you're getting over towards san francisco. that means a distraction toward the off ramp, again, just past the fremont street off ramp where the crash is reported. you see slowing now on the approach toward the tunnel, getting over towards the approach into san francisco. the metering lights are now on at the bay bridge, so there's a backup on the side hoping to ease traffic on the bridge itself. northbound 101 also slows. considerable slowing just north of bailey to metcalf, the scene of the crash at bernal which blocks two lanes. another crash just before you get metcalf on old oakland road so that's a problem for surface streets as well. >> busy morning. breaking news we continue to follow out of kabul, afghanistan. at least 80 people dead and more than 300 wounded in a suicide

bombing that detonated hundreds of yards from the german embassy in a packed part of town considering one of the safest in the city. employees from the german and jap embassies were injured although none seriously. most of the people killed in the attack were civilians, mainly women and children. the bomb exploded in morning rush hour and at least 50 cars were destroyed. it was considered a blast, blowing out the windows of buildings a half mile away. live pictures just coming in to our newsroom from kabul. it's about 5:00 in the afternoon there. about nine hours after the attack. we see that the cleanup crews have now arrived to try to go through some of the remains. the taliban issued a statement saying it had nothing to do with the attack. so far, no word isis. >> back in the bay area, this morning we could learn the fate of antolin garcia torres, the man convicted of killing sierra lamar. jury deliberations set to begin in just a matter of hours. they will decide if garcia

torres will be put to death. >> kris sanchez live at the hall of justice with a final plea from defense attorneys to try to save his life. good morning, kris. >> good morning to you, laura and sam. his lawyer pleaded with the jury to consider his upbringing, a violent childhood, and to ask them to show mercy and not strip his two young daughters of an opportunity to know their father. that was one of the last things that the jury heard before the judge gave them their instructions, explaining what they had to consider as they decide garcia torres going to jail for the rest of his life or to death row. our legal analyst was there as well as the defense painting a picture of a man shaped by violence and poverty. >> he was someone who suffered as a juvenile growing up with a lot of hardships, and that could have led to the decisions he made. he's not someone who had been spending his whole entire life committing crimes. >> coming up at 6:00, i'll show

you what the district attorney's office presented to the jury to counter that argument. it did take the jury about 12 hours to decide that he was guilty of the murder and kidnapping of sierra lamar and the attempted kidnapping of three other women. when the jury reaches their decision today or if it's today or tomorrow, whenever they reach it, we'll have one hour to get to thehouse to bring you that decision and we'll be here. kris sanchez, today in the bay. >> thank you. right now, authorities in san jose aren't saying whether or not a san jose state student is going to be charged for a hoax involving an alleged abduction that never actually took place. just about 24 hours ago, we first started reporting that a student was being treated at an oregon hospital after she said that she was forced at knifepoint in san jose to drive north some 500 miles last friday on the eve of her graduation. she said she escaped her kidnapper when the car ran out of gas. after interviewing that woman, san jose police last night announced she made the whole

thing up. we spoke to fellow students right now at jose state's campus who are both relieved and puzzled. >> this happened in the community. for all of us to stick together for each other, and so i feel like everyone felt that hurt, and then when it turned out not to be true, everyone felt maybe a little betrayed. >> well, the student so far has not been identified. the school is saying at this point that they're glad that the student is safe. >> 5:35. we have just learned police came up empty after a lengthy stand-off following a deadly shooting in oakland. the stand-off started yesterday afternoon on international boulevard near 51st avenue. police were outside an apartment unit where they believe the suspect tied to a shooting yesterday was barricaded inside. just a short time ago, officers called it all off, saying the suspect is still at large. >> all new this morning, police in vallejo have identified the victim in a deadly hit and run accident. it happened about 9:30 last on columbus parkway north of tennessee street there.

investigators say that a car going southbound on columbus struck 51-year-old earnest howard of vallejo as he was crossing the street. police right now still looking for the driver. >> happening today, helping some congest on a beautiful commute stretch that might take to work. caltrans will consider a busy peninsula corridor for its next express toll lane conversion project. it would travel highway 101 to santa clara county. it will be free for carpoolers, but solo drivers would have to pay for a faster ride. transportation leaders believe the express lane would reduce traffic through heavily congested silicon valley. some people we spoke to agree. >> we could do some widening here and there, but mostly it's getting the most efficiency possible out of what you have. >> help people get together or carpool more to cut down on being stuck in that kind of traffic situation. >> tonight's public meeting gets under way at 6:30 at san mateo city hall.

we're looking over here toward a very calm drive on the peninsula right now. we see that road weather index showing you perhaps damp roadways in the east bay, try valley. tracking a crash in san jose. all lanes have just reopened, too close to the sign that i couldn't change the sign, all lanes have reopened at bernal. that means a slower drive, but still improving. avoid monterey road, that would be an alternate, but there's a crash on that roadway, so that's a problem. the bay bridge toll plaza has the metering lights on and the backup at the approach. the good news is you have the backup on the oakland side. in san francisco, the crash over at fremont has cleared to the shoulder. it's a distraction, but lanes are open on the approach into the city itself. >> good news there. we have made it to wednesday. >> i love the banner. get ready. we have the weekend around the corner. i don't know how you're going to top yourself from last week.

