it's all about brightness and color. we have sparkles on the shimmer and shine float that is all the rage right now on nickelodeon. it's one of several floats we are going to show you coming up on the "today" show this morning. it's not just about the bright colors. we have some surprises. i'm finding a lot of confetti around. i haven't seen where it originates from, but we'll show you coming up later on the "today" show. guys? >> you always pick out your favorite. thank you, dylan. water park lawsuit. the parents of a young boy that went flying off the water slide get ready to take legal action. the reason they are worried about public safety in other places as well. the steps bay area leaders are taking to regulate the sale of marijuana. the calm between the storm. we are tracking a short break in the rain before another storm makes its way into the bay area. very good tuesday morning to you. thanks for waking up with us. i'm laura garcia. >> i'm marcus washington. tuesday. we made it through monday. now we are at tuesday. >> dry today? >> dry today. it's going to be nice. we are walking out the door, seeing the rain and the showers we had earlier this morning. the remnants of that with us this morning. patchy fog. look at this shot in dublin. a beautiful start to the day as we start to see the sunrising and clouds overhead. temperatures reach low to mid-60s. perfect day. then tomorrow, that rain rolls in. we'll talk about that time line in a few minutes. mike has a new warning for bridge goers. >> we have this shot from richmond to san rafael. the mist and the fog. kari was talking patchy fog at times. back upstarting at the toll plaza. this is right where the road is.

it shows that problem may be descending. that's what we have. rumors there may be a crash across the bridge to san rafael. it's critical. fog north of there. no major issues south of there. the toll plaza has a back up. we see this slowing. an earlier crash reported in the left lane. it is still there. we'll track it from chp. back to you. >> thank you very much. it is 6:02. the parents of the child seen in this video flying off a water slide in the east bay are filing a lawsuit against the water park, the city of dublin and others. >> this happened opening day in may at the wave water park in dublin. that's where we find bob redell with what parents are hoping will come from this. good morning, bob. >> reporter: good morning to you, marcus and laura. in five hours, the parents of the 10-year-old boy hurt on the slide behind me, along with

their lawyer will stand in front of the wave water park to announce they are suing the city of dublin an the manufacturer of the slide. in the past 24 hours, take a look at the tv screen, the family's attorney released the photos of the injuries. they are mainly scrapes to the back and shoulder, as well as the arms and leg. he sustained the injuries six months ago, opening day of this park. you can see in the video, the boy flew off the slide, landed on the concrete. he was able to walk away on his own. the city kept the slide closed since then. cal osha says they have been testing the slide useing crash test dumbies. the slide still failed to pass those tests. in a statement released, the city says it continues to express sympathy and concern to the boy. as for the legal action, the city and legal representative have attempted to reach a

settlement with the family, however the family lawyer refused to provide information about the family's jury that is are necessary to resolve the claim. as i mentioned, at 11:00 this morning, the family, the parents of the boy and their attorney will stand in front of the wave park to announce they are suing the city and the manufacturer of the slide. bob redell, "today in the bay." >> seeing those injuries, i hope they get that situated. thanks so much, bob. 6:04. happening today, more lawsuits expected to be filed against pg&e. attorneys from five law firms are joining forces over the fires. there are more lawsuits alleging the utility was neg limit. they have filed legal paperwork saying the tubbs fire may have been started by equipment owned and maintained by another party. preventing another tragedy

like the ghost ship fire. they pledged to hire a dozen fire code inspectors by the end of next year. 1,000 state mandated inspections. councilmember noel represents the district where it burned. he's hoping for faster inspections. >> there's 20 warehouse operations throughout the city that we shut down until the property owner makes all the necessary improvements for safety. >> the city is working with owners to get code compliance. if you would like to see the report, we have a link on our website. leaders in several bay area cities are meeting to talk about regulating marijuana in cities across the state for recreational pot to become legal in the new year. pete suratos is live in san francisco. i know you have been following this story. explain what leaders are doing today to regulate the drug. >> reporter: good morning to you, marcus. we have several cities from san francisco, san jose and walnut

