as we start the day. 5:00 for you as we look at san jose. wet grounds as the rain came through last night. good morning and thanks for joining us, i'm marcus washington. >> i'm glad i didn't wash the car. i'm laura garcia. that's right. i listened to kari. >> hold off on washing the car today, too. the rain is coming back tomorrow. it will be round after round the next several days and hard to figure out when to go. as we start out this morning, all clear. the rain is out of here. the temperature starting out on the cool side in the north bay, upper 40s there. check out the high temperatures. going to be really nice today. you will want to get out and enjoy it. tomorrow, you may not have that chance. i'll talk about the timing of the arriving rain in a few minutes. mike is checking in on the south bay. >> anything north of there is not a problem. there may be mist and fog and slicker roadways.

over here, we have something left over, debris reported. not a lot of detail. pieces of wood approaching 87 should be a traffic break at most. chp doesn't seem concerned about it. just reported, north 17th at the summit, a crash leaving a lane blocked. northbound coming into the area, there may be an issue. i'll check with chp to see if they have details. no delays toward the bay bridge. that's a great drive. we are starting to see more cars. thank you very much. a fire overnight. breaking news we are covering. mulch no longer a threat. we just got video into the news room where firefighters say the call came in just before 4:00 in the morning. they had to force their way on to the property. it's an industrial area with a lot of towing and auto shops. they put the flames out in 45 minutes. no word on the cause. happening today, taking

action. the family of a boy who fell off a dublin water slide is taking the city and the slide's manufacturer to court. >> take a look at that incident. you can see that boy flying off the emerald plunge water slide. bob redell is live with the response to photos of the injured 10-year-old. bob? >> reporter: good morning to you, marcus and laura. at 11:00 a.m., the parents of the 10-year-old boy hurt on the tall, green slide behind me, along with a lawyer, will stand in front of it to announce they are suing the city of dublin and the manufacturer of that slide. within the past 24 hours, the family's attorney released these images, these photos of the boy's injuries. mainly scrapes to the back and shoulder as well as the arms and leg. he sustained those injuries six months ago on opening -- excuse me, opening day of the wave park. you can see the boy flew off the

slide, landed on the concrete. he was able to walk away on his own. the city kept the slide closed since then. cal osha shows the city tested the slide a number of times using crash dumbies. the slide still fails to pass. the city of dublin says it continues to express sympathy and concern for the boy and, as far as the legal action, i'm quoting, the family lawyer refused to provide the injuries necessary to resolve the claim. the city attempted to reach a settlement with the family, again, the city choosing to announce they are suing the city and the slide manufacturer. reporting live in dublin, bob redell, "today in the bay." >> thanks for the latest there, bob. happening today, more lawsuits set to be filed against pg&e. attorneys from five law firms

are joining forces to investigate and prosecute claims over the fire. there are lawsuits against the utility. utility company filed legal papers saying the tubbs fire might have been started by equipment owned and maintained by a third party. oakland is taking steps to prevent another tranlg gi like the ghost ship fire. they plan to hire a dozen fire investigators by next year. they will deal with the backlog of 1,000 state mandated inspection. >> until they make the necessary improvements for safety. >> the city is working with

owners to get code complaints. if you like to see the report, there's a link on our website. at 5:04, a follow up now. prosecutors are seeking to charge two high school football players as adults in connection with a recent sexual assault case. authorities say a student at an all girl's high school in walnut creek was raped by two high school football players. both suspects are currently charged as juveniles. prosecutors are now asking to try the suspects in adult court. if convicted, they face stiffer sentences. the bay area voted in favor of recreational use of marijuana. now, cities are left to decide where it can be sold legally. pete suratos joins us to talk about what officials say will be

the focus today. >> reporter: good morning to you, marcus. as you mentioned, voters approved it and allowed recreational use of marijuana for adults. they have to figure out how folks can sell it. a number of cities have taken up the discussion. san francisco and the board of supervisors talking about the issue. specifically, which dispensers are able to sell the recreational marijuana. it will be the existing dispensaries. 16 delivery services have to decide that. also the location of the shops. right now, you have to keep it between schools and dispensaries and an increase of 1500. then the big one here, the equity is to help those impacted by the war on drugs, a chance to succeed in this recreational industry. it's that equity program that has folks talking. >> you guys don't need help.

