good tuesday morning to you. a live look outside over san francisco as we get this day started, this tuesday morning, as we get on our way after the holiday weekend. i'm marcus washington. >> and i'm laura garcia-cannon. i hope everyone had a nice weekend. extended for some folks who were lucky enough. and it was so high. such amazing sun rises and sun sets. we have a lot of pictures. you can send in your pictures you've taken over the weekend. we can share those. at least we will have temperatures that are fairly mild to start with. this is where we're heading this afternoon into the low 90s for the tri-valley in antioch while the coast in the low 70s. mike also has some breaking news on the peninsula. >> i do. this is a live look here at some fencing. you see the yellow tape.

we have a vehicle that went through the fence and then it ended up on the tracks where the supply train killed the person inside. it has disrupted caltrain. we have a bus bridge in place and i've outlined that between palo alto and redwood city there. it's just off buckingham which is a surface street. it will not impact el camino or wood side. b.a.r.t. recovering from 20-minute delays. laura, back to you. thank you very much, mike. a live look at washington, d.c., this morning where congress is set to return with a very packed agenda. it may be overshadowed by president trump's decision today on whether to deport thousands

of undocumented immigrants. tracie potts, we will learn a lot more of what is next for the daca program. good morning, tracy. >> laura, good morning. >> reporter: that daca news conference set just under three hours from now and interestingly not from the white house. the announcement is not being made by president trump but by his attorney general. immigrants known as d.r.e.a.m.ers brought to the u.s. illegally as children may no longer be protected from deportation pending an announcement by the attorney general this morning. >> we're not criminals or thieves or rapists like the president said when he began his campaign. we're here for a better future for ourselves, our families. >> reporter: the obama order known as daca, deferred action for childhood arrival, protects

as many as 800,000 immigrants, many of them now adults. >> they are contributors and the last thing we'd want to do is kick them out of this economy. >> reporter: nine states have threatened to sue to end daca. republicans are split. two sources say the administration may include a six-month delay. they're back in session today. plus, the budget. that may be pushed until the end of the year. they need to allow america to borrow more money. >> no one is going to let the u.s. default on its debt. >> reporter: and lawmakers will seek billions for hurricane harvey recovery. national flood insurance, children's health insurance, and the faa. with all of that it's a wonder they can even get to dealing

with tax reform but it's a priority. the treasury secretary steve mnuchin thinks they can get to it by the end of the year. >> bay area politicians also reacting to the president's pending decision. to read more head to our website nbcbayarea.com. breaking news, we are just getting word hurricane irma is now a category 5 storm. that is the strongest level hurricane on the scale. new information coming in within the last few minutes or so. we have more on the storms and are tracking its movement. >> home of the national hurricane center, florida's governor has declared a state of emergency for all of florida. we're getting a new glimpse from inside the hurricane. here we go.

a hurricane hunter plane actually flies into the eye of the storm. >> now we want to bring in kari hall with new information that's just coming in on irma's path. look at the size of that storm. >> this is definitely a textbook hurricane that we see category 5. they are very unusual and for them to make landfall, had about five in recorded history. this is so close to those islands. they are going to feel the brunt of the storm first. when they do hit the tropical islands a lot of times we have so much flooding and fatalities. as it continues to move near cuba close to miami a large area that will be watching but mostly florida is in the target zone as a category 4 hurricane.

the last time it hit this area has been at least ten years. watching irma from now through at least next sunday and then we'll see if it ends up in the gulf and from there there could be the possibility that more states will be in the target for this hurricane. breaking news out of fair field. two or even three people have been shot. we don't know much information. it happened in the neighborhood off cement hill road around 10:00 last night. no word if the victims have serious conditions, but we don't even know really what may have led up to this. we checked on social media with those accounts for the school and they have not posted anything about this. we reached out to see if there will be any impact for those people.

developing news in the south bay. the fight to contain these flames still far from over. >> as bob redell is live with the progress firefighters are making this morning. >> reporter: good morning to you, marcus and laura. i spoke with cal fire within the past hour and they have reestimated the size in the eagle ridge housing development here in gilroy. we believe they have calculated the size to be 87 acres not the 100 that was initially reported. not sure when they'll have the fire surrounded. this fire could force the evacuations of people who live around here but the fire now appears to be moving away from these homes. about 100 men and women are battling this fire.