creek hashing out how they are going to regulate the sales of recreational marijuana in their city. details in a couple months. san francisco, the board of supervisors meeting later today on a number of topics they are going to discuss, specifically which dispensaries are able to sell recreational marijuana. there are 30 dispensaries and 60 delivery services. also the location of the shops. right now, you have a 1,000 foot bumper between schools. maybe they will increase it to 1,500 feet. equity helps out communities who are historically disenfranchised by the war on drugs, giving them a chance. the equity program has been a hot topic of discussion. >> you don't need help. you don't need equity. you don't need anything. we don't care, we want the money. >> the longer we punt the land

use decisions down the road, the longer that equity program is not going to take effect. it's fair criticism. a fair comment and a discussion point we are having right now. >> reporter: san jose is going to meet to discuss the topic later today. their topics are similar as far as which dispensers will sell recreational marijuana. the protocol for the dispensaries as far as obtaining a license from the state and prohibiting multiple dispensaries. the goal for the city is to have these regulations in place by january of 2018. live in san francisco, pete suratos, "today in the bay." >> thanks for the latest there, pete. 6:07 right now. follow up. prosecutors seeking to charge two high school football players as adults in connection with the recent sexual assault case. authorities say a student at the all girls high school in walnut creek was raped in september by

ready to head out, it is soggy. the wet weather has mostly moved on. the roads are wet, cloudy skies and patchy fog and drizzle. willow glen, 50s, warming up to the mid-60s today with sunshine. we talk about the incoming storm and the time line coming up at 6:19. the glowing light showing the low clouds, fog here at the richmond/san rafael bridge. the san rafael side jams up toward san quentin. >> thank you, kari and mike. we have been following breaking news out of tampa where there are serial killer fears gripping a neighborhood. another person has been found shot dead in seminole heights, florida, an area where there have been three other homicides. they are calling the death suspicious and treating the situation as related to the other killings. nearby residents are told to

stay inside their home. now to the previous three deaths in that neighborhood i mentioned, one person was waiting for a bus, another just walking down a street and another victim found in a vacant lot, all of them shot dead. we'll keep you updated on the story all morning long. the las vegas strip is about to get safer. city officials taking steps to prevent the terror attack to took place in new york city. they are putting up steel barriers. they say they can with stand a 15,000 pound car traveling up to 50 miles an hour. the city plans to have the entire vegas strip protected in time for new years. 6:15. new this morning, a dallas county d.a. is out of a job after an uber driver says she hit him, assaulted him and accused him of kidnapping her. he was taking her home friday night when she slapped his

shoulder and berated him. warner worked in the d.a.'s office for six years as a prosecutor for crimes against children. we are hearing from the uber driver. >> i want to go home so badly, but you are so stupid, i want the cops to come so they can [ bleep ]. everything is being reported. i am a district attorney [ bleep ]. >> the dallas district attorney said warner had been fired saying the behavior is opposite of the core principle of integrity. business and tech news, one of tesla's board members is leaving the company. >> scott mcgrew explains why. >> steve serves on tesla's board as well as spacex. a very important venture capital firm. he tweeted i am leaving dfj to focus on personal matters,

including taking legal action against those whose false statements defamed me. several news outlets say he has been investigated for harassment claim. as you saw from the tweet, he denies it. he is on the board of spacex and tesla. several men have run into similar cases. their accusers went public. general electric is getting so small, they may be off the dow 30 industrial. who would replace it? googles parent company alphabet and amazon, but they are too expensive. amazon is trading above, $1,000 a share. really interesting news out of redwood city, a company called proteus is making a bill that can be detected.

