watching out for, bob? >> reporter: well, they do not have a suspect as of yet. no arrests according to san jose police department. this happening in the elan luxury apartment complex. it's a very large complex. i just got done speaking to a man, a next door neighbor to where the murder took place. he heard one gunshot, thought it sounded like a cap gun. he didn't think anything of it. thought so little of it, he did not call 911. the people who live next door, at least one man and another person, they just moved in about a week ago. police got the call to 911 someone had been shot. they found a man suffering from at least one gunshot wound. that person was taken to the hospital where he was later pronounced dead. investigators do not know what led up to the shooting. i asked that next door neighbor,

did you hear a noise before the shot went off? he said no. they do not know if it's a random crime. they are trying to identify a suspect. reporting live in san jose, bob redell, "today in the bay." >> thank you, bob. new this morning, firefighters are investigating this late night fire that destroyed a home on the peninsula. it happened near alameda village in redwood city. firefighters say that home was fully engulfed by the time they arrived. the good news is there was no one there at the time. it took crews an hour to get it under control. developing this morning, the second big rock slide in as many days at yosemite. visitors say the second one was bigger than the first. >> it sent visitors scrambling for safety. the dust cloud left some areas briefly resembling a war zone. no one died, but one visitor had to be air lifted to the hospital

which is that old law that the president struck down at least for the next ten days so the ships can get the items into ports. american shipping companies don't like that. they want to see that law in place. it's good for them and competition. they could give pushback. lawmakers are already starting the process to try to permanently get rid of that law. in addition to what's happening in puerto rico, we could see a fight over that on capitol hill. back to you. >> nothing is easy. thank you very much. a developing story out of oakland. the investigation continues after a man died while in police custody. this happened hours after he was hit by a taser. details are scarce about what happened in those moments. the alameda coroner looked at it. police are not revealing what

led to that incident. federal immigration agents continue their raids in the bay area. 27 people arrested this week alone. 21 happened in santa clara county, six in san francisco. i.c.e. reports they violated u.s. immigration laws. daca recipients were not targeted. i.c.e. says many arrested have crimes ranging from traffic violations to sexual assault. they all face deportation. 5:07. in north bay, san rafael police are looking for a sexual assault suspect. they took this picture where the assault took place. it happened on the path by the park. the suspect grabbed her on three occasions while she jogged. the suspect is hispanic, about 15-20 years old. call police if you recognize him. happening today, police officers will patrol a north bay high school campus of repeated

threats of violence were made adpa against that school. off sirs will be on campus. they found graffiti in the bathroom saying there would be a shooting on campus today. the threat is under investigation. classes will still be in session. last week, the school was evacuated after a bomb threat. happening today, loved ones will say a final farewell to a chp officer struck and killed on his way to work ten days ago. the 44-year-old was a 12-year veteran of the force who worked in the south bay. they say he struck a pick-up truck, turning into his path on monterey highway. the driver has not been charged. this afternoon service is at the morgan hills community center. no more weeknight con serce at levi stadium. that's the message from the 49ers until they hear about the

heat. by 9:00 a.m., 62 degrees. we start noticing an increase in the cloud cover. by 12:00, 67 degrees. today, san francisco expecting a high of 69. san francisco saw 80s earlier this week. they are going to feel the impact once the fog rolls in. san jose, 60 degrees right now. by 9:00 a.m., 10:00 a.m., we'll get the hazy sky look where it's still sunny, but still incorporating clouds. by 11:00 a.m., 72 degrees. today's temperature trend in san jose, 79 degrees. so, we are getting a break from the 80s for parts in the south bay. inland spots are getting a break from the 90s, which is, i think, the most welcome change in the forecast for today. mike, how are the roads? >> thank you. we dealt with the 90s in the fall. we are looking at the south bay, the peninsula no problems. the crash, a couple chp crews in

nice, cool, 53. today's highs, here is a look at what to expect. i was mentioning we could drop anywhere from 10-15 degrees? here it is. cupertino, 78. east san hoe, 81 degrees. even for the warmer spots, a noticeable difference. oakland, 70s. the one thing missing, 90s. i don't think anybody misses those. today, san francisco will be at 59 degrees, which is great. more fall-like temperatures. s santa rosa, 80. if you have plans to go to the beach, it's a little chilly. half-moon bay, if you are getting your weekend started, 51 degrees by 12:00. napa valley will have great weather. a combination of 70s and 80s. then this temperature trend sticks to the 70s into the weekend.

while you drive. it can automatically turn on once it connects to the bluetooth system. the use of public banks. >> they collect and store umbilical cord blood. a study looked at 19 public cord blood banks in the u.s. and found fewer people are coming in and the costs are going up. researchers say the banks value is over a billion dollars. the annual cost is $70 million annually. there are calls for the government to better support that program. getting the dtap vaccine can protect babies from whooping cough. they looked at three years of data from six states and found that third trimester vaccination was 80% effective in preventing whooping cough in babies.

