good wednesday morning to you. another day to smile. it's hump day. a live look at the bay bridge as people start their day. you can see cars beginning to move ready to go. good morning and thanks for joining us. i'm marcus washington. >> and i'm -- we're just waking up. no, i'm laura garcia-cannon. let's get this day going together. >> it's going to be the best day of the week in terms of weather. cooler temperatures today. it will be really nice. and you'd better take it in and enjoy it. we have some high heat in the forecast. as we start out this morning it's in the upper 50s for the tri-valley, peninsula, and some lower 50s now for the north bay so a nice cool start there. as we look at the high temperatures today up to 68

degrees in san francisco. antioch, 94. lower 90s inland. this is nothing compared to what's on the way. i'll talk about that coming up in a few minutes. >> just a few folks who might be using a specific off ramp. speed sensors all over the bay. we did get word the embarcadero off ramp is expecting tree branches down. we will look at traffic in the area, though, and the palo alto camera shows how light traffic flow is. should be clearing. tropical storm harvey came ashore a second time. this is a live look at the radar this morning. >> the morning rain continues to pound texas forcing levees to overflow. the official death toll is nine

now including a houston police sergeant. our own damian trujillo is in the houston area this morning. >> a look at what people are dealing with now. >> reporter: many families are waking up only to find nothing has changed. their homes remain not accessible at this point. it's been a nightmarish four days. by nighttime thousands of people had already been shuttled to emergency shelters and schools, churches and convention centers. a curfew ordered by the mayor, the mayor said loot eers, they needed to keep the streets safe. national guardsmen maneuvering through floodwaters to rescue families from the rising waters. the children, elderly, pets, all were loaded onto boats and trucks and taken to the

shelters. this morning there is uncertainty as to when the families might be able to return home. the wrath of hurricane harvey is still visible. >> i just can't believe it. i lived here when katrina was going on. those poor people and now it's happening to us. >> reporter: roughly 200 police officers also had their homes destroyed or damaged by harvey yet there they've been helping others in the midst of one of the worst natural disasters in american history. the sun will come up soon here in the suburb of houston and people will wonder if it will be more of the same today. we're in katy, texas, damian trujillo, "today in the bay." >> thank you, damian. it is 4:33. houston and its surrounding areas will be massive. she spoke about harvey during an event in san francisco last night.

divisive ideas like building a border wall. >> i think texas takes the place of the wall and america would much rather contribute their tax money to the rehabilitation of texas and all that 1,600 square miles than another wall on our border. >> they hope people will begin to unite a divided country. our coverage of the unfolding disaster in texas continues this morning. breaking news this morning the u.s. military confirms naval teams have conducted a successful planned missile defense test off the coast of hawaii. the medium range launch comes one day after north korea fired a ballistic missile over the japanese island eyisland.

a proposal that would split mt. diablo school district in two was voted down. >> where the plan now stands this morning. good morning, bob. >> reporter: now it will be up to the state. whether or not they decide to split the mt. diablo school district in two. early this morning at 12:30 against the split in a 3-2 vote. they've created this map if you want to take a look up. the new proposed north gate unified school district would splinter off and consist of five schools, walnut acres, bancroft and valverde and north gate high school. critics of the secession called the proposal segregationist because the new district will be predominantly white and wealthy. advocates say it's not about

good morning. i'm landon dowdy live and here are today's top business headlines. futures are higher this morning. stocks recovered yesterday as investors shook off concerns over north korea's latest missile launch. data on the job market and the dow rising 56 points to 21,865. the nasdaq up to 6301. flooding in texas has spawned local fuel shortages and disrupted a major pipeline to the east coast. the system which runs from texas to new jersey is starting to have problems due to the storm. analysts likening it to a mississippi river of fuel. nashville, charlotte, and washington-dulles.

american express is unveil ing a new plan that allows customers to pay for certain purchases of $100 or more in installments. it's not necessarily a better deal for consumers but a way to feel more comfortable. you can separate selected purchases from the rest of your bill and pay a flat monthly fee until it's paid off in full. mark a marcus and laura, back to you. kaiser permanente fined more than $2 million. fined for failing to provide data on patient care to the state's medicaid program. this follows another $2 million fine back in january for the same issue. three years ago kaiser was fined $4 million for problems with patient access to mental health treatment. coming up, preparing for a bay area heat wave.

