root her on as well. right now, we are following several breaking news stories this morning. terrifying moments overnight as gunfire erupt during halloween festivities in castro. what led up to an officer being shot. a fire breaks out on the caltrain tracks. the impact it's having on the commute and how to get around. the terror attack in new york. new information on that and the investigation. what we know about the suspect's past and, of course, the victims who died. "today in the bay" continues right now. a very good wednesday morning to you. thanks for joining us, i'm laura garcia. >> i'm marcus washington. we begin with breaking news in san francisco this morning. a police officer shot overnight during halloween festivities in castro. this morning, witnesses are sharing video which shows the moment the shooting started.

[ gunfire ] >> you can hear the gunfire there. still a very active scene and the investigation is continuing this morning as police try to piece together what exactly happened. "today in the bay's" pete suratos join us live at the scene. he's been out there to bring us up to speed on the investigation so far. pete? >> reporter: good morning to you, laura. we are going on nearly six hours since that officer involved shooting took place. you have an officer shot and sent to the hospital, as well as a suspect. since we have been here at 4:30, you can see where the shooting took place on 18th and diamond, still a very active scene with sfpd processing the scene. we'll show you video someone tweeted out. you can hear those shots being fired just after 12:00 a.m. [ gunfire ] [ sirens ] [ gunfire ] >> reporter: you can hear the

shots -- [ gunfire ] >> reporter: you can hear those shots fired from the skyline in the video tweeted out. information from san francisco police at this time is the shooting took place just after 12:00 a.m. near 18th and diamond streets. officers were working in the area doing their beat on halloween night when they were flagged down about a suspicious vehicle in the area. gunfire was exchanged and you have an officer shot and a suspect shot. both of them sent to the hospital. their conditions unknown at this time. now, as i mentioned in my last report, castro no longer has the city event due to a shooting that took place in 2006. that started with a fight between two groups and someone throwing a bottle at someone and shots fired. the officer and suspect shot in this were sent to the hospital. their conditions are unknown at this time. we are hoping to get another briefing from sfpd to give you updates on the situation.

we'll continue to update you in a half hour and get information on when the streets are going to open up. live in san francisco, pete suratos for "today in the bay." >> thank you for keeping us updated there. we are following breaking news in the south bay this morning. a fire erupts on a train tressel interrupting service. >> kris sanchez has how it could affect the morning commute. >> reporter: it's going to be a difficult morning. perhaps not more difficult than folks got used to. we saw a train going by. caltrain did inspect their tracks and they are singing tracking. they have been doing that for a while because of restoration work. let's show you the flames firefighters came on shortly before we got here at 4:00 this morning. they were flying 40 feet in the air. we know it is a 200 stretch of wooden train tressel on fire.

the fire put out in 45 minutes. in that time, the damage was done. caltrain will be impacted. we have seen union pacific crews out here this morning. here is where you can expect the slowdown in your commute. it is between the tamien station and diridon. the fire captain tells us crews were out here just a week ago. >> this has been a problem area for fires due to there's a high population of homeless people that live in this area. we were just out here a couple nights ago for the same thing, not with the tressel, but a grass fire in the area. >> reporter: a grass fire, then it went into the tressel. because those wooden train tressels are filled with cresol, they used breathing apparatus' fighting the fire. the crews are watching to make

sure there are no other hot spots and trying to make it clear for the union pacific crews to get out there and inspect the freight lines because that could impact all kinds of material that is going from the south bay up to the north bay and beyond. so, crews will remain out here on scene. your commute will be impacted a little bit through the area as caltrain is single tracking. the good news, we just saw a train going by and looked like everything is moving smoothly, at least for now. kris sanchez, "today in the bay." >> good to see for the morning commute. thank you. we want to check in with mike inouye right now. he's tracking the issue on the tracks out there and also a big problem in the east bay. >> a deadly crash in the east bay. the fire that impacted the tracks, a big impact. now it has been lifted. maybe minor delays for the trains out of gilroy and morgan hill. they are only the first trains

from tamien. so far, we haven't seen anything. over here is where we have the deadly crash in san pablo where all the slowing is. a live camera where our photographer said the flames are out. i saw chp put out fresh flairs. they were going to schedule at 6:00 a.m. but they are not going to clear anytime soon. the coroner was on scene earlier, but more investigation is going on. they are remaring the flairs. the onramp is closed. let's look at the map. the onramp is closed by the deadly crash investigation. you see the back up here, adding 25 minutes from highway 4. that is an issue from the morning commute. the good news is the rest of the maze and the east bay, the tri-valley in the south bay

