humidity and cooler temperatures. we are going to be up to 65 in san francisco. north bay, upper 70s. also, low to mid-70s for parts of the south bay and the santa cruz mountains. getting a look at the seven day forecast, looking forward to rain late tomorrow evening into friday morning with the highest chance in the north bay. see that in san francisco as well. as we look at what's ahead for the inland areas, north bay showers mostly, but a few spotty showers making it to the rest of the bay area friday morning. we'll talk more about that. mike is talking about wet fires in sunol? >> exactly. a number of vehicles with flat tires and a truck that dropped paving stones. that driver has been apprised, there are a bunch of people that got flat tires that ran over by your debris. a majority of vehicles are

clearing. chp is making sure everything is moving along. out of the altamont pass, we are talking the north bay freeway. they have the road closures. 101, 37 and 80 on the perimeter of the fires we are watching in the north bay. they maintain open status. i know talking about the fires. back to you. >> thank you very much, mike. people in the santa cruz mountains are hoping for the best and hoping to go home today. fire crews have been battling a wildfire that burned four structures. >> bob redell is one of the first reporters on the scene yesterday morning and joins us live in santa cruz mountains. bob, a lot of people are waiting for that press conference to find out more information. >> reporter: that's right. good morning to you, marcus and kris. what we do not see right now in the dark are the big flames we witnessed 24 hours ago. i spoke with the command set up behind me. they said the fire moved further

away from our vantage point. they have been in radio contact with colleagues who are at the fire right now. those colleagues, they are men and women, hand crews, they are digging lines, removing vegetation. they tell us that the air attack we saw yesterday, they expect that to resume this morning as well. cal fire tells us the bear fire has consumed 271 acres, just 5% contained. we expect the agency to update those numbers, report better containment. again, it is scheduled for 7:00. the bears fire started monday night and spread into the woods. four structures are destroyed, 150 more threatened and a number of people evacuated including a woman who raced inside her home to save the things that mattered most. >> i grabbed my daughter and my

to the rest of the house and trees. one person was home and they were taken to the hospital for smoke inhilation. the cause of the fire is under investigation. turning to the north bay fires as fors get a handle on the flames there. there are a lot of questions about what sparked those fires and one family lost it all during the fire is taking matters into their own hands to try to get some answers. >> "today in the bay's" pete suratos joins us with the late es on the legal action the family is taking. pete? >> reporter: good morning to you, marcus and kris. before we get into the legal action, i want to make it clear, the cause of the fire is still under investigation. that could take months to determine the cause. one family in places the blame on pg&e. this is happening as crews are working to contain the fires. you are looking at the video from overnilgt. those flames popping up along

highway 12. you can see the flames behind the trees. we saw the orange not long ago. that glow is gone. the details of the lawsuit is filed by wayne and jennifer of santa rosa. they have lived in santa rosa more than 30 years in the coffey park neighborhood. their house burned to the ground. their attorney alleged pg&e broke federal and state regulations by having a high fire danger, yet they did nothing to prevent their equipment from igniting the dry grass. this is days after pge notified california regulators of eight separate equipment failures in eight days, but declining to say exactly what caused those equipment failures. downed lines are being investigated by cal fire as a potential fire of at least one

north bay wildfire. that's one of the elements they are investigating. we are hoping to get more details from the family and their attorney. they are going to hold a press conference in san francisco at 1:30 p.m. live in santa rosa, pete suratos, "today in the bay." >> a lot of people will be paying attention, that you think so. investigating fire evacuations at two assisted living nursing homes. so far, social services is giving little information about why those investigations are open. a spokesperson tells us because of information found during a routine review. they are both in santa rosa and run by the oakmont management group. evacuation orders have been lifted for much of the oakmont neighborhood in santa rosa, 200 people can't go home because there's still an active fire burning. new this morning from overnight,

