the south bay, a nice 53 degrees, 57 degrees for the peninsula, tri-valley, and a chilly 50 degrees and we are seeing some clear skies, nice clear skies, north bay 42, east bay 50, but don't be surprised if you start seeing a couple of high clouds in the forecast. but have no fear, those should clear out quite nicely and make for an overall sunny saturday across the bay area. by about 12:00, we will climb into those mid 70s and we are expected to hit 80s in san jose and most inland spots, but we do have a couple of factors that will come into play for today and into sunday. we do have a beach hazard in place for the coastlines if you have plans to head to the beach. you may want to tune in, in about 15 minutes. also, fire warnings because we are expecting some winds to pick up. i'll let you know when the strongest winds are expected and who's going to see the cooler temperatures heading into

tonight. >> vianey, we will see you then. thanks. we want to start off this morning with a developing story in the east bay. a family of four is still reeling after someone started shooting at them on the freeway. the family's car was hit around 7:40 last night. they were driving on highway 24 near 580 in oakland. the chp is searching for the gunman, who was riding in a gray sedan. investigators say the gunman fired at least one shot after pulling up alongside the family's car. thankfully, no one inside was hurt. they pulled off the freeway to get help at a gas station in downtown oakland. if you have any information about the shooting, give chp a call. now to the las vegas shooting rampage and a bittersweet farewell. last night, hundreds gathered at san jose city hall to honor michelle vo. friends and family remembered her as a vibrant and loving daughter, sister, and friend. she was the youngest of four kids, liked golf, traveling, and making new friends. michelle grew up in the south bay, attended independence high in san jose, where she was

student body president. last night, more than 200 people turned out to remember her. >> one of the things that came to my mind was she was so young, she didn't get a chance to do anything. but looking at this outpouring of support from all over the world and from everyone showing their love for her, i'm so proud of her. >> family says they're working with the coroner in las vegas to bring her body back to the bay area. the funeral will likely be held next week. well, grief in san jose and new developments in las vegas. investigators are now reaching out to the public for help. as many survivors are leaving the hospital, our own raj mathai has the latest. >> reporter: home and healing, 26-year-old samantha is out of the hospital after being shot four times during sunday's massacre. >> i'm just grateful that i didn't have to completely say good-bye to all the people that i love. >> reporter: more than 300 of the injured people have been treated and released.

however, more than 20 people remain in critical condition. investigators say their search for the gunman's motive has so far come up short. there's now a billboard campaign asking anyone with valid information to contact the officials. >> we do not still have a clear motive or reason why. >> reporter: they also believe there was no other shooter, despite some online speculation otherwise. and they've matched all cell chargers with the multiple cell phones that stephen paddock had with him. answers to questions that had earlier puzzled officials. >> we're very confident that he did not -- there was not another shooter in that room. what i cannot confirm to you today and what we continue to investigate is whether anybody else may have known about this incident before he carried it out. >> reporter: there are new revelations about paddock and his past. irs records reveal he was a very successful gambler, earning at least $5 million in 2015. those who knew him describing him as a temperamental gambler

who once worked for the irs as a tax agent. high above the strip, you can see the workers replacing those blownout windows of his suite on the 32nd floor. while in the shadows of the hotel, 58 lives recognized by people, bringing flowers, candles, and prayers. >> i felt like it was something i needed to do. pay respect for those that were lost in this insanity. >> reporter: raj mathai, nbc bay area news. and people continue to gather at a very visual tribute right in the shadows of the mandalay bay. 58 white crosses representing each of the victims. that includes michelle vo and novato's stacee etchberg. vice president pence will be in las vegas today to honor the victims of the massacre. organizers plan to release a flock of doves after his speech in honor of all 58 victims

killed in the shooting. yesterday, vice president pence visited puerto rico, flying over st. coix. he spoke with first responders and survivors there and promised more support from the white house. another storm is swirling in the gulf. nate is now a hurricane and it could hit florida, alabama, and louisiana. evacuation orders are already in effect in parts of new orleans. nate also devastated communities in central america, killing at least 25 people. this is a look right now at severe flooding in nicaragua. and b.a.r.t. is in the hot seat. a judge has found b.a.r.t. guilty of, quote, serious safety lapses following the deaths of two workers in 2013. now we first showed you this b.a.r.t. surveillance video earlier this year, obtained exclusively by our investigative unit. it shows a trainee alone in the cab while his trainer chats an his cell phone in the car behind. the trainer is clearly frustrated when the trainee asks for help.

