rn breaking right now a liquor store turned crime scene in the south bay. an armed robbery takes a violent turn. we are live in san jose as homicide investigators still combing that scene. good morning and thank you very much for joining us on this tuesday. i'm sam brock. >> and i'm laura garcia-cannon. we'll get to that breaking news in moments. first, i want to talk about the weather this morning with meteorologist kari hall. good morning. good morning. it's going to be another nice day and comfortable temperatures as we head into the afternoon looking first at the south bay where san jose will be up to 83 and 89 in morgan hill. some lower 90s in antioch and concord. hayward will be at 77. for the peninsula up to 75 in san mateo and for san francisco

68 in the mission district. very nice today but slightly warmer as we go through the week. i'll talk more about that coming up in a few minutes. mike has had an eye on the golden gate bridge. overnight the closure of all but one southbound lane. we see all of the lanes open now as you approach the toll plaza. we'll look at our sensors as well. this is an overnight project we told you about yesterday on had this same show and we did see slowing on the approach from the robin williams tunnel toward the toll plaza. all lanes are cleared and now the sensors have cleared up as well. that's great stuff. an easy drive approaching the bay bridge and green the rest of your commute. back to you. >> thank you, mike. back to our breaking news this morning. an armed robbery turned homicide investigation. san jose police looking for answers. this is going on near the intersection of equipment by and white roads. >> we he are joined live with what we know so far about the crime scene. good morning, kris. >> reporter: good morning you to you, sam and laura. usually this kind of strip mall

would be very quiet this time of night. as you see behind me there's a liquor store with lights flashing. inside there are police officers gathering evidence because this is the city's latest homicide. we've seen officers combing the parking lot for any sign of clues. we've seen them taking pictures of the outside of the building and the inside of the building. here is what it looked like earlier this morning and what we can tell you at this point is this was -- appears to be a robbery that then turned into a homicide right around the 11:00 hour last night. the victim was shot at least one time and was found here near the liquor store. there appears to be two liquor stores here at this location. paramedics did arrive on scene but it was already too late for that victim. the san jose police department is investigating this situation and until their investigation is complete here at the scene the coroner will not come and remove

the body which means that we will not know who the victim is at this point. until the coroner notifies next of kin. >> we'll be checking back for updates. 4:33. new this morning dramatic video of a home completely engulfed in flames. that was a two-alarm fire that started about 10:30 last night. you can see the house is under construction. you can tell that from all the scaffolding on the facade. take a look at how intense the flames are. firefighters had to call in for extra help to quell that. the home is on 57th near seminary and international boulevard. now at this point there are no reports of any injuries. also no word on how the fire started. bob redell is heading to the scene right now, bringing us a live report coming up at 5:30. it is 4:33 and developing right now san jose police say they're looking for more sexual assault victims that follows the arrest of a man they say claimed to be a dock are tore. police say ezequiel carbajal ran

what he called a holistic pharmacy. the woman says the suspect gave her an examination and it crossed the line. we talked to people who live near the business. the man says the charges surprised him because the suspect seemed like a smart person. the arrest took place last week but police announce d it yesterday. they're asking any other vehicles to call the special assault investigations unit. >> belmont police looking for a man involved in a deadly shooting over the weekend. police are looking for 27-year-old javon stewart. investigators want to question him about the deadly shooting of dejon jones of union city who was killed in an apartment in belmont early saturday morning. happening today councilmembers will had receive public feedback on the fiscal emergency declaration.

repairs of a costly sinkhole have an unexpected punch. the sinkhole has been there for 16 months. they declared a fiscal emergency in june. councilmembers will hear comments and suggestions with about how to dig out now of the financial hole. big news out of palo alto. that city's school board members today are meeting to discuss the district's response to sexual assault on harassment cases that follows recent controversy surrounding how the district has handled such cases over the past few years. among the new goals for the coming school year are better compliance to the federal title 9 law and unifying the district's complaint procedures. at 4:35, coming up, the san francisco housing market, a street is if for sale and relatively speaking it's a bargain. we're going to tell you who now owns one of the most exclusive streets in the city and how they did it. plus, breaking the bank. a stunning new report out shows american consumers have broken

good morning. i'm landon dowdy live at cnbc world headquarters. today's top business headlines. wall street could start the day slightly in the red. they rose monday with the dow climbing for the tenth day in a row and closing at a new record high for a ninth straight session. consumer stocks leading those