their biggest challenge is the terrain. >> reporter: cal fire has not figured out what caused the fire, though. neighbors tell us it was illegal. a quick note for parents whose students attend the middle school no pickups in christmas hill park as a result of the firefighting effort. reporting live in gilroy, bob redell, "today in the bay." >> higher humidity helping firefighters knock down the largest fire ever. burning in the hills near burbank. l.a. fire chief says there's no active fire left. monitoring hot spots that could rekindle if the hot weather returns. the fire started on friday and burned 7,000 acres destroying

seven homes. we're coming up on 5:09, a few clouds in the sky. high humidity and some very warm temperatures. a lot of people are heading back to work. and then those temperatures making it into the mid-80s even though our temperatures are lower than we've had recently. that very muggy weather we're feeling right now. we've had a couple showers around the region. mike has been keeping us updated on what's happening as your morning commute begins. >> just off 101, the deadly crash on caltrain tracks. there will be delays as it comes up. tracking that with pete suratos on scene. we also have a little slowing as you travel past the slow lane.

it is 5:13 on this tuesday morning starting out with muggy conditions, a live look outside in san jose. to the neighborhood of evergreen. we will be at 74 degrees at 9:00 this morning. temperatures rising into the mid-80s. still above average. we'll talk more about this and what's ahead for the week. an update on the cleanup from hurricane harvey and what's ahead for hurricane irma all in less than five minutes. >> more traffic at the bay bridge, i'll talk about problems on two sets of rails as well. >> it's 5:13. a worker owned taxi company

trying to raise money to stay in business. the company is the only worker owned co-op. all workers have a say. published in january. researchers say since uber launched in 2009 around 50% of taxi drivers are now self-employed. hourly earnings for taxi drivers dropped about 10%. the holiday is over and wall street is eager to get back to work after the day off. >> it was unwelcome. a lot happened since traders started their three-day weekend. more on tax cuts and north korea. investors would like to get back to trading.

the dow starts under 20,000. testifying before congress almost exactly a year ago today and calls for him to return to answer new questions. this after wells fargo said last week it had found far more examples of dishonest banking. look at what the chairman of the house financial services committee said in a written statement to "the new york times." this latest revelation of customer abuse is further evidence of catastrophic mismanagement. 70% bigger than what it originally told congress.

china has taken action to regulate the currency market like bit coin. and the value of bitcoin has fallen enormously. after a record high for bitcoin on sunday, after that news about china. you see people use the bitcoin. it moves around a lot. there's no point to it. one talked about using bitcoin for pizza. you regret the pizza, you should have bought the ferrari. >> it's the value. developing now at 5:16 the rain may be gone but many parts of southeast texas are still under water.

this is something that will need to be watched over the next few days. you see that cluster of clouds, that could be a developing tropical system so this could be something else that could develop in the gulf of mexico and showers pushing into texas as they try to clean up. we'll keep you up to date on that as you head out the door this morning temperatures are in the low to mid-70s. it feels very muggy. a few isolated showers and storms popped up yesterday. we will still have that same chance today. it's 68 degrees in san francisco and the north bay and a very mild start. from santa rosa to napa and some low 90s in livermore. half moon bay a high of 72 degrees. we've been watching spots like livermore where those

temperatures have been hot. poor air quality with all of that haze. temperatures in the upper 60s rising into the low 80s by noon. as we look at the seven-day forecast for san francisco the low 70s be a we are going to keep the 70s for the next few days dropping into the upper 60s by thursday and friday and then warming up again. that same trend for the inland areas. very humid today. we'll drop the humidity tomorrow and then our temperatures gradually will be heating up again in time for this weekend with highs in the low 90s. i'll have another look at that forecast coming up. >> of course yesterday the labor day holiday a lot is off and the morning commute not a problem. a live shot throughout the morning. a new crash that just popped up coming right up to downtown.

a trip to the beach with the weather so warm this year. park rangers at ocean beach say this year a lot more than the normal share of garbage out there. crews worked overtime to make some extra trash pickup. still more to clean up this morning. some couldn't help but notice what others were leaving behind. >> it's such a shame. >> a beach cleanup for ocean beach along with other bay area beaches. happening today san francisco supervisors are expected to tackle new questions about their recently approved tobacco ban. unanimously approved a flavored tobacco ban. enough signatures to bring that to voters. the board will have to appeal or put it on the ballot.

