department is on the hunt for a group of men. sergio quintana joins us from the scene with the newest details. >> reporter: raj, as we speak, police are following up on any clues and trying to track down the group of men you just described. they are -- witnesses say they were all wearing bandanas to cover their faces. these are pictures that one witness shared of paramedics taking one of the victims away on a stretcher. the witness said this person was shot in the back. according to multiple people who saw what happened, there was some kind of commotion here on the steps leading to the pedestri pedestrian bridge. one witness who called himself the hatter said he walked up to see if he could calm the situation and that is when shots were fired. >> somebody yelled out they are strapped and i'm in front of everyone, the kid raised a gun straight to me and hits two people behind me. i don't know how i didn't get hit. but it's pretty mind blowing, he

app. >> fire gutted a victorian home on east 19th street just after 5:00. oakland firefighters posted that video of flames raging out of the second story window. the house was vacant. it was boarded up in the front. no one was hurt in the fire and the cause hasn't been figured out yet. mixed messages in oakland, as fire investigators try to figure out how a 20 acre fire in the oakland hills started. berkeley police say the fire started on the university property and they are investigating it as a possible arson case. but the oakland fire department said cal fire is the leading investigators and it is still trying to determine the origin of the cause. cal fire at this point not talking arson. >> if it is determined to be arson, they take a certain action. if it is negligent, they take one action but right now it is an open investigation. >> a man involved in a crash who brandished a gun at a driver near the fire scene yesterday morning has been arrested, but

so far they have not been able to connect him to the fire. fire is about 50% contained. the weather has been favorable for firefighters, let's take a live look over san jose. beautiful as the sun goes down. a little humid and sticky. more florida than california. let's bring in jeff ranieri. and it is threatening to rain, at least for much of the day. what will actually happen. >> we do have thunderstorms getting close by right now. it was so strange outside. temperatures as hot as 99 in concord and the humid monsoonal moisture moving up from the south and things are active toward the east. we are seeing a thunderstorm approach brentwood. it looks like a heavy downpour here over the next 20 to 30 minutes. the other spot we're watching is towards the tracy triangle. a thunderstorm headed right toward the north side of tracy as we head through the next 30 minutes, doesn't look like the hold up toward livermore, but we'll closely watch that for any kind of redevelopment as we get

that is where tom jenson picks up the story for us live. >> this is a bizarre robbery that led to everything we know about right now. a week ago here where this suspect bar boa came into the store and grabbed the cash register and the owner and the son are in hot pursuit. >> he just picked it up like a baby and snapped it. and he just walked out the door. >> it was a strange shift from the start for cameron sims. >> customers were yelling, so i just came out, i ran out. i didn't even look. i just ran out with everybody else. >> reporter: on a hot day with lunch crowds everywhere, he and his dad chased a robbery suspect across the parking lot outside of their donut shop before the suspect threw a register into his car, that he just stole from the shop and then turned and confronted the two. >> when he turned around, after he dropped the cash register and kind of said, do you want to

fight, i have a gun, i have a knife. that was -- that was -- this guy is serious. it is in the middle of the day. >> they walked away as did numerous other witnesses but clearly saw his car and got his plate number. >> so we entered that license plate into the law enforcement data base. >> and wednesday at about 5:15 police spotted the driver jeff bashoa. after being forced to pull over, he was surrounded and police were forced to shoot and kill him. on the ground, there appeared to be a knife that looked like a machete. his former neighbors in a quiet benecia neighborhood are stunned. >> he waved and said hi. >> he had a wife and two small children but on his facebook page, he described a family problem in april and may. >> i have no idea that he would be up to something like that. that is terrible. >> reporter: and public pleas to help find his children. >> i didn't know he would be violent like that.

