5:00 right now. good morning. thanks for joining us, i'm laura garcia. >> i'm marcus washington. a lot of families are wondering what it's going to look like tonight. we are going door-to-door, knocking, knocking, knocking. >> my son is so excited practicing his trick or treat. >> that's good. a lot of kids stand there. >> you have to teach them the proper way to ask. it's going to be cool this evening and we have been asking for fall-like weather in time for halloween and you have it as we look at the high temperatures. 59 degrees at half-moon bay and 67 degrees in livermore. that's the span of the temperatures today. check out the trick or treat forecast for redwood city. this evening, mid-60s as you head out the door and quickly dropping back to the 50s with clear skies. we'll take a look at other spots where you may be headed. we'll talk about rain coming up in a few minutes. mike has a new report for the east shore freeway.

>> talking about this, the drive is showing no major problems for the freeway. we have the east shore which can be a tricky situation. westbound 80 at gillman, reports of a disabled vehicle. a larger truck, they need a heavy duty jack. folks are splitting off at the off ramp. no problems. i will continue to follow that. it's an issue as folks head to the bay bridge. slowing shows up. we'll show you on the live shot. waiting for one more cash lane to open. back to you. >> all right. a lot going on in washington. developing news that we are following this morning. in fact, a live picture from the nation's capital. we could hear from former trump chair, paul manafort. he was charged with a dozen counts of money laundering. the white house says the investigation has nothing to do with the president, his campaign or alleged collusion with

russia. a guilty plea by a campaign adviser is raising questions about where the investigation is headed next. tracie potts is live in washington checking the fallout. could be a big day there. >> reporter: well, another big day. we saw the indictment yesterday along with this surprise guilty plea from someone a lot of people didn't know, a low level staffer working with the government. former trump campaign chair, paul manafort and his business associate, rick gates face a dozen charges. the indictment alleged they hit $175 million in offshore accounts for a russian backed ukrainian leader. >> there is no evidence mr. man fort or the trump campaign colluded with the russian government. >> reporter: this could be the link they are looking for.

george papadopoulos admits lying to the fbi about his russian contacts during the campaign. >> they had him out there playing dialer crook, calling people with wiretap phones. i'll bet anything, they have an array of tapes. >> reporter: the white house insists papadopoulos's role was limbed. >> a volunteer position. again, no activity was ever done in official capacity. >> reporter: on capitol hill, democrats pointed fingers and republicans said little. >> it's not a hard job. >> reporter: some believe the seemingly unrelated gates/manafort charges could link to russia. >> they are looking at decades in prison. there's an incentive to them to come to prosecutors and say we would like to cooperate. >> reporter: why aren't crooked hillary and the dems the focus? as you saw there, he insists no collusion. now, there could be a new

possible connection. law enforcement officials tell us paul manafort forwarded an e-mail from the low level policy adviser suggesting manafort, when he was at the top of the campaign may have known about that adviser's russia connections. >> so interesting. thank you. new this morning, terrifying moments at a wall green. police are looking at an armed robber who took off with opioids. thom jensen is live with what we know about the investigation. this comes at a time when the nation is dealing with the opioid crisis. >> reporter: you are right. this is a national epidemic. less than a week ago, five days ago, you know the president declared opioid abuse a national health emergency. this is the second case like this, in fact, in the last month. you remember just in september, in danville, there was another robbery like this where we had a

surveillance picture. in this case, the thief, just over the pharmacy counter at 10:40 and threatened the pharmacist with a gun before stealing opioid based drugs, the most popular. the thief ran to the store where we are and took off on foot. that was the last they have seen of the suspect. the number of deaths every year from opioid overdose is nearly 2000. the last full year of data from 2015 and there were 1966 deaths that year. that means on average, five or more people died from opioid overdoses in the state every year. that said, the state's rate of prescribing the drugs, a key indicator of abuse. that shows california is doing better than most states in that respect, somewhere between 50-70

prescriptions per 100 people every year. this robbery last night, we hope to get another picture from surveillance like we got in the danville robbery last month, hoping to get that from the contra costa sheriff's department later this morning. live in walnut creek, thom jensen, "today in the bay." >> it is 5:06 right now. developing now, san jose police are asking robbery victims to come forward. newly released video shows a man walking up to a woman and rips off her jewelry from around her neck. 21-year-old lawrence carter has been arrested. the victim's son says he's relieved carter only robbed her mother. >> my mom was trying to, you know, push back and grab the chain back. lucky she didn't get hurt. >> the suspect robbed at least

