5:00. are you ready for thanksgiving? of course you have to gro to the store to pick up the last minute things. take the turkey out of the freezer, now, and get it ready. good morning and thanks for joining us. i'm marcus washington. >> i'm laura garcia. the temperatures are going to cooperate, mild, right? >> yes. as you are cleaning the house, you can open up the windows and doors and let the fresh area. i love that this time of year. we are going to have more comfortable weather in san francisco, all clear. then maybe you want to get in an early morning jog before you really get this day started. our temperatures will be in the mid-50s and really nice as we go throughout the rest of the morning with low 60s later today. upper 60s for that high temperature in san francisco. look at san jose, 75 degrees. warming up here as we head closer to the holiday. i'll talk about what's ahead in a few minutes. mike, what's happening at the bay bridge? >> for most commutes, we are

entering the holiday season. the bay bridge did see a back up. then i saw these folks from the hov lane and squeeze over. looks like everything is back to normal. for a few minutes, there may have been a minor fender bender and looks like one of the cash lanes is not open. this should clear before they turn on the metering lights. the timing lets us know about the maze. slowing from highway 24 away from the toll plaza. no other slowing around the bay. back to you. >> thank you. it is 5:01. a san jose police officer recovering after being attacked by several suspects overnight. bob redell joins us live at the university with what investigators are telling us happened. good morning, bob. >> reporter: good morning to you, laura. we are not clear whether or not the police officer is the one who initiated contact with the three suspects or if the three suspects jumped him. we know that officer was

attacked, punched at least one time in the nose. this happened around 12:20 this morning, a block off campus. the sergeant who was on his bicycle ended up in an altercation. a number of people were taken to the hospital, including this sergeant who was being treated and is going to be okay. his colleagues, other officers did respond. they arrested all three suspects. we are not showing the suspects faces. it's not clear whether or not they are juveniles. one was tased and another hit with a baton. the third suspect taken into custody without incident. reporting live in san jose state university, bob redell, "today in the bay." >> thanks, bob. 5:02. a developing story. ntsb is investigating two more close calls at san francisco international airport. both involve plane that is could have ended up on the runway at

the same time. pete suratos is at the airport with what we know so far. this is a time so many people are traveling during the busiest travel season of the year. >> reporter: good morning to you, marcus. that's right, a lot of people flying out of town for the holidays, specifically thanksgiving for a couple days. it's the national transportation safety board handling the investigation to the two new incidents. this is after two more that involve air canada. here is an animation shows what happened in july of this year. i want to bring down a time line of the recent incidents at sfo. the new ones we are learning about take place in february of 2016. this involves compass airline. their plane was forced to abort because a virgin america jet was lined up and waiting to take off on the same runway. the other warning, in december 2016, a sky west plane crossing

a painted runway line. he was supposed to stay behind while a plane was taking off. now, the two incidents i mentioned involving air canada, the first was in july of 2017. air canada plane almost lands on a taxiway where four other planes were on the ground. they pulled up just in time. then in october, air canada having a communications breakdown what a jet ignored or did not receive instructions to abort a landing. there were no injuries, but in the fiscal year ending in september, many incidents happening. we are live at sfo, pete suratos for "today in the bay." >> a lot of information there pete, thank you so much. immigrant rights supporters this morning, are plotting a huge, legal victory for sanctuary cities. a federal judge blocked president trump's executive

order to cut funding for sanctuary cities. in his ruling, the judge says the president cannot set new conditions on spending approved by congress, calling it uninstitutional. santa clara county says it will be a knockout blow to the white house. >> the trump administration has lost every step of the way, not only on legal procedure, but they have failed to understand the constitution of the united states. >> santa clara county stood to lose $1.7 billion if the order was upheld. many experts believe the white house will appeal to the u.s. supreme court. meantime, we are learning president trump is expected to speak with russian president, vladimir putin today. >> "today in the bay's" tracie potts joins us from washington with more on what the conversation is expected to be agent. good morning. >> reporter: good morning, marcus and laura. thinker supposed to talk about

