variety of reasons. but i asked him to because i thought that might appropriate the appointment of a special counsel. >> pointing comey as a leaker for that move made days after the president tweeted about tapes of the conversation. >> i have seen the tweet about tapes. i hope floor tapes. release all the tapes. i'm good with it. >> it wasn't just the trump administration in the spotlight. loretta lynch asking him to call the hillary clinton inquiry a matter, not an investigation. >> we had an investigation open at the time. and, so, that gave me a queasy feeling. >> a person familiar with lynch's thinking tells nbc news comey never said at the time that he wasn't comfortable with the word matter, which lynch words so as not to confirm or deny an investigation. >> the senate intelligence committee expects top presidential advisor and the president's son-in-law jared kushner to meet with committee staffers this month. two sources familiar with the planning are telling nbc news the committee expects kushner will meet with staff, provide

documents and ultimately take questions from the senates the two sources said. although, a third source says the timing conversation is is still ongoing. all of this an indication that the russia investigation will remain front and center. matt, savannah. >> thank you very much. corey lewandowski is a close confidant of the president. nice to see you. james comey called the sitting president of the united states a liar, not once, not twice, but multiple times. he did it under oath. he did it methodically and seriously he basically said i will stake my reputation as a career prosecutor who kept notes, my word against the president. who do you think the people will believe? >> we've seen he has made numerous mistakes when sworn in under oath. the previous time he testified in congress, he had to go back and clarify his statements because he made a number of misstatements. what we have seen from jim comey

and we need to be very, very clear. if for any indication, any reason whatsoever he ever thought the president did something that was obstructing him of justice, he is obligated under 18 u.s. code section 4 to report that. and if he does not, he is guilty of a felony. >> he's said i turned my memos of my conversations. >> to "the new york times." >> but he's also turned them over to the special counsel. >> that's mighty nice of him after he gave it to "the new york times." >> he said i turned them over, so now wouldn't it be a great idea, those tapes the president trump tweeted about, let him turn those over to robert mueller and let robert mueller decide whose word is right. >> the story coming out yesterday was the president, candidate trump, president-elect trump has never been under an fbi investigation. now, that's very clear. he was very clear about that. he told the president directly that he was never under an investigation and all of a sudden, jim comey, who mind me is a career prosecutor, spent

five years as the fbi director was so stunned he had a one-on-one private conversation with the president of the united states. he didn't know how to report this to the attorney general to say i'm concerned. >> you don't get to have it both ways. >> according to you. >> according to you. so wait a minute. >> he gave his notes to a columbia law professor because he wasn't man enough to give the notes directly to the media when he wanted them out to the media. >> what's happening here and that you and presumably the president are saying comey is telling the truth when it is good for the president and when it is bad for the president comey is not telling the truth. that's not intellectually honest. >> there is a clear dichotomy here. either you are or are not under investigation. you can't be kind of under investigation. and what director comey said is that the president has never been under an fbi investigation. >> he also said the president demanded a loyalty oath.

would you agree that would be inappropriate. >> it's subjective. if it was inappropriate and if jim comey was so concerned about it -- mind me he also testified loretta lynch asked him to speak about an ongoing investigation in a manner that wasn't comfortable, but he had to change the verage he was using. >> is it ever appropriate for a sitting president to ask an acting fbi director for loyalty? >> look, he has to be loyal to the country, of course. >> to the president of the country, not the president. >> the president didn't say he wanted loyalty from -- >> is it ever appropriate for a sitting president to ask an acting fbi director to let go of an investigation into a close associate. >> he said i hope we can get this resolved. if you listen to the testimony closely -- >> i hope you can let this go. >> and what director comey said under oath was in his experience he has never hoped something would happen. >> the last one, was it ever appropriate for a sitting president to clear everyone else

out of a room and keep an acting fbi director in that room and ask him about an active investigation? >> you know why that's appropriate? because jim comey is the one who originally asked for a one-on-one private meeting with president-elect trump on january 6th in trump tower. >> something he denies. >> that was to brief him on a dossier. >> a false dossier that he knew was false. but jim comey is the one who asked for the private meeting the first time. so the pattern was set by jim to say i want a private meeting with president trump. >> comey stayed after to avoid embarrassment for the president saying you should know this is out there. okay. just real quickly because it seems like there is debate over what really happened, what was said in the oval office, the president has hinted that he has tapes. comey says release the tapes. i give you permission. you're free to do so.