you don't need equity. we don't care about you, we need the money. that's what they are telling us. >> the longer we punt these land use decisions down the road, the longer that program is not going to take effect. it's fair criticism, a fair comment and a discussion point we are having right now. >> reporter: the city will take up the issue later today. the topics are similar and talk about current dispensaries selling the recreational marijuana. also, as far as obtaining a license from the state, submitting an application and city fees for those interested and prohibiting an owner from multiple dispensaries. the city of walnut creek will take up the issue with similar concerns today. the goal is to have some form of regulation in place by january, 2018. live in san francisco, pete suratos, "today in the bay." >> the change will be here before we know it.

thank you, pete. it is 5:07 right now. continuing coverage, president trump enroute back to the u.s. he's going to stop for fuel in hawaii then continue on to washington, d.c. the philippines bringing back $300 billion in trade deals. lawmakers are divided on tax reform, specifically whether property taxes should be deductible. >> the reality is we are going to address the problems with our tax code. >> a big chunk of the bill is being paid for on the backs of middle class families. >> the president is also returning home to controversy. a spokesperson says the president will review sexual misconduct allegations against the nominee, roy moore. there's also a report that donald trump jr. had a correspondence with wikileaks. we are coming up on 5:09. we will have a dry, beautiful

day. then we'll turn our attention to the incoming storm. we can see the center of that storm still well to the north of us. it's going to tap into subtropical moisture that will be funneled over the area. as we look at the timing, all dry today. by tomorrow afternoon, we'll start to see that rain moving into the north bay during the afternoon hours. it could bequite heavy and into san francisco, the east bay in time for the evening commute and to the south bay later tomorrow evening with still scattered showers in the forecast for late thursday night into early friday morning before this system tapers off. this could bring in gusty winds. we'll talk about the wind speed forecast coming up in a few minutes. as with we head over to mike, the commute is smooth, so far. >> we don't want to ruin a good look. a smooth, commute, despite the

right now, it's 5:13. the streets may be wet as you get ready to head out. a live look in san jose. the rain is cleared out. that will be the trend for the day, drying conditions as we look at what's going to happen in santa teresa. good morning, the temperatures upper 50s at 9:00. then today, the mid-60s with a mix of sun and clouds. this is the rest before we get a lot of wet weather moving in for tomorrow. i'll talk more about that and the wind speeds coming up in

five minutes. your freeway speeds are slower out of the altamont pass and pleasanton to sunol. >> thank you, kari and mike. we have breaking news out of tampa where there are new serial killer fears gripping a neighborhood. another person has been found dead in seminole heights, florida. it's an area there have been three other homicides. tampa police say they don't think they have gotten very far in reference to the killer. here is what else they are saying. they are calling the death suspicious. it is related to the other killings. nearby residents are told to stay inside their home. now, to the previous three deaths in the neighborhood, one person killed waiting for a bus, another walking down the street. the other victim was found in a vacant lot. all three of those victims shot dead. moments ago, one reporter tweeted this video saying she

can see officers on every street we are going to keep you updated on the story all morning. warning for anybody headed to the gas station. be on the lookout for scams. the gilroy police department is flooded with calls about bogus charges right now. officers found a credit card skimmer at a gas pump on 1st street. at least 40 victims had their card information skimmed. now, a few months ago, a gas station in antioch was hit by skimmers. we have tips on how to protect yourself. it is on www.nbcbayarea.com. the las vegas strip is about to get safer. city officials are taking steps to prevent the kind of terrorist attack that took place in new york city. they are putting in permanent steel barriers along the strip. they can with stand a 15,000

pound car traveling up to 50 miles per hour. they hope to have it up in time for new years. for the first time since the massacre in las vegas we are hearing from jason aldean. >> everybody was scrambling. you didn't know what was going on. it was panic is the best way i can describe it. everybody was kind of panicked. >> coming up on the "today" show, after "today in the bay," hear more from aldean in an nbc exclusive interview. >> the list keeps growing. another former tesla employee is coming forward of racist language inside the car makers fremont factory. an african-american worker said shortly after he started on the production line, co-workered started calling him a derogatory phrase. they filed a class action lawsuit saying the company has done nothing to stop the pattern of racist name calling.

