so-called d.r.e.a.m.ers. the trump administration unveils new hard line guidelines. first, football and politics. vice president mike pence walks out on the 49ers to protest the protesters, but some are saying the whole thing was a setup. good evening, thanks for joining us on this special edition of nbc bay area. san jose on the police of a homicide in south san jose around 7:00 at the 200 block of tradewinds drive near oak grove high school. police found a male victim shot at least once, taken to the hospital, there he was pronounced dead. the circumstances surrounding the shooting are not clear. we have a crew on the scene gathering information and we'll have an update at our 11:00 news. the 49ers find themselves in the middle of a political controversy. the vice president's decision to leave the gale in indianapolis is causing quite a stir on social media and some are saying

the president orchestrated it as part of a political stunt. thom jensen is in san francisco. >> reporter: during a game in his home state between the 49ers and the indianapolis colts -- ♪ by the dawn's early light >> reporter: vice president pence walked out after several niners knelt during the national anthem. part of an ongoing civil rights protest by players criticized by some as disrespecting the flag. while his motorcade headed toward the airport, vice president pence tweeted. the president then tweets, i asked vice president pence to leave the stadium if any players kneeled, saying he was proud of him. 49ers' safety eric reid say what pence did was a political and oppressive stunt. >> obviously, we had the most

players protesting and knew we would do it again. >> reporter: some telling nbc bay area they agree with reid, including one marine. >> it's their constitutional right. that's what we fight for. it's part of the constitution, so they're entitled to do what they choose. >> it's about how they feel and who are we to judge that? >> reporter: others told me they agree with the vp. kneeling during the anthem disrespecting the flag. >> i support my vice president. >> reporter: is it the flag you fight for or the freedom? >> both. they both respect the same thing. >> it's about us being united, together as one. i think we need to show respect for that flag. there's people that served, that died. >> reporter: people asking, why the vice president flew from las vegas to indianapolis for that game when he had to know that the 49ers were going to kneel and then fly onto los angeles where he is tonight. of course, the administration already under fire for travel

expenses, the health and human services secretary resigning after exposed he spent more than $1 million in taxpayer's money for private and military plane travel and the treasury secretary also under scrutiny for more than $800,000 in military aircraft travel. we're live in san francisco, thom jensen, nbc bay area news. as discussions continue on a potential deal to reform the daca immigration program, president trump released immigration principles that must be included in any deal. experts say it could derail a potential agreement. the president's legislative proposal includes funding a wall along the boarder with mexico, a crackdown on central american children coming into this country, limits on federal grants to sanctuary cities and also seeks to curb legal immigration. all of that will get the president's support of daca. the demands are being criticized by democratic leaders who were working on a deal with president trump to keep the daca, or

d.r.e.a.m.ers, program. they say the list goes far beyond a reasonable compromise, leaving the fate of d.r.e.a.m.ers very uncertain tonight. firefighters will work through the night to monitor a fire near nap that airport that started around 2:30 at a salvage yard near american canyon packed with dozens of vehicles. strong winds quickly helped that fire grow to 20 acres and the smoke, as you can see, could be seen for miles. firefighters have a handle on that fire now but are monitoring for hot spots. investigators a a car that went off the road and crashed is believed what caused that fire. a fire remains under red flag warning. winds leading to fire danger. that's why they're staying on that fire up in napa. here's more on the local situation. a lot of red behind you. >> the highlighted areas are an immediate fire threat. the biggest concern is going to develop within the next couple of hours because that's when we're expected to see an increase in those winds, especially for the north bay

mountains and east bay hills. just kind of fast forwarding ahead, believe it or not, we had relative humidity at 4% in the north bay, which is probably what did not help in kicking up that fire in that brush fire. over the next couple of hours, we will start seeing the wind speeds increase. right now it's not too bad. fairly calm for the majority of the bay area. current wind speeds out of napa at 8 miles an hour. the rest of the bay area light and breezy at 5-plus. santa rosa at 18 miles an hour. the highlighted areas under a wind advisory. the majority of these advisories are expected to remain in place through monday and tuesday morning. fast forwarding into the overnight hours, this is where the highest threat and the biggest concern is going to come in. at about 12:30, 1:30 a.m., look at the wind speeds and wind gusts. napa up to 40 miles an hour. san francisco, offshore winds along the coast, 34 miles an hour. redwood city, 29 miles an hour. as we continue to progress over the next few hours is when we'll

