your time is 7:00 this sunday, july 2nd. we want to give you a live look outside this morning at san francisco, the embarcadero there. it's 56 degrees outside. some cool, misty fog earlier but that should be burning off on this holiday morning. good thank you for waking up with us. i'm vicky nguyen. vianey arana with what's to come. a lot of people have a five-day weekend. >> lucky you guys. and for those of you who do get a chance to enjoy either staying at home, go outside because it's going to be nice. nice and cool right now. we're still in the 50s in the south bay and it was a little bit breezy along the coast and even here in the south bay 56 degrees. the peninsula 57.

the tri-valley is nice and clear at 56 degrees. we were seeing that hazy sky that is quickly starting to burn off. san francisco still seeing that early morning fog thanks to that marine layer with a little bit of a system building off the pacific. doppler radar is showing that fog coming in but this will eventually burn off and will make way for more seasonable temps with a warming on the way. the temperature trend does show slightly warmer temperatures. yesterday 55 degrees. today's predicted high is about 68 degrees in san francisco. we're expecting a very nice day on the 2nd day of july. i think it will make a perfect setup for any plans for people that are visiting the beach. a look ahead at your day planner and, of course, fourth of july in the next seven days coming up in a bit. >> fantastic. vianey, thank you. a hit-and-run crash in concord takes the lives of two

young boys this holiday weekend and leaves their mother and baby brother badly hurt. the driver suspect ed of fleein the scene is now in an oakland hospital. 35-year-old wilson is in stable condition. investigators say he's a suspect in friday night's fatal crash. this is the mangled infinity suv. california highway patrol officers believe wilson was behind the wheel. they say his car veered off a highway exit ramp and collided with a dodge durango. two he boys, ages 10 and 5, both died after being thrown from the durango. their mother and 3-month-old baby brother were rushed to local hospitals. >> i think about my own family or somebody else out there that could have lost a 4-year-old, 5-year-old son or any of their family and it's horrific. for the person's first inclination to run makes it even worse. >> police say witness descriptions and a trail of blood and evidence found inside the infinity led them directly to wilson. he's currently under the watch of chp officers and alameda

county sheriff's deputies. for continuing coverage of this it deadly crash in concord head to our website nbcbayarea.com. we will continue to post updates on the investigation as it unfolds. we are also following another deadly hit-and-run crash, this one in san jose. a woman was killed after two cars were involved in a collision. the search is on now for the man who officers say fled the scene. the crash happened at the intersection of mclaughlin avenue around 5:30 last night. police say the male suspect was driving a brand-new gray bmw. it slammed into the side of a white infinity killing the person behind the wheel this is a dangerous intersection where they've seen several accidents. >> i think the problem in this neighborhood is the speed. i think the city has to do something because there are too many accidents already. >> how fast do they drive down this street? >> i think 50, 55. >> the area was closed for five

hours as police searched for the driver who left the scene. again, they say he was driving a new gray bmw with paper dealer plates. tense moment in the south bay after a brush fire that burned close to homes. firefighters remained at the scene overnight to watch for hot spots. that fire broke out yesterday about 6:00 p.m. in east san jose near capital expressway. parts of capital expressway were closed as crews fought the fire. neighbors say they were relieve ed to see firefighters get there so quickly. >> an excellent job. i was scared. they left because everything is under control. >> the brushy area that burned is surrounded by houses and it's a middle school. it is not yet clear how the fire started. to an update on a larger brush fire burning in the south

bay. cal fire says the so-called ranch fire near mt. hamilton is now fully contained. the flames broke out on thursday. that's just off grant road in san jose. a total of 85 acres burned. how that fire started is unclear but it is under investigation. no one was injured and no homes or buildings were damaged. a warning for people heading to lakes around the bay area this holiday weekend, watch out for potentially dangerous algae blooms from napa county to the east bay. this is video from the regional park in livermore yesterday. park rangers expect to see more swimmers there today. they say keep the little ones out of the water. >> small children and small animals should be advised to stay away from water. if you see algae blooms stay away. if you have contact with them, wash yourself off. >> park rangers say no medical emergencies so far, but two dogs died after swimming in a napa county pond just days ago. we're following developing