seven women between july and september. this crime was caught on camera. carter was arrested in 2014 for a similar robbery. the murder trial is now under way for a man accused in a dui crash that killed a mother and 14-year-old daughter. in may of 2015, she was killed when a car plowed into them. they were attending a party at a livermore home. two boys were seriously injured. the suspect here, was drunk and left the art wine festival according to the east bay times, attorneys delivered opening statements. the attorney admits the client's involvement in the crash, but argues the circumstances of the case do not amount to murder. happening today, berkeley leaders and the changes to force policies. officers are required to file a report when a weapon is used, a citizen report is filed or

injury occurs. they consider changing the policy to include physical force is used. another change classifies use of force by severity. the meeting is at 6:00. contra costa county is expanding the car pool program adding more perks. the pilot program is a partnership between the county and technologies. here is how it works. download scope, the app and find the ride. so far, they were getting $2 discounts. now they get a $2 reimbursement and guaranteed bart parking. we looked at the number and half a million seats go unused in cars in the bay area every day. >> 5:08. new details on contaminated water in san francisco public schools. school leaders were shutting down drinking fountains. this morning, we look through new data to see how bad the

problem is. at least 30 water taps tested positive for high lead levels. they had a lead level 60 times the amount under federal guidelines. the other schools impacted, now the district said the problem is due to plumbing. metal is leeching into the water. happening today, with the rainy season approaching, san francisco tleleaders want to be the same page. later this morning, the public utility's commission will meet with supervisors to go over the rain ready strategy. this includes infrastructure improvements and a coordinated flood response. no worries about rain this morning as we get ready to head out the door for school. right now, at 5:09, we are getting ready for a cold start in napa as we check out the school day forecast.

it will be in the mid-40s. as we go throughout the school day, it will rise into the low 60s as the kids head out to recess and lunch and going home will be mid-60s. in time for trick or treating, it's going to be upper 60s at 5:00, then quickly dipping temperatures around sunset. be prepared for that. as we look at the forecast, rain on the way. i'll talk about that in a few minutes. mike is checking in with i-580. >> those were cool pumpkins on that graphic. is cool drive. 580 out of the altamont pass, an earlier crash. the commute off the merge with 205 about grant line road. two vehicles were reported in the center divide after a fender bender. now, another report. one is involved. i'm going to say they removed one and another calling to say, hey, there's still a truck over there. the travel time after the crash is just fine at the dublin

and what reach did they have? we know the most popular republican twitter account in all of tennessee, ten underscore gop was russian. twitter shut that down. they are telling actual numbers. they will tell congress. facebook says there were 470 russian accounts pretending to be something else. twitter about 2700 accounts, far more than first acknowledged. take a closer look. facebook found 478 accounts. they were created in 80,000 posts. most of the fake news reaching 126 million facebook users. when you consider 139 million americans voted in the election, you begin to see how these numbers add up. twitter, 2,752 accounts. again, when you look at the original number, you think, not

look at san francisco. now the seven day forecast is at the bottom of the screen. you can check that out as well. 55 degrees as you head out. in morgan hill. 42 in fairfield. you have a cooler start in the north bay. as we look at the high temperatures in the afternoon for the south bay, 66 degrees in morgan hill and 67 in milpitas. danville, 69 degrees, 66 in hayward. for the peninsula, 61 in daly city. san mateo, lower 60s. mission district, 62 degrees and the north bay reaching the upper 60s in napa, sonoma and navato. we are looking at the rain in fact forecast coming up friday. until then, we can enjoy the dry weather. no need for the umbrella as you head out in oakland. the school day forecast, a nice, warm sweater to start with. the temperatures in the upper 40s. through the day, it makes it into the upper 50s as they head out for lunch.

long sleeves and 60 degrees by the time school is out. if you are going trick or treating in antioch, we start out with upper 60s there. 68 degrees, then look at what happens by 7:00, we are down to 60 degrees. it continues to dip back into the 50s after sunset. then, we have been tracking rain that will start to move in late friday evening. so, we are looking at, here we are friday, 11:00. the rain moves into the north bay and looks to be heavier by saturday morning. then it wraps up sunday with another round possible, right after that into monday morning. off and on rain starting friday into monday. meantime, we have dry weather and cool temperatures in the forecast for the end of the workweek. let's head over to mike checking back with the east shore freeway. >> we had this crash reported and anything going on for the freeway, we have to keep track of that. an easy drive right now. easing into the morning commute

