"today," tuesday, september 5th, 2017. >> from nbc news, this is "today," with matt lauer and savannah guthrie. live from studio 1a in rockefeller plaza. good morning, everybody. it's 7:00 a.m. on the west coast. it's tuesday morning, we're glad to have you with us. still recovering from harvey and now another hurricane to talk about. >> it's always good to have al with us at the top of the show. but this time it's because of what's over your shoulder.

>> that's right. and i want you to take a look at a really well-defined eye of this thing. i mean, this is about as classic as you could possibly get. now we have this storm that has intensified over the last several hours to a category 5 storm. 270 miles east of antigua, right now hurricane warnings up for puerto rico and the northern leeward islands. 175-mile-per-hour winds right now. moving west at 14 miles per hour. hurricane hunters now crisscrossing across the eye and sending more data back to the national hurricane center, so we get hopefully a better idea of the movements. here's what we see as the track. comes across puerto rico early thursday morning. still a category 5, 160-mile-per-hour winds, bringing storm surges from 6 to 10 feet. rain fall amounts of up to a foot. by sunday morning it's in the florida straits between the keys, and cuba, with 150-mile-per-hour winds. so, as we track this, we put in what we call this ensemble model

and it has what we call the spaghetti strings. it puts together all the possible scenarios that it sees. even still, category 4, but still could be a 5, and then early sunday morning, does it make the turn? we have to wait to see. that big area of high pressure out over the atlantic, if it continues to push it, it actually will start pushing it out into the gulf. but right now most of the models keep it coming somewhere either on the west coast of florida, east coast of florida, into the southeast, guys, the fact of the matter is, we've never had a category 4 or higher, two storms making landfall. if this happens it would be unprecedented. and that's why everybody from the gulf all the way up into the mid-atlantic states have to really keep an eye on this. >> by the way the spaghetti as you called it is changing hour to hour. >> it is. >> all right, al, thank you very much. appreciate it. as we mentioned, irma is prompting emergency declarations in florida, the u.s. virgin islands, and puerto rico. nbc's morgan radford is live now in san juan, where as you can imagine, residents are getting ready.

morgan, good morning to you. >> matt good morning. residents and officials getting ready. i'm coming to you live from the headquarters of the emergency response center here in san juan, puerto rico. and this is where now they're under a state of emergency ahead of what has been upgraded to a category 5 hurricane irma. and that means today is all about preparation. now the people outside we've spoken to on the ground have said look, we're caribbean. we get it. we're used to heavy rain and heavy winds. this time of the year. but a category 4 or 5 that's an exceptional different beast. so that's why the national guard has already been activated. schools have been closed and almost 500 emergency shelters have been set up all throughout the island. but it's not just here. also in florida, they're also getting prepared with supplies. with food. with gasoline. because territoauthorities are they can't afford not to take irma seriously. 57 counties under a state of emergency and some are debating whether or not they should evacuate.

this is an event that has been described as catastrophic, as life threatening, and that is headed our way. >> all right morgan, thank you very much. and be careful. >> yeah, absolutely. there's a lot more to get to this morning, including a major controversy facing the white house. about an hour from now the president is expected to announce his long-awaited decision on daca. that's the program that protects undocumented immigrants who were brought to this country as children. nbc's white house correspondent kristen welker has the latest for us. kristen, good morning. >> hi, savannah. good morning to you. president trump previewed the big challenges he faces in an overnight tweet using four words. big week coming up. and this morning, congress get ready to do your job, daca. it all starts this morning at the justice department where attorney general jeff sessions is expected to announce the president's controversial plan to end daca, the deferred action for childhood arrival with a six-month delay. as washington gets back to work today, president trump is setting off a bruising immigration battle.