gains. disney reports results this afternoon. the dow raising 22 points. the nasdaq up 32 to 6383. americans have now acouple hated the most credit card debt in u.s. history. a report from the fed shows consumers have $1.02 trillion in outstanding credit card debt as of june topping the record set in 2008. credit card debt has been growing at an annual rate of about 5%. one main reason lenders are giving consumers, especially those with subprime or below average credit scores more access to credit cards. and cbs plans to launch a 24/7 live streaming sports channel. there aren't many details yet but it may be modeled around the company's streaming service for cbs news. may be part of skinny programming bundle through internet tv providers. cbs sees this as a way to

compete with and stand out against espn, fox sports, and others. sam and laura, back over to you. >> a little bit of the march madness from last year. if that's on 24/7, sign me up. tar heels fan. 4:40 right now. happening today alaska airlines says ola to mexico. the launch of new expanded service to mexico city. the airline plans to allow 30 new routes by the end of the year calling it the most significant expansion in its history. among the first of those routes daily flights connecting sfo and mexico city. it starts today. the kickoff celebration is later this morning. apparently including mariachi bands and what they say will be mexican libations. i'm not sure if that means margaritas or not. >> coronas in the cabin. did you know this was even possible, one of san francisco's most exclusive streets now owned by san jose couple. a private street filled with

multi million dollar homes was snapped up for $90,000. we're talk iing about the stree obviously not the homes. property taxes went unpaid by the homeowners' association for 30 years which prompted an auction. the residents reported ly not happy about this turn of events especially since the street's new owner is thinking about charging to park. >> it's a private street and that's not prohibited. >> well, there you go. the homeowners have filed a lawsuit against the city for failing to notify them and also for sending a property tax bill to the wrong address for decades, so maybe that might explain why it wasn't paying its property tax. 4:41. another great start weatherwise in the bay area. kari has a look at the forecast. >> we do start out with some clouds. we know it will be a fairly mild day as we take a look outside in san jose. temperature trend forever green starts out in the low 60s.

a very good tuesday morning to you. can you make out this shot? it's the golden gate bridge this morning. the lights aglow , maybe moisture in the air. traffic is picking up. >> that's the zipper truck and it's the second change of the morning because the overnight construction, all but one lane closed and then the zipper truck -- >> people are up and at them. >> a lot of zipping and unzipping. i'm just saying. >> it was actually mising in san francisco this morning as well. >> we've had that the past few mornings and it continues today. that's all thanks to the marine layer coming back. as we take a look outside right now it's 63 degrees in the peninsula and the south bay. 59 degrees in the tri-valley. also 59 in the east bay and in the north bay it's cloudy and 57 degrees.

high temperatures, we're looking it at the 80s. we'll be at 89 degrees in livermore. some of these temperatures may be just a degree or two warmer than yesterday but overall it's going to be a very nice day. a little bit toasty, though, as you head from concord to antioch where we reach into the low 90s and half moon bay will be at 65 degrees. the seven-day forecast is up at the bottom of the screen showing our temperatures will be slightly warmer as we go through the week. as you get ready today about to head out the door you'll probably be comfortable wearing short sleeves and pants. it's one of those days where it starts out cool but it does warm up as we go into the afternoon. and looking at our hiking trails in the east bay in the forecast, and we do start out with some early clouds at 7:00, but our temperatures warming things up to 67 degrees. mild temperatures. lots of sunshine and then those winds will be picking up. we could have gusts up to 20 miles an hour as we head through the evening and if you're going to napa and sonoma valleys, a

great day for enjoying some of the tourist attractions there, the vineyards. it will be in the lower 60s early in the morning but then reaching into the low 80s this afternoon. look iing it at the seven-day forecast upper 60s throughout the week in san francisco so the low clouds and the drizzle that you're seeing right now you'll see it pretty much every morning and then as we head into the next several days for the inland valleys it will be a little bit warmer but look towards the end of the forecast and i'm highlighting this weekend and early next week. that's when temperatures actually get cooler. it looks like we could be under way with some much cooler temperatures after this week for the next couple of weeks looking ahead in the computer models. it looks like cooler air is on the way, and mike has a heads-up for highway 17 drivers. >> like you, kari. i'm looking ahead for some folks also who might be heading south because this map i'm showing you green sensors all over the bay. a nice portion of the roadway.

