happy tuesday morning.. as we take a live look outside in san francisco -- the fog still hanging over the city. ad lib happy tuesday morning as we look live outside in san francisco. the fog hanging over the city so you may have noticed a bit of a climate shift there. in the south bay i was hot getting ready this morning. thanks for joining us. i'm kris sanchez in for laura garcia-cannon. >> there's so much energy bubbling inside of you. >> i might have over caffeinated. >> all these changes going on right now but the fog has been consistent. >> it's been lacking the last couple of days and that's what caused the temperatures to really heat up. so glad to see it has rolled back in but it's still clear as we look outside at fremont. it's 57 degrees and already warm

inland. we are making progress here. oakland 73. 83 in palo alto and san francisco will be up to 64 degrees. >> southbound down through los gatos hills we did have a lot of slowing because of construction. all lanes have cleared up. we look at the rest of the south bay. the crash in milpitas still on the shoulder. the crash to the richmond san rafael bridge still on the shoulder. no major injuries. the bay bridge westbound we did have an earlier bit of debris clear cleared. back to you. >> mike, thank you very much. it's 5:01 on your tuesday. another violent attack and ironically comes just hours before the b.a.r.t. board of directors.

>> pete suratos is live at the station in fremont with new information gathered overnight. >> reporter: if you're a b.a.r.t. rider, you might want to listen up because we're talking about your staft. this latest incident just up the track from the warm springs area happened in san leandro. police are saying the incident involved someone being assaulted by a group of throw to four men. and we know that victim was taken to the hospital for facial cuts and swelling. that happened in in april involving dozens of youth at the oakland coliseum station which really put the safety issue for b.a.r.t. in the spotlight.

certain crimes are on the rise. an increase he in violent crime which includes the robberies over the past few months as well as sexual assaults nearly doubling. that's just this year and there were four in 2016 so that's nearly doubling this year. b.a.r.t. says people feel there aren't enough and we spoke to a spokespers spokesperson. >> there have been concerns there isn't enough police presence. where are the police. more people on platforms, more visible police presence. >> reporter: security cameras are on trains to help fix this issue but that board meeting takes place in oakland.

we're live in fremont. pete suratos for "today in the bay." >> the search continues for two men who robbed a walnut creek family in their home yesterday and it happened at 8:30 in the morning. that home is near sidro lane. the suspects were armed with guns and they came in through an unlocked door. they got away with cash and personal property. the family is physically okay. neighbors are still on edge. >> are you going to do anything different ly? >> keep the doors locked. >> i've been thinking of getting security cameras. i think we will do it in the near future. >> one neighbor tells us their surveillance camera did get video of the escape. they tell us the community doesn't deal with had on a regular basis.

information available through may of this year. what we found the department's residential burglary sta ttisti are down 35% compared to 2016. property crimes are up to about 1,200 incidents so far this year. >> from a popular hiking spot to crime scene, police are going to start patrolling twin peaks 24/7 after a man was shot and killed on the lookout point sunday morning. the victim was 71-year-old edward french. "the chronicle" says he is a well-known photographer in the city. witnesses say a man and woman approached him, shot him, and may have stolen his camera before speeding away in a dark green honda. this is not the first deadly incident at twin peaks either. on valentine's day of last year three people were shot, two killed on an early sunday morning. one person was arrested and charged in that case.

san francisco is getting ready to create a new office of cannabis that will handle all pot permits and complaints. the board of supervisors is voting on the new office this fall. it will be responsible for developing and managing all cannabis-related businesses. pot sales go on sale here in california on january 1. city councilmembers are introducing an ordinancordinanc. it would have coupons and special discounts from being offered. that gets under way tonight at 5:30. developing news out of washington this morning. a live look as republicans scramble to figure out what they're going it to do next.

this is another blow to the trump administration. what's next for our nation's health care coverage. what does this mean for all of us? >> reporter: with senate republicans unable it to come up with a way to replace obamacare they are focusinging on trying to repeal it. they will come up with a fix for the replacement at a later time. mitch mcconnell has been walking a tightrope to plead moderate and conservative republicans. in a statement mcconnell admitted the replacement of obamacare will not be successful. the senate will vote to repeal the health care law phasing it out over two years with no immediate replacement. along with utah's mike lee that they he are now against the senate bill. joining kentucky's rand paul and maine's susan collins to effectively kill it.