deciding the fate of more than 780,000 young immigrants brought here illegally by their parents. white house sources tell nbc news the president will likely end up daca today, with a six-month delay for congress to come up with a fix. the program protects dreamers from being deported while they work or attend school. the executive decision already triggering cross-country protests over the holiday weekend. and a blue state backlash with attorneys general in new york and washington vowing to sue if the president cancels daca. candidate trump pledged to repeal the obama era program. >> -- you're saying the dream act -- >> we have to make a whole new set of standards, and when people come in they have to -- >> you're going to split up families? you're going to deport children? >> no, no, we're going to keep the families together. we have to keep the families together -- but they have to go. >> as president he sounded more compassionate. >> we're going to show great heart. daca is a very, very difficult subject for me. i will tell you. >> the gop remains deeply divided. with some republicans urging the president to allow congress to

come up with a solution. >> we haven't made this a permanent law. so it's up to us to do so. >> others insisting the president must end daca now. including iowa representative steve king, tweeting the six month delay could lead to amnesty, which amounts to republican suicide. it's the latest addition of the gop's daunting to-do list for september. first up, funding for hurricane harvey relief. starting tomorrow, congress will take up a bill for more than $7 billion in aid. next, a number of must-do items, raising the debt limit, funding the government by the end of the month, or running the risk of a government shutdown. complicating all of it, the president's insistence on money for that long promised border wall. and the other items on the gop wish list? tax reform and another shot at health care. as for daca, hundreds of business leaders have called on president trump to keep the program, from apple to facebook and microsoft. today there are already protests scheduled all across the country and here in d.c. all setting up a big fight this

fall. matt, savannah? >> kristen, members of congress haven't seen eye-to-eye on a lot of key topics. what's the likelihood that they can come up with some kind of fix for daca? >> well, look, matt, in the words of one top republican who i spoke to, the fight over daca will either unite the republican party or tear it apart. you have republicans who want to find a fix but for many on the far right, they just think daca goes against the rule of law and think it should be scrapped altogether. but, and this is a big but, there's some buzz about a potential compromise that could bring both sides together. legislation that would, for example, fund the border wall. that's critical to trump's base. while also preserving daca. but, matt, the challenges are very steep. >> and it's not as though, kristen, that's the only item on lawmakers' agenda. you've got tax reform they want to do. there's a debt ceiling to be raised. how are they going to address all of those priorities? >> well you're absolutely right. the to-do list for september is very long. everything from hurricane harvey

relief to raising the debt limit. by the way those two things could be linked in legislation. but the president's top priority is tax reform after the failure to repeal and replace obamacare, he wants it. frankly, he needs a big legislative victory. so expect the president to be more engaged than he was during health care. he's going to be hitting the road to sell his tax reform package this week, in fact. he'll be in north dakota, but republicans are still very divided over the details, i'm told. still, as one top republican source told me, republicans need tax reform because, quote, we need to show we can govern. savannah, matt? >> kristen welker at the white house, thank you. >> there's some breaking news overnight in the north korea crisis. south korea carrying out live fire exercises for a second straight day. following the regime's most powerful nuclear test to date. and the trump administration is again warning kim jong-un that enough is enough. nbc's keir simmons is is in vladivostok, russia, near the north korean border. keir, good morning to you.

345u9, good morning. evening here in russia's far east, and the russian border with north korea is just along the coast in that direction. and this morning, russia's president putin issuing a thinly veiled rebuke of president trump saying that what he calls the hysteria over north korea is senseless, and could lead to a global catastrophe. south korea, demonstrating its power on the water with military exercises. a commander vowing this morning, north korea's navy will be buried at sea. but today, russia's president putin issuing a stark warning. north korea would rather eat grass than abandon its nuclear program. and tougher sanctions will make no difference. russia threatening to increase its missile capability in the pacific. on land, limits on south korea's missile payloads will be lifted by president trump, according to a south korean defense spokesman. and the president, on twitter this morning, announcing he'll allow japan and south korea to buy more advanced military

