right now at 6:00 breaking news. a live look from east san jose this morning. a very active scene outside a liquor store. the new information we're learning about what led up to the deadly incident. >> plus more concerns of crimes on b.a.r.t. hours after a man was arrested in connection with two violent assaults at b.a.r.t. stations. and the steps the military is taking to defeat isis. "today in the bay" continues right now. a very good tuesday morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm sam brock. we'll get to your weather forecast in just a second. mike, this is a time of day a lot of things happen on the roads. you have breaking news for us? >> the south bay we're going to show you on the live shot first of all let me point out what we have. northbound is a major problem for traffic flow. i did spot this on our live

camera as well. i will show you here the flares, that's south 101 on 280. i saw a couple crews with flashing lights. we checked with c had hp and fire. there's a small fire, a small grass fire off to the shoulder. it does not sound like a problem as far as closing the freeway. we'll track that in addition to what's already going on on our map. three out of five lanes are closed on 101 before you get to story just south of 680. this is jammed up traffic all the way just coming north of the 85 split. and now folks are moving over and taking 87 as an alternate. it's rippling back throughout the south bay. we'll watch as that continues to build. overall your commute for the bay area looking light so that san jose crash is the big issue now, kari, and also a big focus is our weather today. the weather is nice.

we do have cloudy skies and leaving from parts of san jose into the downtown area heading further to the north here is a live look outside. the temperature trend for campbell, the neighborhood view of what to expect as we go through the day. high temperatures reaching 84. a little bit warmer as we head through the week. i'll talk about that in a few minutes. >> thanks so much, kari and mike. it is a very active scene. police are investigating a de deadly shooting. >> we first broke the story when we came on air at 4:30 this morning. it happened at a liquor store. this is where we find kris sanchez live to explain what led up to the shooting. kris? >> in the last half hour san jose police confirmed the suspect in the deadly shooting is still at large. officers are still onscene here at the liquor store gathering evidence which might be easier

now that the sun is starting to come up. this appears to be a botched robbery inside that liquor store and the parking lot is still locked down. officers say they found one man shot and pairics tried to save him but it was just too late. the coroner only took the body away about an hour ago so we don't yet know the identity of the victim nor whether it was an employee of the liquor store or perhaps a customer. san jose police are keeping us about 300 feet back from the scene. the liquor store is pretty far back off the road so i would not anticipate any impact to traffic this morning. i have passed that on to mike inouye as well this morning. we know that there are surveillance cameras up and down the strip mall and we know that police are likely going to be looking at that for any sort of evidence but at this point we don't have access to that.

kris sanchez, "today in the bay." new this morning b.a.r.t. safety coming into question again after a series of crimes reported at b.a.r.t. stations overnight. >> it comes, sam, less than 24 hours after police arrested a suspect wanted for two assaults at ba.a.r.t. stations. pete suratos joins us live we warm springs station to break down some of the latest incidents as riders get ready to hop on b.a.r.t. and head to work. good morning, pete. >> reporter: good morning to you, laura and sam. it looks like these incidents at b.a.r.t. continue to pile up and our newsroom looked at the police log from overnight. it looks like it's more of the same. in fact, let's show you the list of the most recent incidents. these are station wide. a number of them still looking for suspects in some of these cases. a stolen iphone, a stolen laptop, as well as west oakland stations with reports of bike thefts. now all of this coming just days after b.a.r.t. police arrested

this man, this mug shot you're looking at is of mario washington. now police say washington randomly assault ed two riders last week for no reason. and in one case hit a b.a.r.t. rider in the head with bolt cutters. it was an oakland fire investigator who spotted him near the oakland police department after seeing these pictures that you are looking at right now from b.a.r.t. surveillance video that we aired on "today in the bay" yesterday morning. now while the arrest comes as good news we did speak to a woman recently attacked in san fran san fran who says there still needs to be more security at b.a.r.t. stations. >> i think there needs to be more of a police presence because there have been times i've beening b.a.r.t. where people come on and they're really drunk. >> reporter: now b.a.r.t. recently installed surveillance cameras in june to better track these incidents and no ward as far as this morning when the suspect will will appear in court but we'll continue to keep an eye on that and as far as security as that woman mentioned