br okay. a new live look outside across the bay area. this is the bay bridge from our camera in emeryville. i promise you we are broadcasting to you in color television this july 2nd. but that looks like a really crazy almost black and white. you see a little bit of the blue water there but things are starting off cloudy. vianey says we will get some relief and it will be a great day to get outside and get to the beaches and enjoy your holiday weekend. it was supposed to be the party of the year. instead it was a colossal disaster. the entrepreneur behind the failed fire festival in the bahamas is now being charged with wire fraud. billy mcfarland was arrested for allegedly misrepresenting financial documents to investors that backed the festival. prosecutors said in a statement mcfarland presented fake documents to convince investors

to put over a million dollars into his company and that failed fire festival. you may remember thousands of people flew to the bahamas in april for a luxury music and art festival. that's what they wanted. they were stuck instead if fema tents eating cheese sandwiches. starting this weekend it is legal to buy recreational marijuana in nevada. this is video from lass vegas after sales began midnight on saturday. the state made it legal to smoke pot but only in a private home. it's banned from casinos, bars, and other public places. nevada is the fifth state in the united states with stores selling marijuana for recreational purposes. one year ago a stranger saved a sacramento girl's life by donating bone marrow. the two met in an emotional news conference in san jose. our videographer was there to document it.

outside to enjoy the weather. >> i think yesterday was a sneak peek of what we can expect the next couple of days. >> nice and warm. >> we did see the return of the marine layer. yes, we'll be waking up to these foggy conditions at least for the next couple of days and also going to bed with some low clouds. the south bay in the 50s. we're still seeing some nice and cool temps. foggy conditions near san francisco. if you notice doppler radar we can see the marine layer is deepening just a bit but ma maintaining at about 2,000 feet. as we begin to see the burnoff by midafternoon we can expect to see clearing in the skies just like we've been enjoying the past couple of days where it starts off cloudy but then by the lunch hour we start enjoy more sunshine. expected highs for today, san jose, predicted high of 76. los gatos, 82. east san jose warmer than we were yesterday. oakland expected to climb into

the 70s as will concord, 86. antioch, 86. along the peninsula's half moon bay, 65. for san francisco we'll be climbing into the mid to upper 60s. some spots may even hit about 68 degrees so going to be a great day to enjoy the outdoors. the north bay we will climb into the 80s for areas like napa, 83. as cool as 67. areas like monterey, pacifica and half moon bay will stay cloudy longer than most. by about 12:00 we will be at 60 degrees. expect to see those cloudy skies longer than the inlands spots will see it. we'll see it burn off slower and then warm up to about the mid to upper 60s. on this fourth of july week, i nknow it's not until tuesday wih

but a lot of people get to enjoy the next couple of days off. stay hydrated. if you get caught in a rip current swim parallel to the sand. look out for beach warnings along the water. we do have a couple of changes on the way. we will wake up monday morning. fourth of july, look at this, a nice combination of sun and clouds perfect weather although you might see some of the fog but that should be fine. by saturday we see a gradual warming so foggy conditions i think it will still be okay for the fireworks. we'll be able to enjoy them. by tuesday 86 degrees and then we see that gradual warming coming into play by friday. if you notice by next weekend we will be climbing back into the

club sold them one thing. the time is 7:23. nbc bay area responds, the people who say a local health club sold them one thing but bill ed them for something more expensive. that put them on the hook for thousands of dollars so they called us for help. chris chmura has their story. >> reporter: eager to step up his fitness routine, dan joined fitness evolution and signed up for the gym's personal training. >> i thought it would be best to get some personal training sessions so i could really understand what i should be doing. >> reporter: he says the trainer

sold him a 24 session pact to be paid in three installments of $485. he made his first payment that day. but dan says high trainer turnover and conflicts made it tough to get the workout he wanted. he had only four. then the gym dropped a bombshell. they said, oh, yeah, you're behind your billing. your billing didn't go through. you owe us $1,800. >> reporter: they told him he bought a three-month package that automatically converted to month to month if he didn't cancel. dan agreed to this when he signed the contract on a tablet but insists this is not what he was verbally sold. >> that's a rip-off. i mean, it's bait and switch. are. >> reporter: this woman has a similar story. >> i've gone from frustrated to angry. >> reporter: she says the train er sold her eight sessions for $480. weeks later she was told she owed nearly $2,000.