front door you would expect. a car came crashing into a home in castro valley this afternoon. the fire department posting this video on twitter. this is on redwood road and watson street near the b.a.r.t. station. car shredded a gas line during the crash which prompted a response from pg&e to cap the line and no injuries but the driver did flee the scene. firefighters posting this photo to social media of a car that crashed into a gas pump. it happened in newark at the shell station on jarvis avenue and no injuries either. a man flying to the bay area to head up a local company is in the custody of santa clara county jail after a fellow passenger said she saw him texting messages about molesting children. police arrested michael keller after getting off a plane from tacoma, washington. robert handa joins us from the company in union city where some workers must be stunned to hear

their new boss is in jail. >> reporter: stunned is the best way to describe the mood herp at the hard tongue glass company. he was on his way back from the parent company home office in tacoma, washington. to resume being the new manager here. but he never made it. the union city branch of the hart ung glass company needs to replace the replacement mang. michael keller had just come from the company headquarters in tacoma, washington, last month, to be the new interrim location manager and taken by surprise to hear he had been arrested for two counts of attempted child molestation and two counts of solicitation of a sex crime. investigators say during the recent trip back from tacoma this week, a passenger saw his smoep and noticed him sending disturbing text messages and she reported it to southwest staff who called ahead to san jose police. >> the conversations were very particular, in regards to sex acts that were to be performed

on a child. >> after keller was arrested, the noiinternet crimes against children task force led to the arrest of a second suspect, 50-year-old gale burn worth, also of tacoma and investigators say she was with what they called two young victims. police say the alert passenger who reported the text messages saved those children. >> if it wasn't for this young lady's actions, another sexual assault would have occurred. >> reporter: and again those dramatic developments stunned the co-worker we talked to here. they say they didn't know him well enough to defend him but he seemed pleasant and certainly not the type capable of committing the crimes he is accused of. when and where court proceedings will take place are being worked out. robert handa, nbc bay area news. >> thank you. well the president hits the road, addressing new developments in the russia

san jose. they were fined hundreds well tonight nbc bay area responds to a lot of unhappy people in soif. they were fined hundreds of dollars for allegedly setting off fireworks. >> but they insist they didn't do it and now they are accusing the city of setting up an unfair system. chris chmura brought their concerns to the city and we have a follow up. >> a story we've been following for two weeks. some of the citations might not hold water. legal scholars are raising questions and we have an in side like at city data that reveals a

murky start to some accusations. the dispute is simple. >> i think the city should back off. >> these south san jose residents were fined $500 for using fireworks even though no one in authority confronted them with the accusation. >> how many police officers visited you. >> not one. >> how many firefighters? >> none. >> code enforcement? >> nobody. >> nobody. >> so why did they mail the bright yellow citations? someone complained online. they have this internet form and the fire marshal doesn't have the fire power to investigate every complaint, so if he got more than one complaint, he fined them without any investigation. >> as if there is more than one complaint, then they don't really need enough evidence to make you guilty of the crime. >> reporter: we reviewed the city full data base of fireworks complaints, some included vote

photo or video evidence and had a fine and other had detailed statements but several lacked detail yet still triggered a fine. five accusers didn't give an address, just a block. the city issued a citation any way and hasn't explained how it chose the address. one had one word that resulted in fines. some accusers might have gotten follow-up phone calls but it is not clear how many. the complaint that caused amy's fine contains three words -- several high fireworks. >> when is the last time you bought fireworks? >> oh, gosh i haven't touched fireworks in 30 years. >> her citation doesn't lay out any evidence against her. she said the fire marshal told her more than one report against an address triggered the $500 fine. >> i'm automatically guilty and they keep the $500. >> reporter: we only found her address in the complaint data base once. so we wanted to know why she was cited. but the city refuses to address individual cases with us. it said people like amy will have to pay the $500 fine and

request a hearing to see the evidence. >> think they ought to talk to some lawyers about the validity of that system. >> university of california law professor david levine said limited city resources do not justify shortcuts like accepting two complaints as gospel and not contacting the accused. >> make some attempt to talk to the person who allegedly was using the fireworks or was permitting fireworks to be on their premises. at least do that. a few phone calls are not that expensive or time consuming. >> city attorney rick doyle is acknowledging potential missteps and they are re-evaluating how the fireworks citations are handled. he said this is front and center and i think there are some lessons to be learned. we're told the report is coming but in the meantime residents are still required to pay the $500 fine before they can challenge the citation. >> you can't prove a negative. i can't prove that i didn't set