b.a.r.t. plans to continue to increase its visibility at stations across the bay area. live at warm springs, pete suratos for "today in the bay." >> trying to get a handle on on a major crime problem. pretrial hearings expected in the kate steinle hearing. sanchez is accused of killing and shoot iing had her on a pie in 2015. the shooting sparked controversy and political debate over san francisco's status as a sanctuary city. to washington, d.c., we go where there is a new fight on terror. american troops are getting deeper into conflicts abroad. more marines are heading to afghanistan and the philippines where isis has taken control. the u.s. military is expected to pro-void more support to afghan troops where the presence of isis is growing. there have been reports that president trump is getting frustrated at his generals over the war in afghanistan and he has reportedly said america is losing the war there. here is secretary of state rex

tillerson. >> to just say we're going to keep doing what we've been doing the president is not willing to accept that. >> the u.s. is also providing training, equipment, and it is considering air strikes in the philippines where isis has taken control of parts of the southern islands. it is 6:07. the google employee who sent shock waves across silicon valley with the inner office memo about gender inequality is out of a job. the ceo sent a letter saying the memo violated the company's code of conduct. it was written by google engineer james damore who criticized the diversity plan and suggested that men are genetically built better than women for tech jobs and leadership roles. damore told "the new york times" he will likely pursue legal action. 6:07 now. san jose leaders are going to meet to take action on a series of recommendations following last winter's damaging coyote

creek flooding. an emergency management consulting team released the report and the findings will be sent to the city council. leaders are meeting today to talk about ongoing flood risk reduction measures. and we have ongoing problems for the south bay just as the commute is starting to kick in. we do have a big problem northbound 101 approaching story road. now that is -- chp may have two more lanes clearing. if that's the case it's in the last few seconds, we would have all but one lane open and that's a big improvement or should be a big improvement. backup for 10 is 1 and capital lo looking for an alternate. now all around the bay we do have a lighter flow of traffic for the most and that is good news for the rest of your commute but that's a problem for san jose. the 87 build, highway 17, that

moves smoothly past bear creek road. west of the highway we have that full closure of that roadway because of a disabled tanker -- tractor-trailer truck in this case that couldn't make the tight, windy road there. they have yet to clear that. they thought maybe 6:30 but i've heard no progress at that scene. a nice, easy drive to the bay bridge as well as over here to the tri-valley where we have the build as the tri-valley was very hot last week. >> it will be much better today and we start out with the look at 58 degrees on the right side of your screen, mostly cloudy skies. and it's 63 degrees in the peninsula and the south bay. sun rise happening in ten minutes. and it's cloudy in the east bay. you won't see much of that sun until about late morning, early afternoon. high temperatures in san francisco reaching 67 degrees. 85 in napa. in oakland 73 degrees. 83 today in san jose.

6:13 now. cloudy skies as you head out the door and we're taking a live look outside in san jose. we break it down by neighborhood going to santa teresa, 66 degrees at 10:00. reaching into the mid-70s. you may want to take a lunch outside, a great day for a long walk as our temperatures make it into the low 80s with some very comfortable air and mostly sunny skies. we'll talk about what's ahead, a slight warming trend as we head

into the next couple of days at 6:19. >> and here is the problem for the south bay. look at the top number. over one hour heading up to san jose and to mountain view. the problem reduced a bit. the bay shore freeway and the rest of your commute. [ inaudible ]. >> new this morning the arizona game and fish department taking care of this fawn after a man apparently took it from the wild and brought it to a bar. the 3-day-old fawn will have to live in cab tift. experts say pulling the animal from the wild at such a young age means it can no longer survive on its own. the fawn is healthy but needs feeding every three to four hours just like a baby. eventually the fawn will be taken to a wildlife sanctuary. no word yet on whether the man who took the fawn will be charged. >> that is really sad that somebody would do that.