>> fleet week will take over san francisco next week and security is expected to be beefed up across the city. >> "today in the bay," pete suratos is live in san francisco with the preparations under way. going to be a busy time out there, pete. >> reporter: yeah, good morning to you marcus and kris. yes, it's going to be very busy next week when fleet week takes off. i got a chance to talk to officials about the safety and security for next week. they are expecting millions of visitors to be here in the city of san francisco over that next week. now, as far as safety goes, they believe folks who get prepared this week. we want to get the message out there, boats should have a life jacket if they plan on being in the water on their vessels. if you are 13 or under, you must wear that life jacket the whole time. they want the topside weight on the vessel. the higher people are on that boat, the less stable the boat would be. also, this goes without saying, they want folks to watch their

speed causing a tremendous wake in the water, which can be dangerous for folks in the water. they say there will be plenty of active patrol units looking for intoxicated boaters. they will work on issues including potential for terror threats when you consider the large crowd for fleet week. >> we are always on guard. all law enforcement, the fire department and agencies are on guard. communication, really, that keeps that security threat always kind of in the back of our mind and making sure we are assessing and everybody is safe out there. >> reporter: we will see that added emphasis on security during those large, those big events happening next week. the parade of ships on friday, october 6th. the blue angels air show starts on friday and ends sunday. there's going to be three shows

over that period. they are going to have the rescue water craft and teams fully staffed. they are warning people to stay away from cliffs and trails when watching the events. the week kicks off next week, starting tuesday. we are live in san francisco, pete suratos for "today in the bay." >> thank you, pete. 5:34 right now. one day after a student was stabbed on campus, people at the high school in east san jose are returning to class this morning. we brought it as breaking news on "today in the bay" yesterday morning during the midday newscast. the stabbing happened near the gym where two teenagers were detained by school staff until officers arrest them. they did not suffer life-threatening injuries but it rattled a lot of students. >> kind of a scary experience, knowing someone got stabbed here. crazy. >> kind of scares me, you know? i'm still shaking about it. right now, i don't feel safe being here.

>> we are waiting for more details on exactly what happened from san jose police. we know one of the suspects did not attend school in that district. 5:35. a north bay nanny and former ymca worker was arrested for sharing nude photos with a 12-year-old boy in arkansas. they met playing video games on x box live. the 21-year-old was booked into jail yesterday. police say she was in possession of child pornography. the 12-year-old boy's mother discovered the photos on his smartphone. she thought the boy was 14, not 12. they shared pictures with each other on instagram and snap chat. they don't believe the two actually met or there are other victims. two parents are holding vigil alongside their 3-year-old son who was critically injured in a hit and run that led to an arrest. now, police say this red smart car struck the boy wednesday in

richmond at 27th and mcdonald. yesterday, authorities located the car and found out the owner wasn't in the car at the time. he was having his car serviced the day before in richmond. according to police, that's when a receptionist had taken the car for an unapproved drive. >> she is a receptionist for the shop. somehow, she was able to obtain the keys and drove the customer's car. >> the little boy's father says his son is now on a breathing machine. the receptionist faces felony charges. transportation leaders plan to change parking policies and reduce the residential parking permits. they are introducing the pilot plan, pay as you go system for visitors. residents would be eligible for permits but the maximum is cut

in half to two. >> under this policy, visitors can park if they pay. they would not have a time limit, but they have to pay to park there. residents, for them, nothing would change. >> the plan is to roll out the pilot program in two neighborhoods. the mta will debate the proposal next week. the federal government is moving forward to require states to track vehicle emissions. california and seven other states had to sue to get the e.p.a. to act. the rules require tracking emissions on highways looking at gas purchases and miles traveled. the feds are implementing the new rules, they could repeal them next year. 5:37. this morning, four bay area schools have something to smile about. they have received national recognition with a blue ribbon award. public and private schools are

aworded this. this year, the schools are george c. payne elementary in west san jose. sunset elementary in san francisco. albany middle and amador high school. 25 schools in california received that award. a warm traffic slow. a smooth flow of traffic. everybody gets an award. not a big deal, slowing. the construction picked up quickly heading out the altamont corridor. the travel times approaching the north bay, slowing for highway 37 across that bridge. toward the golden gate bridge, an easy drive where the view is clear. we take a live look with no fog. there you go. this is cooler. definitely looking for the weekend. >> i like it.

