the napa valley bridge. the toll plaza, of course, has the metering lights on. you can see the visible movement. the craash lane is not as bad a we often see. back to you. >> thank you. we are following a developing story out of the south bay where a search is on for the gunman after a deadly shooting inside a north san jose apartment. it happened in the north park neighborhood at an apartment complex on elan village lane. that is not too far from montague expressway. >> that's where we find "today in the bay's" bob redell to bring us up to speed on the investigation. good morning, bob. >> reporter: good morning to you marcus and kris. the san jose crime scene unit is still here at the elan apartments. this is a large, luxury apartment complex in san jose. we spoke to a police department with san jose pd within the last half hour to tell what led up to

this murder. this happened around 8:40 last night. two men burst into a unit upstairs in this complex, forced their way into the unit. the two men who burst in, one shot one of the men inside the unit. they left the other man unharmed, according to police. it's not clear whether they stole anything, then they left. when the officers arrived, they found one man suffering from a gunshot wound. he was taken to the hospital where he was later pronounced dead. i spoke with a man who lives in the unit next door. he did not hear anything leading up to the gunshot. when he heard it, he thought it sounded like a cap gun. he didn't think much about it and didn't call 911. he is aware of what happened. he did not hear anything leading up to that, though he was getting ready to go to bed. police are trying to identify the suspect. again, they are not clear what the motive was into this murder of a man inside the elan

apartment complex here in northerly san jose. bob redell, "today in the bay." new this morning, firefighters are investigating a late night fire that destroyed a home on the peninsula. it happened near alameda in redwood city. firefighters say the home was fully engulfed by the time they arrived. no one was there at the time. it took crews an hour to get it under control. developing this morning, the second big rock slide in as many days at yosemite. visitors who witnessed both of them said the second was bigger than the first. >> they scrambled to safety when it happened yesterday afternoon. the dust cloud resembled a war zone. a man was taken to the hospital after rocks took his car off the road. >> it got pitch black. we thought, this is it. something is going to hit us.

>> it seemed like it happened. the trees were white, everything. the whole thing was white. it was like we had a new snowfall. >> the first slide, wednesday, falling rock killed a man and seriously injured his climbing partner. rock slides happen 80 times a year and resulted in 17 deaths in the park's history. our coverage continues online at www.nbcbayarea.com. you can see photos and videos illustrating the power of the slides. we are in yosemite and will bring live reports in yosemite today. loved ones and comrades will say good-bye to this chp officer struck and killed on his way to work. he was a 12-year veteran of the force, who worked in the south bay. ten days ago, investigators say he struck a pick-up truck turning into his path on monterey highway.

that driver has not been charged. this afternoon service is at the morgan hill community center. police officers will patrol a north bay campus after threats were made at the school. students reported finding graffiti in the bathroom saying there will be a shooting today. the threat is under investigation and classes will be in session. last week, the school was evacuated after a bomb threat. this morning, a u.s. navy hospital ship is headed to puerto rico to help the millions of people who desperately need food and water a week after hurricane maria hit the island. >> the trump administration has come under fire for not acting quickly enough. tracie potts is live in washington this morning, where the government is explaining how it is dealing with the growing humanitarian crisis. good morning. >> reporter: hi, marcus and kris. good morning, everyone. we have heard from members of

the trump administration. the president, himself, may speak out in a couple hours. he's speaking to manufacturers this morning. the first high level official, the director of homeland security is headed to puerto rico today. this morning, the u.s. navy ship, "comfort" is on the way to puerto rico where a three-star general is in charge. >> we are using air support. we are cleaning the roads regularly. we have expanded greatly. probably over 90% of the island is accessible. >> reporter: 10,000 federal employees, most military, are on the ground. president trump has lifted a decades old law to allow supplies from offshore on foreign ships to be distributed. >> we don't have water. >> reporter: it's been over a week since hurricane maria hit. texas and florida got help almost immediately. why is it taking so long here.