they reported four other factory workers are suing tesla, alleging harassment and discrimination. tesla told us they provide anti-discrimination training. scott mcgrew continues our coverage here. >> steve serves on tesla's board as well as spacex. a very important venture capital firm. he tweeted, i am leaving dfj to focus on personal matters, including taking legal action against those whose false statements defamed me. they say he's been investigated for some sort of sexual harassment claim. as you sfraw from the tweet, he denies it. several others have run into

similar allegations. those cases, the accusers actually went public. a jury says the firm had not done anything wrong. interesting news out of redwood city. a company that makes a pill that can be detected by your phone. you wear that gray patch there, take the pill and your phone knows you took it. they made a deal with the maker of abilify, an anti-psychotic drug. families want to know they have taken the drug. this is the first ever digital pill approved by the fda. general electric got crushed after announcing they would get smaller. so small, in fact, there's talk of ge taking it off the list of dough 30 industrials. what replaces ge? googles parent company, alphabet and amazon, they are as big as

it moving in tomorrow afternoon. i want to show you how those winds pick up as that cold front and storm system approaches. we start to see the winds picking up around noon tomorrow to 30 miles per hour rushing in from the south. that will be moving as we go through the day, our winds increasing to 25 to 30 miles per hour as that rain arrives. not only will it be wet, it will be windy as well. that could bring down small tree limbs. we are looking at the possibility of seeing the rainfall totals over an inch of rain for much of the bay area. also want to show you what's going to happen in the sierra. we see the snow cranking up tonight by early tomorrow. then we are looking at the possibility of pretty good snowfall totals here. kirkwood may get 31 inches of snow. maybe 37 for king veil. as we are looking at the rain moving in for tomorrow afternoon, it will dry up friday, just in time for the

they initially told investigators. they said they were wrestling with him and realized he wasn't breathing. now investigators believe that wasn't the case. they believe the suspect used duct tape, but didn't tell investigators. separately, a report suggests he refused to pocket dirty money obtained by the suspects. happening today, a celebration of life held for former major league baseball pitcher, roy halladay. he died when his plane crashed. he was a two-time cy young award winner and pitched for the toronto blue jays and philadelphia phillies. he pitched a perfect game in 2010. >> i remember watching that. so sad to see so young. a bay area high school student is going nationwide after graduating to the next round of nbc's "the voice." ♪ i can feel it coming in the

a very good tuesday morning to you starting out with a live look outside. look at the clouds hovering over the transamerica pyramid. can't even make out a peek in that shot. wet roadways out to start our tuesday morning. good morning to you. thanks for joining us, i'm laura garcia. >> i'm marcus washington. we wake up to wet roads this morning. kari has been tracking it. you say we are going to be in the clear today. >> everything is clearing out. this is the break in between the storm system with beautiful sunshine expected today. notice the clouds here, the area of low pressure. that also bringing in that deep plume of moisture, all the clouds we are seeing. that will be moving in for tomorrow. as we track that, we will enjoy clear weather today and san francisco, a high of 61 degrees. it's going to be windy tomorrow, once that storm system rolls in, along with a heavy downpour we are expecting by thursday. we'll start to see this tapering

way home from china after being accused of shoplifting. during the midday newscast, president trump requested help from the chinese president. the players were obtained after stealing from a louis vuitton store in shanghai. they were seen at the airport checking into a flight to los angeles. one of the players is brothers with los angeles lakers star. he'll speak on the "today" show later this morning. the next story is something we have been talking about and hoping to find relief in it. talking about the housing kr crisis. leaders are expected to tackle the skyrocketing prices. kris sanchez is here to talk about help that could be on the way. good morning, kris. >> reporter: good morning to you, laura and marcus. certainly pressure on rent

continues to grow. all eyes are on the city and the county. they are discussing measures for those that could help struggles. they made themselves heard holding signs saying rent is too high and the city needs to put renters ahead of the rights of landlords. the city counsel will consider rent control options, one that caps increases, another that ties the increases to the consumer price index. you might remember, just on friday, we reported on data on how deep the struggle is for renters when it comes to paying rent. 25% of renters say they spent half of their income, half. 50% of renters spend a third of their income on rent. buying is not necessarily an option with the median home price of $775,000 in the bay area. if the city does not take