[ bleep ]. >> that b.a.r.t. train ended up hitting and killing two workers on the tracks ahead. the utilities commission judge yesterday fined b.a.r.t. $659,000. the judgment cites a serious lack of safety culture among b.a.r.t. managers. b.a.r.t. has maintained this was an isolated lapse. scary moments for a construction worker yesterday in castro valley. the worker fell about 15 feet into a creek along crow canyon place. rescue crews were able to pull him to safety. he was transported to a local hospital with an injury to his leg but he is expected to be okay. a tribute to a survivor at the site of a sexual assault on stanford's campus. two benches and a fountain have replaced the dumpster where brock turner assaulted a woman in 2015. soon, it will house a plaque inscribed with the victim's own words. a law professor at stanford proposed the project to the

cyber space. >> reporter: speaking at a global digital policy institute event at stanford, former presidential candidate hillary clinton says the united states is in a cyber war with russia. she says russia flooded social media with misinformation during the presidential campaign, influencing the election. >> we learned just this week that some of the facebook ads specifically targeted michigan and wisconsin. two of the states that decided the election by razor thin margins, which suggests that the russian strategy was even more sophisticated than we knew. >> reporter: the election is over, but clinton says the war is not. she says russia continues to use social media to spread fake news. >> thousands of social media accounts with suspected ties to russia are posting, in some cases, on both sides of all these issues to fan the flames of division and to weaken us as

welcome back, everyone. taking a live look at the financial district there in san francisco. sort of a chilly start already, but warmer temperatures on the way. we have new details now about a data breach involving some local whole foods markets. eight bay area stores are involved. people who used in-store restaurants and tap rooms may have had their credit card information exposed. that main checkout registers were not affected. now, stores in cupertino, dublin, mill valley, san jose, santa clara, and walnut creek were all hit. two stores in san francisco were also affected. well, tesla is moving full speed ahead with big plans in the bay area and the city of fremont, it's along for the ride. the company is expanding. take a look. you can see the two properties on dumbarton circle. now, the move could bring up to

1,000 new jobs to the area, but could that also mean 1,000 more cars in an already congested community? "today in the bay" has more on the plan. >> reporter: new tesla jobs coming to this site in fremont is big news for locals but it may come at a price for commuters. >> bringing 1,000 new jobs, we embrace that, no problem. but the downside to that is the traffic. >> reporter: which some fremont residents hope is being considered as part of this new project. >> we understand the regional nature of the problem, but the solutions are going to be found locally. >> reporter: john is with the metropolitan transportation commission. he says if the city is looking ahead a few years right now, they could do a lot to smooth out future traffic concerns. those include signal light synchronization, improved road conditions. there's already plans to convert parts of highway 84 into express lanes. >> if there are 1,000 new employees coming to a location,

there are probably something like 1,000 different trip calculations that are made every day. >> reporter: in fact, in an e-mail to nbc bay area news, fremont boasts about the new location, saying, quote, it's a reverse commute from the peninsula. but for now, good win says it's wait and see. >> once you've got 1,000 people coming to work every day, depending on what time they're arriving, and what the flow back and forth is during the day, i think those challenges remain undefined. >> reporter: nbc bay area news. an asbestos warning from b.a.r.t. crews are preparing to install new ceiling panels at the san francisco powell street station next week but that means they have to remove asbestos from the building. b.a.r.t. is taking time to tell riders about the changes. >> it's happening so if i'm unaware of all this and walking through some places, i think people should know. >> b.a.r.t. removed asbestos