looking pleasant right now. that should be a nice commute for the rest of the folks. the big problem is coming through san pablo. we don't have problems weather wise, but you have changes in the future as well. >> we are going to have a beautiful day as we look at the numbers here in san francisco. the high temperature this afternoon reaching 62 degrees and 60 degrees for tomorrow. we will have rain in the forecast moving in by friday and it will be off and on throughout the weekend. cooler temperatures, so that's going to be the main story. two days left of sunshine before the rain and cooler temperatures roll in. i'll talk more about that coming up later. >> sounds, good. thanks, kari. a developing story out of new york city. that's where the search for answers continues following the deadly terror attack. >> we know about the suspect and getting a sense of how far the rampage went. we put together a 3-d rendering. it's interesting showing the

route that sayfullo drove down. look how far it was. he drove south more than ten blocks, sadly leaving bodies in his way before crashing into a school bus. >> eight people died from the attack making it the deadliest terror attack in new york since 9/11. 11 others are in the hospital. listen in to a witness as they describe the carnage. >> in the bike lane, clearly. i see two gentlemen there in the bike lane with tire marks across their body. you can tell they are not here no more. you hear a lady screaming. that's what made me go back that way and look. >> the suspect is a native of uzbekistan. he's been in the u.s. since 2010. police shot him. now, he is recovering from surgery, but refusing to answer questions. authorities found a note in the truck claiming he carried out the attack for isis.

>> coverage of the deadly terror attack continues on the "today" show. savannah guthrie is live where we are learning more about the suspect. new this morning, a white supremacist group posters are showing up on campuses. they put up promotional posters at dozens of colleges and units. they follow the appearance of swastikas we told you about on campus last week. happening today, if you see smoke in the skies above, it may be a burn planned by firefighters. they will conduct a controlled burn in joseph grant park eight miles east of san jose. close to 300 acres burned, trying to destroy noninvasive species out there. coming up next on "today in the bay," property tax time.

let's go to the neighborhood of santa teresa where our temperatures by 10:00 will be in the upper 50s, rising to the 60s today. a little bit cooler than normal. it's about to get really cool once the rain moves in. we'll talk about the time line and how much we could see coming up in five minutes. we are looking at the east shore freeway. fresh flairs and the investigation since 4:00 this morning. the deadly crash scene. we'll show you the back up and talk about the changes. >> thanks, mike. san francisco supervisors approved a major development project for pier 70. this is an ambitious plan that's been in the works for years. they want to turn 35 acres of waterfront into business and shopping including 1,000 new homes. they report the supervisors unanimously approved the deal. input on the expansion of santa clara's animal shelter.

it is off highway 101 and san martin. leaders want to expand it, make it a no kill shelter. according to the mercury news they have approved $26 million in funding for construction. help is on the way for homeowners whose property taxes are due. they are coming soon. assessments are on the rise. taxpayers have new options. county officials say property taxes are the biggest expense aside from the mortgage itself. the county estimates 1-20 taxpayers struggle to pay that full amount. with the new option, they are able to pay part of it. it breaks it up, giving property owners flexibility. good news for the county, but the taxpayers association disagrees. >> the notion they get whacked with a 10% fee and 18% annual interest on money they were

prepared to pay is fundamentally unfair. that's what we are trying to address here. >> if the board of supervisors want to help taxpayers, reduce the taxes instead of making it easier to pay the taxes. >> that would be nice. there will be workshops to talk about the partial pay program. we posted more information on our website, www.nbcbayarea.com. 6:15 now. tech companies will be back on capitol hill for more questioning today. >> they are facing the second day of inquiries into the role of russian meddling. scott mcgrew, you say today could be tougher than yesterday? >> good morning. today the tech companies have two hearings in a half hour from now and one in front of the house this afternoon. at tuesday's hearing, representatives from facebook, google and twitter faced a committee on crime and terrorism. what you don't see are the founders of ceos.

