good sunday morning to you. it is 7:00 on the dot. a live look as clouds cover the bay bridge, but it sure looks lovely on this sunday morning. we appreciate you joining us. hopefully you're warm at home. i'm kira klapper in for vicky nguyen. >> it's calm. >> it looks serene. >> that's a perfect word for it. that's what we'll see in terms of the weather, the temperatures. not too much wind. anytime there's no wind we can expect to feel very peaceful out there. 56 degrees on the peninsula. we can expect to see some breezier conditions in the afternoon hours between 10:00 and possibly 15 miles per hour but it's not going to be, per se, windy.

63 for the south bay. and then, of course, that patchy early morning fog in san francisco. about 58 degrees. now we've been talking about a bit of a slight cooling trend on the way because we had the high pressure sitting over the bay area now starting to move out of the region which means we have a system that will come into play. and that's going to switch things up just a bit in terms of the temperatures and also a drop in maybe even some of those clouds. we might even get more sunshine. by 11:00 a.m. we'll be at 55 degrees. in san francisco we should reach our peak of the day at about 2:00 at 68 degrees for san francisco. and if you notice the majority of those clouds really start to disappear at about 11:00 a.m. for inland spots expecting to see areas in the upper 80s. for san jose today about 82 degrees. a closer look at what you can expect for your solar eclipse in 15 minutes. >> that's exciting. vianey, thanks. we begin with developing news in the east bay.

a suspect rams a stolen car into a sheriff's deputy patrol car forcing the officer to open fire. it happened around 10:00 last night in front of a gas station off of highway 680 in martinez. the contra costa county sheriff's department says when the deputy shot his gun no one was hit. the incident is under investigation. a driver was killed when his car went over an embankment in the south bay early this morning and chp is praising a good samaritan for helping save the passenger's life. it happened around 1:15 this morning on northbound 17 in los gatos near the lexington reservoir. investigators say the car went off the road falling 100 feet down an embankment. the chp says the man and woman both were ejected from the car. the driver, the man, died at the scene. another man who witnessed the crash flagged down other drivers to call for help. >> i go down there, i was like, lady, i'm here. she's like, do you have a phone?

my phone's dead. i'm going to go up and try to get some help. i started flagging cars down. >> thanks to that man crews were on the scene. it took them an hour to pull the woman to safety using the rope system. she is in the hospital this morning. the chp is now investigating this as a dui crash. new details this morning about a plane that left a bay area airport and crashed in oregon. investigators now say one person, the pilot, was killed. it was initially reported that two people had died. the plane which took off from the san carlos airport crashed about a mile from madras airport east of salem, oregon, just before 2:00 yesterday afternoon. that airport in madras has become very popular the last few days. about 200,000 people are gathering in the area to watch tomorrow's solar eclipse. >> and the way they have secured and air traffic control today for this big event, i am a bit surprised this happened.

>> the faa says the plane was a single engine model like the one you see here classified as an experimental plane which means it's not assembled by the manufacturer. it had been housed at the san carlos airport. a bay area mother and son are missing. san mateo police are asking for help finding 26-year-old scott and her 9-month-old son wesley. scott was last seen picking up her son at a san mateo daycare back on tuesday. she hasn't had contact with her family since. investigators say they could be in a blue toyota rav 4 and could be somewhere in san luis obispo county. in boston a chaotic scene as tens of thousands of counterprotesters dwarfed a few dozen who turned out for a right-wing rally. they clashed with some of the counterprotesters. >> love not hatred. >> i was thinking we should show up to let the protesters of the

free speech rally know that they're in the minority. >> boston police were forced to lead the right-wing free speech group out of the area. the arrests were for disorderly conduct and hurling items at officers. president trump tweeted looks like many anti-police agitators in boston. police are looking tough and smart. later he switched gears and applauded the protesters who spoke out against bigotry and hate. back here at home a counterprotest to a protest that never happened. the turnout was in the hundreds of civic center plaza in mountain view where the group mountain view voices for peace and justice gathered. they discussed the importance of diversity and peace in the face of recent controversy. speakers talked about topics ranging from sexism in silicon valley to the open display of racism in charlottesville. >> i don't support violence and i certainly don't support terrori

terrorism. yes, i think that i am a suburban soccer mom here peacefully expressing myself. >> the event originally was scheduled to push back against a righ right-wing rally for the firing of james damore, the one who wrote a manifesto saying biological differences between men and women could explain the gender gap in technology. the protest was canceled over the threat of violence. in san francisco demonstrators also gathered to denounce white supremacy. house of representatives showed up to black bigotry and racial violence and wanted the name changed. decades ago the plaza was named after a city official who is now accused of pushing african-americans out of their homes in the '50s and '60s. >> justin herman should not be venerated in this city. he has a history of displacing and creating discriminatory housing policies.

