"today in the bay's" tracie potts live with a plan the president is reportedly leaning towards. good morning. >> reporter: hey, laura and marcus, good morning. he dropped another hint this morning just a short time ago tweeting, congress, get ready to do your job. daca. referring to that policy. we're expecting an announcement in just under two hours from the justice department. immigrants known as dreamers brought to the u.s. illegally as children may no longer be protected from deportation pending an announcement by the attorney general this morning. >> we're not criminals. we're not thieves. we're not rapists like the president has said. when he began his campaign, we're pretty much here for a better future for ourselves, for our families. >> reporter: the obama order known as daca, deferred action for childhood arrivals, protects as many as 800,000 immigrants,

many of them now adults. >> they are contributors and the last thing we want to do is kick them out of this economy. >> reporter: nine states threatened to sue to end daca. republicans are split. two sources tell nbc the administration may include a six-month delay. a fine time for congress to fix it. they're back in session today. >> tax reform is one of the biggest pieces of our agenda. >> reporter: plus the budget. congress may push that to prevent a government shutdown. they need to extend the debt ceiling this month allowing america to borrow more. >> nobody is going to let the u.s. government default on its debts. >> reporter: and lawmakers will seek billions for hurricane harvey recovery. they face deadlines to reauthorize national flood insurance, children's health insurance, and the faa. so with all of that on their flight, will they even get to tax reform? the treasury secretary says yes.

glimpse from inside the hurricane. this is video coming from a special hurricane hunter plane. it actually flies into the eye of that storm but they can verify wind speed and get scientific data, something we definitely are watching closely. >> i want to bring in meteorologist kari hall right now tracking hurricane irma's path so far. >> a look at the storm and areas preparing for this really dangerous hurricane, i say, as it first makes landfall for the u.s. and the virgin islands and port reas well as the other islands in the caribbean. look at this storm. category 5. and we've only had five u.s. landfalling category 5s in recorded history. so this definitely is a history making storm as it continues to move off to the north and east over the next couple of days and moves over cuba and then eventually towards florida and that could re-enter the gulf of mexico as we will be tracking this storm throughout this week so a category 4 hurricane

possibly as it moves closer to miami and a category 5 as it makes landfall for the caribbean islands. more on this coming up. >> we'll continue to watch that. thanks so much, kari. 6:06. following breaking news out of fairfield this morning. we found out police say two or three people have been shot. right now we have little information but what we do know it happened in the neighborhood off the metro just across the street from laurel creek part and elementary school. police say it happened about 10:00 last night. no word on the victims' conditions or what may have led up to the shooting. we checked the social media accounts for the school. they haven't posted anything just yet. we reached out to see if there will be any impact for students. if we find out more we'll bring that information to you. 6:06 and developing in the south bay this morning we are still closely monitoring this brush fire burning near the homes in gilroy. that fire broke out saturday night and it's only 10% contained this morning.

"today in the bay's" bob redell is live near the burn zone with new information this morning about what we learned about how much this has burned. good morning to you. >> reporter: good morning to you, marcus. we're here in the eagle ridge housing development in gilroy. the fire has been burning in the hills behind us which is hard to see right. in the foreground you can see firefighters within the past few minutes have come down from the hill where they've been fighting the fire overnight. it looks like they have chains, shovels to clear brush and get a better sense of containment. we did speak with cal fire over the past couple of hours. they tell me they have reestimated the size of the fire and they now calculate the brush fire has burned only 87 acres, not the 100 initially reported. containment is still at 10%. they're not sure when they'll have it completely surrounded. firefighters were concerned this could force the evacuations of people who live around here but the fire now appears to be moving away from these houses and homes, about 100 men and

women from across the region are battling the fire. their biggest challenge is the terrain. >> working in the wood land area, steep, difficult to get into. >> reporter: cal fire has not yet figured out what caused the fire though neighbors tell us they believe it was illegal fireworks. a quick note for parents whose students attend nearby middle school. there will be no pickup or drop-offs ain or near christmas hill park as a result of this fire and the access the firefighters need to put it out. bob redell, "today in the bay." >> a busy morning for them. thank you for the update. meantime to the south, cooler temperatures and higher humidity are helping firefighters knock down the largest fire ever in the city of los angeles. the la tuna wildfire burning near burbank. the good news here the l.a. fire chief says there's no active fire left but firefighters are still monitoring plenty of hot

spots that could rekindle if the weather returns. four homes were destroyed. overnight a closer look at the active fire map to see just how many wildfires are burning across our golden state. this year's fire season has proven to be a busy one. thousands bat 29 active fires this morning. and right now at 6:09 with all wildfires burning nearby we have unhealthy air quality even as temperatures drop. a lot of that smoke is trapped near the surface especially in the valleys. as you walk out the door this morning it's in the upper 60s it lower 70s. and it will be a very humid day with temperatures reaching 85 degrees in san jose and napa. 79 in oakland. 76 in san francisco. livermore and antioch up to 90 degrees. so we'll talk more about this and a look at the temperature trend in four minutes. mike has an update on the crash on the east shore freeway. >> a lot of icons on the map that shows you scenes were in