susan had also signed a contract on a tablet that enrolled her in a six-month membership for personal training that automatically converted month to month if she didn't cancel. susan also insists this is not what she was verbally sold. >> and we're both retired. i would never sign up for something $480 a month. that's insane. >> reporter: susan and dan say fitness evolution told them to pay up. we've heard from three others with similar problems. the better business bureau received complaints, too. it's given fitness evolution an "f" rating. >> i absolutely apologize. i don't want anybody to be frustrated with the service they're receiving. >> reporter: the vice president of operations insists the gym never misleads consumers about what they're signing. >> that's not something we as a company would ever allow within our business to tell people things that are not true and do it intentionally. >> reporter: she says the gym

the coast has been getting drizzle. mt. hamilton looking clear and gorgeous. have no fear that temperature trend shows these turnt 50s along the water will be warming up quite nicely into the mid to upper 60s for the bay and 60s for the coast, even 70s in some spots and then inland areas slightly warmer than we saw yesterday into the mid to upper 80s for today. expecting a high of about 67, 68 degrees for san francisco at 55. and this will set us up nicely as we begin to see a nice gradual warming pattern. i'll have more details on what you can expect coming up at about 7:45. >> a hit-and-run crash in concord has killed two young boys and left their baby brother in grave condition at the hospital. the driver believed to have left the scene is under the watch of deputies at an oakland hospital. 35-year-old wilson is listed this in stable condition.

of hayward. another crash following a high-speed chase this time involving a marin county sheriff's deppity. it happened yesterday about 10:00 a.m. near the reservoir. the deputy tried to make a u-turn after watching drivers speeding in the opposite direction. witnesses say a woman driving with a child crashed into the patrol car. both were taken to the hospital with nonlife threatening injuries. the child was also okay. residents feeling some relief in the south bay after concerns about a brush fire that threatened their homes. firefighters remained at the scene overnight to watch for hot spots. that fire broke out yesterday about 6:00 p.m. in east san jose near capital expressway and aborn road. parts of the capital expressway were closed as crews battled to gain the upper hand on the fire. neighbors say they were relieved to see firefighters getting there so quick willy. >> an excellent job.

i was so scared because they left there because everything is under control. >> reporter: the brushy area that burned is surrounded by houses near leva middle school. not clear how that fire began. one of the most valuable pieces of undeveloped land in san francisco is still a hot spot for controversy. for four years our investigative unit has investigated allegations of misconduct at the shipyard. former workers who helped clean up the one-time super fund site are warning of a radioactive cover-up. as liz wagner tells us, there's new action being taken against the contractor hired to clean up radiation at hunter's point. since 2006 virtually every step of the radioactive cleanup at hunter's point was a fraud.

>> reporter: the message was clear. the government needs to stop tetra tech from perform radiation cleanup. the community group green action filed this petition with the nuclear regulatory commission detailing intentional fraud by the companies. former workers came together to say that for years tetra tech downgraded radiation which is slated for parks, shops and condos. they say the company cut corners to make more money. they contend radioactive soil wound up back in the ground without being cleaned up and soil was being shipped across the sate under the guise it was clean. >> it just didn't matter. >> reporter: a former worker controlled the trucks and saw what left. do you have confidence the soil leaving was clean ? >> i have confidence that it very often wasn't. >> reporter: he and other

workers say employees tampered with radiation detection equipment and changed test results. they say even top level managers. >> but it was falsified. it was a farce. >> reporter: bert bowers points to a process where soil was scanned for radiation. he and others say the woman in charge either through incompetence or intentional fraud made it looks like the soil was clean when it may not have been. he says a lot of that soil was put back in the shipyard. >> it presents a significant hazard. >> reporter: he and other former workers spoke with nbc bay area starting in 2014 warning of a botched cleanup. that they were falsifying data. the company says it cleaned up those problem areas and

mile corridor between the an effort to secure stable financing of cal train which travels 51-mile corridor between the south and san francisco. counties served by cal train to approve an 8 cent tax. political analyst larry gerston joins us this morning. >> it is in the big picture, no question. cal train carries more than 60,000 people a day. historically san francisco, san

mateo, santa clara county, they've been the major funders of cal train on a voluntary basis. >> and why are lawmakers considering changing the way cal train is funded? >> two reasons here. first, voluntary. cal train had to reduce service by about 50% because the three counties slashed their contributions. second, is it doesn't have the resources to create capacity. a permanent funding source of $100 million annually from the sales tax. those new funds would provide stability and the opportunity to increase capacity. >> there's an argument to be made about why those funds shouldn't come from an actual sales tax versus fees or increasing the ride for riders who use cal train. >> that's a fair argument.