from eight other stations over the summer without any problems. crews will put up a protective enclosure during the renovations. hard hats and golden shovels were the accessories of choice in oakland. it was all part of a ceremonial groundbreaking to welcome in more housing. at at a time when the city says it's suffering from a serious shortage. the new development is called coliseum connections, fitting since it's across the street from the coliseum b.a.r.t. station and near other transit links. the 110 mixed income units, half will be affordable housing. >> the 55 affordable units will be -- people will qualify through a lottery based on their incomes being between 50% and 60% of area median income. the other 55 units will be market rate. >> supporters hope the development spurs even more construction to address oakland's housing crisis. and vianey arana is back with us for another check of the forecast. >> yeah. we've got a couple of things going on. but the overall picture, it's going to be sunny, which is great. so don't worry, even though i

know we're talking about fire danger and beach hazards. at least you have a nice clear day to start and will hopefully keep that around at least through the remainder of your weekend. but let's talk about your temperatures as you're heading outside, maybe you have an early morning jog. you're going out to get your coffee. 57 degrees right now in the peninsula, south bay, a nice clear 53 and in the tri-valley, still a chilly 50 degrees. the peninsula, oh no, where did my camera go? well, it was san francisco but it's at 53 degrees right now. and we are in the 40s in some areas so yes, it is on the cooler side, the colder side in some areas but look at san jose. even though we're at about 53 degrees right now, by about 11:00 a.m., the temperatures will climb into the lower 70s. if you notice in the icons, not a cloud in sight. don't be surprised if along the coast, we do pick up a couple of high clouds by about 1:00, 78 degrees, and then by 2:00, we'll be climbing into the 80s. now, more or less, we will see temperatures in the 80s for san jose, expect the climb into the mid 80s, san francisco, 55

degrees, 69 degrees by 1:00 and then by 2:00, expect those temperatures to jump into the 70s. so it is going to be on the warmer side, which means, yes, a lot of you folks might be heading to the beach, but i want to give you something to keep in mind if you're heading out there today and tomorrow. we do currently have hazardous rip currents, which means there could be the potential for some dangerous surf and also sneaker waves, so if you're walking along the water, never turn your back towards any wave and if you get caught in a rip current, remember to serve parallel, never against it. this is in place for the entire bay area coastline and this will stick around through the weekend, so if you had plans to head to the beach, i know the temperatures are definitely calling for it, just be safe out there in the water. let's talk about today's forecast. our temperatures will journey into the 80s and 70s but a big change heading into tonight and tomorrow, those dry winds. i know we're in october, but we're not in the clear of fire weather danger just yet. as those winds pick up and we

get that low humidity coming in through tonight and into tomorrow, we do have a red flag warning with the highest risk coming into play at about 11:00 a.m. tomorrow and this is going to stick around at least through tuesday. mainly for the north bay mountains, east bay hills, and the santa cruz mountains, so definitely outdoor burning is not recommended so if you have any plans to barbecue or be outside, maybe plans to cook up for a birthday party, try not to burn anything near dry brush. let's take a look at those winds. today, great day to be outside, nice and breezy, but as we head into the overnight hours into 10:00, 11:00, and 12:00, you'll really start to see those winds picking up. 20-plus miles per hour. napa, 29-plus miles per hour and we're talking about gusts 45, possibly plus miles per hour as we head into tonight, and into tomorrow. fast forward through sunday and we keep the 20-plus mile winds in the forecast. but check out sunday at about 10:00, 29 miles per hour in san

francisco, orinda, 34 miles per hour, and that's when we really see that threat of the fire danger. now, over the next seven days, we do have a couple of changes on the way. we kept a little bit of the warming temperatures through today and we'll keep that in through tomorrow but if you notice, just kind of looking ahead through tuesday and wednesday for san francisco, and also for inland spots, we go from 80s, breezy to windy as we head into saturday and sunday, and then as we head into fu tuesday, we start dropping to much more comfortable temperatures into the 80s and into a bit of a cooling trend. we've got to get through these warmer temperatures this weekend. >> i like those numbers. vianey, thanks. still ahead on "today in the bay," features in the car supposed to make driving safer. but not so fast. a new report says drivers are more distracted than ever.