roads, then that san francisco camera is all fogged over and drizzling as well. we can see that beautiful shot in the north bay with patchy fog in spots, 46 degrees now. as we look at the high temperatures, it's going to be very comfortable, especially with that sunshine, with the highs in spots like concord in the upper 60s. mostly mid-60s. san jose, 65 degrees. this is our break before we start to see more wet weather moving in, we can see this cluster of clouds. this is going to be a tap of pineapple express-type moisture. then it's going to be brought in by an area of low pressure well to the north of us. looking at the timing, we see that rain moving in from the north bay. by tomorrow afternoon, by 2:30, we start to see heavy downpours moving in. makings it into san francisco in time for the afternoon to evening commute and during the sunset hours, we see that moving into the south bay as well as the east bay. that first initial round will be

quite heavy. then we start to have after cold front rain, post cold front rain moving in for early on friday morning. looking at how much we could see, about an inch of rain for much of the bay area, may be higher in the coastal areas in the mountains. the winds will pick up as well. that may be another concern. we start to see those winds increase from the south coming up at noon tomorrow afternoon. for the rest of the bay area, the winds picking up to 25-30 miles per hour. so, not only will it be wet, it will be windy. temperatures dropping to the upper 50s for san francisco. inland areas stay in the 60s and clearing out for the weekend. mike is showing us what's happening now at the richmond/san rafael bridge. >> west 580 should see recovery. look how much it's built up. the richmond side to san quentin with a crash. it's cleared from the roadway.

professor is testing a new new this morning, university of north texas professor is testing a new program that could help improve radiation treatments for kids with cancer. the doctor is working on a program called promise. it distracts kids during radiation by using a special cartoon. if kids move too much, it stops or turns off. it's designed to encourage kids to be still without using

out of here. windy tomorrow as that storm system approaches and our first real pineapple express of the season bringing heavy rainfall for tomorrow evening into early thursday. so, i'll have more details on that coming up in a few minutes. mike is tracking the ripple effect for the east bay. >> now i'm thinking about pineapple. the east bay, the red zone. we have a lot slower speeds kicking up from highway 4 to the bay bridge, 42 minutes. the reason is because of the earlier crash. san quentin folks, west 580, the bridge is jammed up. try the bay bridge as an alternate. the richmond to san rafael bridge cleared. pretty standard, but more traffic could lead to more problems at the toll plaza. we have a slower drive for hayward. the northbound build is standard. peninsula, very light traffic.

we'll talk about the santa cruz mountains coming up. back to you. >> sounds good. thank you. 6:31 right now. happening today, a battle for affordable housing heats up. >> leaders will talk about plans for rent control and creating low income housing. kris sanchez joins us live in san jose with what it could mean for your wallet. good morning, kris. >> hi, there. the pressure is growing for the city and the county and the elected leaders to do something to help people who are stuck, trying to pay rent. there should be no doubt for these elected leaders where the housing advocates stand. >> fight, fight, fight. housing is our right. >> reporter: here at san jose city hall yesterday as renters made themselves heard. they held signs saying rent is too high. renters need to be before

landlords. they want to cap the increases or tie them to the consumer price index so they can't go up too fast, too far. we have data on how the struggle is when it comes to paying rent. 25% of renters spend half of what they make on rent. 50% of renters spend a third of their income on rent and buying is not an option for a lot of folks with a median home price of $775,000 in the bay area. if the city does not take action, working families will end up on the streets, the renters will end up with fewer protections. >> they will be voting on a series of proposals to tighten up our rent control and to help tenants be able to pay the rent. >> these folks right here are trying to repeal an historic win that we had earlier this year to give valid reason to every

requested help from the chinese president. the players were detained after stealing from louie vi tan in shanghai. they were seen in the shanghai airport getting on to a flight. one is the brother of a los angeles lakers star. he speaks on the "today" show later this morning after "today in the bay." 6:35. happening today, tensions will likely be high in stanford where a controversial speaker is set to speak. he is known for views on cable news on muslims. he calls himself an expert on radical islam. they invited him to lecture on terrorism, but it is sparking backlash. they call spencer a pundit who promotes hate. he is scheduled to appear at 8:00 p.m. san carlos leaders halted the opening of a store selling guns and ammunition. in a meeting councilmembers approved a temporary 45 day moritorium on retailers selling