syria, one of the countries the u.s. says is a state that sponsors terror. the president wants to expand that list as he also takes care of ceremonial duties for the week. the turkey's have arrived, staying in a luxury d.c. hotel, awaiting a presidential pardon today. first, a major shift in u.s. policy on north korea. >> the united states is designating north korea as a state sponsor of terrorists. should have happened a long time ago. should have happened years ago. >> reporter: this move makes it easier to impose sanctions. >> north korea repeatedly supported international terrorism including assassinations on foreign soil. >> reporter: it's part of a pressure campaign. >> we hope for diplomacy. the timing of this is just one of us concluding the process. >> reporter: before leaving for

mara largo, president trump is laying out welfare reform, but first taxes. senators are concerned the biggest tax cut in history could swell the deficit, put small businesses at a disadvantage and raise health premium ifs they get rid of the mandate for insurance. it's up for a decision with the next vote scheduled after thanksgiving. but, after thanksgiving doesn't give them a lot of time to deal with this with the goal being to get it done by christmas. laura? marcus? >> tracie potts live from washington. we appreciate it, thank you. 5:07. a follow up to a settlement has been reached in the deadly berkeley balcony crash. five students from ireland and another from roanoke park were killed. seven other irish students were hurt. a partial settlement has

been reached with the defendants who owned and managed the complex. the settlement is confidential. continuing coverage, there is a lawsuit related to the north bay wildfires. four people at the oakmont facility are suing management. according to the press democrat, the staff abandoned some residents during the fire. the facility was destroyed during the tubbs fire. they have lodged a formal investigation. police say more drivers are finding out that they are victims in the car sting operation at two gilroy gas stations. last week, they found devices on pumps on 1st and westwood near monterey road. investigators believe there may be at least 200 victims. the skimmers are undetectable to

customers. thieves obtain atm cards and numbers. one victim had $900 stolen. she uses both gas stations. >> luckily, my bank took care of it. it's an inconvenience. this time of year, it's hard to lose that much money. >> investigators are looking at surveillance video to term who might have planted the devices. the station has put up near shields to indicate tampering. at 5:09, a live look at the bay bridge toll plaza. chp asking drivers to be careful. every morning, wear your seatbelts, slow down as you travel for thanksgiving. a maximum enforcement goes into effect tomorrow. 27 people died during the thanksgiving travel season last year. let's hope those numbers are reduced if none at all.

right now, as we approach 5:10, if you are traveling, driving farther north, i-5, wet roads. we are seeing the showers near mendocino county and to the east. looking at the national picture, here, we are going to have mid-70s and drying conditions. they have snow around detroit, but we are seeing some of the snow flurries tapering off. temperatures today, reaching the low 50s. and for areas like florida, they are going to have rain today. it's going to be very nice and mild. we'll bring you back home and take a look at our temperature trend for the day coming up in a few minutes. mike, you are updating us on the crash in san jose. >> nothing more than the crash. that's good news. i don't mind that you drive right now. a light build. looking here southbound 101, underneath that 880, the earlier crash made its way to the shoulder. no slowing or further updates from chp.

right now at 5:14, we walk out the door to milder weather. right now, mid-50s and clearing skies for the south bay. as we go to willow glen for the temperature trend, we start to gradually warm up by late morning. a mix of sun and clouds. look how warm it will be by 3:00, up to 73 degrees. normally, 63 degrees. more of this well above average as we go into the next few days. then we throw in rain. we'll talk about that in five minutes. >> taking a long look at 880, nimitz has traffic, but doesn't have a problem. that's great past the coliseum. how things are shaping up, the changes that continue at the bay bridge toll plaza. >> thanks, kari and mike. it is 5:134. cbs and pbs suspended charlie rose after explosive allegations

he sexually harassed multiple women. new this morning, within the last hour, rose's co-anchor, norah o'donnell had this to say. >> let me be very clear, there is no excuse for this alleged behavior. it is systematic and pervasive. >> the allegations are part of an expose published by "the washington post." it lists eight women, some identified others with held their name. each said they experienced rose grope them, made lewd phone calls or appeared naked in their presence. he apologized and does not believe all allegations against him are accurate. sacramento's transit system is recovering from a hack attack. now the hack did not affect buses and trains, but affected how some fares are paid. i.t. teams are trying to recover