will the president release the tapes? are there tapes? >> i don't work for the white house. i don't work in the white house. i don't know if tapes were made, are made. if they are, look, i think jim comey's credibility is at about zero right now. that's from the democrats who questioned him. it's from the republicans who questioned him yesterday. marco rubio from florida said, dan, the only leak not coming out of the fbi was that president-elect trump and now president trump isn't under fbi investigation. >> if you were advising the president today, would you say, sir, release those tapes if you have them. >> i think the conversation actually didn't take place in the oval office. i think jim was referring to a discussion they had over dinner. >> he said he had tapes of these key conversations. >> he didn't say there were. >> there's that word hope again, corey. >> corey, thank you. >> let's bring in nicole wallace right now. what were the big questions that

lingered to you after james comey's testimony? >> well, if you needed any more evidence that we live in america, corey just gave it to you. trump's enthusiast are going to stair at the trees that paint the picture of the forrest they want to live in. the truth is what we learned yesterday is that donald trump had a lot of interactions with fbi director jim comey as president-elect and as president. no one can deny that. in one of them, in none of them did he ask the single question about the ver roracity of russi meddling in the american election. that is the most troubling and really the big structural sort of blow for the president is that he's also worried about his personal legal equities and about the % criminal legal liabilities of his buddy mike flynn. >> it is interesting because -- corey we'll let you back in here. but it is interesting to me because on the one hand there

were things that were problematic with james comey's testimony. i think it is a fair criticism on the issue of leaking to "the going through proper channel like the congress or for example what dine feinstein asked him about. why didn't you stand up then and there? but there are parts quite damaging to the president. >> if you listen to the testimony yesterday, he testified under oath. he knew that jeff sessions was going to recuse himself. he made that statement knowing on february 15th he said i knew that attorney general jeff sessions was going to recuse himself. he didn't recuse himself until march 2nd. >> he said we had good reason to believe he was going to recuse himself. he also did this. he dropped another little morsele. >> our judgment as i recall was that he was very close to and inevitably going to recuse himself for a variety of reasons. we also were aware of facts that i can't discuss in an open setting that would make his

continued engagement in a russia-related investigation problematic. >> he chooses his words very carefully. he just dangled something there. if you are the president of united states, do you walk into jeff sessions today and say, what are they talking about? what else is there? >> what we have seen in jim comey, his goal is to manipulate the media and the press. he's everything that's wrong with washington. what happened on march 1st, the wall street journal publish add story about attorney general jeff sessions and his unreported meeting with kids lee yak, the russian ambassador. what it said in that story is there were hammering at the department of justice and there was no formal way to remove an attorney general from an investigation. jeff sessions recused himself the following day. but the testimony was i knew he was going to recuse himself because he's probably the one that leaked the story to the wall street journal.

investigators are trying to figure out if a series of early good morning to you. it's 7:26. i'm laura garcia-cannon. investigators are trying to fig out if a series of early morning fires san jose are connected. there have been six separate fires in all. this latest one, as you see in the surveillance video, is at willow and vine. someone on a bike riding to a dumpster, moments later, the dumpster catches fire. the suspect gets away with the face down. firefighters are still not connecting all of the fires to the same suspect, but police do want to talk to that suspect. we want to talk with kari this morning about the forecast that we're having for today. >> we start out with some fog as we take a live look outside at san francisco. the golden gate bridge showing low visibility there. we're seeing that in spots as you get ready to head out the door. and our high temperatures reaching into the low 70s.