supporters plan to hold a rally today at city hall. the recent study backed by the national institutes of health. 73% of young adults 18 to 24 use flavored products. and more than 8 in 10 say the first tobacco they tried was flavored. that's compared to a little over half of users who are over 25. >> at 525 now happening today a plan to rename terminal at sfo could take a step forward. there is a push to rename after harvey milk after it failed in 2013.

hollywood is reeling from the worst summer in more than two decades. >> the box office rushes returns were down 35%. the movie season runs from the first weekend in may through labor day. returns were down about 16%. analysts blame bad review movies, competition from cinematic tv shows such as "game of thrones" and gaming services, netflix and hulu. so sitting down for dinner, family dinner, is not as easy as it used to be. the recent survey found only about 57% of parents eat dinner with their children each night. as children back to school they are reminding everyone that it is national family meal month. they are encouraging americans to have at least one more family meal at home. >> i like to do it every single night. no devices at the table either.

hurricane irma which is barelling towards the caribbean is n a breaking right now, hurricane irma, which is barreling towards the caribbean, is now a category 5 storm. the strongest level hurricane on the scale. we're going to bring you the latest coming up in a few minutes. we've been tracking it this morning. first i want to say good morning to you and thank you for joining us. i'm laura garcia-cannon. >> and i'm marcus washington. we want to head over to kari because we have more storms possibly popping up. kari? yeah. we've been watching all of this. yesterday around the bay area we had some showers that moved through parts of the north bay, but you're feeling that leftover humidity this morning and as we get a live look outside in san jose and our temperature trend for this afternoon will be reaching into the mid-80s with a mix of sun and clouds throughout much of the morning and looking at our high temperatures today reaching into the low to mid-80s

in the north bay. oakland, 79 degrees and san jose, 85. morgan hill up to 89 and 90 in antioch and livermore. we'll talk more about this and an update on hurricane irma and what's happening in the gulf as well but mike has some delays to report. >> three sections of delay. we do have caltrain, thatly crash on the tracks in redwood city. pete suratos will bring you more detail just after my report but we wanted to let you know the trains are moving now on the tracks, give you more of what caused that problem. b.a.r.t., what caused the problem over the weekend track maintenance. took extra time to clear this morning. they're expecting some delays through oakland. we're looking at overall a smooth drive but we're seeing much more volume of traffic on the roadway like at the bay bridge toll za. with the metering lights we have this filled in. your commute is back this morning. >> thank you very much, mike. back to the breaking news we are

covering, continuing to cover on the peninsula where we're tracking the latest on the deadly wreck involving cal train and a vehicle. pete suratos live off buckingham avenue in redwood city with what we know far this hour this morning, pete. i understand you talked to the person who 911? >> reporter: good morning, laura. we did talk to the person who called 911. he tells me he heard a loud bang. we're standing here on buckingham and westmoreland in redwood city. this is where the bang came from. the car driving through this fence just before 2:00 a.m. i did get a chance to speak to the neighbor who called 911. there were some trains moving along these tracks not too long ago. the video from earlier this morning and according to chp they're saying the car crashes through the fence i just showed you just before 2:00 a.m. apparently the cardi disabled a a few minutes later an oncoming caltrain carrying supplies

smashing into it and dragging it about half a mile. we did reach out to caltrain and they say the driver's car was on its roof when the train hit it and the driver was killed due to the impact of the train collision. here is the neighbor i spoke with who called 911 describing the impact this morning. >> at first we were expecting maybe a house to get hit or something major. it was a major accident. we weren't expecting it to hit the fence. we expected another car or a house. >> reporter: chp believes only one person was in the car and they confirm it was an adult male. we'll continue to monitor this and bring you any new updates in the next hour. pete suratos for "today in the bay." breaking news out of washington president trump

tweeting moments ago about daca, a program that allows young, undocumented immigrants to live and work in the u.s. legally. >> now this comes just before his decision on the program expected to come down in a matter of hours. here is the tweet, congress, get ready to do your job -- daca. "today in the bay's" kris sanchez with the impact on thousands of people here in the bay area. good morning, kris. >> reporter: a lot will gather here to make clear even if president trump dumps daca they will continue to fight for those children who are in this country illegal illegally through no choice of their own. more than 800 thousand undocumented youth applied for protection. critics of daca says this amount -- they say this amounts to amnesty. proponents say the so-called

d.r.e.a.m.ers contribute an estimated $2 billion a year in state and local taxes according to the nonprofit institute and taxation and economic policy. kevin ins he made himself known as undocumented but says he can't afford to live in the shadows anymore. >> i think the biggest thing that i'm afraid of is losing our jobs because we're not going to have a work permit to continuously work lawfully within the country. >> reporter: a look at the top five states. california has the most with more than 220,000 d.r.e.a.m.ers, more than 120 th,000 are in tex. the rest of the d.r.e.a.m.ers live in about five other states all across the country, so this is not a regional issue. this is according to u.s. immigration data through march of this year as analyzed by the nonpartisan pew research center.

