mira mirage. so mar detectives say they do not think the shooting is terrorism related. >> as of right now what we've determined that it's random as of right now because there was no direction or anything like that as the witnesses stated, the person came in and just shot towards a group. >> witnesses say the gunman simply walked inside that walmart and opened fire. developing right now, police in dublin are investigating reports of a student assault that started with racially charged words. the parents of the 14-year-old african-american girl said she heard students using a derogatory term and asked them to stop. that's when they say a boy punched her in the mouth and gave her the concussion. the district would not comment on the incident due to privacy concerns but did speak to us about school policies. >> we don't tolerate that behavior and we take it seriously and we absolutely go

out of our way to make sure that we're correct that go behavior in one form or another. >> the girl's parents say the boy received a three-day suspension but they want him expelled. when they never heard back from the district they went directly to police. this morning a man is behind bars accused of discovery bay's first homicide since 2015. brayan zavala turned himself in last night. he was wanted in connection with the deadly shooting. happened sunday morning. contra costa sheriff's deputies believe bradley machugh was shot after couldn't fronting zavala and friends about speeding in the neighborhood. zavala is being held on a $1 million bail bond. in sonoma county the cleanup is just getting started today. the epa will address the efforts to remove hazardous materials. they will show off some of the equipment being used and the

containers that will store hazardous waste. libby schaaf will be giving her state of the city address tonight, it's an annual event. what's different this year the mayor will be giving her speech as an islamic cultural center. these are pictures that the mayor posted on her facebook page earlier in year. she says she wants to make tonights address about diversity, inclusion and compassion. tonight's speech starts at 6:30. more details, mayor's schaaf's address will be met with protests, the city is closing some facilities early because unions plan to start. they will close head start and senior centers and libraries at 2:00. the workers say they have no input in changing working conditions. coming up on "today in the bay" these are billion dollar corporations dropping the ball when it comes to protecting your private information. today former and present ceos from yahoo and equifax testify about what led to the massive

>> that is a bad day. >> i like being outside and even if i just have to pick up a few things here and there. as we take a look at the rain still well to the north of us, but here is the moisture that will be moving in, so as we start out today we have low 50s as we take a look at the peninsula looking live in palo alto and the seven-day forecast is up at the bottom of the screen showing a lot of rain drops there, but it won't be raining the whole time. the east bay 49 degrees. milpitas and san jose up to 68 degrees, the east bay also going to have upper 60s today, we will bring those temperatures down just a couple of degrees from yesterday mainly because we will have more cloud cover. redwood city expect a high of 65 today and 60 on the embarcadero, north bay going to see those highs in the mid 60s this afternoon and those breezy winds starting to pick up as we go through the day. as you're getting started this morning getting dressed we have mostly clear skies and some chilly temperatures.

so grab a nice warm jacket and you will probably be comfortable wearing some jeans or some pants today. as we get a look at the forecast for the school day in san jose right now we are going to see those temperatures in the low 50s, that's where we will be as you head out the door for the school day and then as the kids read out it's still going to be quite chilly only in the low 60s and heading home a little more comfortable with mid 60s. by early tomorrow morning we will start to see spotty activities popping up on the radar, we will start to see a little bit of the rain moving through here and there and some of the heavier showers may hold off until late tomorrow afternoon. most wraps up by saturday morning so looks like by saturday afternoon we will have a little clearing and time to get outside and then again on sunday another round of rain moving in from north to south. some of our rainfall totals may reach about a tenth of an inch up to a quarter of an inch and higher amounts farther to the north. so looking at mostly a light

rain, this does not look to be a big heavy rain event but at times that rain off and on may put a damper on your outdoor activities but as we check out this seven-day forecast more showers in the forecast, temperatures only reaching into the upper 50s for part of the weekend and early next week still a chance of rain in that forecast. as we head over to mike now, tracking a crash in fremont? >> i am. there is a passenger vehicle, reportedly there was a spinout off of 680, look at all these green sensors, this may show some slowing over the next few because that sedan over on the shoulder and now there is a big rig as well. i don't think they collided but there is more activity on the shoulder as you're coming out of the sunol area and into fremont. that may be an issue. meanwhile getting into the area out of the tri-valley the rest of the tri-valley moves well, even coming out of the altamonte pass. we talked about the altamonte pass, the altamonte commuter express that's where ace trains

gets the acronym, capitol corder no delays as well. we will look at palo alto where palo alto tall trees, we are looking at a smooth freeway, there are beautiful trees there as well. 4:49. police in england have issued an arrest warrant for the brother of the suicide bomber behind the ariana grand a concert attack. investigators say they are charging the bomber's brother with murder, attempted murder and conspiracy to charge an explosion. the brother is being detained by authorities in libya, english officials are asking them to expedite them. back in may 23 people were killed, 500 injured. new this morning the california family is safe three days after pirates attacked their boat in the amazon. these are images of the harto family. the mother is from sacramento. the family has been living in south america for five years and those over this investigation

say the gunman held them hostage after boarding their boat sunday in the amazon river delta. the couple and their two daughters eventually got away and they were found yesterday in good condition in brazil's northern jungle. it is 4:50. the kate steinle murder case continues today in san francisco. yesterday a revealing interrogation video of the suspect josé garcia zarate was the focus. zarate an undocumented immigrant was questioned using a translator. now, on the tape he offered three different versions of what happened during four hours of questioning. at one point he denied he was even on the pier, then he said he was shooting at a sea lion, he changed his story again saying he stepped on the begun and it went on accidentally. >> here is how the defense attorney explains his client's responses. >> i have seen a lot of videotapes of interrogations and it's very common that people do not want to started a myth to things until, you know, it's proven to them and demonstrated

dirty right now, just dirt. so looking forward to some of those showers to move through, it's still well to the north of us so we do have the day -- we will start to see some clouds moving in as we go into the horning and afternoon and our high temperatures will reach into the upper 60s so it will be nice and comfortable. we will talk about the cooler temperatures and the arrival time frame of the rain coming up in a few minutes. mike is checking out what's happening now on the roads. that's right, kari. we have right now some slowing, it's just starting to clear up in oakland. you see this one set of flashing lights, it looks like there was one last road crew that was clearing just south ft coliseum. that distraction as the crew clears the lane leads to a little slowing, you see it south down toward high street. just before you get through downtown all the way down to high street is where we have the arrow showing you down to the coliseum. that's the only issue on the east bay. we have a smooth drive. over in the tri-valley still following that crash in fremont for south