175 hospitals received an "f." we put a link to the results on our website. you can get a closer look there. it turns out high prices and low inventory not just a problem for the bay area. the same thing is squeezing home buyers around the nation. thanks to the lowest level in three years. an expert believes the only way it tapers off is if more homes are built. >> look, the tightness in inventory and the huge increase in crisis is tapping down sales. >> part of the slowdown is attributed to the sales in texas and florida. home construction is down nationwide. overnight, we look closer at bay area numbers according to the

california association of realtors. home sales were down from august through september. across the region, home sales fell 14%. year over year, sales declined 4%. home sales across the state were slightly higher than the same time one year ago. perhaps a sliver of misery from houston's painful summer may be washed away by one more win in baseball classic. >> the houston astros could win if they can win game six against the los angeles dodgers. the astros are up three games to two after game five. many calling that an instant classic. a 12-11 extra inning walk-off win. houston fans are still recovering from hurricane harvey. definitely tonight is going to be one that a lot of fans are going to be watching. some hoping for a victory for houston, others not.

district where it happened. what led up to this? >> reporter: good morning, marcus and laura. what led up to it is a shoplifting incident. that's what we are told by sf police. the suspect was shoplifting inside the store, which led to an altercation outside where the stabbing took place. it is clear behind me at 7th avenue. you are looking at video with a couple squad cars on the scene following the stabbing. we are told this happened around 12:30 a.m. they got into an altercation of the shoplifting where an employee from the safeway. the suspect's dog bit that employee. that's when the suspect stabbed the employee numerous times in the leg and torso and a number of areas along the victim's body. the employees naturally tried to

help their colleague. that's when the suspect tried to stab them as well, failed, but fled the scene. they detained and arrested the suspect. crime stats in that area, in the past month, not much crime in that area. the victim was taken to a hospital with life-threatening injuries. we are going to try to reach out to sfpd to get an update on the injuries. live in san francisco, pete suratos, "today in the bay." >> thank you so much. kate steinle's murder case continues in san francisco. right now, both sides are fighting over the path of the bullet that struck steinle. they claim he intended to shoot steinle on pier 14. defense argues the bullet hit the ground first, which could have changed direction of the bullet. the tomattorney says the suspec

was too far. >> when i see the photographs posted, they seem far away. you can see the divot, the chair and you don't see the memorial that was set up. that's how far it was. >> both sides are back in court and so is sam brock. follow nbc bay area on twitter for the latest on the case. new details on great america this weekend. santa clara police are looking for 15-20 people. this is cell phone video of the attack at the amusement park. a group of five juvenile girls who investigators say used a taser to attack people. they are investigating several cell phone thefts. now, a developing story and the search continues for whoever killed a bay man. this is 40-year-old bradley. his family is making funeral preparations now this morning. police say he died on sunday morning. he had been arguing with a group of young people driving

recklessly in the neighborhood when he was shot to death. neighbors say he was trying to protect the community. >> i probably would have done the same thing. heard the car screeching first, like them doing doughnuts. that woke me up. i was listening, then i heard, pop, pop, pop. i jumped up and told my wife, that wasn't fireworks. >> they have photos of two cars they are looking for. one, a red mitsubishi eclipse, the other a ford mustang. a law requiring gun owners to lock up their weapons when they leave their home. the law requires them to lock the guns in a safe or use trigger locks. they have 24 hours to report a stolen gun without facing penalties. similar laws are in effect in oakland, berkeley and sunnyvale.

a homeless advocate group sued berkeley to stop eviction at a homeless camp. this is the moment they issued the notice. the judge temporarily stopped the evictions as he reviewed the case. a follow up in the sale of a san francisco street to a couple. it has now been moved. city officials tell us the meeting will take place november 28th. you may recall a small, private street on the edge was sold earlier this year. the neighborhood and the homeowners association are challenging the sale and asking supervisors to rescind it. fill up before you have to pay up. tomorrow, the new california gas tax goes into effect. that means more people are going to be heading to the gas pump today. sanchez is live with what you need to know before you fill up your tank. good morning, kris. >> reporter: you cannot hoard gasoline, so it's only going to save a little at the pump. the gas prices are going to go up because of the taxes on november 1st. it is 12 cents per gallon, going up in the regular gas tax. diesel users are going to pay 20 cents more plus sales tax. this is $5 billion for state and local projects. take a look at this graphic. by 2019, nearly 77 cents of every dollar you spend on gas will actually pay for taxes with states getting 58 cents on the dollar. the president of the silicon valley taxpayers association says before tomorrow, california pays the highest gas prices in the country with little to show for it.