equipment from the u.s. meanwhile two days after the north korean nuclear test, reports kim jong-un is preparing to launch another missile. the u.s. will table the u.n. resolution later calling for further actions. >> but he is begging for war. >> reporter: on north korea's northern warder is vladivostok, north korea's nuclear test site is just 200 miles from here. sunday's explosions rocked the city. so you were sitting on the couch here when you felt the tremor? artem liukin was in his small apartment. >> it lasted maybe 20, 25 seconds. >> reporter: but we soon see some of the thousands of north korean workers who also live here. sending money home. russia's connection with decree's communist north runs deep. artem, a professor tells me he has north korean students. >> they use smartphone. they have access to internet. >> reporter: and this is his local north korean restaurant,

as we're talking a north korean man walks by. he doesn't want to talk. the u.s. and its allies say russia, and particularly china, should cut off north korea. but here, at least, those ties seem as strong as ever. and tomorrow here in this city, president putin will host a conference that will include south korea's president moon, japan's prime minister abe and a delegation from north korea. once again, president putin putting himself at the center of the international stage and in the middle of the north korean crisis. he has a lot to win, matt and savannah. and a lot to lose. >> all right, keir simmons in russia for us on this story. keir, thank you. >> as the u.s. is preparing for a potential hit from hurricane irma the death toll from harvey is still growing. and this morning, the nonstop recovery efforts in southeast texas are stretching resources thin. nbc's national correspondent miguel almaguer is in bridge still near the louisiana border. miguel, good morning.

>> savannah, good morning. it's been ten days since harvey made landfall. and so many communities look just like this, surrounded by water or beneath it. and they desperately all want to dry out. this morning in hard-hit east texas, this is the road leading to a city still under water. entire neighborhoods here are submerged. the cleanup can't even begin. row city won't have electricity for two weeks, but they do have the power of neighbors. >> never in my wildest imagination could i have ever pictured this in my mind. >> reporter: with parts of houston flooding today, controlled releases by nearby reservoirs, means thousands of frustrated homeowners are losing dry ground. >> this is a sacrificial area for all of houston. >> reporter: this natural disaster is still unfolding. with a somber reminder of the lives lost, while trying to save others.

>> i feel good inside and out. i never saw this much. >> reporter: this morning, a community coming together in a region still struggling to get back on its feet. officials say it could take several days, if not several more weeks for all of these floodwaters here to recede. the damage no doubt will be in the hundreds of billions of dollars. the death toll from harvey stands at 45. savannah and matt? >> miguel, thank you very much. >> in the meantime, a wild fire burning out of control in oregon forced more evacuations overnight and led to the closure of interstate 84. the eagle creek fire has grown to about 5,000 acres. an air quality warning is in effect, ash could be seen falling up to 90 might away. oregon state police say fireworks likely to blame for that fire. and a suspect is in custody. a labor day block party turned chaotic monday after an suv drove into a crowd in philadelphia. police say the festivities had just started when the driver hit several party goers, including elderly people, and a pregnant

officer grabbing and manhandling alex wubbels, the university of utah hospital is taking measures to make sure it doesn't happen again. >> no individual in the role of educator should ever be treated this way. >> reporter: from now on, police will have to talk to hospital administrators, not doctors or nurses. detective jeff payne wanted a blood sample from truck driver william gray, who was burned in this crash involving a car being chased by police. but the supreme court ruled that police must have a warrant or a patient consent. when wubbles explained why she couldn't draw blood, payne became physical. >> stop! i said, stop it! stop! >> reporter: watching it all unfold, university police and security failed to protect the nurse. >> i apologize to her for what she had to go through. she is a rock star. she did everything right. she didn't deserve to be arrested for what she did. >> i don't know what his problem was. >> reporter: monday on "today,"

wubbels said she went public because police were slow to take action. >> i'm not here to police the police. the police have to do that, if they're going to gain any trust by me or the public. >> reporter: but detective payne and other officer was placed on paid leave when the video was released. now a criminal investigation as the salt lake police department's facebook page fills with thousands of people demanding justice. the salt lake city police and the major have responded to nurse wubbles. detective payne is not responding to requests for comments. william gray, hit by the car being chased by police, sustained serious burns in the crash. he is also a reserve idaho police department. he and his department have publicly thanked nurse wubbles for standing up for his rights while he was unconscious and in the burn unit. friends have set up a gofundme page to help with his serious