guns and ammunition. this is backlash over opening turner's outdoorsman. they sell firearms. it brought out emotion on both sides of the issue. >> they have invested money and obtained a space to put in a lawful business that is regulated by the state. >> there's a swimming center, a dance school, a laser quest, so the young boys do laser, then the gun store and check them out? >> at the next meeting, the council is expected to expand the moritorium to one year and in all likelihood stopping turner's outdoorsman from ever opening. the company is threatening legal action. the first of three seminars aimed at helping identify sexual abuse. "today in the bay" talked to an advocate to keep kids safe. authority figures will try to groom victims. it's not a familiar term. you may have heard raisman

talking about it on the "today" show. in a new interview, an organizer called grooming the process a predator use zs to identify and build a relationship with the victim. >> the predator, you know, utilizes his or her abilities to coerce the child in thinking this is okay or if they don't, they will be punished or make physical threats. sit the child down and be open and ask, what's going on and encourage them, let them know they have done nothing wrong. >> that's his advice to parents. talk to your kids. we asked about red flags on a child being a victim. look for changes in behavior, reclusive, frightened, doors locked. there is a meeting thursday at santa teresa library. this morning, we are getting a sense of how many hate crimes are being reported nationwide.

the fbi released data showing 6,000 criminal incidents in 2016. more than half motivated by race. more than 20% were motivated by religion. 18% by sexual orientation. new this morning, bicyclists and walkers may have safer and easier access over an east bay corridor. a new steel truss bridge over dublin boulevard for people using the iron horse trail. people can use that trail to get to nearby dublin/pleasanton station. right now, they have to cross a six-lane boulevard. it can really cause dangerous activity for a lot of people. >> you know, dublin is always busy. there's a lot of traffic. the train is like so easy, you know, to get to bart that's right there or, you know, get to the other side of pleasanton.

yeah, having a foot bridge or something would be great. >> yeah, this is very slow. a bridge will help. >> the bridge is expected to cost around $7 million. funding could come from a measure voters approved two years ago. let's look at the roadways as they currently stand. more traffic through hayward and also through the south bay, silicon valley shows the build. we see relief through 17 coming up from the santa cruz side. the crash at the summit and possibly the second one near redwood are cleared from the roadway. that's much better news. southbound, to santa cruz, no problems. 42 is still at the top of the krein. it went as low as 38. slower through berkeley. no problems for bart. that's one good option to avoid the east shore freeway. >> there you go. think about what you are going to do next weekend.

you can tell the roads are wet still from the rain last night. let's go to los gatos for the temperature trend. the temperatures mid-60s at 10:00, mid-60s, later. rain moves in. i'll have a look at the time line and what you can expect where you live in about five minutes. we have more clouds here in san rafael. this shot looks like light traffic, it's not. it's a tough drive. i'm going to point out a couple things you can barely make out through the low clouds. 6:45. new this morning, an overnight fire is no longer a threat. we just got video into the news room. that call came just before 4:00 a.m. they say they had to force their way on to the property near oakland road, an industrial area with multiple tow and auto shops. they say they put the flames out in 45 minutes. no word on the cause. 6:45. looking live in dublin.

today, the family of boy who fell off a water slide filing a lawsuit. the family plans to sue the city and the slide's manufacturers. within the past 24 hours, the family's attorney releasing these photos of the injuries, scrapes and bruises. you may recall the video that showed him flying off the emerald plunge. he landed on the concrete but was able to walk away. we'll hear from the family later this morning. the city tried to reach a settlement. happening today, a celebration of life will be held for former major league baseball pitcher, roy halladay. he died last week when a plane he was flying crashed off the coast of florida. he was 40 years old. held a two-time cy young award winner and pitched for the toronto blue jays and philadelphia fillties. he is credited for pitching a perfect game in 2010. the first time since the massacre in las vegas, we are
