so we don't see as much of a change as the inland areas heat up. a look in san jose as you see the clouds overhead. at least we do have that nice and cool start to the morning with some clearing skies here within the next couple of hours. we'll talk about what's ahead with hotter temperatures coming up. mike takes us back to santa clara. >> we had a crash involving a gas tanker truck that's alarming but no issues as far as any gas spills, not the even a hazmat situation. i double-checked and the situation was waved off. not a problem there. we are looking at this activity on the shoulder north 101. a couple of cruisers and that tanker truck on the shoulder so a little distraction as you pass by great america parkway but no major slowing as you see on the sensors. we're locking at the earlier slowing. these travel times are great become to 14 minutes as we would expect down to the bay bridge toll plaza. sam, back to you. 5:00 on the dot this morning

and live now to washington where the plan to repeal and replace the affordable care act took one step forward dramatically yesterday. then took one step back. first senators agreed to open debate on a new health care bill and then hours later republicans faced their first defeat. they failed to pass a had measure they've been working on that would partially repeal and replace obamacare. "today in the bay's" tracy poth joins us live with what is next and the full palate of options, tracie. it is hard to keep track of. >> reporter: well, let's try to simplify it for you because what happened is repeal and replace didn't work. nine republicans voted against that. today, though, giving lawmakers two more years to figure out what to replace obamacare with. that's not expected to pass. then it's open season after that for amendments and other ideas one of which is the so-called

plan, allowing republicans to repeal or get rid of certain parts of obamacare like the individual mandate. the fact businesses have to provide health care. but keeping some of the more controversial and larger and more expensive parts like medicaid and subsidies for low-income families to pay health insurance doesn't really solve some of the issues both democrats and republicans have that allow them to say they repealed but there would still be a lot on the table. we don't know where they're going to go with this today. we do expect there will be more debate coming up this after knoop. live from washington, i'm tracie potts, back to you. all right, thank you very much. happening today leaders from all nine bay area counties are meeting right now to talk about the future. >> at issue housing infrastructure and jobs. b"today in the bay's" pete suratos joins us live in san carlos with some of the details on today's vote. good morning, pete. >> reporter: good morning to you, laura and sam.

officials will be voting later today. i went to the plan 2040 website to see what this is about and how it will affect our viewer who is watching right now. it comes down to housing and jobs. it revolves around the two key issues as we see the population grow around the bay area year by year. by 2040 they would like to add 820,000 housing units around the bay area as well as 1.3 million jobs. now i want to point out according to the plan a majority of the housing and jobs will be focused on larger cities such as san francisco, san jose and oakland. if you're a smaller city such as richmond, emeryville and mountain view, those are being looked at as key locations by officials as well. they want to look at invest pt strategies for regional transportation which would be paid for by $303 billion in expected revenue from federal and local levels over the next 20-plus years. and it's also this plan that

will comply with senate bill 375 which addresses climate change from cars and light duty trucks as well as providing housing for projected growth. the metropolitan commission and an association of governments as well as representatives from more than 101 cities around the bay area coming together to discuss this plan. they will be meeting in san francisco tonight at 7:00 p.m. we're live in san carlos, pete suratos for "today in the bay." >> all right, thank you, pete. >> thank you, pete. it is 5:04 right now. are a fourth suspect linked to the brutal killing of an elderly san jose woman will face a judge today. santa clara county arrest a man. douglas was well known and loved in the community. many calling her miss flo. she died last october after being attacked inside her home. all new this morning belmont

police looking for the man in a bold restaurant break-in. look at this surveillance video showing him riding his bike through the window and quickly smashing it with a chair. this happened at a restaurant in el camino real just before 7:00 in the morning. you can actually see the cars whizzing by but no one called 911. he check out the cash register at first but it was empty. he ended up taking nothing from the restaurant. if you know who the person is contact belmont police. now we did look at some recent crime numbers in belmont. we counted about 20 thefts reported by belmont police since july 1st. at the same time that restaurant break-in we showed you belmont's only reported burglary. over the same period last year belmont police reported three burglaries. some new details now on a story that our investigative unit was the first to break this last week. a childhood friend talks about the bay area terror suspect accused of plotting to kill

hour. b"today in the bay's" bob redel live with what's being done to ease some of tonight's congestion. this isn't the first time a major event at levi caused rush hour headaches. >> reporter: no, it isn't. good morning to you, laura. anyone who lived in santa clara, who has been to levi stadium for a big concert or game knows getting in and out of this venue isn't always easy and we do not expect, unfortunately, today to be much different when the united states men's soccer team takes on jamaica tonight in the gold cup final. levi is expecting more than 60,000 soccer fans to fill the stadium. the game starts at 6:30 p.m. however, traffic headaches in the area are expected to start much sooner than that. tasman drive will be shut down starting at 9:30 this morning, about 4 1/2 hours from now, it will be shut down throughout the game. parking lots will open at 1:30. that's so fans who have tickets can go to the siesta in the