it will be nice with fleet week. that is always a concern. >> we have the coastal cloud that is are coming into play. we'll have to, you know, look for those. at least the temperatures will be nice. it won't be too cold, but it will be on the chillier side if you are headed anywhere near the coast. 69 degrees for the saturday forecast. in the bay, 74, inland, 81. in terms of the cloud cover, the best day for plenty of sunshine is going to be on sunday. that's because that nice marine on shore flow is going to stick around, then we see the clouds burning off. by sunday's forecast, bay and inland can expect to see a nice clearing of those clouds. a high of 76 for the bay, inland, 85. coast, 73 degrees. if you are heading out toward the beaches, it is going to be cloudy today and tomorrow. the temperatures will be in the 70s. i think this is actually normal for beach goers.

we are looking at the bay bridge toll plaza. the back up is at the toll plaza, but it's moving. a little lighter here for friday. we'll give you an update on what's going on with the fire in san jose. police are investigating a purse snatching that happened wednesday night. it happened outside a home on brian street south of oregon expressway. two men on bikes punched a woman in her 60s, took off on the bike with her purse. she suffered minor injuries. happening today, a possible probation and sentencing hearing for a man accused of killing a missing teen. it's on the docket, but we do not expect it to happen. the attorney is trying to remove the judge. the judge failed to disclose a potential conflict of interest. he investigated a lead

investigator in another suit. there's speculation this weekend could be o.j. simpson's last weekends behind bars. he will be removed from the prison near reno to another prison. here is what an official told the "today" show. >> they are not staying here, obviously. we try to get people to a location where they are going to fly or do something, besides being in nevada. we'll make it easier than that. >> 70-year-old simpson was granted parole for his involvement in an armed robbery in will halas vegas. simpson says he wants to live in florida after he is out of prison. >> 5:45. happening today, scheduled to appear in court for a bond hearing. attorneys for the 25-year-old reality winner plans to ask the judge to free her. winner had top secret clearance

and classified information in an nsa report and she leaked it in june. happening today on the peninsula, powerful women unite to support victims of military sexual assault. a congresswoman and ashley judd are heading it up. last year, more than 6,000 cases were reported, which is the highest number, ever. california's top pot regulator amiss anxiety. pot regulator says, quote, we all have anxiety. she says we don't know how many operators will come forward seeking those licenses. they are expected to be handed out in late november. you will remember, they passed proposition 64 legalizing recreational pot in november. folsom dam is a landmark.

faa is granting no-fly zone. hoover dam and statue of liberty made the list. the new restrictions take effect next thursday. scientists are calling it one of the largest migrational hitchhikes in modern times and it's involving hundreds of sea creatures. the 2011 tsunami in japan, sending a flood of species to the u.s. shores up and down the coast. scientists counted 289 fish and other creatures swept up in debris across the pacific. some of those species may push out native west coast sea life. the warriors will provide and assist today for an east bay young people hoping to become tomorrow's hoop stars. the warriors foundation is helping unveil two refurbished

the first victim came forward and the alleged incident happened while the victim was under the care of the probation department. she resigned in july. she had been working as a probation department counselor since 2009. construction crews are ramping up repairs at the oroville dam spillway in advance of the rain season. you may remember how it collapsed in february. >> we uncovered more safety issues that go beyond the spillway and the dam itself. stephen is here to tell us how it could impact the dam. >> we spent the last six months reviewing 20 years worth of inspection resports, memos, scientific papers and other records with safety concerns of oroville dam itself. the issues are a 15-foot long crack at gate 8. cracking rods or things that

maneuver the gates themselves and failure to monitor the amount and speed of water that flows through the dam naturally, known as the phreatic surface. if that water comes out at the wrong speed, it could wash out the dam entirely. the agency in charge of overseeing the dam insists these issues are not an immediate cause of concern. is the rest of the dam safe? >> yes. i think from today's assessment, inspections, we have had, you know, structural engineers looking at those cracks. today, yes. obviously, we need to keep monitoring. we need to improve our maintenance prom. >> we spoke with several state engineers who tell us dwr is not doing enough to address these problems. the insiders told us, if nothing is done, disaster could be imminent. when i show you that, what does