they say michelle carter used text messages to encourage conrad roy to take his life three years ago. late thursday, the defense filed a motion so dismiss the case against their client. a judge will hear arguments on that later today. we have video to serve for warning for texting and walking. a 67-year-old woman didn't notice an access door in front of her. she fell six feet down the hole. emergency crews got her out. took her to the hospital. she's being treated for serious injur injuries. >> that's a cautionary tale and i'm guilty of it. >> you see people go off of the curb into a street. >> there wasdy falling into a fountain. new, disturbing developments of the nsa contractor accused of leaking a top-secret document on

russia's election tampering. really winner may have had more classification. that comes after a court appearance that saw a judge deny her bail. gabe gutierrez has more on that. >> reporter: it was a dramatic court hearing wherele from prosecutors laid out more details about their kags. reality winner has two cases. one, an air force veteran, a loving daughter and yoga instructor. the other, a person who had taken a keen interest in the middle east with suspicious motives. 25-year-old reality winner, denied bail and led away in shackles. this morning, prosecutors have new questions about whether she may have been planning to reveal more classified information. they say during a recorded phone conversation with her mother in jail, winner said, mom, those documents, i screwed up. documents, plural. now, federal agents are looking to see whether she may have stolen other classified information, including some on a missing flash drive she inserted into a top-secret computer.

south bay. morgan hill, expect a high of 73 degrees. for the east bay, we're going see mostly sunny skies there. antioch up to 73, and fremont looking at a high of 70 degrees. the peninsula will be reaching into the upper 60s to low 70s, and 63 today in the mission district. for the north bay, expect it to be cool along the coast. point reyes only 67, but 75 degrees in napa. >> and you can find your full forecast 24/7 on the weather channel on cable. >> dylan, thank you so much. now, to a heartbreaking story out of texas, where a grieving family is speaking out, as they try to come to terms of the tragic loss of their little boy, an apparent condition known as dry drowning. frankie delgado passed away six days after his family returned from a weekend trip to a fishing and recreation area in galveston bay. >> he was my best friend. and i miss him so much.

>> reporter: his parents say the 4-year-old was briefly knocked over by a wave while playing in shallow water. he got right back up and seemed normal. but days later, this went quickly downhill. >> the night before this happen, we were throwing the football with him. i was playing catch with him. i was running around. and then, saturday morning came arnold. and -- >> our world just turned upside down. >> reporter: frankie woke up vomiting and in pain. >> he was like -- he went like that. looked at me with these painful, hurtful eyes. like, i've never seen him before like that. >> reporter: an ambulance rushed the boy to the hospital. but he didn't take it. the family says emergency room doctored said the cause of the death was dry drowning. >> they explained to us that it's something about him ingesting water into his lungs. >> reporter: when it does occur, secondary drowning usually happens after a child inhales water into the lungs, which become irritated and start to fill up with fluid.

>> breathing problems, coughing. they may have episodes where their behavior changes, where they're more fatigued than usual. and these are signs they may not be getting enough oxygen to the brain. >> reporter: doctors say it is extremely rare but there have been cases. >> i believe he's in a better place. i believe my son's an angel. >> reporter: frankie's grieving family says they hope sharing the story will help other parents avoid such tragedy. >> dry drowning, let's bring that out into the world and let everybody know this exists. >> that's what i'm trying to do, spread awareness. i don't want nobody to go through what we're going through. >> drowning is actually the leading cause of death for kids from ages of 1 to 4. but an overwhelming number of those cases do not involve so-called dry drowning. experts say parents should not expect the worst every time your child swallows some water.

♪ all right. we're back. 7:43, with a "today" exclusive that will excite anybody who flies. >> this is very good news if you're frustrated by the slow internet connections you get when you're flying. there's new technology that will allow you to use your netflix account or video chat midnight. tom costello is live from a test plane flying at 25,000 feet to demonstrate this. tom, where are you? >> reporter: we're over upstate new york, right now, matt. we're coming to you via wi-fi in this honeywell test plane. they're using satellite to get us the signal on wi-fi. some airlines may not like the idea of you using facetime or skype to have a conversation with your spouse on the ground and everybody onboard doing the same thing.

but this is where it gets interesting. you'll be able to watch videos, netflix, download files. your internet experience six miles up is going to get a big upgrade. in-flight wi-fi has come a long way. what started with a handful of passengers has become a bottleneck at 35,000 feet. with everyone competing for limited bandwidth, e-mailing, texting, tweeting. >> i have a hard time getting service up there. if i do, it's limited, for sure. >> reporter: now, passengers are demanding better wi-fi to make a cramped flying experience a little more bearable. the big names are dramatically picking up the pace. when we tried jet wave, our connection was so good, we watched the rolling stone on youtube, "house of cards" on netflix and video chatted with someone in a new york city taxi. >> it looks good. i hear you perfectly.