i will put this on my twitter feed and facebook page so you can look it up for yourself. at 6:30 i'll talk about what the options are for president trump if he decides to end daca. kris sanchez, "today in the bay." >> thanks for the latest, kris. and more breaking news now. we're following within the last 30 minutes data from hurricane hunters discover irma strengthened overnight as it barrels to possibly south florida. irma is now a category 5 storm packing winds up to 175 miles per hour. hurricane warnings are up in the u.s. territories of puerto rico and the virgin islands. meanwhile today six bay area red cross emergency response vehicles will leave oakland and head to florida. this is in preparation for a fob landfall. volunteers will also go to operate the vehicles. this morning a search and rescue task force is back in oakland. they, too, may head to florida

for hurricane irma. they returned from flood ravaged texas last night. the stories of courage. >> the cattle were up to their ears in the water. the people from texas were there to help rangel the cattle, take them to high ground and the horses. >> a very texas moment. >> it was extremely texas. >> if irma makes landfall the team could fly to florida as early as this weekend. 5:37. happening today the city of piedmont may be under new leadership as soon as tonight when councilmembers are scheduled to appoint a new mayor. previous mayor jeff wheeler resigned ten days ago after controversial media posts some racially charged. wheeler has since resigned. councilmembers are set to hold a vote tonight. the meeting begins at. >> and an activist accused of

weapons is due in court this morning. kyle chapman calls himself stickman. they say that video shows him confronting left-wing protesters with sticks and clubs. authorities arrested him at a rally in march but previously ordered him to stay away from rallies in berkeley. a man accused in the deadly shooting of kate steinle is due back in court for a pretrial hearing. jury selection is scheduled this week to start in the murder trial involving jose inez garcia-zarate. he previously went by the name of juan francisco lopez-sanchez. authorities say that he shot and killed steinle as she walked on the pier with her father two years ago. they plan to argue that shooting was accidental. a big heads-up for two agencies. caltrain where pete suratos

as go into the day in campbell we will have temperatures well above our average high temperature of 81 starting out in the mid-70s. we'll be up to 86 degrees by 3:00 today so we'll talk about this, an update on hurricane irma and tropical storm jose as well as our dropping humidity that's all coming up in five minutes. >> and looking at the lowering speeds, decreasing travel times. yesterday had no problem. today delays there as well as on two sets of rails coming up. >> the chp is trying to determine if bris from the roadways led to a deadly crash on the sunol bridge. it happened a little before 10:00 last night. the officers say that the in the bmw suddenly swerved into the embankment and rolled over. the passengers in the minivan were not injured. the chp did receive calls in

about the same area. they do not believe the driver was impaired. it is 5:45 and happening today san jose city leaders asking for feedback on a plan to add bike lanes along minnesota avenue in willow glen. it crosses lincoln avenue, we've been covering it for a years. in 2015 the city made lincoln avenue a three-lane road to accommodate bicyclists and encourage slower driving. the change became permanent. now adding bike lanes will make it safer as well. not everyone agrees. >> even if you're a pedestrian or driving having more people jammed in the same area. >> you can share your thoughts tonight. the meeting is set for 6:30 at willow glen elementary school. the rising tensions with

north korea this morning, president trump says he will sell weapons to u.s. allies in the region. in the past ten minutes or so president trump tweeted, quote, i am allowing japan and south korea to buy a substantially increased amount of highly sophisticated military equipment. unquote. south korea carried out live fire exercises and russia's president sent out a warning they would rather eat grass than give up nuclear weapons. putin also called for talks and warned against whipping up hysteria. president trump said all military options are on the table. monday u.n. ambassadory haley said kim jong-un seems to be begging for war. >> and we've been talking about the president's plan for daca all morning. been tweeting about that. he ex the white house will announce it's putting an end to