>> those who heard from their constituents heard overwhelming opposition. >> reporter: the president is onboard tweeting republicans should just repeal failing obamacare and work on a new health care plan that will start with a clean slate. >> and we must repejob killing obamacare. >> reporter: he prodded republicans monday at the white house. >> vote no and have a spine. >> reporter: in recent months support for obamacare has grown. supporters rallied on capitol hill again monday. democrats say republicans have tried to go it alone for too long. >> we ought to bring the american people into this debate and there's no excuse now for not having open public hearings. even a simple obamacare repeal might be hard for senate republicans to achieve when the congressional budget office looked at a simple repeal.

series of meetings on the proposed expansion of a reservoir located between brentwood and livermore. it would provide water for hundreds of thousands of more people not to mention farmers and add another layer of drought protection. there will be six meetings planned through the end of the month. it's 5:10 on your tuesday morning. we wake up with mostly clear skies for the inland areas and the coastal fog back and it's going to reach up to 77 degrees on the peninsula today so we're bringing down those temperatures. it will be a little bit cooler than it was yesterday but still very warm in the tri-valley with the high of 89. also 89 in the north bay while san francisco will get some clearing and a high of 64. coming up in about three minutes a look at today's temperature trend for cupertino. mike says the freeways are moving well. >> yay! it's not even 5:11. a few more seconds.

it's 5:14 and we do have have some mostly clear skies and checking out the temperature trend for cupertino will be at 64 degrees at 9:00 this morning. it's going to be much nicer as we go through the day with highs reaching into the low 80s. we are continuing to bring down those temperatures from the high heat we had over the weekend but it's very dry. we'll talk about what's ahead as temperatures go back up coming up at about 5:19. >> and a look at the san mateo bridge. we have a good amount of traffic westbound. smooth flow on a flat section but an incident looks like it affects only part of the street

and not your approach to this bridge. that's good stuff. we'll bring you the rest of the commute coming up. still moving smoothly there, mike. stop what you're doing to check out this video there. you have to understand, we understand, that neither driver was hurt despite what that looks like. a van carrying flammable material crashing there into a broken down truck just explodes into a fireball yesterday. that was out of shanghai, china. both drivers managed to escape the flames somehow. that was so strong it shattered windows of nearby buildings. that too close call at sfo on the ground. a state leader who happened to be onboard the plane is demanding answers. dave jones was on the air canada flight that almost turned into a catastrophe on july 7th.

pilot almost land ed on a taxiwy instead of the landing strip only to abort about 100 feet from hitting several other planes. faa investigators are looking into how this happened. jones wants a complete and thorough investigation and answer from air canada. >> we appeared to be pretty close to the ground. i do recall at the time that he began to execute the climb that it looked to me we were seconds away from landing. >> aviation experts say the plane may have been less than ten seconds from disaster. >> happening today another bay area city is going to consider robot delivery service. walnut creek will consider a pilot program with starship technologies that will allow the use of autonomous robots for

delivery. also happening today uber is offering a possible added incentive to use the ride share's new in-app tipping option. it plans to match all such tips by riders today. uber is trying to get the word out its in-app tipping option is available everywhere in the united states. your name is not linked to the tip and uber won't ding you with an extra charge. more business and tech news now. you can expect shares of netflix to explode on the opening bell. >> let's take you to kate rogers live. good morning, kate. >> reporter: hey there, sam and kris. wall street doesn't appear to be reacting to the collapse of the republican health care bill. however, the u.s. dollar is at a ten-month low falling against other major currencies such as the pound and the yen. the currency market is one of the most sensitive and this could be seen as another major

for president trump's agenda. prices for housing and earnings from johnson and johnson. the dow fell to 21, 629. the nasdaq those to 6314. shares of netflix could hit an all-time high as you mentioned after the company reported better than expected earnings last night. the streaming service adding more than 5 million new subscribers in the second quarter. netflix now says the majority are outside of the u.s. customers aren't watching as much. viewing type dropped 25 minutes. and samsung plans to recycle parts from its galaxy note which gave notoriety last year after a battery problem caused some to catch fire. samsung will reuse memory chips and camera modules. the company will recover more than 100 tons of rare metal such as gold and cop earp as it tries to reduce its impact on the planet. back over to you. >> kate rogers. we can applaud any effort to