parking lot from 1:45 to 5:45. the gates of the game open at 4:30. the game starts at 6:30. expected to run to around 9:30 tonight. the santa clara police department is talking about traffic delays. if possible they recommend you consider taking caltrain, the h train or vta. vta will be running extra trains. now if you are driving levi's encourages you to buy a parking pass in advance via their website. one reason why so many fans are interested in tonight's game is that the u.s. is looking for system payback because a couple years ago jamaica beat them in the semifinals of the united states defeated el salvador and costa rica to make it to tonight's gold cup final. there are still tickets available. outside levi stadium, bob redell, "today in the bay." >> the u.s. team looking for a

little revenge. apresht that update. 5:08. surf is up around the bay area. that can be a very dangerous thing. the national weather service is warning beachgoers to be aware of the possible threat from large waves and strong rip currents. a spike in sneaker waves. that warning will be in effect for south facing beaches from friday through monday. >> and those south facing beaches as we are going to see temperatures today and we'll be starting out with cooler air and clouds in the low 60s this morning. low 70s for this afternoon. and if you are planning to head to levi stadium for the gold cup final it will be very warm out there reaching into the mid-80s this afternoon and right in time for kickoff that will be 6:30 and in the lower 80s, cooling off nicely. a look at today's temperature trend coming up in three

5:24. welcome back to you. football season right around the corner this morning we're diving deeper into an alarming new report that shows just how dangerous that sport can be. >> and we're not just talking about professional football. the crazy thing this goes as early as high school football. researchers at boston university studied the brains of dead former football players. here is what they found. evidence of severe brain damage

in the vast majority of college players. here are the numbers to bring it into perspective. after studying the brain of 177 former f eer football players t showed signs of cte, a brain disease linked to repeated blows to the head including 110 out of 111 brains of former nfl players. 48 out of 53 college players and for high school players the numbers were quoite a bit lower. 3 of 14 also showed signs of cte. right now research is limited because the disease can only be diagnosed after death. >> these are people that chose to donate their brains to science because they suspected that they or their family members, loved ones, had cte. it turns out a lot of them were right. >> that is amazing. the nfl issued a statement on the new reporting that it's going to work with a wide range

to improve the health of current and former nfl athletes. >> it will be interesting to see if it changes the way parents enroll their kids in football. 5:26. the text-alyzer may be coming to new york. new york state will study the use of that device. if you're not familiar with it, it lets police see if a driver was using a cell phone before a serious crash. opponents have privacy and constitutional concern. they compared it to a breathalyzer to determine if a driver is drunk saying that test is perfectly legal. >> an alarming recall to tell you about this morning. polaris is recalling more than 16,000 recreational off highway vehicles due to fuel leaks and fire hazards. that recall involves all model years 2015 through 2017, youth rzr-170-rovs. they have two seats, sold in red, blue and white. polaris has received more than 100 reports of cracked fuel tank

back to you. >> thank you very much, mike. 5:31 now. a developing story this morning, what would you do if you got a call from someone saying your loved one was in accident? one peninsula police department is saying you should just hang up the phone. >> kris sanchez joins us live with the cam warning so you don't get taken and, kris, this is frightening for anyone to get that call. >> reporter: yeah, i can't imagine getting this call being able to hang up the phone even if i knew where my loved ones were moment. but police say that's exactly what you should do because the longer you safeway on the phone the better the chance scammers have of getting your money. several citizens have reported getting phone calls from people demanding ransom for their loved ones. in some cases the caller will say the loved one was in a crash or a collision, damaged their car, and will be held until the caller pays up.

if you get a call like this, police say hang up, but if you cannot, then demand specifics and demand to speak to your loved ones. >> what does my loved one lock like? what are they wearing? can you describe their car? can i speak with that person? just ask very direct questions that will require a direct answer. >> reporter: now just yesterday the fbi announced the arrest of this woman, the ringleader of a virtual scam ring with victims here in california and in three other states. lapd reports that since 2015 victims in l.a. alone paid $114,000 for loved ones had who were never in danger. the good news here in palo alto no one has lost any money. we did post advice from law enforcement on my facebook page. in the comments tell me if you've gotten a scam call like this one. now in regard to that woman arrested, i'm digging into that indictment. it is a ten-count indictment, to see if any of those california victims are here in the bay