bottle rock, a mushroom mardi gras. >> more events going on, and it's been so nice. we're going to have some cooler weather, but then as we look at saturday's forecast, it does start to warm up a few degrees. now, the coast will be up to 69 degrees. 77 degrees for the bay. and inland, 82 degrees. for sunday, more of the same. we really won't see too much of a change in these temperatures. and it will be nice and comfortable all around the bay area. so if you will be heading to napa, no bottle rock going on, but you can still enjoy all of the events going on this weekend, including some live music on sunday. so that's when we will see the temperatures up to 81 degrees. and mostly sunny skies. cherry festival happening on saturday in san leandro. and we will start out with temperatures in the 60s. some clouds during the morning. but then we will see some sunshine and high temperatures in the upper 60s there. maybe you're heading to the sierra. here's a live look outside at

let's take a live look outside at san jose as you get ready to head out the door. we're getting some clearing and it may still be wet in some spots after some early morning light rain. the temperature trend in evergreen in the low 60s at 9:00, and then some low 70s as we go through the day. it will be cooler than average, but we will be warming up a few degrees heading into the end of the week. more on that coming up in five minutes. >> and right now, we're already seeing improvements. top of the screen, highway 101, a couple minutes faster now traveling through the area.

approved by the state assembly yesterday. it now moves to the state senate the goal is to stop pet stores from buying animals bred at puppy mills. look at that face. more than 30 cities and counties in california already have such a law in effect. there is a high profile state immigration bill that is winding its way sacramento, but reportedly, not getting support from marin county's top law enforcement officer. sb-4 would limit state and local law enforcement ageanies from communicating with i.c.e. the marin ij spoke with sheriff robert doyle. he says she does not support the bill and believed more undocumented immigrants may end up being deported if it passes. he said i.c.e. would focus more of its energy on enforcement across california. supervisors in marin have already endorsed it. again, sb-54. >> a mysterious tweet from the president overnight has people on twitter scratching their heads. >> and doing a lot of tweeting. scott mcgrew, not the most

75 tomorrow. and some low 80s just in time for the weekend. and mike gets a start on a positive note for the south bay. >> let's start with the positive. looking over here, and the roadways look pretty good. things are starting to dry out, so the green highlighted the road weather index moving fard to the east. tri-valley not effected right now, but maybe slick off ramps. north 101 completely recovered over just seven minutes. north 101 at bernal road, the earlier crash has cleared from the roadway. a damp interchange. a little slowing for 101 at 680. that's the typical pattern for san jose. over here, the crash is on the shoulder as you approach san francisco. the backup, now it's back at the toll plaza. the metering lights likely cycling a little slower to keep the span moving well. it is moving well past the crash at fremont. as we look a at waze, nothing really unusual. 680 slows a bit through

traffic starting to pick up. a live look from our san jose came camera. off to another cool start and then it's going to warm up as we head to the waekd. >> a follow-up for you. arson investigators looking into the massive pallet fire that broke out near downtown stock n stockton. five homes near the pallet yard were destroyed in the fire. one fire victim says she's been warning the city for more than three years. she said the pallets were stacking up too high, creating a fire hazard. the city spokesperson confirmed the pallet yard had been fined by the fire department twice, in march and april. because pallets were stacked too high. the owner received a code enforcement warning on may 9th, but the fire broke out just two days later. so they've got through executive process, but none of that really mattered to a person who has just experienced a tragedy. >> some neighbors are set to meet with the mayor this week to talk about their concerns. >> preschool teacher's aide now facing charges this morning, accused in the deadly stabbing

in san francisco's mission dwiktd. that stabbing happened early monday morning. police say the 52-year-old was arrested and the sf gate reporting wolf was a teacher's aide in the bay view. a spokeswoman for the school said wolf is on unpaid administrative leave. a 45-year-old man was killed in the stabbing. >> happening today, day four of jury deliberations in the trial of three santa clara county jail guards accused of beating an inmate to death. michael tyree died in 2015. pross say three deputies abused their power, but the defense is questioning the evidence in the case. the guards face life in prison if convicted. the cleveland police officer who shot and killed 12-year-old tamir rice is out of a job this morning. firing comes after an extensive internal investigation that found that timothy loman was guilty of rules violations related to his employment application.

he was a rookie police officer with the cleveland police department when he shot rice at a recreation area. that shooting, of course, sparks dozens of protests across the country. a grand jury ruled against the charges. >> operations back to normal at orlando international airport after an hours-long standoff. a portion of the airport locked down for a couple hours while a crisis negotiator was talking to a man who was pointing what appeared to be a gun. later it turned out to be a fake. investigators say that man told officers to shoot him. he was later taken into custody. >> we're getting an incredible look at new photos showing a cow bison defending its newborn calf from a coyote in yellownational park. >> a park ranger capturing the photos immediately after the bison gave birth. a coyote had been staring around the area waiting for the birth of bison calves. the mother was going to have none of it. she was able to protect her