a season where the qb refused to stand during the national anthem. meanwhile across the country a legendary police officer took part in a rally urging nfl teams to sign kaepernick. "today in the bay" explains. >> reporter: san francisco 49ers fans guardedly optimistic about the new season. >> they can use improvement. i think they're heading in the right direction. >> reporter: not only did the 49ers have a rough time on the field they were embroiled in controversy as quarterback colin kaepernick took a knee during the national anthem, protesting what he called the oppression of people of color. >> i think a lot of heart and guts to do what he did and to stand up for his beliefs. >> kaepernick, i loved him as a player and i love him as an activist. i admire him on both ends. >> reporter: after the season kaepernick opted out of his contract with the 49ers and is still a free agent unable to find a team to sign him. >> he's kind of like can't touch

welcome back. it's 7:14 on your sunday morning taking a live look outside as fog covers the san mateo bridge. quite a few people out already on this sunday morning. vianey arana will be along in just a bit with our sunday forecast. millions of people across the country hoped to win the record setting powerball but, in the end, there were no winners once again after two months of near misses. the powerball grew to $535 million which was the eighth highest of all time. since nobody won the jackpot grows to $650 million for wednesday's drawing. a look at last night's numbers. 17-19-39-43-68 and the powerball was 13. take a look at this video from the santa rosa fire

department. it's not the call for help firefighters are used to. the department got a call about a kitten stuck inside a car engine. luckily crews were able to eventually free the little kitten who was not harmed. this weekend nbc bay area and telemundo helped clear the shelters. it's our third annual event to find forever homes for shelter pets and thanks to the generosity of all of you another resounding success. about 1,500 pets were adopted during yesterday's event and tens of thousands nationwide. "today in the bay's" ian colt gives us a look. >> reporter: hundreds of people piled in to silicon valley to find a new pet like hannah olson a cat lover who just moved to the bay area. >> i knew as soon as we got settled in our apartment we would go look for one and this sealed the deal. >> reporter: choosing ricardo, one of many cats, dogs, even bearded dragons happy to find a

home. >> we are sending a lot of babies home. we're losing track how many animals are going home. it's great. >> reporter: nbc bay area and telemundo 48 were spread out across the bay. >> well, good luck. >> reporter: from milpitas to berkeley, also in burlingame. >> come on down, help us clear the shelters. >> reporter: and over in dublin helping match pets to families. >> we have angie. i'm going to keep the name angie from upstairs. i am so excited to take her home with me today. >> reporter: last year about 54,000 pets found their forever homes on clear the shelters day and again this year so many people supporting animals opening their doors and hearts to new friends. in milpitas, ian cole, nbc bay area news. it is 7:16. we'll check in with vianey arana with a look at our weekend forecast. you saw a lot of people going out, adopting pets. >> so many people. i think what made me even more happy, too, a lot of big dogs.

typically the puppies get adopted right away. there were a lot of big dogs and elderly dogs that got a second chance at life and i have a cute story of a pit bull mix on my facebook page, zeus. he's a big, meaty guy, and he got adopted yesterday. >> all thanks to our wonderful viewers. >> so thank you guys for coming out. i hope you get a chance to tune into my live stream. let's talk about the forecast. if you adopted a pup yesterday, today the weather is going to be perfect so you can go outside and enjoy your new best friend, enjoy the outdoors, take him on a nice walk, even a play date. 56 degrees right now in the peninsula at 63 degrees right now for the south bay and we're seeing partly cloudy skies in the tri-valley. hazy skies as well and patchy fog along san francisco at 58 degrees right now. 61 degrees for the east bay and over near the north bay at 57 degrees. now the temperature trend as of right now we have that high pressure sitting over the area. as it begins to move out we're going to see more of some slight cooling temperatures.

