very foggy out there. it is tuesday morning, a live look outside right now at the golden gate bridge. hard to make out at the moment. pretty foggy along the coastline right now. you will find it's chilly when you step outside the city by the bay. good morning and thank you for joining us on this tuesday. i'm sam brock. >> and i'm kris sanchez in for laura garcia-cannon. we want to get right to the forecast because it is changing, kari. >> it will be a good change, something we've been waiting on since the weekend. our temperatures will be copping down several is more degrees today and especially for the inland areas you'll notice the difference by this afternoon. we're going to see the highs reaching into the mid-80s for san jose and cupertino. still 91 in gilroy. it will be hot in the south

county and the tri-valley and the delta while we'll have low 80s for palo alto. the embarcadero at 66 degrees. and the north bay looking at mostly mid-80s for some of the valleys. we'll talk more about this and what's ahead as we keep these temperatures throughout the week and, mike, already you're looking at a crash. >> westbound 580 where you see the toll plaza camera here. i wanted to show you how light and intermittent the traffic flow is and that's why we're able on our map to see a steady flow westbound 580 from the richmond side over to san r rafael. a little bit of slowing around the toll plaza. it's just past that as you get over mid span. it sounds like everything is off into the service lane area but we'll track that of course. the bay bridge also has some slowing getting out of san francisco that lasted about five minutes there getting out of there they had a quick traffic break to remove cones. looks like the traffic break

just cleared. the rest of the bay moves well. i'll give you a note about oakland in the next report. back to you. mike, thank you very much. let's go now to a developing story since yesterday out of d.c. the headline right now the latest republican plan to repeal and replace obamacare is dead. two conservative senators came out yesterday and said they would not vote to even advance the bill for debate, effectively quashing it. the big question this morning, what's next? >> senate majority leader mitch mcconnell admits the replacement of obamacare, quote, will not be succe successful and said the senate will instead vote soon to just repeal the affordable care act with no replace. president trump does support that plan. all right. back in the bay area now and a developing story this morning out of the south bay. a live look from sayratoga. firefighters trying to get a handle on a brush fire that's burning dangerously close to mt. eden winery.

no homes are threatened. we've had crews all night long watching this. we got an update ten minutes ago. fire is at 40% containment. >> that is good news. firefighters say a drone spotted over the flames created a real problem for them. "toda in the bay. >> reporter: a drone presented a major problem. >> we had a helicopter coming in on a drop and it had to be waved off because a drone was spotted. that investigation is ongoing. >> reporter: it's on going because flying drones in an emergency zone is a violation of faa rules and california code. >> it probably didn't affect this fire that much, however, if that drone impacts that helicopter, it could potentially cause it to crash. >> reporter: luckily that didn't happen. there were 150 crew members on scene to fight the blaze along with helicopter drops of fire retardant.

the 20-year-old died after she was shot. police say they had been arguing. 4:34 right now. a uc-berkeley student accused of vandalizingi inmore than a doze cars. one of two accused of spray painting hateful messages on besrkeley cars and homes last month. peter estrada was also arrested for that. prosecutors say they have surveillance of the two committing the crime. an unexpected twist in the recent rollout of a new bike share system in the east bay. we told you last week about the go bike system in oakland, berkeley and emeryville. now the "east bay times" reports yesterday vandals slashed all the tires at a station on telegraph avenue. the company quickly replaced all of those damaged bicycles. well, it is a new look this school year, the dress code is changing for students after

parents and students complained that it was discriminatory toward girls. school officials we talked to agree. >> the types of clothing, spaghetti straps, halter tops, so we found after reviewing it, it was actually quite biased towards young women. >> the district says it is now going to leave most of the clothing rules up to parents to decide. one rule stays, though, no red or blue outfits. those are traditional gang colors. a tax cuts for owners in the millennium tower. it comes with a very big cap. the reason people would rather not see their taxes drop. >> and wiping out billions in student loan debt. why students taking their creditors to court are expected to win. san francisco )s troubled

millennium tower is sinking and leani 4:39. san francisco's troubled millennium tower is sinking and leaning. we know that. now property taxes might also be falling. we've been investigating the tower and its problems for the last year. now we know that about 100 units will be entitled to a property tax cut this this year according to the city's assessor's office. the savings will be about $3,000 per owner. that reflects a loss of about $300,000 in property value per unit. however, the owners say this is really a joke for them. they contend their property values have plummeted to near zero. but the city's assessor tells us

the value is based on recent sales of comparable condos as well as sales in the building itself. millennium owners can appeal that ruling but the process can take more than a year. a new report may just prove what you thought you already knew. bay area wages are not keeping up with housing costs according to a report by the silicon valley institute of regional study and reported by "the mercury news." wages are up 14% since 2011 in santa clara county, san mateo and san francisco. the median rents are 45% higher during that same time period. statewide wages rose about 1% in the last six years while rents rose nearly 8%. new this morning student loans for tens of thousands of people may soon be wiped away because of missing paperwork. "the new york times" reports $5 billion in student loan funding from the national collegiate private trust is now in limbo. judges are voiding some fashion

collegiate loans this court because the trust has not been able to prove that it owns those loans which were originally made by banks and then sold to investors. the issue is similar to the subprime housing loans that were once ruled uncollectible because of missing or fake documentation. high school students with their sights set on the uc system may have an extra chance to shine but not everybody is happy about this one. campuses can now ask students for letters of recommendation. in addition to grades, test scores, extracurricular activities, the letters had will help the schools decide whether to admit them. the uc regent believes a high-quality letter recommendation will help students stand out and will only request them from 15% of the applicants. >> be nice to your friends. 4:41 right now. cool and forecast, kari hall? >> we'll say cooler because it's not going to be still really cool but we're going to bring it