lawmakers want to know why they are cut off from the kremlin's use of the platform. here is a straight forward question asking why would facebook know it was russian if they paid in russian currency. >> you can't put together rubles with a political ad and go, hmm, those two data points spell out something bad? >> today, the same tech execs are in front of the senate intelligence committee. this afternoon, the house select intelligence committee. just moments ago, we talked to california congresswoman jackie spier. she would like to see more regulation on what those social networks can allow. >> we tend to move gingerly in areas around the first amendment. i'm one of the biggest advocates for the first amendment, but i'm not going to be duped by the

laws that allow foreign adversary to come in and use our constitution and our democracy to their advantage. >> another important story, tesla opened financial books to investors. we are looking for two numbers. how many model 3 cars they made. last quarter, a couple hundred. hundreds of thousands of people put down money. secondly, how much money tesla has on hand. put it another way, how much money they have left. markets will be watching about tax reform. we just heard we are not going to see that tax reform plan today. it's been delayed until tomorrow. we have been talking about how it will affect bay area families. it could be very serious. tune in for more. >> a lot has to do with 401(k)s. >> they are serious things that affect the median income in silicon valley. >> the future, too. 401(k). >> a lot of people rely on that.

6:17. happening today, time to lace up those skates for the return of a great bay area tradition. later this morning, the ice rink opens in san francisco's union square. the event kicks off with cast members from the disney show "aladdin." the holiday ice rink will operate through january 7. it's a place we can all go and pretend to be an olympian. >> or come visit me in a few weeks the week before, the friday before thanksgiving, i'll be opening downtown ice with kristi yamaguchi. super sweet. >> she's great. >> let's bring in cooler temperatures to make it feel like we are entering into the holidays. it's november 1s. now, we are getting ready for showers in the forecast and winter-like weather. now, we start out today with,

yeah, it's fall. it's going to be exactly where we should be for this time of year, reaching the upper 60s, low 70s. a lot of sunshine. beautiful today in concord today, 71 degrees and 64 degrees in oakland. looking at the peninsula, 65 today in san mateo. the seven day forecast is coming up at the bottom of the screen starting in the south bay. the embarcadero, a high of 59 degrees. wearing long sleeves all day long there, but maybe getting out the short sleeves for a couple hours in the north bay. santa rosa, 67 degrees. as we look at the forecast for the north bay, napa, it is going to be chilly again with lower 40s. then, look at later today. 65 degrees. really nice to take the kids out to the park. then, we'll be tracking rain. you want to get in those outdoor activities today and tomorrow because look at friday. north bay sees the showers moving in around noon. this will become more widespread

as we go into the afternoon and the evening hours between friday and saturday, off and on rain. there will be breaks, but plan on chilly temperatures, breezy winds and, at times, showers. as of right now, still up in the air on exactly how much rain we'll get. this is a look at what one computer model is showing over an inch of rain in the santa cruz mountains and lesser amounts, a tenth to quarter inch in the valleys. another model showing more of the same. the heaviest rain stays to the south of us. so, still differences here. if you have weekend plans, let me know. we have rain on the way. friend me on facebook. then, as we look at the rest of the forecast, the rain will be off and on, starting on friday, continuing into early next week. we won't be done, just a quick shot of showers. this will last several days with cooler temperatures through next week. mike has sky ranger over the

east shore freeway. >> i'm going to get out of this shot. the flashing lights. this is the overhead view of the shot i'll show in a second. this is the active investigation. some activity here. chp. one, two, three, four, lanes of traffic. all lanes are open. the onramp is still closed because of the deadly crash that happened at 4:00 this morning. we'll show you from the ground level. ethan our photographer is out there. chp crews moved the flairs over and we just saw, look at that, we just saw this flat bed tow truck. all the activity on the right shoulder. another vehicle or two involved in this deadly crash after 4:00. this distraction on the map will show the slowdown. you are adding 20 minutes longer than your typical commute, which is backed up off the carquinez bridge. that makes the rest of berkeley

man who his new macbook did not perform as advertised. nbc bay area responds to a man who says his new mac book did not perform as advertised. the new batteries lasted only a few hours. >> after trying everything else, he called chris chmura. >> he bought a mac book prothe day it was released and ordered every bell and whistle. right away, jim noticed something was wrong with the battery. it only lasted four hours, at most, compared to the ten hours apple advertised.