but not by much in san francisco. we can expect to hit a high of about 60 degrees by 2:00. we'll start seeing some of the fog burn off by 10:00 a.m. and then you can expect to see slightly breezy conditions along the coast. now in san jose 63 degrees right now and we will start climbing into the 70s by about 12:00 with the upper 70s, lower 80s by 2:00. typically the hottest portions of the day are anywhere between 12:00 and 3:00. so keep that in mind if you're out walking your pet. it's better to take him out during the cooler portions of the day. today's predicted highs very comfortable for the most part. the warmer spots will be further inland in areas like livermore and antioch and concord. we head over to palo alto we'll be in the upper 70s. san jose in the lower 80s and oakland a high of 72. san francisco 68. even in the north bay will remain in the 80s. i definitely want to say we're experiencing a nice combination between summer and fall.

now let's talk about next week's outlook. we have that high pressure moving out. by tuesday we can expect to see the system that will bring in the chance of seeing some early morning clouds tomorrow which is, of course, what we're keeping a close eye on because we are expecting that solar eclipse and we can expect to see some changes on the way as well. the later portion of the day we'll begin to see some warming. let's talk about the eclipse outlook. many of you are wondering where there are going to be the best spots to view it. the eclipse starts at about 9:01 and if you notice we're looking out for this marine layer. it will depend on how deep the marine layer is but typically we can expect to start off with early morning clouds and that dense fog early on. but right now judging by the models i have a feeling that, as always, it will be the best location to view it will be further inland spots. if you notice by about 10:00 a.m. when we're expecting that eclipse the inland spots have little to no cloud cover.

==take vo== millions of people aren, the countdown continues to the solar eclipse and excitement is building. millions of people are in or on their way to cities along the so-called path of totality. highways, airports, train stations and stores are packed. everyone is looking to snag a

spot along the 70-mile-wide path where the sun will be completely blocked by the moon tomorrow. >> business wise we are up like 800% over this time last year. >> something you will remember the rest of your life. the stories of seeing that eclipse are things you will be passing down to your grandchildren. >> some cities are hosting eclipse festivals this weekend. how best to see epic eclipse here in the bay area. >> reporter: the space and science center in the oakland hills is a place to see the stars. it's home to some of the most powerful telescopes around. >> this is a computer control telescope. >> reporter: but when it comes to total eclipse, you need

nothing more to see it than a piece of paper. >> it's a piece of card stock and punch a hole in it and use it to project an image on to a white surface. >> reporter: it's, of course, dangerous to look at the sun. so many outlooks are peddling eclipse glasses for $2.99 a pop. >> you won't be able to see anything unless you're looking at the sun. another safe way is welder's glass. this is called a sun spotter and we'll see a little image of the sun right here on this white screen. if you really want to get serious about observing this telescope set up to take photographs. this is a solar telescope. call it the great american eclipse because it's going to cross the entire country. >> reporter: a swath of the country in what's called the path of totality will witness the total eclipse while the bay

>> it really is. it was mt. hamilton. move on to walnut creek. this is a live view, 62 degrees. now we have low lying clouds for inland spots through the midafternoon like what we've been seeing. the current temperatures right now in inland areas, the most of the south bay, an increase in temperatures along the coastline about 60 degrees. pacifica, 62. now we will be seeing a couple of changes. now that doppler radar is showing off some of the marine layer but patchy fog along the coast. the temperature trend is showing an increase in temperatures into the 80s. 63 degrees right now. we do have a cooling trend on the way. i'll break that down for you in about 15 minutes. >> all right. we'll stay tuned, vianey, thanks. this morning a driver was killed when his car went over an

wesley at a san mateo daycare on tuesday. she hasn't had contact with her family since. investigators say they could be in a blue toyota rav 4 and could be in san luis obispo county. one of the bay area's most popular beaches may be getting a new look. a new warning sign. san francisco's ocean beach attracts more than a million visitors each year but many people, especially tourists, don't realize how dangerous the water is. so what's the new plan? here is investigative reporter liz wagner. we heard from world-class swimmers and concerned locals that ocean beach is often too dangerous for swimming. the national park service is responsible for ensuring safety there. tonight we investigate what the agency is doing to alert the public and we'll show you the changes that may now be coming to ocean beach. beautiful, inviting, and sometimes deadly.