tries to reduce the impact on the planet. be careful. >> you do it. >> i thought we were better friends than that. it has been so hot here. now the last couple of days it's been nicer. >> it's going to be really nice and we can't complain about this because we are in the middle of summer. it's going to be warm in the inland valley and will be coming down along the coast as far as our temperatures and as we take a live look outside in san jose it's all clear. the seven-day forecast is coming up at the bottom of the screen and you'll see it will be a nice rest of the week ahead but heating up this weekend we'll get to that. but right now as you get ready to step out the door on this tuesday morning it's 53 degrees in napa. 58 degrees in san jose and 57 in fairfield, livermore, oakland and palo alto. some pretty even temperatures but it will start to spread out as we go through the day. los gatos will be up to 87

degrees and still 91 degrees in gilroy. you did hit the triple digits. i know it was really hot. antioch will be up to 91 degrees. and hayward will see a high today of 80 degrees while the peninsula will also have a wide range in temperatures from the foggy half moon bay at 60 degrees and 80 degrees in belmont. san francisco at 67 in the mission district and 78 degrees in mill valley while santa rosa at 85 degrees. as we break down the day for oakland we start out with some temperatures in the low 60s. lunch time temperature of 66 degrees and a breezy 73 degrees by 4:00. and if you're planning on going golfing in the tri-valley it won't be as hot but still very warm had this afternoon. best to have the tee time before noon as our temperatures will be much more comfortable. if you're planning to head to the sierra looking now at squaw valley highs reaching into the mid-70s for the next several days and a quick update on hurricane fernando as a category

2 will weaken. something that may be making headlines over the next couple of days so i'll keep you up to date on that. we're going to see san francisco's temperatures staying in the 60s, the low 70s for the end of the weekend and inland will go from the 80s to the mid-90s by sunday. and, mike, you have a second crash on the bridge into san rafael? >> just before the actual span so it's right around the toll plaza. the last one to report was here in the last lane as you head through the toll plaza but it has not shut down any lanes. i thought chp was arriving. we'll track that. no slowing there across the top part of your screen. no slowing except for right at the toll plaza where folks are slowing and gathering for the cash lanes. the rest of the bay does move very well. let me show you waze and we'll see how things are shaping up on the peninsula. san francisco, take 101. you want to take a little more of a roadway here 280, great. a couple more minutes but no

sued, accused of elder abuse and welcome back. this morning ucsf is being sued, accused of elder abuse and fraud for not helping this woman, judy dale, end her life. the 77-year-old woman was diagnosed with cancer and wanted to end her life under the state's end of life option act which was passed last year. during our investigation family says that's not what happened. they say dale's doctors declined to help her end her life as she wished. her attorney says she died a painful death at home before another doctor could give her that life-ending prescription. here is her attorney. >> during the entire time she was there she was having conversations with her health care provider saying i want to take advantage of this and it's all over the records. >> ucsf declined to comment on the case. the hospital's website says participation in the end of life options act is voluntary for doctors. it says if your doctor refuses a social worker will help you find another doctor who might

participate. new this morning we are hearing from a man who risked jail time to help a baby after a very bad crash. >> all of this happening on sunday in spokane, washington. he says he heard a 6-month-old crying after a crash. video shows him climbing into an overturned van and lifting the little boy of the wreckage. >> they think you're a guardian angel. >> it's all good. reactive, you know. i did what i thought was the right thing. this is the polar opposite of everything i've been through. >> so here is why this might actually cause him to face action. he served 17 years behind bars. he got out three months ago. he's on work release with a strict curfew which he says he risk risked violating to help the child. the baby's family says the little boy is going to be okay. >> now there's a good occasion for a letter of recommendation, right, for sure. coming up a break in the case, a woman gunned down in a