flux over there. also building around the bay much heavier traffic flow than yesterday although there are a lot of green sensors. we showed this. a couple of other crashes that appeared just as i showed the report. the right lane is blocked. not just the disabled vehicle but a crash reported there west 80. no injuries reported. at most one lane is partially blocked and getting away from the bay bridge just wanted to show you what over there on the report. meanwhile your drive times to the bay bridge just half an hour from highway 4 to that backup. the san mateo bridge gives you an idea of the big difference in volume. now slowing because of that volume across the flat section. the build should start on the peninsula. back to you. >> thanks so much, mike. tobacco ban battles. new questions bay area leaders are facing after banning flavored tobacco. plus, we investigate those claims that flavored tobacco companies are targeting younger people. wall street back to work after a three-day weekend and

we're heading today into the lower 80s. we'll start to see the clouds clearing out throughout the morning. an update on what's happening for the rest of the weekend and the tropics. an update from caltrain. a crash investigation on the side of the tracks and delays for b.a.r.t. happening today san francisco supervisors are expected to tackle foo questions about their recently approved tobacco ban. in june supervisors unanimous approved a flavored tobacco ban, the first anywhere in the country. since then opponents have reportedly gathered enough signatures to bring that issue to voters. "the chronicle" reports the board will have to either repeal the ordinance or put it on the ballot in june. supporters plan to hold a rally at city hall. we looked closer into just who

is using flavored tobacco. opponents argue it's mostly targeted to younger tobacco users. a recent study backed by the national institutes for health seems to support that idea. researchers found 80% of users under 17 use flavored tobacco. 73% of young adults 18 to 2 use the flavored products. more than 8 in 10 young users say the first tobacco they tried was flavored and that's compared to a little over half of users who are over 25. the box office returns for august were down 35% from last year. the first weekend of may, the box office was down about 16%. game of thrones and streaming services like netflix. >> and people don't seem very excited about the new apple phone due to be unveiled next

week. >> people aren't even aware of it? >> right. afterry just released a report showing the majority don't know that the phone is expected to be a tote redesign. it's the tenth anniversary. the pressure is on apple to perform. 16% of people say they will upgrade. a totally new naming scheme as well. testifying before congress almost exactly a year ago. last weekend it found far, far more examples of honest banking.

reaching into the mid to upper 80s. the seven-day forecast is coming up at the bottom of the screen. in oakland expect a high of 79 degrees. some upper 70s for the peninsula. palo alto will reach up to 82. the mission district at 76 today. we have been talking spots like the tri-valley where temperatures have been the hottest. and as we start out the day we are still going to have that poor air quality, the smoke and the low clouds then temperatures reaching up to 85 degrees today. looking at santa cruz our temperatures hold steady around 70 degrees. clouds throughout much of the day. in san francisco temperatures in the 70s today, upper 60s for the middle to end of the week and then a little bit warmer for the weekend.

29-year-old involved. this was a 29-year-old driver killed in that fatal crash. on westmoreland and buckingham avenues. i want to show you more video in the last hour when you have crews cleaning up debris following that deadly collision. that scene on the tracks clearing up the past hour. through 2:00 a.m., the cardiss abled after driving onto the tracks and later you had that oncoming caltrain carrying supplies, crashing into it and dragging it about half a mile. they said the driver's car was on its roof and the driver was killed due to the impact of the train collision. i did speak with a neighbor who lives right on this corner who called 911 describing the impact. >> expecting a house to get hit or something major.

we were expecting it to be another car that got hit or a house. >> reporter: chp believes only one person was in the car and exactly what led the driver to crash through that fence is still under investigation. the delays are only minor. we're live in redwood city. >> we will be following this for days. irma strengthened to a category 5 storm. wind speeds up to 175 miles per hour. >> people in south florida are bracing for a possible impact. supplies already running out in some stores. the nfl is meeting to discuss options on sunday between the

tampa bay buccaneers and the dolphins. kari hall joins us to give us an date on what we can expect. >> it's been at least 12 years since we've seen a category 5 hurricane. a category 5 making landfall in the u.s. now you see all of these islands in the caribbean highlighted in red. they are under hurricane warnings right now. wind speeds 175 miles an hour. moving closer to dominican republic and haiti, cuba as bah. this could move closer to southern florida a category 4 hurricane. we will continue to watch this

to amnesty but proponents say d.r.e.a.m.ers contribute an estimated $2 billion a year in state and local taxes according to the nonprofit institute on taxation and economic policy. this man made himself known as undocumented but can't afford to live in the shadows anymore. >> the biggest thing is losing our jobs. we will not have a work permit. >> reporter: california is watching for the decision. we have the most dreamers, 220,000. more than 120,000 in texas. and the rest of the dreamers live in about five other states. really a national issue not a regional one. this is according to u.s. immigration data through march of this year as analyzed by the

pew research center. you can have a refresher of what daca has been for the last five years and forward what it will mean. we are monitoring that decision. we expect we will hear something later on today. president trump called on congress to do their jobs. republicans saying we may not dump daca after all. kris sanchez, "today in the bay." >> it is 6:37 right now and happening today the city of piedmont may be under new leadership as soon as tonight when councilmembers are scheduled to aa new mayor. the previous mayor jeff wheel resigned ten days ago after controversial social media posts, some racially charged. wheeler has since resigned from the city council as well. councilmembers are set to hold a meeting tonight at 7:30.