four people died in these waves last year. >> i think this is one of the most dangerous beaches in america. >> kim chambers would know. she's one of the top marathon swimmers in the world. chambers and fellow open water swimmer simon dominguez respect the hazards at ocean beach. >> i have a lot of trouble getting through the surf and i'm an experienced surf swimmer. >> what makes ocean beach so treacherous is a one-two punch. first, long and powerful rip tides push people out to sea and they're always changing because of huge amounts of shifting sand. so what could be safe for wading one day may not be the next. then once in the open ocean currents coming out of the bay can carry people away. the nasty conditions prompted federal officials to make this announcement earlier this summer. >> the most important takeaway about ocean beach is it is not a swimming beach. >> but some say that message is murky. do you think that visitors to this beach are getting the

message that this is a no swimming beach? >> of course not. >> longtime local and former police inspector points to these signs posted along the three-mile beach warning of rip currents and drowning. but he says the signs don't go far enough. you think this sign should say swimming prohibited, swimming not allowed, do not swim. >> too many lives are being lost. and as far as this sign is concerned, yes, it is, because it doesn't say no swimming. >> are you okay? >> reporter: so we raised the issue with the national parks service, the agency in charge of the beach and the signs. if the message is ocean beach is not a swimming beach, why is that not reflected on the signs that are posted up and down the beach? >> we can't just tell everybody you're not allowed to swim here. >> reporter: doug armstrong supervises the ocean rescue unit where during the past 20 years patrollers have made at least 429 rescues at san francisco

beaches. he's the man you saw issuing the warning about ocean beach. >> we're here to allow people to enjoy it and to enter the ocean, but just be aware it's dangerous. >> reporter: because this is such a dangerous beach at what point can officials step in and say don't swim here? >> yeah, that's a good question. you'd have to ask those officials who make the decisions. >> reporter: we did ask. the national park service says because of our question it will now consider putting stronger language on the signs. beyond written warnings, the agency sends out roving patrollers to alert people wading too far from shore to be careful. >> we have dangerous rip currents out here at ocean beach so we want you to be about ankle to knee deep, okay? >> reporter: but you may never know the risks by looking at the language in some travel guides. we wanted to know how tourism groups craft their messages about ocean beach so we talked to howard picket, chief marketing officer for san

francisco travel, the most prominent marketing group for the city. >> i think our messaging is fair and balanced and i don't think we're putting anyone at risk. >> reporter: the water is cold most of the year and advises extreme caution but stops short of stating what the national park service has said publicly that ocean beach is not a swimming beach. >> somebody felt like we ought to be much more strenuous in that messaging. obviously we would do that in partnership with them. >> reporter: that could very well be the case. the national park service said just this week officials met to consider putting new language on the signs. the proposed change, wading, swimming, and surfing is not advised. enter at your own risk. with the investigative unit, i'm liz wagner. back to you. if you have a tip for our investigative unit give us a call at 888-996-tips or send us an e-mail to the unit. in boston a chaotic scene as tens of thousands of

the president wrote a letter saying the decision was made to protect duke's chapel after it was vandalized days earlier. this comes one week after the deadly protest in charlottesville when alt-right groups rallied against the removal of another robert e. lee statue. since then many cities have removed confederate statues and plaques. the president and first lady will not attend the annual kennedy center honors in december breaking from tradition. the white house made the announcement yesterday saying the decision will, quote, allow the honorees to celebrate without any political distraction. the kennedy center gala is held every year to recognize the lifetime achievements of people in a variety of performing arts fields. it typically includes remarks from the president. this year three of the five honorees including lionel richard threatened to boy caught the event because of president's involvement. comedian dick

gregory has died. his son says he died late last night in washington, d.c., after being hospitalized for severe bacterial infection. he ran for president as the peace and freedom party candidate. dick gregory was 84 years old. at 7:40 we have much more ahead on "today in the bay." coming up, a big night in bay area sports both the raiders and 49ers played their preseason home openers. we'll show you how each team did next.

the nbc sports bay area newsroom, a big sports night in the bay area with the giants, raiders, and 49ers all at home. let's start with the 49ers preseason home opener in santa clara, shall we. the 49ers hosted the coast. the first game as head coach at levi stadium. second quarter, now down 10-0. brian hoyer over the middle for

find your child's class supply list at walmart.com. but sometimes, seemingly unimportant changes can have major impacts on the welcome back. when it comes to elections few people have an interesting in election rules. they have major impacts on the state's political process and the laws that come out of sacramento. nbc bay area political analyst larry gerston joins us. what is this all about and what has changed? it sounds eerily frightening?