>> right. >> oh, dear. this morning at 6:14 brisbane leaders are meeting tonight to discuss a massive development plan that could more than triple that city's population. these are project renderings. promises more than 4,000 new housing units, 7 million square feet of office and retail space. in the past this issue has been very heated. planners and city leaders have been resistant to approve the project despite pressure are from state lawmakers to do it. this morning amazon is trying to explain some confusion for california customers. it has to do with who you're getting your stuff from out of uniform delivery people. amazon has a program that uses private delivery drivers to save on costs. some customers in the sacramento area say they are split on this idea. >> my concern would be if somebody wanted to have ill intent it would be that they could just throw a box under their arm and wander up to a door, knock, nobody home. i'm in. if they're going tos pass the savings on to me by hiring joe

driver that's got his white van or red truck more power to them. i'm happy with it. >> check for the name tag joe driver right on there and you'll know. amazon says drivers have to pass criminal and driving background checks in order to do that. all right, business and tech news. travis kalaick who had to leave his post as uber ceo told friends he will return to that position. scott mcgrew joins us now. much like steve jobs. >> he was fired from apple, came back, made apple even better. cal nick says he wants to pull a steve jobs and return as ceo. he's on the board. this week his fellow board member, this fellow, who co-founded uber with him, wrote an e-mail to employees and slammed the door shut on kalanick returning as ceo. despite rumors i'm sure you've seen in the news, he wrote,

travis is not returning as ceo. we are committed to hiring a new world class ceo to lead uber. tesla is offering what are called junk bonds to fund the purchase of new equipment to build more batteries. tesla sometimes dilutes stock. it hopes to make up for it with lots of car sales. "the new york times" calculated tesla owed 5 1/2 times what it makes every year. markets rose monday. a new record high, 22,118. alibaba starts selling its new voice assistant today. now there are lots of these from amazon and google. how alibaba is going to power it i don't know. anyone can make a speaker with a microphone connected to the internet. amazon google have the power of

many of the roads are impassable. some streets looked more like rivers. people have been asked to remain in place. >> nothing like that in our neck of the woods at all. we'll get to the forecast in a little bit. >> those traffic issues, i do have big traffic. kari go off the tail of that. >> it was a little crazy to see all that flooding across parts of the south. we are starting out with cooler temperatures. a look at ocean beach, it's cloudy. you may feel some drizzle, too, and we are seeing clouds in c concord. it starts out with cloudy skies but clears out as we go through the day. the seven-day forecast at the bottom of the screen. we're going to start out in the south bay and look at today's high temperatures for the south bay will be a little warm for

morgan hill and gilroy. cupertino up to 84. to the east bay, 89 degrees. pleasanton at 87. oakland today a nice cool 73 degrees with breezy winds. half moon bay heading up to 66 today. palo alto, 80 degrees today and 77 in san carlos. san francisco will be reaching into the mid-60s today. the outer sunset while the north bay 79 in mill valley. sonoma up to 82 degrees. looking live in san francisco you see the clouds and fog now and we will still see he that tonight rolling back in after a few hours of clearing. at first pitch for the cubs versus the giants game it will be at 61 degrees and then a lot of clouds. make sure you have on some layers there. it's going to feel cool especially as those winds pick up. a beautiful day, though, if you're heading to sonoma and napa. mid-80s after a start this morning in the upper 60s.

san francisco will reach 67 degrees today for the high. and staying in the 60s throughout the week looks like a nice weekend ahead and also for the inland area. so we are going to have a couple days of some warmer temperatures starting tomorrow reaching into the 90s and then coming down for the weekend and early next week. mike has an update on the traffic jam through san jose. >> that's right. and it is a big jam and it's growing. however, the situation did improve as we told you just a you few minutes ago, north 101 up in that story road where the crash had three lanes blocked. now just one lane remained blocked. look at the jam that formed basically back to highway 85 for the bay shore freeway and showing the ripple effect north 85, north 87, the build as folks struggle to get around this big backup. capit capital expressway. that's the breaking news. that sig i alert that continues in san jose. waze will help you get around this backup. we'll take you to our waze system and we're looking at the

tracking yet another crash in the south bay. tell us about it, mike. this is complicating the situation. we have this sig alert which continues in san jose. most of the issue. the majority of rain now clear but north 101. look at the big jam just off 85. now 85 over is the alternate. 85 now has a crash. northbound right along the escape route at blossom hill shy of 87 causing a big problem now. up on the split. this is why there's even more traffic on the monterey highway and the capital expressway. those are the two options. one horrible who are dore coming had in through san jose. the rest of silicon valley moves well and the rest of the bay. i guess the better news, take a look outside at slow traffic and see pleasant weather, kari. >> it does feel nice out there.