we'll follow the rest of your commute. >> sounds good. 6:44 right now. a live look at gilroy where firefighters continue to fight flames. the blaze here is impacting schools. you see the flames shooting up here but they have been reported. we talked with officials from cal fire who say containment is still at 10%. it's actually down from initial reports of 100 acres. officials say it appears to be moving away from the homes of eagle ridge. chp is trying to determine if debris in the roadway led to a crash on the sunol grade before 10:00 last night on interstate 680 near the andrade area. a woman suddenly swerved into the embankment and rolled over.

her car was struck by a minivan. sadly she died. passengers were not injured. before the crash chp did receive some calls about a camper shell in lanes in about the same area. they believe that driver was impaired. 6:46. san jose city leaders are asking for feedback on a plan to add bike lanes along minnesota avenue. this crosses lincoln avenue, the of the so-called road diet we've been covering for years. in 2015 lincoln avenue was made a three-lane road to encourage slower driving. the change became permanent in 2016. now the city says adding bike lanes will make minnesota avenue safer but not everyone agrees. >> even if you're a pedestrian or a bicycler or driving there's just a lot of things going on at the same time and having more people jammed into the same area will be rough. >> we do realize that within the peak, 16 to 20 minutes in the

morning and evening there will likely be some additional backups but there's offsetting benefits to the safety, mobility, and liveability of that entire community. >> and you can share your thoughts tonight. that meeting is set for 6:30 at willow glen elementary school. developing news on the rising tensions with korea this morning. south korea carried out live fire exercises overnight and russia's president issued a stark warning saying north korea would rather, quote, eat grass than give up nuclear weapons. putin also calling for talks with the country and warned against whipping up military hysteria. president trump said all military operations are on the table. monday u.n. ambassador nikki haley said kim jong-un seems to be begging for war. happening today congress returns from a five-week summer recess. you're looking at live pictures this morning. among the key tasks for congress funding the government and raising the debt ceiling by the

end of the month. experts say the immediate focus will likely be passing an aid package to help harvey victims. gop leaders have also said they want to focus on tax reform. >> we've been talking about the president's plan for daca all morning long. we expect the white house will announce this morning it is putting an end to the plan to protect so-called dreamers. >> scott mcgrew us now and, how did we get here? >> congress would not take action on comprehensive immigration back when president obama was present. now daca is not a law. it's a presidential order and there are people who say president obama overstepped his bounds, the president can't order something if congress doesn't allow it. states like texas said they'll sue to stop daca. the legal reasoning is it's an unconstitutional use of power

and they've given president trump a deadline to undo president obama's order. now that puts trump in a tough position because at different points in his campaign he's both promised to end daca and he's promised to leave young immigrants alone and those are opposite promises. attorney general jeff sessions will announce what sounds like a compromise. the president will say he's ending daca but not for six months giving congress time to pass comprehensive immigration reform and maybe keep kids in america. but the president has a terrible relationship with congress. the new york sign says president mcconnell hadn't been on speaking terms since their argument described as a shouting match and congress has a full plate. you were talking about this. reform, debt ceiling, and irma

north bay. looking at these high temperatures today we'll be in the mid-80s in napa and santa rosa. 79 in oakland. 85 in san jose and san francisco looking at a high of 76 degrees. and you can check out the seven-day forecast at the bottom of the screen. as we look out the window we see it is another hazy start to the day and it will be warm once again. so another day to wear some short sleeves, maybe some shorts to try to stay cool but it's been so hard. and we will have more weather like this over the next few days. we're going to get rid of this humidity as we step out the door this morning. feels muggy and at recess it will be warm. by 1:00 expect those temperatures to start to rise into the 80s with some sunshine and some breezy winds. we've been keeping you up to date on what's happening all across the tropics. keeping an update on what's happening across texas as they tried to rebuild and recover. we have some nearby scattered showers and the possibility of a developing tropical storm. if it does develop this could become jose. this most likely, though, will

before you head out the door here are the top stories on "today in the bay." >> we begin with breaking news. within the past two hours we've learned irma has strengthened into a category 5 hurricane. this is a live look at our radar this tracking irma as it barrels to the caribbean and possibly south florida. irma is packing winds of up to 70 miles an hour. one person is dead and two others are injured in a shooting in fair field. this happened in the neighborhood around 10:00 last night. this is video just in to our newsroom showing the scene which is still an active one this morning. no word on what led to that shooting. a live look from redwood city. around westmoreland and buckingham avenues. the chp says the 29-year-old man driving the car died during the collision. police still trying to figure out why the driver crashed the car through a fence and on to the tracks in the first place.