>> we need americans to unite instead of pointing fingers. >> reporter: half the island has no clean drinking water. lawmakers are planning for an effort. >> the resources are there, but we clearly believe and understand those resources will eventually be tapped. >> we have to move as quickly as posz zable. >> reporter: time is critical. fuel is scarce. flood could damage hospitals. power out for months in some areas. 3.5 million americans waiting for washington to come to their rescue. i want to take a second to explain what's going on with the jones act, that law the president lifted temporarily, so the ships could come in, foreign ships can come in with goods. american shipping companies, not so happy about that. there was pressure there and the white house waited for some time because american shipping companies want that law to stay in place, it prevents competition for them. here on capitol hill, lawmakers

online ticket seller to buy last minute theater tickets. last spring in new york city, she spent $446. then a schedule conflict popped up. she asked if she could exchange her tickets for an earlier performance. they said no, but she could buy new tickets and the representative could help her with a refund or credit. she went ahead and bought the new ticket. but, when she went ahead and asked about the refund, she was told, nope, we don't do that. julie felt she was caught in the middle of miscommunication between the theater and the ticket. she reached to us for help. we contacted today tix and they issued a $446 credit for future use. however, it didn't have to. the theater gave julie wrong information. they are not affiliated the

sure everyone stays safe. good morning, pete. >> reporter: yeah, good morning to you marcus and kris. fleet week kicks off next week. we spoke to officials about the security measures they are going to have in place when they are expecting millions of people to be in san francisco to celebrate fleet week. as far as security measures go, the police said they are going to have active patrol units in the water and on land as things unfold. they want to watch out for intoxicated boaters during fleet week. they are going to watch the speed of those boaters, especially after the air show when boats are going back and forth in the water, which causes a tremendous wake in the water, making it dangerous for folks. the rescue team is going to be fully staffed for the week, keeping an eye on conditions. the coast guard made it clear they won't ill be working close

stabbed on campus. students in san jose will return to class. we brought this as breaking news at 11:00 yesterday morning. the stabbing happened near the gym. two we are detained by school staff until officers could arrest them. the victim did not suffer life-threatening injuries, but the ordeal as students feeling rattled. >> it's kind of scary, knowing that someone got stabbed here. crazy. >> kind of scares me, you know? i'm still shaking about it. right now, i kind of don't feel safe being here. >> we are waiting for details about exactly what happened from san jose police. we know one of the suspects did not attend school in that district. 6:35, happening today, a possible probation and sentencing hearing for torres, the man accused of killing sierra lamar. it's on the docket, but we don't

think it will happen today. they are trying to remove the judge from the case. the judge failed to disclose a conflict of interest. the judge investigated a lead representation on this suit. a north bay nanny and ymca worker was arrested for sharing nude pictures with a 12-year-old boy in arkansas. they met playing video games on x-box live. she was booked into jail yesterday. police say she was in possession of child pornography. the 12-year-old boy's mother discovered the pictures on her son's smartphone. her defense, she told the police, she thought the boy was 14, not 12. they shared pictures on instagram and snap chat. police don't believe the two ever met in person, nor that there are other victims. 6:36. two parents are holding a vigil.

this red smart car struck a boy at 27th and mcdonald. yesterday, authorities located the car and learned the owner had his car serviced the day before in richmond. according to police, a receptionist took the car for an unapproved drive. >> she is a receptionist for the autoshop and somehow she was able to obtain the keys and drove the customer's car. >> the father says the son is now on a breathing machine. the 19-year-old receptionist faces felony hit and run charges. details from san francisco transportation leaders about a plan to change parking policies that could reduce the number of residential parking permits. the mta is debating a pilot program to introduce a meter-like pay as you go system for visitors.

residents would be eligible for permits, but the maximum number of permits per household would be two instead of four. >> under this policy, visitors could park, if they pay. they would not have a time limit, but they would have to pay to park there. residents, nothing would change. >> the plan is roll out a pilot program to see how it works in two neighborhoods. mta will debate this proposal next week. the federal government is requiring states to track vehicle emissions. after months of delaying the process. california and seven other states add to sue to get the epa to act. they will look at gas purchase and miles traveled. even though the feds are implementing the rules, they could repeal them next year. this morning, four bay area schools have a lot to brag about and smile about as they received

national recognition with the prestigious blue ribbon award. each year, hundreds of public and private schools are awarded it. this year, george c. payne elementary in west san jose, sunset elementary in san francisco, albany middle school in albany and the high school in pleasanton. a total of 25 schools in california received that award. it is october. we can start to feel the spookiness start to creep in. i keep waiting for people to scare me around the corner. we are very close to halloween. >> everyone is getting in the spirit. tonight, san jose winchester mystery house kicks off the 20th night of fright. you can take a tour of the mansion by candlelight. the mansion began construction in 1884. it is world famous in the paranormal activities.