the screen it's 59 degrees. 60 degrees in the south bay and in the east bay right now. 57 degrees the clouds and fog back in san francisco and that is going to make all the difference today bringing down those temperatures with a high today expected up to 64 degrees. still 85 in santa rosa even though you're seeing patchy fog there now in oakland. 73 degrees in oakland -- rather, in san jose. it's going to be up to 84 degrees. as you look out the window and getting ready for the day, it's still going to be quite warm and actually above average for this time of year. so i'm breaking out the short sleeves and also some shorts, something to keep you nice and cool especially if you're going to be away from the coastline. at the coast you'll need some more layers. look at how cool it's going to be at half moon bay. we'll still see the clouds throughout the morning and a little bit of sun this

afternoon. a great day for golfing there or going out to at&t park to enjoy the giants game. late they are evening you'll need a light jacket as our temperatures drop back into the 50s and those winds will be picking up, too, so it will be breezy and cold out there. and as we look at the san francisco forecast for the next seven days we will eventually make it up to 70 degrees but it looks nice and cool over the next few days thanks to the fog. the marine layer at about 1,000 feet. it will still be very warm inland, some of the valleys reaching the upper 80s today and then the 90s will be back this weekend. it looks like a the hot weekend ahead so prepare for that. and mike starts us out with what's happening in the south bay. first i want to let folks know the shorts you showed today i didn't have those. those were short er than my shorts. >> daisy dukes. >> we're looking to the south bay, indeed. 237 a number of vehicles involved in a crash. it sounds like the last of them got over to the right shoulder and there's no slowing. no major injuries but i'm tracking reports as they continue to come in. slowing southbound 17 right

around the overcross and continuing down to bear creek road. one lane is blocked. only two in each direction. the northbound side cleared up nicely and southbound should clear very soon. it looks like they're moving equipment. they did move it earlier from oakland. that's the good update. yesterday construction and the backup with the closure lasted until almost 6:00. that was almost an hour late. today they cleared both sets an hour early. so that's a nice drive to make up for yesterday. let's take a look at waze and see how things are shaping up. no need to make up time now. castro valley to the san mateo bridge, it's just fine. shows you a few routes including the route for the blue section will. it if you want to take that add another ten minutes on to your drive, waze lets you do that no matter what your diversion, they'll get you back on track. join our team nbc bay area wazers so we can help keep track of each other. >> that y is a funky looking shape. 4:48. it is a go, an extension of the

state's landmark law to combat climate change is moving forward this morning. >> it's a great day for californians. it's a great day for bipartisanship. a great day for the planet, climate, and clean air in many of our cities. >> you can tell governor brown has some passion over this issue. that decision came after passionate appeals by governor brown and hours of debate in the legislature. cap and trade has been extended through 2030. that program requires polluters to buy permits for the gases they emit. it's an incentive to reduce carbon footprints or to shell out the money to pollute. the missions are capped and companies can trade for more capacity through a state-run auction or on the private market. this morning only the bow of a sunken barge is still at the bottom of the bay. work crews started pulling out last remaining segment of that sunken barge. that 112-foot barge sank because of a storm. the good news is no one was onboard.

happening today san francisco's transportation agency finally votes on a $300 million plan to create bus only lanes on one of the busiest streets in the city. we've been reporting on the geary street project for a while now. that project calls for dedicated bus lanes from market street all the way out 34th avenue. that plan also includes sidewalk extensions, new bus stops, and traffic signal improvement. what you're looking at is not a finished product. this is the animation of what that will one day look like. >> as we've been reporting cal trains project is rolling forward. new this morning we're learning they are eyeing dozens of private properties along the track. through eminent domain will acquire 55 properties in the south bay and the peninsula. some of those properties will require an electrical safety zone which requires the removal of pools, ponds, and foliage. and speaking, kris, of cal train, they permanently close add parking lot as it builds the

new san carlos transit. parking lots closed at 2:00 is on the north side of the station. there's a newly completed parking lot at el camino and cherry avenue now open to everybody. outrage continues to grow over the shooting of a bride-to-be. the police body cameras and the role they could play. but first happening now breaking news out of the philippines. the president is asking congress there to extend martial law until the end of the year. the country is battling a movement inspired by isis. and some doggie drama overnight. wide receiver lucky whitehead's pit bull has been returned after the dog was was stolen and held for ransom. we're back with more news on this tuesday in just two minutes. ♪

minneapolis - where many questions remain unanswered about the now to a developing story out of minneapolis where many questions remain unanswered about the shooting death of a bride-to-be at the he hands of a police officer. 40-year-old justine damon reportedly called 911 to report a possible assault in an alley behind her house. two officers responded. one of the officers shot her in the stomach in the alley a short time later. here is the woman's fiance. >> the death of justine is a loss to everyone who knew her. she touched so many people with her loving and generous heart. >> the minneapolis police chief is promising an investigation but not saying much else. the officers did not have their body cameras on. damon was from australia and her shooting death is dominatinging

headlines there. australia has some of the most restrictive gun control laws in the world. had this morning a developing story. still no sign of the father who went missing during a flash flood in central arizona over the weekend. that man was at a family outing at the time when a river flash flood struck. you can see the waves of debris there. nine people were killed, first responders describe that flood as a 40-foot wide black wave. it was triggered by thunderstorms upstream. new this morning nbc news investigates water contamination here in california. state officials knew for decades millions of people living in the central valley lack access to clean, safe drinking water, but they did not begin to address the issue until about five years ago. here is attorney ed todd robbino explain how it got contaminated in the first place. >> pcp got into the the drinking water because dow chemical and shell saw an opportunity decades ago to take a hazardous waste