area. i'll tell you what i find at 6:30. in palo alto, kris sanchez, "today in the bay." it is 5:34 right now. happening today the 18-year-old father accused of abandoning his baby in a parking lot is expected to make his first court appearance. barbers at a nearby shop say they saw daniel mitchell leave the 16-day-old baby in a parking lot. the newborn was still in a car seat. it this surveillance video captured that incident. it happened monday afternoon. the barbers who rescued the child say they can't stop thinking about him. >> we just want to know what's going on with the baby. he looked all right sitting in the seat. he was alert, relaxed, sucking on a pacifier. >> the father is charged with child abandonment and endangerment along with cocaine possession. police say he now claims he did so much cane he didn't know that he left his baby behind. the mother is not considered a

suspect. a developing story overnight, firefighters knocked down a grass fire in south san jose. this is some video of the flames yesterday. that fire started yesterday evening near the golf club in almaden hills. the video you're looking at. the quick action by fire crews did keep the flames from spreading. only about five acres of land was burned. 5:35. leaders will debate a temporary freeze on the marijuana dispensary permit at least until the smoke clears on legalization. when new year rolls around, recreational marijuana will become legal in california. after the board yesterday approved new dispensary limits for just the excelsior district, mal malia cohen called for the 45-day moratorium. she wants the board to gauge how marijuana clubs will fit into new state and local cannabis framework. the push to change the name of san francisco's justin herman plaza is now official. new this morning san francisco

supervisor is introducing legislation calling specifically for that change. that bill proposes removing the name from the plaza at embarcadero right there by the ferry building until a new name is determined. skr justin herman did lead in the 1960s but pushed out african-american communities from the western neighborhoods. thousands of people signed an online petition calling for the name change. happening today transit considers the future of bus routes to three schools in the observing hills. oakland unified has been paying transit to provide service to mon ttero middle school, skylin high school, and community day school. but in january the district cut all that funding. ac transit says the bus services will go away without the money. the meeting is today at 1:00 in the east bay room in oakland. and a light, easy drive showing up right now around the bay. we do have a tree down on highway 9 at sanborn.

inland. the bay up to 87. and 70 near the coast. we are going more of the same. hot inland for valley, the bay pretty warm and the coast will be much more comfortable. this will be the last weekend of the outdoor summer concert series at the park. maybe you'll want to check that out. throughout the afternoon it will be in the low 90s saturday but by the time the concert starts at 5:00 we'll be at 88 degrees dropping back into the low 80s with some mostly sunny skies. if you are planning to head to the sierra, a live lock as the sun rise and the temperatures for kirkwood will be in the low 70s on friday but then some mid to upper 70s for the rest of the weekend and then going hiking in uir woods in the upper 70s on friday. lower 80s for the weekend and some mostly sunny skies. a nice weekend to go there if you want some hotter weather you may be heading to paso robles

filed against tennis star venus williams. she says she's not at fault in a crash that killed a 78-year-old man in florida but that man's family attorney says williams was in the paying attention while she was driving. here is that attorney. >> we believe that the evidence from the black box download will demonstrate that she was distracted and delayed in her reactions which ultimately caused this accident. >> that deadly crash happened last month when williams struck the man's car at an intersection and police say williams was not at fault. according to legal documents williams says this story coming up on the "today" show at 7:00. would you vote for california to secede from the united states? you might soon have to answer that question at the ballot box. the state attorney general has given the green lit for a group calling for secession to start collecting signatures for a ballot initiative.

the campaign needs more than 585,000 signatures to qualify for the 2018 ballot. the movement is being called cal exit. an earlier attempt to put it on the ballot was withdrawn in april. to let you know there's no procedure in the constitution for a state to secede. the president says the battle in the senate will bring great health care. >> what's actually going on there, scott mcgrew? so far little progress. yesterday's vote, which the republicans won, sam, the vice president broke with a tie, merely allowed debate over health care. it was not a win for a bill. there really is no specific bill. overnoight a bill called the crz amendment failed when nine voted against it. that bill would have been a full repeal and replace. the cbo never scored it. it needed 60 to pass. republicans so far can't muster