off any fireworks. >> reporter: this is not the first time the city of san jose has faced scrutiny for stream lining law enforcement. >> this is another gimmick on the city to raise money. >> reporter: this attorney filed a class-action lawsuit against the city of san jose about ten years ago after it deployed unmarked vans to snap photos of suspected speeders, who later got tickets in the maim mail -- the mail. the city did halt the program and sees sim lair ates in today's fireworks fines. >> you have to do this right and respect the basic principles of democracy, which is you should show know who your accusers are and what is nature of the accusation and having a hearing in front of an impartial officer without paying an arm and leg about it. >> they are urging the city counsel to address concerns at the next meeting on august 8th because their fines are due the following week. but nothing is on the agenda

the president pledged to increase coal mining jobs and pass an infrastructure bill but police did remove one protester after the special investigators looking into the russia meddling is convening a grand jury, the president dismissed that as fake news. >> the russia story is a total fabrication. it's just an excuse for the greatest loss in the history of american politics. that is all it is. >> president went on to say that prosecutors should be looking at hillary clinton's e-mails but that is not what is happening because robert mueller is impanelling a grand jury. the move considered away from mueller to subpoena witnesses and records as part of the probe. insiders say this likely means the probe has expanded beyond just michael flynn, the former national security adviser and his ties to russia. >> it is suggesting there is more to investigate than just

that, we are going to transfer everything to a grand jury because we are using a lot and we want it to be more convenient. president trump's attorney said they had no prior knowledge of the grand jury and there is no reason to believe the president is under federal investigation. okay. back here at home, a scene in southern california, self people rescued from flash flooding. take a look. heavy rain creating rivers of mud. this is in acton, a small town about 50 miles north of l.a. a lot of people stuck in this dangerous mess. many of them, you could see there, drivers and some had to be airlifted to higher ground. the weather is part of a monsoonal flow out of northern mexico and arizona. a flash flood watch is in effect tonight for the san gabriel mountains and the valley. >> and they are so dangerous and you talk about the inclination to try to drive through some form of water and you don't know what will happen. >> six inches of water could carry a car away.

just be careful. we won't see anything like that tonight but we are tracking isolated thunderstorms close to the east bay. as we get you into the microclimate forecast right now. it is all about contra costa and alameda counties, where the hottest temperatures have been. you could see the cloud cover in place. it issa humid all day and down right uncomfortable and feeling strange after 99 in concord and down to 85 and eventually see 70s tonight but the cloud cover is not going anywhere as we head throughout the next several hours. let's take a look at the monsoonal moisture that brought the flooding to southern california and it is continuing to bring thunderstorms close to us, also a few lightning strikes in the central valley. the one spot we're keeping an eye on is brentwood impacted by a thunderstorm. head inside. we have had a lightning strike in the past 15 minutes. we are looking at heavy downpours, possibly even some isolated hail. we'll continue to monitor this. it looks like it might just hold up towards west hartley, as we head into 9:16 for tonight.

one eye open. right now, on nbc bay area news, one of the safest neighborhoods are now sleeping with one eye open. burglars are targeting willow glenn. in at least one case, a homeowner said would-be thieves knocked on the window of his young daughter's room early in the morning. >> we have the exclusive story. >> well i spoke to the father of

the little girl and he did not want to appear on camera out of fear. but in walking around the neighborhood, it appears he may not have been the only victim. neighbors here tell me it has been a couple of sleepless nights for them. >> reporter: this is grainy surveillance video of one of the cars neighbors believe those suspects were driving. this was early yesterday morning. the red light is the infrared light of a camera belonging to the neighbor. >> i went to sleep and my truck was there and locked and i woke up for work at about 430 -- >> he isn't alone. a jaguar was stolen from the neighborhood around the same time. and one father told me it is possible that the same suspects knocked on his daughter's window early that morning preparing to break into his home. >> is this neighborhood on edge. >> yes, very much so. >> neighbors are looking out for each other. the area is plastered with warning signs. >> we're on next door, so everyone is communicating with each other and a lot of people are home and we're just watching out for each other.