a woman in the crosswalk and this one nearly runs a stop sign while using a touch screen. aaa and the university of utah study 120 drivers trying to use the technology in 2017 models. of the 30 vehicles tested, 23 demanded high or very high driver attention to use the interface. some drivers were distracted for a full 40 seconds. on a closed maryland parking lot, i tried changing the radio station in a new car with lead researcher david strayer. how do you change screens here to even get from a.m. to fm? watch how long my eyes are off the road. i then tried a voice command for a phone call. dial. >> let's try again. say dial. >> reporter: just changing the temperature can require a touch screen. i'm spending soechl time trying to figure out how to make a phone call or change the radio, i'm not even looking at the car ahead of me. >> these in-car systems are really distracting.

they're much more distracting than talking on a cell phone. >> reporter: in a statement, the automotive industry takes issue with the aaa study saying, researchers continue to make no attempt to tie their results to actual crash risks or actually simulate how drivers actually use these systems in the real world. but the aaa researchers disagree. >> by building these systems into cars, consumers assume they are safe to use and this research shows clearly that is not necessarily the case. >> that was tom costello reporting. some automakers require the vehicle to be stopped in order to type in those commands but aaa says 40% of cars tested allows drivers to type in those commands while the car is moving. the automakers emphasize that technology is meant to help drivers keep their eyes on the road. the question is whether all of this becomes too tempts and too much for the typical driver. coming up, trying out a new tactic, santa clara hires a pr

current temperatures. 53 degrees in the south bay right now, peninsula, 57, the tri-valley is at 50 degrees, and it's still on the chilly side of the north bay at 42 so we definitely have been seeing a cooler start in a colder start in some areas to our temperatures, but look at what you can expect for today. overall, 80s in the south bay, inland spots will be in the upper 80s, so concord and antioch still at about 88, 89, and that's because we have a ridge of high pressure sitting over the area. we are expecting a couple of changes. another thing to keep in mind, if you're heading to any of the beaches today, we are looking out for some dangerous surf, danger water, and that's because of the possibility of some sneaker waves and tall waves will come into play. we do have a dangerous surf warning in place right now and we have some winds that are expected to kick up as we head into saturday, but for today, 70s and 80s, with a cool coastline. i'll talk about how long these winds will be sticking around and of course some changes we can expect heading into sunday as well.

warning. nate is expected to hit the gulf coast late tonight. we now know the name of the woman who fell to her death in san francisco. 36-year-old from tracy. she fell off a cliff around 5:00 thursday night. those cliffs are dangerous. city officials warn, stay on the trails. and a new twist in the feud between santa clara and the 49ers. the city had hired a pr firm. public affairs is a washington d.c. based firm that specialized in government and crisis relations. the 49ers and santa clara have butted heads on a number of issues since the team moved from san francisco. including disputes over rent, parking, financial audits, and a week night concert curfew. the price tag? $50,000, tax dollars, that is. what the city is hoping to get in exchange isn't clear. and still ahead on "today in the bay," raider fans could be waking up to some good news on

the 40s like palo alto, so it is on the chillier side, but we are expected to warm up and the reason for that is because we still have a bit of some high pressure sitting over the bay area, although we are just a few degrees cooler than we were yesterday, we're still above seasonal in terms of the temperatures. we will climb into the 80s for san jose, 83 degrees is expected, milpitas 84. as we head to the east bay, an increased chance of a fire danger. for today, though, expect just breezy conditions, light winds, and then the winds will pick up along the coast as we head into the afternoon. now, peninsula temperatures will be in the upper 60s, 69 degrees for daly city and we are talking about those beaches because we're talking about sneaker waves and strong rip currents, and so if you have plans to head to the beach, definitely something you're going to want to keep in mind. san francisco will climb into the upper 60s for outer sunset and of course in the mission

area, we're talking about mid 70s, 74, 75 degrees, if you're heading out to the north bay today or you're going to be in the north bay, novato, 84 degrees, mill valley, 82, sonoma, 86, so notice even though we're in october, those temperatures are remain above normal. let's talk about fleet week and what you can expect. look at this. perfect conditions. we're talking about sunshine all across the board. we are seeing a little bit of some patchy, dense fog along the golden gate bridge, but for the most part, 70s in the forecast, and we are keeping the 70s through the afternoon, but if you're headed to the beaches, here's a live look right now using our weather underground camera. it is going to be a great beach day when we talk about the clear skies and the temperatures but of course we've got hazardous rip currents and a very strong swell at about 6 to 7 feet so not going to be a good day to go swimming in the water, but i think you can probably hang out alongside the water. just be safe and look out for that. all along the coastline, all throughout the afternoon, and