>> i have somebody that has to say hello or she is in big trouble. >> i h this is an nbc news special report. here's lester holt. >> good morning, everyone. we're coming on the air on this busy back-to-work tuesday, as the trump administration is about to announce its decision on daca, the immigration policy put in place by president obama that allows people that came to this country as children deportation. currently 800,000 of them. as a candidate, president trump promised to end daca. jeff sessions is going to make the announcement at the justice department. kristen welker is there. talk about the timing and why they may want to announce this

now. >> reporter: well this, is against a deadline with a number of states attorney general that they would sue the trump administration if it didn't scrap daca today. it is expected that jeff sessions is going to end daca, with a six-month delay, giving congress that amount of time to fix the program. this is highly controversial. that's why you have the secretary general, and not the president announcing it. >> kristen welker, thank you. attorney general sessions has now entered the room. he will speak. but we are told, will take no questions. >> okay. good morning. i'm here, today, to announce that the program known as daca, that was effectuated under the obama administration is being

resended. the daca program provided a legal status for recipients for a renewable two-year term, work worker authorization and other benefits and participation in the social security program, to 800,000 mostly adult illegal aliens. the policy was integrated unilater unilaterally. after congress rejected legislative proposals to extend similar benefits on numerous occasions to this same group of illegal aliens. in other words, the executive branch, through daca, deliberately sought to achieve what the legislative branch specifically refused to authorize on multiple occasions. such an open-ended circumvention of immigration law was an unconstitutional exercise of authority by the executive branch.

the affect of this unirat ral amnesty, contributed to a surge of minors at the southern border that yielded consequences. it denied jobs to hundreds of thousands of americans by allowing those same illegal aliens to take those jobs. we inherited from our founders and have advanced an unsurpas d ed legal heritage. as attorney general, it is my duty to ensure that the laws of the united states are enforced, and that the constitutional order is upheld. no greater good for the overall health and well-being of our republic, than preserving and strengthening the impartial rule of law. society where's the rule of law is treasured, are societies that tend to flourish and success. totes where the rule of law is

subject to political womhims an personal biases are afflicted by poverty and human suffering. to have a lawful system of immigration that serves the national interest, we cannot admit everyone who would like to come here. it's just that simple. that would be an open borders policy. and the american people have rightly rejected that. therefore, the nation must set and enforce a limit on how many immigrants we admit each year. and that means all cannot be accepted. this does not mean they are bad people or that our nation disrespects or demeans them in any way. it means we are properly enforcing our laws as congress has passed them. it is with these principles and duties in mind, and in light of

imminent litigation that we reviewed the obama administration's daca policy. our wisdom is that the policy is vulnerable to the same legal and constitutional challenges that the courts recognize with expect to the dapa program, which was enjoined in a decision that was affirmed by the fifth circuit court of appeals. the fifth circuit concluded that daca has not been implemented in sufficient discretion. and that dapa was closed by congress' careful plan. the immigration law that congress passed foreclosed this possibility of daca. it was inconsistent with the constitutional separation of powers. that decision was confirmed by the supreme court on an equally undivided basis. if we were to keep the obama

administration's policy, the likeliest outcome is it would be enjoined just as was dapa. the the department of justice has advised the president and the homeland security, that the homeland security should begin an orderly, lawful winddown, including the consolation of the memo that authorized this program. acting secondary duke has chosen appropriately to initiate a wind down process. this will enable the department of homeland security to conduct an orderly change and fulfill the desire of this administration to create a time period for congress to act should it so choose. we firmly believe this is the responsible path. simply put, if we are to further our goal of strengthening the constitutional order, and the rule of law in america, the