two-thirpdz of the cal train operating budget, much higher percenta percentage, opponents say and understand this that riders benefit directly. in addition to sales tax increase drivers will be paying another 12 cents a gallon. 12 cents a gallon beginning november 1st. supporters counter that everyone benefits from cal train because riders take cars off the road. if fares are too high, riders might begin to drive. that's the delicate balance. also point out that the new funds will be used partially to increase capacity which would ease traffic benefits everyone. >> how soon could this go before voters and what's the likelihood this passes? >> good question there. assuming the legislature passes and the governor signs the bill, the proposal would go to the voters next year.

that's what happens there. but the threshold for passengers is very high. two-thirds, vic. but a recent survey by the silicon valley leadership group finds 74% in favor of the measure. that number is astounding at least for the moment. >> so why stick the local government with this? isn't there funding with federal, state sources? this is an infrastructure issue so it's about everyone. >> yep, yep. that's another good question. it's also about political reality. over the past decade both the federal and state governments, what have they done? they have dramatically reduced their commitment to infrastructure including mass transit. meanwhile local governments and their voters have stepped in especially in the bay area. now according to the silicon valley lead ership group since 1984 silicon valley voters have passed six major transportation proposals committing $18 billion in local taxes and bonds for projects ranging from highway 85

hazy skies for the east bay at 58 degrees. it's on the cooler side and it's all thanks to this fog here keeping us nice and cool and we've been seeing the fog the past couple of days. we've been calling it june gloom. we can expect to see the deepening marine layer which means you will be waking up to foggy conditions tomorrow morning as well as heading out for work early on. now today's highs will be slidely warmer than yesterday. a high of 76. predicted high in cupertino. warmer at 70 degrees and for the east bay into those mid to upper 80s. so please remember if you are planning on having any fireworks or maybe lighting up any grills, don't do it around any dry brush because that fire danger is there for areas further inland where we're going to see the warmer spots and lower humidity levels as well. half moon bay, daly city, 62.

mid to upper 60s with the predicted high of 68 for san francisco. outer sunset, 63. marina, 65. the north bay, novato, 84. the cooler spots around point reyes at 67 degrees. now if you're heading out of town and you plan on heading to lake tahoe, it will be beautiful up there. we can expect to see loads of sunshine. not a lot of clouds in sight by about 8:00 a.m. we're in the upper 50s and it warms up beautifully to the 70s by about 11:00 a.m. upper 70s and 80s in lake tahoe. i have a feeling there will be plenty of people enjoying lake tahoe. maybe you're heading out to santa cruz. well, santa cruz is expecting to see more of that cloud cover and it will stay that way for the next couple of hours, unfortunately, because of that marine layer. at least temperatures will be quite comfortable in the mid to upper 60s and your day planner today for san francisco, we've caught a little bit of that patchy drizzle the past couple of days and then we'll keep that marine layer at least until 12

chock clock, 12:30 when it starts to burn off making way for 68 degrees and most ly sunn conditions by about 2:00 p.m. by 6:00 we start to cool off and we also begin to see more of those clouds clearing off and it'll become a very sunny and also a bit of a breezy day as well. by 10:00 we start seeing an increase in the cloud cover again but it will stay clear until the overnight hours and the next several days changes on the way. we'll keep that patchy fog in the forecast. as we head into monday and tuesday while people still have days off. as we head into the fourth of july we can expect to see decent conditions as well. we'll keep the cloud cover in the forecast. because the marine layer will stick with us, 64 degrees expected high for tuesday and then as we head into wednesday and thursday, we'll see a bit of a gradual warming. we'll go up a couple degrees in the temperature trend. by monday 88 degrees for inland a areas and then tuesday 86 degrees and a lot of fireworks i'm expecting on the way. i think inland spots will be

year. it reopened yesterday thanks to a new shuttle service to bring visitors into the area. highway 1 is still closed because of damage caused by the fire last summer and made worse by this winter's mud slides. just in time for the holiday weekend some very popular businesses cut off since february are back open thanks to a hiking trail. the public path leads to restaurants including the big sur top house. and it's just a half-mile walk. it's a perfect time to get out there. lionel messi arguably the world's biggest soccer star, is now a married man. argentine locals are calling it the wedding of the secentury. he married his childhood sweetheart in argentina which is their hometown. the couple met they were just 5 years old. they've been dating for ten years and shared their special day with their two sons and they look very happy. gorgeous. beautiful dress. thank you so much for making us a part of your morning.