cars up on the curve and into a vta bus stop and that is where the man was sitting. police say the driver of that car -- that hit him, also was hurt but not seriously. investigators say both drivers involved are cooperating with police. two years after their son was shot and killed while painting a mural, the family of a oakland man is taking legal action against the federal government. the family of tony ramos is suing immigration and custom enforcement known as i.c.e., according to the claim filed this week, the family said i.c.e. should be held responsible for their son's death, because the gun used in his murder was stolen from an i.c.e. agent's car. that gun was allegedly sitting in plain sight in the agent's car and he was killing while painting an anti-violence mural in the overpass in 2015 and an oakland man was charged with his murder. an attempted kidnapping investigation in the east bay after police say a man tried to pull a teenager into his car. concord police released a sketch

of the superintende of the suspect. it happened back on july ofth but plus just announced it today. it happened on laguna street near the concord b.a.r.t. administration. the 16-year-old was walking nearby when the suspect drove up and tried to pull her into the car. that is what the car looks like. she fought back and ran away. the suspect fled in a car similar to this buick lesabre pictured here. two walnut farmers are suing the water department following the failure at the oroville dam. the rushing water wiped out large portions of crops. the farmers are near the dam and they filed a $15 million claim because they say that is how much money they lost since february. the lawsuit claims state knew about the structural failures with the dam and spillway but did nothing about it. >> the land we speak of is gone

and it is irrecoverable and the trees with it and those trees represented a good portion of my life. >> the main spillway of the dam was severely damaged during the winter storms and when the back-up spillway was put into use it almost collapsed. well nbc bay area was the first to report about at parent fire -- the apparent fire safety unit in the sinking and tilting millenium tower but city inspectors went to the unit after the complaint about the fire risk but as we are shown, those inspectors quickly left saying they couldn't take action on what they could not see. >> paula has longed complainted about odors in her unit in the millenium tower. later last year outside experts hired by the homeowner's soerks, discovered they were invading through unsealed holes in the

walls. at a supervisor hearing on tuesday, pretlow said fire safety experts told her the flames could invade her unit as well. >> this is a serious fire and life safety concern. >> reporter: responding to her complaint, city inspectors went to her condo today, but they left without taking action. they told us that is because they could not actually see the gaps that were once found when crews cut open her walls to do testing. >> in order to verify a complaint, they have to be able to see sort of what is at issue here. >> reporter: williams, a spokesperson for the building inspection, promised that inspectors would be back when they reopen the wall for tests as soon as next week. meanwhile, building inspectors continue to find similar problems in it other parts of the building. this july 18th notice against millenium identified gaps around pipes in the basement.

these are openings that code requires be filled with red fire safe caulking and that came after building inspectors first warned about the need to fix the problem in december. at tuesday's hearing, a supervisor asked what, if anything, the city plans to do to assess the entire building. >> is there any plans for a more systemic review as to whether that fire safety issue is more pervasive than that one unit? >> well, i'm not aware of anything systemic that has been planned at this point. >> reporter: strewn told peskin he believes widespread problems would have been found during earlier inspections. >> there is a final inspection before you cover the walls and floors and i have to believe that a lot of different eyes looked at that situation and i have to believe it was done appropriately. >> reporter: pretlow said what has found in the unit, the city can't assume the rest of the tower is fire safe.

take vo sam liccardo made it officia san jose mayor said he is throwing his hat back in the ring for re-election in 2018. he made it official he is running for a second term at mayor. he won a close race in 2014. so far no challengers have stepped forward. the results are in for oakland's annual pothole blitz. a lot of work going on during the last seven weeks of the blitz. more than 5,000 potholes were filled which is a city record. and it is not just patch jobs, we're talking entire streets here that are getting repaved. the mayor said the voters get the credit because last year they approved measure kk. >> this is not a one-shot deal. because of your generosity and these new funding sources, for the first time we are repaving these roads, we are fixing the raggedy potholes, we are getting this city safe and smooth, going