the data deleted during the attack. they demanded $8,000 in bit coin. they did not give in and took it offline. >> they shut down the network. it was determined we had a cyber attack and that files were being deleted. >> the attack started with a message on the agency's website when teams went in to investigation that message, it opened a wider attack on the network. uber could be facing a $9 million fine in colorado. investigators found dozens of drivers giving rides who shouldn't have been allowed to. the yearlong plus investigation found 57 uber drivers should not have passed a criminal background check. 12 of the drivers had felony convictions. 17 have major moving violations, three penalized for driving under the influence. dozens have drivers license

problems. one offender, at one point, escapeed from the colorado department of corrections. the company is working to resolve the errors in the background check process. the drivers mentioned specifically in the investigation are no longer driving with the company. of course, some day there will be no uber drivers. >> scott mcgrew joins us now. >> one step closer. uber made a deal with volvo. they are fit with automation hardware to eventually pick up passengers automatically. we have seen them in san francisco. uber didn't have permits at the time to do it. automated uber is one step closer. that is a privately held company. volvo is a chinese company. there is an american stock play in this. the chips that go into the ubers. the stock is near a record high. stitch fix continues to be a mess. it is now trading below its own

ipo price. they debuted on the markets friday. except for a quick spike, it's been downhill ever since. we should hear more detail about the plan to end net neutrality rules. the fcc chairman will talk more about that. internet companies, start up, facebook and google oppose it, too. comcast is in favor. this tv station, by the way, owned by comcast. it is the idea that everything should be treated equal. nobody should get a fast lane and nobody should be slowed down for not paying extra. marcus and laura, i think every science fiction movie starts with a newscaster saying a strange item entered the atmosphere. the first documented object.

the bottom of the screen, we will have very warm weather for this time of year, reaching the mid-70s for the south bay. as you step out in the low 50s, 55 degrees in oakland. san jose, 54 degrees. as we get a look at where we are headed for today, going to see mid to upper 70s this afternoon. gilroy, 76 degrees. 74 in m-- the peninsula, expect highs in 70 in half-moon bay and san francisco upper 60s, north bay lower 70s. as we go through the day planner in oakland, starpts at 56 degrees. a cool start. a comfortable afternoon, upper 60s. if you have the day off, the hiking trails in the south bay, clouds. sunny with breezy winds and highs reaching the upper 60s to low 70s or going golfing in the tri-valley, we will have a start

in the mid-50s. 69 degrees by 2:00 or 3:00 today. as we go to the rest of the forecast, warm in san francisco, reaching 70 tomorrow. a slight rain chance thanksgiving for the evening. for the weekend, we will have another chance of rain moving in on sunday. mike, you are talking act a few of those changes at the bay bridge. >> the only changes we are seeing. the bay bridge, a back up. they may have turned the metering lights on. this is about the time they typically do. this is a slower build. we look at the map, no problems. no slowing on the approach of the upper east shore freeway. we see a lighter volume of traffic. we have the metering lights on the typical schedule. we expect a morning commute, but lighter than a tuesday. the rest of the bay, the south bay, the tri-valley, no problems. mass transit, no delays reported for the rails. that's great news for folk who is want to take a ride on the regular schedule. back to you. >> thanks, mike. the massive explosion that

take a look at this video from overnight-- after a high pressured gas main developing news out of michigan. take a look at this from overnight after a high pressure gas main explode d led to this fire. you can see the flames shooting into the air. city officials say they shut down the gas line so the fire burned itself out. so far new york city reports of injuries. if you happen to have lost your job or missed work because of the fires, you have more time to file for unemployment. they have filed an extension. it's until december 18. there have been 4700 unemployment claims filed because of the fire. coming up next on "today in the bay," remembering a police canine killed in the line of duty. how the police department is honoring the life of jax today. bart downtown, the question is, how is it going to get there? we are digging into the