the dangerously flawed and vows to continue fighting it. president trump is throwing his support behind a bipartisan short term plan to stabilize health care markets under the affordable care act. leading senators on bothsides of the aisle drafted subsidy payments. that would keep premiums from going higher, en though the resident is opening to overhaul obamacare. senators say right now, bigger issues must be resolved. >> this is a limited bipartisan step that only affects -- it is important to show we can resolve our differences on something. >> we were able to find common ground on a number of steps to stabilize the market and to help protect families from premium spikes. >> while the president supports the plan, it may not get very far. senator republicans are giving mixed signals about supporting

highs in the low 70s. we'll talk about what's ahead as rain approaches. that's coming up in five minutes. >> the travel times for the tri-valley look great. 680, bricks in the roadway. i'll talk about why that great travel time might not be a great route. 5:15. new this morning, chp says one person is hurt after a shooting on 580. it happened after 9:00 on redwood road and storebridge in castro valley. a black sedan pulled up and opened fire. he went to the hospital and has been released. police have not located the suspect or suspects. the cause is still under investigation. now, developing news out of southern california. a massive fire at a chevron refinery overnight. this is near l.a. it broke out around 10:30 p.m.

background here, the state fined chevron $1 million after a 2012 refinery fire here in the bay area. it is 5:15. even though the plan may have already been dead in the water, governor brown is praising a decision by south bay water leaders supporting the overhaul of california's water delivery system. the plan is called water fix. it would create twin water tunnels from the delta to provide water to southern california. agencies shot that plan down. the water district voted unanimously yesterday to support the plan, but only if it involves one tunnel instead of two. in a statement, the district wrote, the board vote is a major step forward for california water fix and ensures santa clara will have the water they need. they may get the smaller scale project on tract. >> we'll get a look at this

morning's business headlines including big news concerning apple. >> we start with the stock market record. kate rogers is live at cnbc world headquarters, good morning to you. >> good morning to you both. wall street could continue the upward trend following a mixed session yesterday. the dow broke above 23,000 for the first time. but it failed to close above that level. it did take 53 trading sessions for the dow to go from 22 to 23,000. you can look for data today on housing starts. the dow closing 40 points, close to that 23,000 mark yesterday, to 22,997. the nasdaq flipped to 6623. apple has responded to concerns from senator al franken about the security of the safe id feature on the iphone x. apple says the chance of a random person unlocking your phone with safe id is 1 in a million. after five unsuccessful scans,

year, reaching the mid-70s. los gatos, 77 degrees. hayward, 74. 81 in danville. for the peninsula, 74 degrees in palo alto. daly city, 64. 65 in the outer sunset. embarcadero, 66 degrees and 76 degrees in navato. we are looking forward to the next chance of rain. right now, it's still up around oregon and will make its way farther to the south heading into the bay area tomorrow evening. looking at the timing. as we go through the day, high clouds drifting by. as we start to see light rain moving through by tomorrow afternoon, it will be spotty, getting heavier by tomorrow evening for the north bay. we are still expecting a lot of rain to fizzle out. but, the models are back on with showing we will have at least good, measurable rain across the area, which is great news. as we start out early on friday morning, light showers starting

to taper off, then a dry weekend. looking at how much rain we could see, the possibility of up to at least a quarter inch of rain. about a tenth inch for most of the bay area, including the south bay. rain chances moving in for san francisco for tomorrow afternoon and friday. the weekend ahead looks nice and cool. it starts to warm up early next week. the inland areas, the warm up comes more quickly, starting on sunday into early next week. mike is still cracking those bricks. >> the bricks aren't moving, unfortunately. a look at the traffic, which is moving on the speed sensors. the bay shows a nice green. that means speeds close to the limit for most of the bay. we are looking here, southbound 680, a number of flat tires as a result of paving stone that is fell off the back of a truck. the number of vehicles on the shoulder, three of them have flat tires. we haven't heard of traffic problems. let me show you what waze can do for you.