department of justice cannot defend this overreach. george washington university law professor jonathan turley in testimony before the house judiciary committee was clear about the enormous constitutional infirmities raised by this action. he said, quote, in his testimony, in ordering this blanket exception, president obama was nullifying part of a law that he simply disagreed with. if a president can claim sweeping discretion to suspend key federal laws, the entire legislative process becomes little more than a pretense. the circumvention of the legislative process, not only undermines the authority of this branch, he's referring to the legislative branch, but

destabilizes the tripartate system as a whole. the disrespect for the legislative process is an important first step. all immigration policies should serve the interest of the people of the united states. lawful immigrant and native born alike. congress should carefully and pursue the types of reforms that are right for the american people. our nation is comprised of good and decent people, who want their government's leaders to fulfill their promises and advance an immigration policy that serves the national interest. we are people of compassion. and we are people of law. there's nothing compassionate about the failure to enforce immigration laws. enforcing the law saves lives. protects communities and taxpayers and prevents human suffering. failure to enforce the laws in the past has put our nation at risk of crime, violence and

terrorism. the compassionate thing to do is end the lawlessness, enforce our laws, and if congress chooses to make changes to those laws, to do so through the process set forth by our founders, in a way that advances the interest of the american people. that is what the president had promised to do and has delivered to the american people. under president trump's leadership, this administration has made great progress in the last few months, toward establishing a lawful and constitutional immigration system. this makes us safer and more secure. it will further economically the lives of millions who are struggling. and it will enable our country to more effectively teach new immigrants about our system of government and to assimilate

them to the cultural understandings that support it. the substantial progress of immigration at our border is almost entirely due to the leership of president trump and his inspired immigration officers. but the problem is not yet solved. and without more action, we could see illegality rise again, rather than be eliminated. as a candidate and now in office, president trump has offered specific ideas and legislative solutions that will protect american workers, increase wages and salary, defend the national security, ensure the public saufety and increase the general well-being of the american people. he has worked closely with members of congress, including

introduction of the raise act, that would increase benefits of fur country. there's powerful interest groups in the country. and every one of them has a constitutional right to advocate their views. and represent whomever they choose. but the department of justice does not represent any narrow interest or subset of the american people. we represent all of the american people and protect the integrity of the constitution. that is our charge. we at the department of justice are proud to work and advance this vision for america and to do our best each day, to ensure the safety and security of the american people. thank you very much. >> attorney general sessions not taking any questions, reading off a prepared statement, announcing that the daca program -- this is a program

that allowed undocumented immigrants that tham co-the country as children to remain in the country and to work. he used the words rescinding it and winding down. chuck todd, did the administration just drop back and punt on this? >> that's one way of looking at it. there's a reason why you heard the attorney general lay out a legal case against daca. he did not lay out the political case against daca. i think that's always been the problem and the controversy surrounding daca. the legality of it isn't clear-cut. what the attorney general laid out there is true. it is vulnerable. when you do something via executive action, it is a vulnerable part. and you could absolutely see lawsuits come in and question the constitutionality of it. if okay doesn't do anything,

what happens to the 800,000 folks. what country do you send them back to? for many of them, they don't know of a home country. they may have been born in another country. but they don't have a place to be deported to. this is a punt to congress. now, we're going to have a long, drownout political fight. congress has a big to-do list. throwing this on top of it is probably the top issues that have fractured this issue more than anyone else. you throw that in the next six months to find out a solution. can democrats live with funning a wall. can republicans feel comfortable voting for a form of amnesty, protecting these folks legally would do that. is the wall enough to keep them from dealing with the challenge on the right? the politics of this is so complicated. the legality was complicated

enough. but the administration has a strong legal case to make in withdrawing it. they don't have a good political one. >> let's go to hallie jackson now. hallie, to what extent is the administration prepared to held and guide congress as they come up with a solution? >> that's a million-dollar question. and it's a question you have 800,000 people in this country looking to. it seems the president is putting distance between himself and this decision. putting out jeff sessions to make the announcement from the department of justice, rather than announcing it himself. if we see this distance, this is a ball, to continue with the football analogy, to be picked up and run with by congress. what happens in ex-to the daca recipients, the so-called dreamers. we know that the protections, we learned, will expire on a rolling basis. there's no plans, dhs says, to target the daca recipients.