morning and get ready for work with that cup of coffee and take in the beautiful sights here of san rafael. roads are starting to fill up. nice day in store and we're glad you're with us. good morning and thank you for joining us on this tuesday. i'm sam brock. >> and i'm kris sanchez in for laura garcia-cannon today. a look at that forecast. and we have a difference in opinion. i think it's hot and sam thinks it's cool. >> i think we have a scientist. >> it all depend on where you are because in san francisco, yes, it will be cooler today. we're heading into the mid-60s for this afternoon. if you're inland, you're going to feel much warmer weather up to 9 degrees, even a few low 90s in spots. and that's the kind of weather we'll see over the next several days. it does get hotter. we're talking about the mid-90s. i'll focus in on the weekend. we'll talk about some events going on coming up in about six minutes but mike takes us out on the roadways. >> a lot of light behind me. you have the headlights, the brake lights now because of the

metering lights right on schedule at 5:30. we had the metering lights turn on. the backup. the map shows you nothing major on the approach. travel times look great. that's 14 minutes from highway 4 down to the backup i just showed you and the overall look at the bay shows you green sensors, just a little slowing out of the altamont. that looks good. 5:31 right now. developing news this in the south bay. firefighters at this point to battle the flames that burn dangerously close to the winery in saratoga yesterday. we have a crew on scene. they've been there all morning long getting updates. bob redell joins us live talking to crews out there. we understand you have some new information for us this morning. good morning to you, sam. yes, i did speak with the fire department and here are the latest numbers. the fire burning in the foothills of western saratoga have burned ten acres and is 40% contained. in other words they have fire lines around 40% of the burn area. right now the flames have is

laid down but that could change once the sun comes up and things start to heat up again. if i asked if they were calling more aerial attacks the fire department told me absolutely 10 100%, most likely a helicopter at the very least once they get daylight. the fire started around 3:20 on mt. eden road here in the bay and it burned close to the mountain winery, a popular concert venue here in the saratoga area. no structures were threatened. no one has been hurt. at one point yesterday afternoon firefighters had to suspend their air attack because of an unauthorized drone flying over the fire. >> it probably didn't affect this fire that much. however, if that drone impacts that helicopter, it could quite potentially cause it to crash. >> reporter: the fire department is investigating who was pil piloting that drone. flying a droep over an emergency area is a violation of california law and faa rules. the fire department he can inspects to be out here for at least another 24 hours. they'll get a better sense of what lies ahead for them during

the briefing scheduled for later this morning at 8:00. reporting live here in the foothills of sayratoga, bob redell, "today in the bay." thanks, bob. it is 5:33 now. new this morning police in richmond say they arrested a teenager for the killing of a woman in may. police say he is a 15-year-old. as for the victim police say 20-year-old allie died after she was shot. they had been arguing. a student accused of vandalizing more than a dozen cars is expected to face a judge later today. he is one of two students accused of spray painting hateful messages onto berkeley cars and home gates last month. peter estrada was arrested for the same crime. prosecutors say they have surveillance video of the two committing the crimes. and an unexpected twist in the recent rollout of those brand-new blue bike sharing

systems in the east bay. we told you about the go bike system debuting in oakland, berkeley and emeryville. now the east bay times is reporting yesterday vandals slashed the tires of all the go bikes at a station on telegraph avenue. the company quick ly replaced al the damaged bikes. >> i think berkeleyville. a new look at the schools this year. the dress code is changing for un school district after parents complained it was discriminatory against girls. the school district officials we talked with agreed. >> the specific types of clothing, spaghetti straps, halter tops, so we found after reviewing it it was actually quite biased towards young women. >> the district says it will leave most clothing rules up to parents. so one more argument in the morning. one rule stays, though, no red or blue outfits because they are affiliate affiliated with gangs. san francisco's troubled

millennium tower is sinking and leaning and now property taxes might be falling. we've been investigating the tower and its problems for the last year. now we have learned about 100 units are going to be entitled to a property tax cut this year. that is according to san francisco city assessor. the savings will be about $3,000 per owner which reflects an average loss of $300,000 in property value per unit. however, owners call this, quote, a joke. they contend their property values have plummeted to near zero. the city's assessor tells us the value is based on recent sales of condos as well as sales in the millennium tower. owners can appeal that ruling but that process can take more than a year. a new report may just prove what you thought you already knew that wages aren't keeping up with housing costs according to a report by the institute of regional studies and reported by the mercury news. wages are up 14% since 2011 in