the north bay wildfires. kari, what is the weather looking like today? >> tracking the bear fire and cooler air this morning. in the upper 40s to start. we'll see those temperatures slowly starting to climb as we go through the day. it will be a cooler day, also with higher humidity as we are in some spots, near 100% relative humidity this morning and a very light wind. we'll talk about what's ahead as the rain approaches. that's coming up in a few minutes. mike starts out with bart delays. >> we got word from bart there's delays between union city and south hayward. keep that in mind, it's in both directions. the rest of agencies are reporting no delays. we are tracking to see if bart is clearing. meanwhile, the roadways will be seeing more traffic. it's moving smoothly right now, including highway 17 through the santa cruz mountains where we covered the mountains all

yesterday. back to you guys. >> thank you very much. back to breaking news. people living in the santa cruz mountains are eagerly awaiting news on the wildfire burning near their homes. 150 homes under mandatory evacuations this morning. we brought this as breaking news here on "today in the bay." >> at this time yesterday, they were out of their home for hours. "today in the bay's" bob redell is live in the santa cruz mountains. bob, they are not going home anytime soon. >> reporter: we hope to get a better idea of when the evacuees will return, kris and marcus. cal fire is holding a news conference at 7:00 this morning. we hope to hear that firefighters have established more of a perimeter around the fire in the santa cruz mountains not far from boulder creek. we spoke to the command behind me. they stay fire is still 5% contained at 271 acres. so far, it's burned four structures.

not clear if they are homes, outbuildings or something else and threatening 150 structures. it forced the evacuation of 150 homes. the challenge in this fire fight is the steep terrain up the mountainside, which is why cal fire relies on hand crews who hiked their way in and are out there now at this hour and relying on a number of aircraft dropping water and retardant from above. we expect that to resume once the sun comes up. the weather cooperated. the air is cool. oddly enough, firefighters wouldn't mind a touch more wind. >> obviously, you don't want that big wind. we don't want big wind. a nice little breeze to blow a little of the smoke out makes it easier for those guys to fly in there. >> reporter: cal fire called up 600 firefighters to put out the bear fire here in the mountains. five firefighters were hurt

yesterday. one fell 50 feet, he broke his wrist. another treated for smoke inhilation. the other three were minor injuries. there's a news conference at 7:00. we'll stream that live at www.nbcbayarea.com. reporting live in the santa cruz mountains, bob redell, "today in the bay." >> bob, thank you for that update. we are turning to the north bay wildfires. happening today, a couple is filing lawsuit against pg&e. the couple lost their home in the tubbs fire and in their lawsuit, they allege that the utility company was negligent. it claims pg&e broke federal and state legislation by not preventing their equipment from igniting dry grass. in the response, pg&e says they will not speculate about the cause at this point. our investigative unit has been looking into that. pg&e acknowledges they had eight equipment instances in eight days. they say that is significant

because cal fire is investigating whether downed power lines were responsible for the wildfire. >> the latest numbers in the wildfires, the death toll stands at at least 41. flames burned 213,000 acres statewide. 5700 homes and businesses are destroyed. pg&e says they have restored power to 97% of customers. cal fire granted crews access to 6,000 homes yesterday. they expect gas service to be restored to all by today. senator dianne feinstein and harris are -- the fwo sent a letter to the fcc arguing that the current wireless emergency alert system is inadequate. when it comes to targeting specific locations, there's no way to do it. sonoma county leaders suggested they did not send an alert blast in the early moments of the tubbs fire because the coverage

was too wide and they didn't want to create mass panic amongst those who did not need to evacuate. the senators argue a timely alert could be the difference between life and death. we are following breaking news in oakland. that's where one person died and two others are critically injured after a house fire. it happened before midnight not far from lakeshore avenue north of 580. they have not indicated the names or ages of the victims. they say four adults and two children live at the home. the two children got out unharmed. the cause is under investigation this morning. 5:36 right now. also breaking right now, a crime scene right next to a south bay school. police are investigating a deadly stabbing which happened just after midnight near the intersection of brandon lane and lyric lane across the street from davis middle school. >> thom jensen is live at the scene. that is still very active right now. thom, what have you been able to learn new?