the dreamers. but if the protections expire and congress does nothing in six months, we're being told that the daca recipients will be treated like any other immigrant. the priority is to prioritize the deportation of other criminal offenses. committed other crimes besides being in this country illegally. when you talk about personal information, there's no plans to use the personal information, given by the recipients to the government. but it could be provided if requested by law enforcement. >> lets me quickly go to kasie hunt on capitol hill. this cuts across lines in vulnerability. is there a stomachache on capitol hill? >> this congress has struggled to make any kinds of compromises in the trump administration. and this is an issue that fractures both sides. brings out emotion. there are republicans that want to extend a hand to the 800,000

people. lindsey graham has sponsored a bill to that effect. there's republicans that are worried about the business community, who has been vocal saying they want the people to continue to work for their businesses. this is going to require democrats. there's going to be the right wing of the party that's not going to accept it. do you couple this with funning for the border wall to get enough people to vote for it. backing the border wall that president trump campaigned on is impossible for so many of the democrats here in congress. the reality is, democrats and republicans will have to compromise if they want to help these people. we've seen no evidence that they're going to be able to do that. >> kasie hunt, thank you. the administration winding down daca and giving congress six months to come up with its own

solution. we want to switch to hurricane irma. a dangerous category 5 storm as it bears down in the caribbean. let's get the latest from al roker on that. >> it's been interesting to watch this intensify. in the last 36 hours, it's gone from a 3 to a 5. and right now, it's a category 5 storm with 185-mile-per-hour winds. the track of it keeps to the north of puerto rico, the leeward islands, with 175-mile-per-hour winds on thursday. friday morning, near cuba, sunday it's between havana and miami and the florida straits. we'll be watching this very closely. right now, hurricane watches up for his ppaniolahispaniola, sane leeward islands. we have tropical storm warnings also for the leeward islands.

we look at the different models. they're all together pretty well saturday afternoon, coming through the bahamas or north of cuba. by monday, they make this turn and by tuesday, a little more focused on florida and to the west of florida. we're starting to see a lot more of the strands coming over into the mid-atlantic states. we're going to be watching this very closely, lester. if this makes landfall, it would be the first time ever in the same season we had a category 4 storm or higher make landfall twice. two storms of category 4 strength or higher. this could be devastating. that's why everybody in the gulf, all the way up into the mid-atlantic, has to continue to watch this. >> al roker, thank you for the update on irma. stay with nbc and msnbc for the latest on irma and the daca decision. and we're following the crisis on north korea. i'll victims of the hurricane. so many of you want to help, as

dad? >> both of my parents grew up on farms. we've been around animals our entire life. i've been a huge animal lover and dog lover. i wanted to write this book too teach people about the amazing animals that are available for adoption. >> the story goes, one thanksgiving not that long ago, you and your sister brought some dogs. >> food is not our forte. we decided to bring puppies. we walked by a store that kneaded to find posters for some puppies. we turned my mom's garage into a little kennel. >> how did maria feel about that? >> she loved it. the last one turned out to be a foster failure because i adopted maverick. >> maverick you've had how long now? >> 2 1/2 years. >> how did he inspire you to write this book? >> i got maverick, two weeks

old. very sick at the time. and i ended up creating a special bond with him and i kept the him and i decided to bite the bullet and adopt him and to see how kids responded to him. they could get a dog that came with the story. i saw my cousin react to me getting him. they thought it was so interesting. i wanted to write the book because i wanted to teach kids about the option of animal adopti adoption. when time comes for them to get a dog or a cat, they might choose to adopt. >> what have you learned about this group through writing books like this. >> this is my first children's book, which i always loved children. >> it's really fun for me. i love kids. to teach them at a young age, you know, about animals and the ones available for adoption. it's something i'm excited about. >> you posted a picture of you working out, with dad. >> that was my father. >> he posted it? i don't know why that doesn't