see those temperatures, of course, will remain on the cooler end but the winds are what's going to keep us on high alert especially when it comes to any potential hot spots. be sure to tie down any patio furniture or anything that might fly away, that could also, of course, be a dangerous situation if it goes into the roads. we'll keep a close eye on the red flag warning and the fire danger. i'll have a look at your local forecast as we head into monday coming up in a bit. >> thank you very much. look forward to that. in the south bay, a dangerous situation near san jose's main transit hub. police are trying to figure out if a woman violently forced out of a taxi cab is the victim of a kidnapping. mayor a details on that at the dichlt ridon station. >> reporter: police say the attack happened around 2:00 outside diridon station. tonight investigators are looking for four different suspects who allegedly grabbed a woman out of the cab and took

off with her. it all started when a cab driver picked up a woman at tasman and great american parkway early this morning and drove her to diridon station. police say that's when two men in a white lexus tried to convince the woman to get out of the taxi. she refused and the cab drove off. investigators say the men stopped the taxi, slashes several tires with a knife and stabbed the driver. they then pulled the woman from the backseat of the cab and drove off with her. >> it's not uncommon. >> reporter: taxi drivers we talk to say their job is increasingly more dangerous and this attack has left them on alert. >> it's surprising, especially the kidnapping. >> reporter: the cab driver survived the attack and was treated at the scene. this woman and her friend are headed to a concert near diridon station and are rethinking where they park. >> trying to snatch the lady out of the car, i mean, it's not

safe anymore. that's how i feel now. they need to beef up more security people here in the station. >> reporter: police are trying to track down four suspects, two men and two women. they were last seen in a white lexus with license plate ending in 801. investigators say because the suspects used the victim's name, they believe they knew her. we reached out to san jose police and they say so far they have not received a missing persons report matching the description of the alleged victim. reporting live in san jose, marianna favro. >> thank you very much. another troubling situation also at a train station in the east bay. the lafayette b.a.r.t. station closed for hours after an attempted robbery left three people suffering from stab wounds. police say the attacker is still on the loose tonight. this happened about 10:00 this morning. b.a.r.t. police say the suspect

told a man to hand over his backpack. during the clash, the robbery victim and two others were stabbed. none of them had life-threatening injuries. two wine tours ended abruptly in napa county when a train crashed into a limo bus. got some video sent to us from a tourist passing by the wreck. the accident happened around 12:45 off highway 29. you can see the napa valley wine train broadsided the limo on the tracks. nobody hurt. the chp has yet to release a cause of that crash. a follow-up now to a hit-and-run in marin county during a bike race. police have arrested a 21-year-old man accused of swesh swerving into four cyclist on petaluma road. one cyclist was left in critical condition. once police released the photos of the truck involved, tips started pouring in. one led to the damaged truck parked right outside a navato

house. aaron paff was charged with hit and run. the chp says a group of people called an yoouber in oakland. the when the car reached 23rd avenue, another car pulled up and someone open fire. three people in the uber were kit by fire including the driver. police say it was not a random act of violence. >> our major concern is the safety of the freeway. we want people to know this was a targeted attack, meaning if you jump into an uber you're subject to gunfire. >> the uber driver pulled off the road. the passenger jumped into the driver's seat and got everyone to the homent. hurricane nate is now a tropical depression but it did plenty of damage as it moved across the south. the storm is currently moving across tennessee and parts of south carolina. nbc has a look at the sdaj damage across the gulf coast.

>> reporter: hurricane nate slammed into the gulf coast as a category 1 storm. the storm surge washed over roads and caused flooding. in by locksy, the first floor of the golden nugget hotel was filled with storm surge. >> appears we have a lot of jellyfish in our yard, about two feet of water in the bottom of our house. just a lot of mud and debris. >> reporter: roadways were impassable and there are reports of widespread power outages on the island. elsewhere, nate's power watched small vessels ashore and caused some soil erosion. many residents who rode out the storm are breathing a sigh of relief. >> very lucky. really impressive we haven't had so much damage as expected. >> reporter: while crews work to remove debris and repair power lines be, for many residents, life is back to normal. >> we're walking on the beach looking for shells and stuff, so it's much better than i thought yesterday. >> reporter: the threat from nate is over but the atlantic