department is still investigating what caused this two-story house the 2100 block of 57th avenue to burst into flames last night. if you take a look at your tv screen, you see this video. it gives you a sense of what the firefighters were up against. the video just came in againto newsroom. it had no electricity and was supposed to be vacant. the battalion chief says people said there may have been squatters living inside the structure. it started in the 10:00 hour last night, it was fairly involved by the time firefighters arrived. there was a downed power line and exposure to two other homes on the sides of the house. we he did drive by the house this morning and it appears they were able to keep the fire contained to just that property. reporting live here in oakland, bob redell, "today in the bay." new this morning a reported

abduction in last night turns out to be false. this morning police are telling us there's no merit to the story. the abduction of a woman in oakland. police are now saying the all e alleged kidnapping did not happen in their city. >> developing right now san jose police said they are looking for more sexual assault victims, this following the arrest of a man they say claimed to be a physician. police say this man right here, ezequiel dureo-carvajal ran what he called a holistic pharmacy. a woman says the suspect gave her an examination and that ended up crossing the line. we talked to people who lived near the business. so that man says that the charges surprised him because the suspect seems like a smart person. the arrest took place last week. police just announced it yesterday. they're asking any other victims to please call the department's sexual assault investigation

unit. this morning a northwestern professor formally faces murder charges. wyndham lathem has waived his right to an extradition hearing. he should be back in chicago by early next month. his attorney says lathem had will plead not guilty to killing a 26-year-old chicago man. >> what he is accuse d of is totally contrary to the way he has lived his entire life. >> his alleged accomplice is an oxford professor, warren. both are skill jailed here in the bay area. there are some grim accusations in the killing that we don't want to get into here but we posted the details at nbcbayarea.com. it is 6:35 today and happening right now moraga counscilmembers are receiving public feedback on the town's recent fiscal emergency declaration. repairs on a massive and costly sinkhole provided an unexpected punch for the affluent town.

it has been there almost 18 months. at tonight's meeting councilmembers will hear comments and suggestions about how to dig out of this financial hole. another bike sharing company debuts in the area. this new company doesn't have traditional bike stations. it's call spin. the idea is you can pick up a bike anywhere and leave it anywhere. all bikes have individual locks. they cost just $1 to rent for a half hour. all drivers know about the rush hour commute in the bay area. it looks like a stall in the middle of the road there. new this morning the bay area air quality management district has a new way of thinning out traffic and protecting our air, offering up to $4 million in grants to pro-void shuttle bus and ride sharing service. the money comes from a $4

surcharge the dmv collects. >> i hijacked the camera because i heard about the crash and moved it around. it just cleared to the top of the screen. thank you for taking that shot and showed folks there was that pickup truck loaded with all of that cargo. that tied up the freeway for the last few minutes. we see this jam all the way down to powell. that crash just cleared. that will make things congested. a smooth drive off the maze. a lot more traffic flow. we continue to have this problem spun off by crash at story. we do have recovery approaching 680.