into sunday morning, we're expecting to keep a close eye and a close watch out for those sneaker waves. never turn your back to a wave, so if you're heading to santa cruz, here's a look at what you can expect for your temperatures. 73 degrees by 1:00, by 2:00, we're talking about 76 degrees, and then the temperatures will start to change just a bit, but the reason they're changing is because we're going to start picking up in terms of the dry north, northeasterly winds and that's why a red flag warning is in place and the biggest potential fire risk is going to come into play tomorrow at about 11:00 a.m. the reason for that being is the winds start kicking up tonight and into sunday. let's take a look at the future cast when it comes to those winds. if you notice, sunday, by about 12:30, we see light winds but if you fast forward through the afternoon, you see those switching off. by 10:00 p.m. tomorrow, we see gusts up to 43-plus miles per hour, for napa, sustained winds in san francisco, orinda, 34,

chase. make more of what's yours. . welcome back, everyone. they're taking a live look at 580 there in emeryville. traffic building up but moving along. a visit to the spa turned traumatic for a woman who claims her massage therapist crossed the line. physically and sexually abusing her. she turned to the investigative unit for help after filing a complaint with the state and getting nowhere. senior investigative reporter vicki nguyen looked into the case. >> the woman speaking out worries she wasn't the only victim and as we learned, some massage therapists with a history of complaints and even arrests stay off the radar. >> the massage started off with him being so rough. >> reporter: soo young kim says she froze at first. >> it was like a crazy naightmae and i remember thinking the words, i'm getting a brutal

beating. >> reporter: then it got worse. >> he was running his crotch on the top of my head and i'm scooting down to avoid is this. >> reporter: what's going through your mind. >> i'm just fearful and thinking, how am i going to get out of the situation. >> reporter: kim says she left the room hysterical. she filed a complaint with police but officers closed the case. frustrated, kim sued the massage therapist, joseph sanchez, and the spa. subpoenaed records show he was fired from two previous jobs after too many complaints. kim also found these photos of partially nude clients on his social media with the caption, the most extreme therapist in the country. >> the pictures, you know, of his private clients, you know, were sometimes really explicit and really graphic. >> reporter: aaron funnel worked with sanchez for several months. >> i had never had any interactions like this. >> reporter: sanchez was never arrested and had no history of complaints alleging sexual abuse.

sanchez didn't respond to our requests for comment. >> reporter: kim sent her photos to the police. the mtc oversees the state's massage therapists. what is the burden of proof that you need in order to take action against a massage therapist? >> one of the reasons why the california massage therapy is being so effective in protecting the public is not being a governmental agency. the burden of proof that we are looking for is preponderance of the evidence, which means more likely than not. >> reporter: he says his agency can close a case within days, but nearly two years after kim's complaint, her therapist remains certified. council data shows a rise in sexual assault complaints since 2010. but the council keeps details about those complaints hidden from the public. >> it's striking a balance between protection of the public and also making sure that the integrity and the reputation of honest, hardworking certificate holder is being maintained.

>> reporter: the council doesn't report arrests either. do you think it's fair for the public to know if a massage therapists has been arrested? >> it is very important for the consumer. the consumer has the right to know if a massage provider is currently certified. >> reporter: so we searched court and arrest records. we found several massage therapists arrested for sex crimes whose certificates are still active. that can happen? >> it can happen. it can happen. absolutely. >> the sheriff's office has -- takes a zero tolerance approach. >> reporter: a detective with the san mateo county sheriff's office, unlike the mtc, san mateo county publicizes all massage therapists who have been arrested. >> we've had incidents where we post information to social media where other victims -- where the posting has motivated them to come forward. >> reporter: do you think there should be more transparency at the massage therapy council to post as your department does? >> i don't know what criteria