>>. power or keeping power. november 2016 election we all recall produced a two-thirds margin for the democrats in both chambers of the state legislature and that's something that's very rare. now that margin is critical because it takes a two-thirds vote in both chambers to raise taxes which is exactly what the legislature did last june when it added 12 cents per gallon to the state gasoline tax to tackle deferred maintenance on the state's miserably organized highways and roads. now that increase starts in november. >> and that stirred a lot of controversy, hasn't it, some people say i'd rather pay more taxes to have the roads be better so my car doesn't get ruined, my tires, but then a lot of people are upset about it. >> they don't like the money coming out of their pockets. to be sure that new tax has been very unpopular with some voters.

seizing on the unpopularity republicans and taxpayer groups mounted a recall campaign against the fellow by the name of nojosh newman who is a democratic senator who won an election by a very narrow margin in 2016 and also voted for the tax increase. now republicans viewed newman as the easiest target to defeat which would then drastically reduce the democrats' power. it's important to note the legislative recall elections are very rare. only twice -- twice in the state's history a legislator been recalled but republic see newman as their chance to make history and out that two-thirds democratic majority. >> so will there be a recall election? >> yes, there will be a recall election but not at the time and under the conditions that we would have expected. and until recently a state law requires recall election to be scheduled between 60 and 80 days after the local officials, after

the local officials certified the signatures. now that would have meant a standalone election. a stand alone special election some time this fall. they have very small turnouts which tend to benefit republicans. but last june democrats got smart. they changed the rules. theyed the rules by adding 30 days for voters to reconsider the signatures and an evaluation of processes related to that particular recall election by the department of finance and 30 days more for the legislature to review the total findings. so combining these new requirements all but guaranteed that the special election will not bealone but rather held in june and improving newman's odds and keeping the democrats' power. >> okay. but newman still might lose this. >> oh, i like your optimism.

yes, he still might lose. but get this, the past week the california political process commission which regulates campaign finance considered a proposal to eliminate a 4,400 dollar cap on how much a legislator could transfer from his or her own campaign account to another. that cap was removed which means that in all likelihood democrats will empty their coffers to help newman keep his seat. so between the new recall process and the lifted cap on contributions from other campaigns, bingo, the odds of newman retaining his seat next year have improved immeasure play. >> okay. so it looks like the democrats have the -- have stacked the deck. how is this legal? is this legal? i it's legal. >> it's legal, yeah. these are legal changes. let's be fair. that's true. but whether they are fair

changes and ethical actions, those are going to be for the voters to decide but, you know, this situation does remind us of that well-known phrase, to the victor go the spoils. democrats are in power and they've used the power to try to protect the two-thirds majority. what kind of a negative reaction comes out of this, will there be pushback if the voters actually see what's happened? those things remain to be seen. >> remain to be seen and probably a lot of people don't even know this will be happening. >> and that's why sometimes as difficult as it is it's kind of important to walk through weeds to see exactly what's going on. >> i wish we had more time to talk about this, larry gerston. thank you. i was wondering if an electric toothbrush really cleans...

it is 7:54. good morning, bay area. we're still seeing a cloudy start especially if we have plans to head to the beach. 61 degrees and a live look over point reyes and it looks overcast and cloudy using your weather underground cameras. it will stay that for the majority of the morning and the afternoon we to see those clouds burn off and that's going to make way for an overall nice day. the peninsula 56 degrees. nice and mild. 61 degrees for the tri-valley and san francisco of course that fog very typical for this time of year. we've been seeing it really for several days in a row.

61 degrees in the east bay and slightly cooler temps. by slight i do mean slight. a few degrees, maybe three or four degrees with some warmer still inland spots. concord at 87. we head more close to the coastline. down in san jose expect a high of 82 degrees. san francisco, though, will be topping out into those upper 60s at about 68 degrees. half moon bay will be cloudy all day long, even through the afternoon. so keep that in mind. let's talk about your monday forecast. by 9:00 a.m. we do see the marine layer. it's a deep marine layer which means it looks that coastline will be very foggy right at the start of the eclipse. we fast forward throughout the

day. it does burn off a bit but if you notice further inland that marine layer seems to be just fine so i think your best viewing areas will be down near the south bay, near the pleasanton/livermore area. we can also expect to see some coastal as we head into monday morning but i also want to make mention of this additional system. popping up on the radar for the sierra, about a 40% chance of seeing thunderstorms up in monmouth. please check road conditions. up near the area. not so much lake tahoe, maybe a few pop-up showers that might carry into mon morning. we'll start out with the patchy fog.