now we are also looking over highway 17. i zoomed in over here. you see some slowing south of highway 9 at bear creek road. i'm told about three miles left of the freeway of highway 17 we do have an issue. there's a tractor-trailer with the trailer there as well stuck. couldn't make a tight turn there. it will be an issue for folks who are familiar with bear creek road and who will take bear. they may have closed the off ramp. chp will get me an update and i'll track it. on our waze system, this will get crowded, the castro valley y making your way over from 580 and to 880. right now clear as a bell and a very smooth drive. we're looking at no problems for any of those routes. we'll track that over the morning. you track it as well on your phone before you leave this morning or whenever you leave. nbc bay area is our team. remember that. you know that. click on the profile and select us as your team. back to you. >> that is the team to be. thank you very much, mike. live pictures from our

emeryville camera and all drivers know about the rush hour commute as you try to get back and forth. bay area air quality management district has a new way of thinning out traffic and protecting our air. that agency is offering up to $4 million in grants to public agencies to provide shuttle buses and ride sharing services. that money comes from a $4 surcharge the dmv has been collecting. another way to protect our air, biking. happening today yet another bike share company is debuting. this new company doesn't have traditional bike stations we're used to seeing everywhere. this company is called spin and it's debuting in south san francisco. the idea is you can pick up a bike anywhere and leave it anywhere. all bikes have individual locks on them. they cost about $1 to rent for a half hour. 4:49 right now. california leads the country in the number of minority and women owned businesses according to new numbers from the u.s. census

bureau. experts say the surge could be in part of a growing trend in culture and lifestyle changes. still, critics say millions of small businesses are struggling with taxes and regulations built in by state legislators who have no business experience. >> your voice is desperately need ed in making those decisios because right now you have a lot of folks who have never been in that situation, so it's easy to pass a regulation when you don't fully understand how that regulation will play out and expect the bottom line of a business opener. >> nearly 13% of all women owned businesses in the u.s. are based in california. some tragic news this morning. police in orlando trying to figure out what led to a hot car death there. they said they found a preschool aged child in a parked van outside of a daycare. it happened about 8:30 last night. all police are saying at this point the investigation is in its preliminary stages. now more details, we did look up this morning all the details on this. the san jose state professor

tells us that 30 children have died in hot cars this year nationwide. noheatstroke.org, climate science. she was inspired to start this organization following a 2001 hot car death in san jose. since she started keeping track in 1998, 730 kids have died in hot cars. >> wow. just needs the education to get out. 4:51. this morning a fallen hotshot firefighter's body is back home in california. he died fighting a fire in montana. he was from san bernardino. hundreds of firefighters gathered for an emotional sendoff ceremony. follow-up now, the fire in the oakland hills is officially out. it burned off grizzly creek road, came dangerously close to the uc berkeley hall of science. firefighters called for voluntary evacuation.

no buildings burned. firefighters made a final sweep yesterday to make sure the fire was 100% contained. the cause of that fire is still under session. coming up next, laura, there is a new climate report out this morning. the effects on the united states and why it's being reviewed by the trump administration. but first, happening now, a houston family claiming united airlines is responsible for killing their dog. the family says the dog was in the cargo hold of the plane heading to san francisco when it was delayed on the tarmac for two hours. united said it is looking into that matter. and barry bonds says he wishes he could have played one more season, and he claims if he did, he would have hit 800 homers or at least some close to that benchmark. yesterday, of course, marking the tenth anniversary of barry bonds breaking hank aaron's all-time home run record hitting 756. he did that ten years ago to the day yesterday. we'll be back with more news.

welcome back. it's 4:55 right now on your tuesday morning. the trump administration is looking at a climate change report that was performed by 13 different federal agencies. that report finds the u.s. is feeling the effects of climate change and human activities are responsible for it. "the new york times" acquired a draft copy of the report. it has not been publicly released. president trump has called it a hoax created by the chinese. they are concerned the administration is going to try and suppress that report. nikki haley, the u.s. ambassador to the u.n., was asked about the report this morning on the "today" show. >> will we embrace the results of this it report from 13 federal agencies? >> i haven't seen the report but i don't see any reason why they wouldn't.