>> it's coming tomorrow. >> it starts tomorrow and friday and then it just continues. i'm not even ready to deal with this. a look at what it feels like this morning as you head out, napa at 53 degrees. oakland and palo alto starts out at 57 degrees. mostly clear skies. milpitas a high of 82 degrees. for danville, 94. hayward, 75. san mateo up to 75 degrees and san francisco reaching into the mid-60s. novato at 88. santa rosa a high of 82 degrees. also some sandals to keep you

nice and cool and then even less layers as these temperatures heat up as we're seeing at the bottom of the screen in that seven-day forecast. you'll have to head closer to the coast. we'll start out with nice weather. low 60s. mid to upper 70s by noon and then 81 degrees as we head through early afternoon, still continuing to climb into the upper 80s today. we do already have excessive heat watches in effect for most of the bay area. that kicks in tomorrow. excessive heat warning will begin tomorrow. we're ramping up and getting ready for hot temperatures over the next several days. starting on friday and saturday, we'll also have some slightly warmer temperatures into next week warmer than average. and then look at the inland areas, reaching the peak of the heat friday and it still continues with triple digits

now to our continuing coverage of sunday's anti-hate demonstrations in berkeley. 13 people were arrested. we don't know the fate of 12 of them. one person has been charged. a san francisco state student charged with battery and resisting arrest. mendez appeared in court yesterday as she pled not guilty to her misdemeanor charge. police say she threw an apple at officers and used her german shepaherd dog. >> it is absolutely necessary at this point. the white supremacists in our communities are not going away by themselves. >> the judge lowered mendez's bail. they tell us they're not aware of other protest cases as of yet.

happening today in oakland, senator harris will have a town hall meeting this afternoon on telegraph. the senator was in san jose last night meeting with mayors from around the state including local bay area cities. the group discussed several topics including the daca program which allows dreamers children who are brought into the country illegally to live and work legally in the u.s. >> we told them if you give us all that information about you we will not share that information with i.c.e. we will not deport you. america needs to keep that promise to our young people. i am determined to fight to make sure we do that. it's the right thing to do. >> there have been reports president trump will soon make a decision on whether or not to continue the daca program. 4:49. starting today people living in the monterey bay region can text 911 for help. it's available in all areas of

monterey, santa cruz, an alternative to calling the emergency service. governor brown signed the bill into law requiring emergency service departments to offer texts to 911 options. so where does the bay area stand in this? the fcc reports so far only sunnyvale, antioch, martinez, and richmond departments offer the service. other departments are expected to come online including belmont, santa clara and vallejo. this may not be surprising to some people but most of the people in the system are men. >> the top 35 earners are all men. according to uc salary data men earn between $1 million to $3 million last year. that excludes the base pay which is taxpayer funded. of the 35 men, 29 are doctors, four are coaches. the others include hospital

executives and an investment offic officer. check out the full list. well, coming up, a look at history. vintage photos in the bay area. the search for the owner. first, happening now, at least 18 people have been -- have fled violence in myanmar and crossed into bangladesh. the government is blaming insurgents for the violence. more than 100 people have died in the fighting. and former white house press secretary sean spicer, who is roman catholic, finally got a chance to meet pope francis. he was at the vatican when president trump visited in may. he was left off the list of white house officials who had a chance to meet the pope.

good wednesday morning to you. 5:54 as people get ready to get on the move. cars already on the road. the suspicious death of a 3-year-old girl. >> the coroner ruled it a homicide but no one was charged for years. senior investigative reporter vicky nguyen joins us with new details in a case that has gone cold. >> you can see why her family calls her the light of their lives. her mother and grandparents hoped for swiss justice even within the care of two people during her last days. they said eden's death was an accident telling authorities

she'd fallen down several concrete steps outside their home and that nine days after the fall she collapsed while playing with play-doh. suspicion lingered. after waiting for the d.a. to take action the lynch family asked us to investigate. we're with nbc bay area. do you know what happened to eden? do you believe the account of what happened to eden? >> i don't. her falling down the stairs, i don't. absolutely not. why didn't you take her to the hospital that day? >> reporter: new action from the district attorney. following our questions, the d.a. has now filed felony child abuse charges against holly diabla. neither holly nor jimmy did anything harmful to eden to cause her death.