6:45 now. we are live in north san jose this morning where police are searching for a gunman after a deadly shooting at a luxury apartment complex. it happened last night at the elan apartments near montague expressway. the victim is a man found inside an apartment. a lot of unanswered questions right now. investigators are trying to find out who the suspect is and whether that victim was targeted, specifically. 6:46. there are speculations this weekend could be o.j. simpson's last weekend behind bars. he will be transferred to another prison first. >> they haven't going to be staying here, obviously. we try to get people to a location, if they are going fly or do something, besides manager in nevada, we'll make it easier than that. >> simpson was granted parole earlier this year from his involvement in an armed robbery

in las vegas. he spent nine years behind bars. this is, of course, after simpson was acquitted of murdering nicole brown simpson. simpson says he wants to live in florida after he's out of prison. happening today, a contractor accused of leaking secure agency material over the summer is scheduled to appear in court for a bond hearing. attorneys for 25-year-old reality winner plans to ask the judge to free her from jail pending trial. winner had top secret clearance and sent a classified nsa report to a news organization in june. happening today, powerful women unite for victims of sexual assault. jackie spear and actress ashley judd are leading the event in hillsborough. we look at the numbers overnight. reports of sexual assault in the military doubled since 2012.

coastline. let's talk about the 24-hour temperature change. the cooling trend started since last night. that means significant decrease isn't going to roll in until this afternoon. looking at today's high, morgan hill, 85 degrees. east san jose, 81. for the east bay, 83 degrees for danville, 82 for walnut creek. along the peninsula, peninsula-like temperatures. i say that because you don't typically need ac. san francisco 70 degrees. north bay, sonoma at 79. let's talk act the next seven days they are going to be good. 70 degrees for saturday, 71 for sunday. monday, the nice 60s trend continues. it sticks around. on wednesday, we are tracking a disturbance off to the north. that could bring a chance for pop-up showers. a sunny weekend with a little cloud cover to look forward too. >> all i heard was weekend.

we are seeing lighter traffic because it's friday. there's a build for the south bay. i want to zoom in to a couple key spots. 880 south from san mateo to dumbarton bridge picks up considerably. we had a crash that cleared toward union city. there's recovery here south of the downtown to the coliseum. both directions are recovering from looky lou traffic. the back up at the toll plaza, i want to show you that back up on the live camera. traffic is marching. you can see that movement. that's good news. let's go to the waze system. the south bay with the speed sensors calling on areas below 30 miles per hour. 101 or 280, through downtown. we are look agent the travel time through the area. they are standard from 101 and 85 toward santa clara.

here are the top stories on today in the bay-- new this morning-- firefighters are investigating a welcome back. before you head out the door, here are the top stories on "today in the bay." a late night fire destroyed a home on the peninsula. firefighters say the home was fully engulfed by the time they arrived. no one was there at the time of the fire. it took crews an hour to get it under control. >> one person injured after a large rock slide. visitors who witnessed both say the second one was a lot bigger

than the first. the latest slide sent visitors scrambling for safety. the dust cloud left some areas briefly resembling a war zone. one visitor had to be air lifted after rocks slid his car off the road. wednesday, falling rock killed a man and seriously injured his climbing partner. >> the tragedy continues today on the "today" show. >> we have live coverage from the scene at 7:00 here, after "today in the bay." >> today, loved ones will say their final farewell to a chp officer struck and killed on the way to work ten days ago. he was a 12-year veteran who worked in the south bay. investigators say he struck a pick-up truck turning into the path on monterey highway. the driver has not been charged.

this afternoon service is at morgan hills community center. a north bay high school campus after repeated threats o of violence were made to the school. officers will be on campus all day at redwood high school. they found graffiti saying there would be a shooting today. classes will be in session. last week, the school was evacuated after a bomb threat. no night concerts at levi station, at least for now. that's the message from the 49ers until they hear more about the noise curfew issue. right now, concerts are not supposed to go past 10:00 p.m. a few have in the past. nearby neighboring neighborhoods are complaining about the noise. 49ers say scheduling the concerts will cost the city $800,000 a year. taking a live look at the