50. this morning we should see an attempt to repeal obamacare with no replace. the cbo says more than 30 million people would lose their health care. after that the so-called skinny bill that with remove the individual mandates would cause the death spiral as insurance companies pull out. this may never get a vote. new this morning trump's former campaign manager will not have to testify in public at today's hearing. the senate judiciary committee drafted a subpoena for paul manafort after manafort agreed to meet privately with committee members and turn over documents. the committee, course, investigating connections between the trump campaign and the kremlin. president trump was asked about his attacks on the general attorney jeff sessions. trump repeated his statement he would never have appointed had he known he would recuse himself in investigation into the campaign. when trump was asked if he would fire the attorney general, he

a lot of problems there. it's because of the monsoon season. i to show you the radar this morning as we are getting that reversal of the winds that brings in more humid air for parts of the desert southwest and as we look at the radar from the past 18 hours we can see by yesterday afternoon those storms really got firing up. we also had some lightning over the sierra so that was a result of all of that moisture rolling into the region so we'll continue to keep an eye on that. as we bring it back home we are looking at a morning start with temperatures right now in the lower 60s with mostly cloudy skies. it's 57 degrees and cloudy in san francisco look live at at&t park, getting ready for that early afternoon game today. in the north bay we're at 56 degrees with partly cloudy skies, and now the seven-day forecast is up at the bottom of the screen, shows hotter temperatures ahead. we're going to rise up to 85 degrees today in san jose and a lot of 90s for much of the east bay from antioch over towards

danville and in pleasanton 90 degrees today and fremont up to 83 degrees. 73 in san mateo and a nice cool half moon bay at 63. 67 on the embarcadero. the marina district looking at a high of 65 with lower 90s. back in the north bay santa rosa looking at a high of 91 degrees. so we're starting out with some clouds, but you want to make sure you still remember the sunglasses today and also some short, great for today because it will definitely feel like summer out there and some sandals to help keep you nice and cool and comfortable, too. no sandals for the hiking trails today as you head out to the east bay orjoying some time at the park. we will have a cloudy start. the sun appearing right at about 10:00. the sun starting to peak out from behind the clouds. after that it's going to get really hot into the upper 80s today. and speaking of hot if you are planning to go golfing in the tri-valley today we will have some mid-60s to start. make sure you go early.

we're head nice, cool temperatures with highs in the upper 60s today. low 70s over the next few days and for the inland valleys nothing but 90s in this forecast over the next several days. i imagine your air conditioning bill is really going to be high. of course unless you have solar panels or something like that. let's head over to mike. now you have a new crash in fremont? >> i do, kari. a crash presenting the biggest amount of slowing because the bay bridge toll plaza is building gradually. the fastrak lanes are filling in. the rest of the bay shows an easy, light drive. this is southbound 880. a tough place to have a crash right over here at alvarado. the slowing is shifting south. that crash may have moved further over down closer but alvarado, the icon moved up will. i don't know why it did that. report reportedly blocking just one lane.

kari hall will have your full forecast coming up in five minutes. are it is 5:54. happening today the trial is set to begin for a man accused of shooting and killing an east bay police officer. robert vega is charged with killing off-duty richmond police officer gus vega. vega, the suspect, had a son with the officer's daughter. the shooting happened at the officer's home. he pled not guilty by reason of insanity. his trial is set to begin in a few hours at 9:00 a.m. noise pollution tends to be the highest in black urban neighborhoods. that is the conclusion of a new study coming out of uc berkeley. researchers studied 13 years of noise data from across the country and has the percentage of asian, blacks or hispanics rose, so did industrial activity. now noise levels were highest in mostly black neighborhoods in segregated cities. that's what the study found.

new this morning bicyclists who seriously injured a runner in a hit-and-run on a trail l e likely will not face charges. the accident happened six weeks ago on the american river parkway trail in sacramento. 61-year-old bill was hit by a bicyclist who then took off. he now has a fractured skull, broken hand, major cuts, road rash and he lost two teeth. >> and it didn't feel like a tire or a handlebar or anything. it just felt like a wall hitting me. >> he says after he was run over the bicyclist quickly gave his name and then left. he thought he would be charged with hit-and-run but experts say charges are not likely because the trail where the accident happened might not fall under the same rules as a roadway accident. we have some new video in to show you this morning of the coast guard rescuing four men from a capsized boat in the waters off of alaska. look at this.

you can see the captain of the fishing boat there had in the frigid waters trying to help out. this happened monday off the southern coast of laalaska. the captain had just jumped in to rescue two crewmen after their fishing boat flipped. the uz up one of the other fishermen. happening today you might see smoke and hear some loud bangs in downtown walnut creek. walnut creek police, firefighters and security guards are conducting a live training drill at the shopping center. that drill will go from 10:00 p.m. until 2:00 a.m. you're asked to just stay away from the area during that time because stores are probably closed. there may be lane closures along broadway and mt. diablo boulevard. also happening today some areas in downtown martinez will be closed as the makers of 13 reasons why do some filming for the second season of the hit netflix show. according to the "l.a. times" film crews will be out until