the plan to protect the so-called d.r.e.a.m.ers. >> scott mcgrew joins us now. let's talk about how we got here. we got here because congress would not take action on comprehensive immigration plans despite there was support from the majority of americans and even a majority of the u.s. senate. daca is not a lau lw. it's a presidential order. there are people on both sides who say the president overstepped his bounds. the president can't just order something if congress doesn't want it. so texas has said they will sue to stop daca. the legal reasoning is it's unconstitutional use of presidential power, and they've given president trump a deadline to undo president obama's order. that puts trump in a tough position. at different points in his campaign he's promised to both end daca and to leave young immigrants alone, which are

opposite promises. today at 8:00 our time attorney general sessions will announce what sounds to us like a bit of a compromise. the president, we think, will say he's ending daca but not for six months. this gives congress the time to go back and pass that comprehensive immigration reform and maybe keep the kids in america. but the president is supposed to meet with senate majority leader mitch mcconnell. they haven't been on speaking terms since their argument over the phone since a profanity laced shouting match. congress has a full plate, tax reform, debt ceiling, the fund for hurricane harvey, looking as if irma will hit florida hard as well. the president tweeted congress get ready to do your job. we will cover this all live at 8:00 a.m. laura and marcus? >> certainly following that. thank you very much. how about a little fun this

we'll book you out for weddings. >> the weather not bad. it was warmer but not bad at all. >> people were just looking forward to cooler temperatures and we're feeling that now but it's still really humid as you get ready to head out the door. i wanted to keep you updated on what's happening as far as texas and the recovery as we are still dealing with major river flooding there and also some scattered showers in the region, also watching the swirl of clouds here, an yeah of low pressure that may develop into another tropical system but it looks like a lot of that could move into mexico. this could become tropical storm jose and we're following what's happening with now hurricane irma. this is a major category 5 storm with wind speeds of 175 miles an hour, so close to the u.s. virgin islands as well as puerto rico so that looks to be right now in the main target and over the next several days this could remain as a category five as it moves into puerto rico and then over cuba and then possibly into

miami and it may move into the gulf of mexico as a category 4. upper 60s and today high temperatures reaching into the low 90s with high humidity. san francisco up to 76 degrees looking outside, dress what you'll want to wear. it will be great for some short sleeves and some shorts just again trying to stay and all of this warm weather as you head out this morning very muggy and then at recess sun and clouds, warm but some sunshine and breezy winds as you pick up the kids. the pickup line will be bright and sunny. as we head over to mike, our transit delays. >> a couple of agencies with delays. b.a.r.t. because of the weekend work. they started out a little late.

meanwhile caltrain is running at reduced speeds. that continuing deadly crash investigation that goes on there. pete suratos reports from the scene but i did want to let folks know that the bus bridge is no longer necessary and i don't think they're honoring caltrain at all anymore. you can just stay on the train. looking at the rest of the bay and we do see speed sensors showing a great read. most of the bay looking good slowing through hayward and over here we still have that delay getting to the crash that has moved to the shoulder. a live look at the bay bridge shows you the backup has been there since 5:20. that's heavier than yesterday and also in the south bay san jose shows more volume and traffic, slowing here 101 north of 680. back to you. >> thank you, mike. and coming up, trouble on takeoff. the reason this plane's engine caught fire just after taking off from tokyo. and happening now on our dij platform breaking news.

the san francisco board of supervisors will meet to talk welcome back, everyone. it's 5:56. happening today the board of supervisors will meet to talk about a city street by a san jose couple. it was sold for $90,000 at auction. homeowners responded with a lawsuit saying the city sent the tax bill to the wrong address. they say they're worried the new owners will charge now for parking. >> happening today a traffic alert in the east bay. the public works department is fixing erosion issues and making shoulder repairs. work starts today and lasts through october 5th. it's happening between deer valley road and clayton city limits. crews will be working monday

through thursday from 8:30 a.m. to 4:00 p.m. showing a japan airline landing after hitting a bird during takeoff. onboard that boeing 777 when it hit the bird just after takeoff. 5:57. happening today we could get somes on the death of two women inside their northern california home. the coroner will perform an autopsy today. the women were found last friday night at a home in sacramento after a carbon monoxide alarm went off. the women didn't die from carbon monoxide poisoning. >> it's just shocking and sad.