it complicates things because that was one of the escape routes. we have more complications. that's a tough drive. we are moving forward. the last few weekends before kids go back to school. how is it looking? >> they've been really hot, too. i think we'll repeat that coming up and i know everyone is excited about that because we have this huge outside festival happening. the weather will be perfect. so starting out your forecast on friday we'll be at 69 degrees. still some lingering clouds. make sure you're dressed if you're out there for a long period of time. the coast will be at 66 and 87 degrees also very comfortable as we head no sunday and may even

the gunman is at large. it happened during an attempted robbery. police say the victim died at the scene. new video to show you that morning that is just hard to believe. the spotlight the top of your screen, that is out of london of an incident that happened in may -- a woman spotlighted. you see her getting shoved. she was involved into the direct path of an oncoming bus. the driver of the bus' quick instincts averpt add more serious situation. the man jog back the other direction and never acknowledged the woman as she tried to address him. london police are now trying to track that jogger down. airbnb has limits who can book from them. kkk members and supporters are apparently not wanted. the company has canceled book

lodgings for those attending a convention this weekend. they have strict standards when it comes to discrimination. the sea wall needs billios s of dollars worth of retrofitting and the city is considering asking taxpayers for the money. the "san francisco examiner" is reporting city lead remembers looking at a ballot measure for next year asking for $350 million as part of the sea wall bond that would 45 in funding for the first phase of that project. efforts to standardized the response to sexual assault and harassment cases. surrounding how the district has handled the cases. among the new goals for the coming school year are better compliance to the federal tigtl 9 law and unifying procedures.

president trump planning on holding a briefing in new jersey to talk about america's opioid crisis. >> it comes as new findings suggest the casualties from the opioid crisis are even worse thanly thought. the chronic underreporting from heroin and opioid. 24% higher than reported for opioid users and 22% for heroin users. they did their recount by reviewing australian prime minister. >> scott mcgrew, we should point out they do have a significant open quoid crisis. >> they do but they didn't appreciate the president he calling it names. it holds the first presidential primary and new this morning polling agency american research group says in a theoretical

matchup ohio governor john kasich would easily beat president trump in the new hampshire primary if the primary were held today. in the cases of presidents truman and johnson, who both lost that primary as president, those two dropped out and didn't serve second terms. polls show president trump's approval rating dropping. this will be a major issue in the upcoming midterms. democrats need 24 seats to win back the house. and if the democrats win articles of impeachment become much more likely. he's tried to take credit but what happens if the economy begins to fade? the president has an approval rating only in the mid-30s and that with full employment.

throughout the day but it will be very comfortable. the seven-day forecast coming up at the bottom of the screen, we'll start in the south bay. milpitas up to 85 degrees and gilroy will see a high of 88 degrees for the east bay, the tri-valley and the delta and antioch up to 91 degrees. oakland 73. look iing at a high of 68 degre and some mid-80s for much of the north bay. santa rosa looking at a high of 83 degrees. so looking out the window right n now, you see those cloudy skies and it will be a great day, our temperatures will be cool to start but then warming up nicely as we get through the day. and if you're planning on going hiking in the east bay, these clouds we're seeing now will still be lingering the next couple of hours and some mild temperatures that kind of go through throughout the afternoon in the low 80s but those winds will start to pick up this evening with gusts up to 20

miles an hour. it's going to be breezy out there at the coliseum if you're watching the a's game. first pitch at 65 degrees and mostly cloudy skies throughout the evening as temperatures drop back into the lower 60s. on the other side of the bay the giants game. our temperatures in the 60s over the next several days and upper 80s for some of those hottest temperatures and in the low 90s for the next couple of days. check out the weekend. it looks beautiful as our temperatures continue to come down. mike has a new jam on the san mateo bridge? >> you listen to jams on the radio but we're talking about the band from the westbound direction even though eastbound we heard about the floot tire being being addressed. really grinds to a crawl westbound. a look at your map, that's the problem. west 92 really jammed up just

where investigators are look in into a fire at an east oakland home. we've been showing you this dramatic video all morning long. it happened late last night. firefighters say they had to call in for extra help because the flames were so intense. that house was under construction. you can tell all of that scaffolding there. firefighters are looking into the possibility of squatters living in the building. nobody was hurt. preare trial hearings are expected to continue today in the kate steinle murder case. juan francisco lopez sanchez is accused of shooting and killing steinle along the san francisco pier back in 2015. the shooting sparked controversy and political debate over san francisco's status as a sanctuary city. san jose leaders today are going to be meeting and taking action on a series of recommendations following last winter's historic, damaging coyote creek flooding. last week an emergency management consulting team issued a report and the group's findings will be presented to