>> the money that's currently being taxed, again, we are the highest taxes in the nation on gasoline. why is that money not being spent on road repairs? >> reporter: if you are thinking, i'm good because i drive a zero emission car, you might not pay at the pump, but you will pay a new $100 vehicle registration fee in 2020. tomorrow is november 1st. it is the first day that gas stations can start transitioning to the cheaper, winter blend. you may not feel the full impact of the 20 cent a gallon tax right away because we are making that switch. but, you are probably going to notice it as you stand and watch the ticker go up and up. san jose, kris sanchez, "today in the bay." >> we know it all too well. >> going to be lines to get gas today. thank you very much. people are out the door, it seems like early this morning. >> probably see folks early in the commute this afternoon and

happy halloween. right now, at 5:44, getting ready to head out the door, cloudy skies to start. a live look outside in san jose, look at evergreen. the temperature trend starts cool with mid-50s and we start to see the sun breaking out by late morning warming up to the upper 60s. it's going to be warmer than it was yesterday and perfect halloween weather. we will take a look at the microclimate where you live and the halloween forecast coming up. right here, we are looking at highway 24. a little build for the travel time. i'm watching for a crash around the kauld cut s people in san francisco have the worst commute in the country. san francisco spent an hour getting to work. it's the second worst rate

behind only washington, d.c. and just ahead of chicago. it ranks stress levels as it relates to commute, sf is fifth in that category. l.a. commuters are the most stressed. this morning, an update on how the clean up is going in sonoma county. the board of supervisors is holding a meeting on the next step. it starts at 8:30. there are 43 confirmed deaths from the fires. new this morning, a report is warning that climate change is already hurting our health and our economy. the national journal says that there is a jump or has been a jump 46% in weather related disaster since the year 2000. 125 million adults over 65 have been exposed to heat waves. the increasing temperatures have led to funds. they estimate economic losses linked to climate related events at $129 billion in 2016.

it is 5:45. tomorrow, health care enrollment begins. we are learning prices are going down. the average price will go down 1.5%, a decrease of $9 a month or $108 yearly. the fate of obamacare is in limbo as the trump administration and republican lawmakers look for ways to gut the law. the president continues to say his campaign did not collude with russia. >> he is saying there's no proof of collusion, marcus. the special counsel leveled charges at two former trump em employee eyes including the campaign manager. the biggest surprise was gorge papadopoulos. the former trump campaign worker who made contact with the russians, then lied to the fbi. he admitted it with a plea agreement. one of the shockers from the

documents in the papadopoulos plea deal is the russians told him they had the democrats e-mails hacked on april 29th. the trump campaign knew about the e-mails months before their candidate said this. >> it would be interesting to see, i will tell you this, russia, if you are listening, i hope you are able to find the 30,000 e-mails that are missing. i think you will probably be rewarded mightily by our press. >> the other thing to think about is documents say papadopoulos has been cooperating with the fbi since his arrest in july. we don't know what cooperation means, specifically. people in washington are checking their calendars to see if they talked to papadopoulos after he became an fbi asset. we are watching the president's twitter feed this morning. you can watch our twitter feed and be contacted on twitter.

e-mail. concerns at a california high school after three reported cases of viral meningitis. a high school in el dorado county is deep cleaning the campus to make sure there aren't any other cases. viral meningitis causes inflammation of tissue that covers the brain and spinal cord. the school district is assuring parents this is not the severe bacterial form. they say they are doing everything they can to keep it. >> this is viral, not bacterial. it's not anywhere near the potential fatalities they could look at. i think that also calmed a lot of people. >> the students who have viral meningitis may have played sports together. they will have to be cleared by a doctor before they can return to school. more details, we want to get a better understanding of what causes viral meningitis and how you can protect your kids.
