concord. yes, the 90s are back. san jose up to 82 degrees. 68 in san francisco. we'll look ahead to how hot for the end of the week and the weekend coming up. mike has an update on a gas tanker crash. sounds dramatic. i want to calm folks down. this was an accident involving a gas tanker truck but no flames, no fire. it does have debris blocking 101 northbound at great america parkway. lanes have cleared. there may still be activity on the shoulder but not a lot of slowing. there was a smaller leak that hazmat has taken care of early this morning. a smoother drive now threw the south bay. we are looking at the approach to the bay bridge, and here are nice travel times. there's more slowing than we typically see. i'll double-check on what's going on. back to you. >> thanks so much, mike. a live look at the u.s. capitol where you can expect fireworks,

heated debate, and perhaps some suspense over the coming days. this after the u.s. senate voted to open the debate on health care reform. u.s. senators narrowly voted to approve that debate. vice president mike pence cast the tie-breaking vote. but then senate republicans were immediately dealt a blow late last night after a bill to repeal major parts of obamacare failed. nbc bay area's tracie potts following all the developments. she'll join us in a live report had in our 5:00 hour. >> we need a flow chart to understand everything going on right now. developing this morning, what would you do if you got a call from someone saying your loved one was in an accident? one peninsula police department is saying just hang up the ph e phone. >> kris sanchez live in palo alto with a scam warning so you don't get taken. good morning, kris. >> reporter: good morning to you, sam and laura. i'll admit as you probably would, too, if you got a phone call from someone saying your loved one had been hurt or was being kidnapped it would be hard to hang up the phone.

the palo alto police department says if you stay on the line those scammers that are calling are one step closer to taking your money. palo alto police say virtual kidnappings are on the rise and that several of the citizens reported getting phone calls from people demanding ransom. in some cases the caller says the loved one damaged their car and will be held until the caller pays up. and by keeping people on the phone the virtual kidnappers prevent people from calling the loved one to make sure that they are okay. but if you get a call like this, palo alto police say press the caller for specific details. >> what does my loved one look like? what are they wearing? can you describe the car? can i speak with the person? ask very direct questions that will require a direct answer from them. >> reporter: now i did post other advice from law enforcement on my facebook page, kris sanchez, nbc bay area. in the comments tell me if you have gotten a scam phone call like this one.

i know i haven't but i think my heart might skip a beat for sure. at 5:30 how this same scam has played out in los angeles and what it has cost people, what people have paid out of pocket in order to make sure their loved ones are okay. in palo alto, kris sanchez, "today in the bay." >> kris, thank you so much. at 4:34 the 18-year-old father accused of abandoning his baby in a parking lot is expected to make his first court appearance. customers at a barbershop say they saw daniel mitchell leave the 16-day-old baby in a parking lot. the newborn still in a car seat. surveillance video also captured that incident which happened monday afternoon. the barber who rescued the child say they can't stop thinking about it. >> we just want to know what's going on with the baby because he looked all right when he was s sitting in the seat. he was alert, relaxed sucking on a pacifier. >> mitchell is charged with child abandonment and

endangerment along with cocaine possession. police say mitchell now claims he did so much cocaine he didn't know he left his baby behind. the mother is not considered a suspect. a developing story now overnight. firefighters have knocked down a grass fire in south san jose. this fire started yesterday evening near a golf club. you see the strength of the flames there. a barn was destroyed. quick action by fire crews did keep the flames from spreading. only about five acres of land were burned. south bay leaders want to make sure there is never a repeat of february's flooding in san jose. the water district is teaming up with the army corps of engineers on a study to reduce the floodriflood risks along the coyote creek. the district plans to pay the corps for its assistance. a temporary freeze on granting new marijuana dispensary permits at least

until the smoke clears on looming legislation. when the new year rolls around recreational marijuana will become legal in had california. after the board yesterday approved no dispensary limits for just the excelsior district supervisor cohen called for a 45-day moratorium. she wants the board to gauge how marijuana clubs will fit into local cannabis framework. >> the push to change justin herman plaza is official. new this morning san francisco supervisor peskin will announce legislation calling specifically for that change. it proposes removing the name on the embarcadero by the ferry building until a new name is determined. justin herman did lead san francisco's redevelopment agency in the 1960s, and he pushed out african-american communities from the western neighborhoods. thousands of people signed an online petition calling for the name change.

some lower 90s for the south county and east san jose. as we go to the east bay we're seeing more of those 90s through the inland valleys. antioch today up to 93 degrees. oakland, 75. hayward at 78 degrees. 63 degrees in half moon bay. 67 on the embarcadero and the north bay up to 90 in sonoma. you will make sure you're wearing something that will keep you nice and cool like some short sleeves and then it's a good day for the sandals as well. make sure you have the pedicure going on. as we take a live look outside, looking at the forecast for levi stadium we are going to have a busy day out there, a lot of fans packing into the stadium, and it will be very warm temperatures in the mid-80s this afternoon. make sure you drink lots of

instagram is expected to make her first court appearance. 18-year-old obdulia sanchez was posting when she lost control of her car in los gatos last friday. after the crash she live streamed even though she, quote, knew she was going to jail. sanchez's 14-year-old sister was in the car. she died. a second 14-year-old girl also in the car was seriously injured. sanchez faces ve hhicular manslaughter and dui charges. 4:49. new this morning new details now in a multimillion dollar lawsuit leveled against tennis star venus williams. she says she's not at fault in a crash that killed a 78-year-old man in florida. they say williams was not paying attention while driving. here is the attorney. >> we believe that the evidence from the black box download will demonstrate that she was distracted and delayed in her reactions. which ultimately caused this

that )s what golden gate transit 4:54 on your wednesday morning. blame it on the rain. that is what leaders are citing for ferry ridership. bus ridership is down 10% since last july. at the same time ferry ridership is down about 1%. they blame an unusually wet winter along with those takinging ferries to giants games and a lot more congestion on highway 101. the faa is now stepping in amid an ongoing noise problem happening across the bay area. thousands of complaints pour in near areas near sfo. the faa is in the early stages of testing and implementing new procedures after a study was implemented by members of congress saying new floit patterns along with planes to land, the planes are flying

lower to the ground and closer to homes. there's a renewed effort to rename terminal one of sfo after the late harvey mil. it was introduced by the board of supervisors. supervisor jeff seehy says he's making it a priority. it has the plan of a key body. the airport facility's advisory committee. happening today transit is considering the future of bus routes for three different schools in oakland hills. they are paying to provide service to skyline high school and community day school. in january it cut funding. without that money the bus services are going to go away. there's a meeting today at 1:00 at the east bay transit office community room in oakland. 4:56. to an unprecedented move, the school board will be the first to be elected from the geographical district. the school board responded to threats of being sued over bias