s santa clara county and san francisco. however, the median rent in those three counties are 45% higher during that same period. statewide wages rose about 1% in the last six years while rents rose nearly 8%. >> as we have been reporting cal train is rolling forward. new this morning we're learning cal train is eyeinging dozens of private properties along its tracks. cal train through nent domain will acquire parts of 55 different properties in the south bay and the peninsula. several of those properties will require an elected are trycal safety zone. this requires the removal of pools, ponds, and foliage. happening today san francisco's transportation agency finally votes on that $300 million plan to create bus only lanes on one of its busiest streets. we've been reporting on the geary street project for a while now. that project kaults for dedicated bus lanes. the plan includes sidewalk extensions, new bus stops and

families planning events for their kids. >> we only have four weekend left before the first day of school. no pressure, kari. >> we have to start studying. summer reading. do you remember that? the pressure is on. >> okay, so we're trying to squeeze in the quick road trips before school starts again and let's talk about some places you might be heading. here is a look at saturday's forecast for the bay area. it's going to be hot again, so we're he taking a little bit of a break now. we'll be back into the 90s in the valleys on saturday. the coast will be at 67 and more of the same sunday up to 69 degrees for the coast. the bay at 80 degrees and hot inland areas into the low 90s and this saturday the san francisco marathon happening on the embarcadero, the start of the race, and it will be right in the low 50s so it's going to be nice and cool. it looks like it will be foggy as well and then our temperature slowly warming up. if you'll be hitting the road and heading to the sierra a lot

it's a clear start this morning on this tuesday. right now at 5:42 as we take a live look outside at san jose some bright sunshine throughout the day and the temperature trend in the upper 60s by 9:00. upper 70s by noon. you see where we're head iing, upper 80s by early afternoon. still going to be very warm in some spots but those temperatures coming down he is pegs ly along the coast. we'll take a look at the wide range in temperatures coming up in five minutes. and the north bay drive times look great right now. just that mild slowing west of 37 out of vallejo. i do have a new crash. we've learned that with some teammates from waze.

let's show you what we have coming up. thank you, mike. 5:42 right and developing news out of minneapolis today where a lot of questions are still unanswered about the shooting death of a bride-to-be at the hands of a minneapolis police officer. 40-year-old justine damon reportedly called 911 about a possible assault in an alley behind her home. two officers responded and then one of the officers shot her in the stomach in that alley a short time later. here's the woman's fiance. >> the death of justine is a loss to everyone who knew her. she touched so many people. a loving and generous heart. >> the minneapolis police chief called the shooting a tragic death and is promising an investigation. not much else, though. the officers did not have their body cameras on. they were not required to. damon was from usaustralia and r shooting death is dominating headlines there. australia has some of the most restrictive gun control laws in

the world. developing story now. still no sign of the father who went missing during a flash flood in central arizona over the weekend. that man was at a family outing at a river when a flash flood struck. nine people were killed as a result. first responders describe the flood as a 40-foot-wide black wave with all the debris in the water triggered by thunderstorms upstream. new this morning nbc news investigates something our investigative unit has been covering for a very long time. that is water contamination right here in california. state officials knew for decades millions of people living in central california lacked access to clean, safe drinking water but they did not begin to address this issue until about five years ago. here's attorney todd robbins explaining how the water got contaminated in the first place. >> reporter: pcp got into rinking water because dow chemical company and shell oil company saw an opportunity

decades ago to take hazardous waste stream at their chemical plant, put it in barrels and sell it to farmers who would inject it into the ground. >> the state legislature is now negotiating a bill which would establish a fund to subsidize water treatment for roughly a million people who still need it. there's still a lot more to the story. you can watch snbs's investigation coming up on the "today" show. all new this morning republicans on capitol hill are unveiling a 2018 budget plan. that plan called for a major overhaul of tax code. spes cifically the plan calls f big cuts to federal spending over the coming decade but not for defense. spending there would increase. that proposal includes a roll back of benefits, welfare spending and more. the house budget committee is expected to vote on the bill this week. on the state level it is officially a go, an extension ofcalcal's mark law to combat mat change is moving forward.