action, working families will end up on the streets, renters will end up with fewer protections. >> they will be voting on a series of proposals to tighten up our rent control and to help tenants be able to pay the rent. >> these folks right here are trying to repeal a historic win we had earlier this year to give valid reason to every renter before they are attempted to be kicked out of their apartment. >> reporter: the city is having their discussion at 1:30 this afternoon. at 9:30 this morning, a lot of folks are watching what happens at the supervisors meeting. they are considering $45 million in loans to help spur low income housing developments. that discussion at 9:30. i'm going to leave you the times and places of the meetings in case you want to show up and have your voice heard. you can find it on my facebook

her abilities to coerce the child thinking this is okay or if they don't do it, they will be punished. they go as far as making physical threats. sit the child down and ask what's going on. encourage them that they have done nothing wrong. >> try to talk to your kids. we asked about red flags indicating a child might be a victim. look for changes in behavior. reclusive or frightened. do they want to keep their bedroom door locked or ask for a night light? the seminar is at the almaden branch library, thursday the santa teresa bran sh library. a blow in the case for the shooting of kate steinle. a judge refused to allow a key expert to return to the stand. questions were raised about his

ability. in a separate case that ended in acquittal, he's accused of giving misleading testimony. zarate's attorney filed a motion saying they were not notified about the possible credibility issues. new this morning, bicyclists and walkers may have easier access. couns councilmembers gave approval. people using the iron horse trail can use it to get to nearby dublin/pleasanton bart station. right now, they have to leave the trail and cross a six-lane boulevard which can be dangerous. >> busy. a lot of traffic. the trail is so easy to get to the bart that's right there or, you know, get to the other side

incidents. more than half motivated by race. 20% motivated by religion. 18% were motivated by sexual orientation. powerful politicians asking tough questions about the president this morning. >> should the president be allowed to control america's nuclear weapons all by himself? scott mcgrew, that's a serious question. >> very serious. the most serious of all. the president can order a nuclear strike by himself. that's from the cold war when the president had minutes to decide whether to retaliate. these days, there's no cold war and we have a president asking why have nuclear weapons if we are not going to use them. then you remember this. >> as i said, they will be met with fire, fury and, frankly, power. the rights of which this world has never seen before. thank you. >> the foreign relations committee will hold a hearing about trump's access to nuclear

codes. bob corr will lead the hearing. corker is a republican, but he's had serious questions about the president's stability and confidence. congress has not considered or questioned the president's power in decades. the hearing starts at 7:00 a.m. our time. the president's son tweeted messages he exchanged with wikileaks during the campaign. it is not a crime, but calls into question whether the trump campaign coordinated with outside forces. wikileaks alerted donald trump jr. there were important e-mails to be found on the site. 15 minutes after it was sent to junior, donald trump sr. tweeted little pick up by the media of incredible information. so dishonest. the pick up trump himself found out minutes earlier.

really hard to bring light and laughter into the world. >> you can feel that love there he had for his mom. fallon tried to hold back those fears saying he would never stop trying to make his mother laugh. >> that's hard. new video for this morning as we pick up the next story here. new video for you. a potential tragedy overted. this man walks up to the train tracks outside of denver, colorado. the problem is, that man is blind. fortunately, someone was able to grab him from behind. i want you to see that if we can get the video. seconds later, that train cam passing by. up there in the right, you can see the man holding that other man as he walked up to that train and seconds later, you see that train pass by. that could have been a dangerous situation there. the man you see, the blind man is wyatt. he calling the man that saved him his guardian angel.

keeping kids safe from pesticides while at school. the state department will adopt rules to protect them. under the rules, california growers have to tell schools in advance if pesticides are being used within a quarter mile of the school. this is the first statewide standard. that policy takes effect january 1st. a crackdown on vaping. students at oak ridge high school may see changes this week after some teens were caught doing drugs on campus. a letter was sent home to parents saying teens are use zing vaping devices for tobacco and thc. it is odorless and smokeless so it's easier to hide. they are cracking down on restroom use because that is when a lot of vaping is taking place. >> i have seen a lot of people