>> reporter: we have not been able to talk to a san hoe apd information officer on the scene. however, we have made a request for that interview with the lieutenant. however, we did have a "today in the bay" photographer on the scene, even as fire crews arrived here this morning in south san jose. he told me, pd did confirm this is a murder investigation. we have seen police detectives focusing on three cars parked across from the school on lyric lane here. warning, this investigation could be going on as your kids arrive at the school this morning. we hope to learn more about that timing when we are able to talk to pd later on this morning. we know that they administered cpr on the scene here. we do not know if it wauz fire crew or police. the victim was pronounced dead at a nearby hospital a short time later. we looked at the murder rate and discovered this is the 28th homicide so far this year in san

jose. that compares to 37 this time last year. marcus and kris? >> thank you very much, thom. good to tell parents they might have to make plans this morning. 5:38. happening now, the search is on for a man wanted for murder in san jose. this happened nearly a year ago last fall. tuesday, police identified 31-year-old joseph miller. police say they think miller killed alfred perez. it happened near 1st street. police said they didn't know what led up to the killing. now, police say they think it may have been a fight turned deadly. 5:38 now. attorneys in the kate steinle case my hint their jury selection. selection continued for a second day yesterday. attorneys asked potential jurors about their stances on issues including gun control and politics. the suspect, jose garcia is an undocumented immigrant who

authorities say fired a gun stolen from a federal agents car. he's not accused of stealing it. steinle was shot and killed on pier 14 two years ago. trial is set to begin next week. after eight decades, pacific steel casting in berkeley is closing. the times reports about 70 people will lose their jobs. the company says the closure will be final as of december 17th. 2011 pacific steel was forced to lay off 200 people because i.c.e. found them to be undocumented immigrants. the company never really recovered after that. right now at 5:39, we will have cooler temperatures today. at times some sunshine. we are looking forward to this rain that is right now well to the north of us. it will start to move into the north baby late tomorrow evening. looking at today, a breezy wind and clouds moving by. looking at the time line of the rain, by 11:30 tomorrow night,

the rain moves into the north bay. mostly, with light showers and then moving to the south by friday morning, which may be wet as we go through that friday morning commute and drying out in time for the weekend. we will have a cool start to the weekend, but then it does warm up. we'll talk more about all of that in a few minutes. mike is tracking bart and bricks. >> not in the same report. we have a major bart delay, major, that is the classification bart gives when it is 20 minutes or more. we have suddenly seen a big delay for union city and south bay. it's likely to affect dublin because they are from the same area. the roadways from the tri-valley and 880 for the east bay, they are moving smoothly. that is an option for you. 680 did clear from bricks in the

they are investigating 20 car break ins on stanford campus alone this month. that is up from the two or three reported most months. similar suspect and vehicle descriptions for a half dozen break ins thursday and friday. in one case, witnesses say the get away car was a black honda with a dent in the trunk. >> ak 45. a flip. new rules requiring gun owners to lock up firearms when they leave their home. the final vote was 6-5. it must be in a lock box. other cities, including san francisco have similar rules. new this morning, san francisco leaders approved a new ban on the sale of furniture and children's products treated with fire retardant. for 40 years, ending in 2013, california required fire retardant in furniture and some children's products. they say it is still added to

30% of the items. the ban applied to sales in store and online. it makes san francisco the first city in the nation to have a ban. the reason is the fire retardant is considered carcinogenic. quick thinking kept two san francisco 49ers from being robbed monday. this is after their game, ray-rey and ruben were at a nightclub. they got bad vibes from a car. they handed off their jewelry to friends and has a security guard escort them out. the two men ran out of and got away unharmed. >> the 49ers are saying, we are aware of the reports regarding the robbery and very thankful that no one was harmed. ruben and ray-ray have been and

investigators cited more than 500 drivers across california in the month of september. 11 of those were in concord. this isn't the first crackdown they have done. in june, investigators caught motorists in contra costa. state officials are debuting new self-serve terminals for the dmv. there's one at the safe way on capitol expressway in san jose. the other is 16th street in san francisco. dmv officials say the terminals are available at nearly 40 grocery stores statewide and 50 dmv field office locations. there haven't been significant progress made in reducing the number of people with hypertension in decades. high blood pressure was 29% last year. that hasn't changed in more than 16 years. medication and lifestyle changes can help lower high blood pressure. a new study finds less than half