garcia. >> i'm marcus washington. we want to head over to meteorologist, kari hall to look at the forecast. >> it starts with clearing skies for the south bay. still clouds and rain farther to the north. we have seen showers rolling by early and year ukiah and to the north. that's moving away from us. we will be left with dry weather and mostly sunny skies. temperatures reaching 75 degrees. 71 in livermore and napa, 73 degrees with upper 60s in san francisco and along the coast. as we go to the next several days, it will change. we have rain returning this weekend. i'll have a look at that weekend forecast in seven minutes. mike has confirmation from chp. >> i am watching for your confirmation. i'll be at christmas in the park, fingers crossed. here, we are looking at a back up at the bay bridge. the metering lights are on. typical time or typical back up. at least from this view.

the travel times, easy drive from the maze. as you look at the speed sensors, travel is lighter around the bay, including the bay bridge. we have that back up there because the metering lights are on typical schedule. the altamont pass, mild back up from there. no other slowing for the rest of the bay. we will track it to see how things shape up. back to you. >> thanks, mike. new this morning, a fire on an interstate off ramp overnight. we got this video into the news room. those flames are out already. crews stated the fire broke out under the bird avenue off ramp from northbound 280 in san jose. caltrans is making sure there is no lasting damage. transit leaders are weighing their options when it comes to building bart's south bay extension. one proposal builds turnls. >> kris sanchez is live in san jose with what is next for the project. good morning, kris. >> reporter: hi, there, marcus

and laura. bart to san jose would be six miles from the station where we are behind this fence here, still under construction, to downtown san jose. the question is, how is it going to get there. work aboveground is just about complete here. it's the work underground that is still up in the air. the design, santa clara valley transportation wants is less disruptive to businesses. according to the news, it isn't used as often and costs are less predictable. i pulled up the two designs for you to look at what we are talking about here. the transportation authority has a single tunnel design underground with trains running above and below each other. the other design is the bore where the trains run side by side, like what you would see in an existing bart station. to make this decision, they agreed to peer review by agencies with rail operation

safety and maintenance experience. they, that panel did not favor the single bore option. in the bta log spokesperson wrote the panel identified key operational considerations related to fire, life, safety that would need to be addressed in the design to better meet bart's operating rirkts. the panel concluded that the twin bore operation would be preferred over the current design. the spokesperson said bta understands bart likes to do things the way they always have. the decision will come down to not what bart wants, but what is best for the people of santa clara county, which it will serve. i'm going to post the two designed on twitter and facebook so you can see them for yourself if you are curious. the decision, meanwhile, is expected sometime in january. in san jose, kris sanchez, "today in the bay." >> interesting to see those

designs. thank you. 5:33 right nou. closing argue mlts continue in the kate steinle murder case. the prosecution will offer a rebuttal. after that, the case goes to jurors. the jury can consider a first degree murder charge. jurors are deciding if zarate intended to shoot steinle or if it was an accident. you can check the updates on twitter from the courtroom and right after at www.nbcbayarea.com. continuing coverage now, police are trying to find whoever killed a redwood city father this weekend. it happened near san leandro's mall. it happened during a cell phone sale arranged online. police identified the victim as 32-year-old daniel carlos. he was survived or is survived by his wife and 5-year-old daughter. yesterday, we spoke with the victim's family. his cousin talked about telling the little girl her father

tobacco ads are banned. there are 130 marijuana dispensary ads on muni vehicles. the most racially unequal county in the state. we looked through a report from the civil rights organization. they examined performance in areas like crime, education, housing and economic opportunity. whites are among the highest performing racial groups. many indicators, asian americans appear to be doing well. it shows marin county tops the charts in most categories. county officials say they will launch new trading to address racism in marin's racial history. how much money will people in the bay area spend this holiday season? it said around $1500. last year, ift was $1300. that's according to new data. they might be spending more, but they will find less. the average person will buy ten