during several weeks he was on the phone with apple techs or in the store trying to troubleshoot. nothing worked. jim wanted apple to replace the computer or the battery, but it wouldn't. he finally turned to us for help. we contacted apple. it ran more tests and eventually shipped jim a brand-new computer. apple declined to comment for the story. if you have a consumer complaint call 888-996-tips or log on to www.nbcbayarea.com/responds. >> thanks, chris. 6:26. new this morning, americans are stressed out. may not be a surprise to a lot of people. the american psychology association is out with the annual stress in america report this mompbing. nearly two-thirds of people surveyed say the future of the nation is a significant source of stress, more so than money and work. 59% of americans consider this the lowest point in u.s. history they can remember. while most people said they follow the news regularly, 56%

bridge and 46 in the tri-valley, 40 in the north bay and a chilly start, but warming up nicely with the high temperatures today for the inland valleys reaching the upper 60s to lower 70s. we are in for nice weather for the next couple days. major changes on the way. i'll have a look at that and the weekend forecast. mike takes us out there for the morning commute and delays. >> this is a problem. look at that. the tow truck we saw arrive on the scene is taking a vehicle associated with the deadly crash, westbound 80. only the onramp is partially blocked. behind me, the vehicles are getting on westbound 80 and moving smoothly. there's a distraction with the flashing lights. on the maps, you see it is dragging down in this short section. just the onramp is officially blocked. now, once you get past that, that keeps traffic held up. berkeley and the berkeley curve

move very well. now, this is actually a light flow of traffic. this shows the worst of the traffic. the south bay showing the volume build as well. the freeways are moving smoothly. over the course of the morning, following an issue with the tracks. over to you for the breaking news. >> that is the news we are following because of the fire that broke out. take a look at it along the train tracks in san jose. >> kris sanchez is live at the scene. she's been there all morning since 4:30. that fire is out but certainly will impact people's commute this morning. >> reporter: right, marcus and laura. before we were on scene when i was driving by i saw that thick column of smoke going up in the air. i was pretty sure what i was going to be doing this morning. we confirmed the fire was actually on the union pacific line. there's two lines through here.

there is concern there is structural damage to the line. union pacific had a number of crews out here. they are sending investigators out as well to talk about the origin of the fire and work with san jose fire department on that. let's look at those flames. this will give you a good indication why there might be structural damage. firefighters arrived after 3:00 and found a 200 foot stretch of wooden train structure was on fire. the damage was done. here is what you can expect. a slowdown in your commute between the tamien station and diridon station. we have been in touch with caltrain. because it is main of concrete, it was not damaged by the fire. the investigation is still under way. >> there's two different tracks in the area where the fire is located. one is union pacific, the other is caltrain. caltrain already made -- there is going to be an impact with

trains running through the area. >> reporter: we can confirm they are single tracking through the area. we saw one of those trains going by in the last half hour or so. no immediate cause for the fire. we talked with the captain about the fact that there are known homeless encampments through this stretch of railway. he says, in fact, they were here a week ago because of a fire that happened in a homeless encampment along the rail line and certainly wasn't the first time. we will continue to follow up to see if they are able to share their line with caltrain then that could have an impact on your commute as they try to move freight through this area while the train track is damaged. kris sanchez, "today in the bay." >> we know you will keep us updated on the changes. thank you. following breaking news in san francisco where a police officer was shot during halloween celebrations in the castro. we are getting a new look. this is video following

witnesses who say they heard those gunshots. [ gunfire ] >> still a lot of unanswered questions about what led up to the violent incident. "today in the bay's", pete suratos is live with an update for us on this investigation. pete? >> reporter: good morning to you, laura and marcus. i spoke to san francisco police in the past 20 minutes. they gave answers to questions. the officer and suspect are in surgery right now at a hospital. we know that officer is a 41-year-old officer who workings in the crime scene unit. the suspect is a male. that's all we can report as far as information on the male suspect. it's an active scene. the shooting taking place after midnight. it's an active scene for the past six hours. we want to show you video and hear sounds of the shooting when it took place. >> reporter: according to san francisco police, they are saying the shooting took place after midnight at 18th and diamond. officers are working in the area on halloween night when they were flagged down for what one person said was a suspicious car in that area. when police approached that car, that's when gunfire was exchanged. i want to olympipoint out, ther no longer a sanction city event in the district due to a shooting that took place in 2006. a fight with two groups beginning when someone threw a bottle at someone. several people were shot and there was no longer a sanction event. still, plenty of big crowds showing up making a shooting that much more dangerous. as far as when it is going to clear up, maybe when the sun comes up so maybe the next couple hours. if you are driving around 18th

and diamond, diamond is going to be an active scene all morning long. pete suratos for "today in the bay." >> thank you, pete. of course we will continue to follow this story, staying on top of it all morning long on air and online. pete suratos will be tweeting updates for us. you can follow him. now to a developing story we continue to develop out of new york city. we are looking live at lower manhattan. you can see that investigation continue. this is into that deadly terror attack that happened in the city yesterday afternoon. it continues this morning. >> the deadliest attack in the city since 9/11. here is what we know so far about the suspect. his name is sayfullo saipov, 29 years old a native of uzbekistan living in the u.s. since 2010. he is recovering in the hospital after being shot by police. he is refusing to answer questions. police searched his new jersey

home and collected evidence at a nearby home depot store. >> the suspect rented that truck from the store and drove down the river front bike path near the world trade center, tuesday afternoon. this is a popular bike path along the river. the truck drove south for ten blocks, leaving bodies in its way. this is before the truck crashed into a school bus. >> 11 others are in the hospital this morning. police found a note in the truck claiming saipov carried out the attack for isis. the governor says new york will not live in fear. >> being new yorkers, live your life and don't let them change us or deter us. they are offering the u.s. assistance in the investigation. president trump says he ordered homeland security to step up extreme vetting of immigrants. >> coverage on this investigation will continue on air and online this morning.

we expect to get new information within the next couple hours. any updates we have we will post at www.nbcbayarea.com. as the white house continues to debate the future of the affordable care act, open enrollment for cover california starts today. >> bob redell has more on what you need to know this morning. >> reporter: good morning to you, laura and marcus. this is the one time a year you can sign up for health insurance under cover california without meeting the qualifying conditions. look at the tv screen. we are putting up bullet points to keep in mind if you are going on the cover california website. the enrollment period, as we mentioned, begins today and runs three months to the end of january. you are encouraged to sign up by december 15 if you want your coverage to start at the beginning of the new year. there are a number of changes for 2018. some insurance companies

withdrawaling like anthem blue cross. others are expanding like blue shield of california. you can compare programs on cover california website. based on a study done by cover california, consumers will see the amount they pay for coverage go down by next year by about $9 per month or $108 for the year. 3 million people have purchased insurance, 4 million enrolled in medical in 2014. there will be a media outreach to get people to enroll. the bus tour will be taking place next week in san jose, oakland and san francisco. you can go on their website, look for the cover california website and start enrolling. again, you would want to enroll by mid december to have your insurance start by 1/1. bob redell, "today in the bay." good date to remember. over here, we want to know

interstate 80 is completely open, so is the onramp. they have been cleared. ethan and the chopper have been cleared. 80 may start to clear as well. we have recovery. this morning, traffic flow is light around the bay especially for a wednesday. look at that. some are slowing off highway 4. now, more traffic toward the bay bridge. that will make the maze slower. a crash clearing from 242 where you meet 680. a slower drive for the south bay. i'm going to update highway 85 in the next report because i see slowing. >> look at you always looking out. you are watching the weekend for us. >> yeah, looking ahead. >> we have rain in the forecast. a lot of people waking up and feeling sleepily after staying up late last night. this will be your weekend to catch up on rest. saturday, raining off and on. cool temperatures reaching the low 60s inland. sunday, more of the same with cooler temperatures, breezy

we are looking over here, the south bay. look at the bottom of your screen. 85 jammed up. i'm checking on two crashes currently affecting the flow on that highway. >> thanks, mike. right now, it's 6:47. we want to continue with more news for you. two people are hurt after a shooting at a side show in oakland. this happened during a large halloween party late last night near broadway and mcarthur near kaiser medical center. a police sergeant told us the victims took themselves to the hospital and are in stable condition. last check, police told us they have not made any arrests. this isn't the first time we have seen a side show in recent days. earlier this week, four were arrested and an officer hurt following a series of side shows in san jose. hundreds of cars were involved. 6:47. happening today, the deadline to

finish emergency repairs on the oroville dam spillway. officials ended up evacuating 200,000 people near the dam because they were worried about intense erosion on the spillway. we have drone video here showing crews almost finished pouring concrete on the spillway. you can see the walls are up there. the department of water resource said the spillway would be easily handle water releases by today. this story will affect anyone who drives, especially if you are headed to the gas station to fill up. get ready to pay more. we have been warning you a 12 cent per gallon gas tax today. >> there were long lines at gas stations last night. some charging the new tax at midnight. others will do it today. the tax should generate $5 billion yearly for road and bridge repair.