gifts. last year, the average was 12 gifts. the top three gift items this year, clothing, electronics and gift cards. yesterday, we showed you san jose's sacred heart community service giving away hundreds of thanksgiving meals. >> it continues today. yesterday, nearly 1,000 meals were handed out. 50 pounds of food in those boxes, including a turkey. more will be handed out. holidays can be extra tough for families. we just want to remind, you know, folks that there's people here that are struggling. the rent is too high, prices keep going up, wages are staying the same. i feel like there's an extra request, i guess, to support one another this time of year. >> sacred heart wants to donate 4200 turkeys this week. it's 1,000 turkeys short. if you want to help, we have information on

www.nbcbayarea.com. looking over here toward the bay bridge, we are looking at a smooth flow of traffic. it's lighter than our day-to-day traffic. a little slowing for the upper east shore freeway toward berkeley and out of richmond. the bay bridge metering lights are on. i call your attention here, the disabled vehicle reported. a truck there, east 24 as you make the split toward 580. it's where the roads split up in that case. the triangle there. it should be out of lanes. a slowing there. make sure no one gets scared by whizzing cars going by. the rest of the bay, the cars are whizzing through the area, pretty much at the speed limit. some folks already have thanksgiving day on their mind, they are already on vacation. we still think about vacation, weekend, holidays. >> kids are already off, a lot of them. >> my kids are. my niece and nephew go through

wednesday. >> what are you doing? >> in bed. >> there you go. everybody getting ready. it's right around the corner. decent weather this week? >> yeah, then the weekend, we are tracking more rain moving in. saturday is the day to get out there. look tat forecast. it will be in the mid-60s and low 70s for the inland area. cooler, then we are going to have, for sunday, a chance of rain rolling back in especially during the afternoon. inland areas, upper 60s. low to mid-60s for the coast and the bay. as we check out the places you may be heading, everyone is encouraged to get out there and enjoy time at the national park. after thanksgiving, we will have breezy wind and highs in the mid-60s in muir woods. saturday, mostly cloudy. then that rain starts to move in on sunday. if you are planning to hit the road, maybe you are going to heavenly. it is going to be partly cloudy and a nice weekend until you start to head back home. we'll start to see that rain moving in.

if you are going up to lake shasta, a lot of showers in the forecast for the weekend. mostly cloudy skies and cooler temperatures. we are only going to make it to the low 50s by the end of the weekend, then, if you are going down to carmel valley, the warmest day will be on friday. check that out. 81 degrees. cooling down as the weekend goes along and as the rain moves in as well. i will have a look at today's temperature trend in three minutes. >> sounds good. thanks, kari. it's 5:43. we begin with clear skies in the south bay. it's going to be a very nice afternoon. let's go to the neighborhood of evergreen. the temperatures will be 52 degrees at 7:00. as we go through the day, look at that. 73 degrees. we should be at about 63 degrees. it's still going to be very warm for this time of year. even as we go to the next several days, we'll talk abltd that and the next chance of rain coming up in five minutes. there is slowing there.

mild out of vallejo. typical pattern, lighter than typical volume for this tuesday. we'll show you how things are shaping up toward the bay bridge and the east shore freeway as well. >> sounds good. we'll check back with you. it is approaching 5:45. bart calling the latest set back for the new cars a bump in the road. the agency says it can be fixed in a matter of days. they hoped to have new cars in service by thanksgiving. according to the examiner, that is off the table because the cars didn't pass inspection. the debut may come as early as december. 5:44. despite ef forfeits by trump and republican leaders, sign up for the affordable care act is outpacing numbers. in california, the numbers are higher. the uninsured rate for states that did not create their own

health exchanges is 16%. the states that had their own exchanges, the uninsured rate is 8%. in california, that's lower. in fact, take a look at these numbers. since cover california began in 2013, uninsured rate has gone down every year. this year, it's expected to dip below 7%. >> another defeat for the president in court. >> this time, scott mcgrew, over sanctuary cities. >> that's exactly right. good morning to you. well, i haven't got a camera to talk into. i'll talk about sanctuary cities. a san francisco judge says the president's threats to with hold money from sanctuary cities is not constitutional. here, we see the president sign thag order early in his presidency. san francisco and santa clara county sued to stop it and it has, indeed, been stopped. though the white house can
