the news starts right now. good evening, everyone, i'm terry mcsweeney. >> and i'm vicky nguyen. because of "sunday night football," it's a prime time edition of nbc bay area news. a live look over downtown san jose. on and off rain throughout the evening. a beautiful look at christmas in the park. >> team coverage of the storm starting with our meteorologist. the heaviest rain isn't here yet. >> next three hours it will start to make its way in, after we've seen an inch of rain in san rafael, marin county. san francisco, 1/3 of an inch to almost 1/2 inch of rain. notice how the hotels from the peninsula into the south bay really drop off. that rain shadow effect we see off the santa cruz mountains. we're about to catch up in that rainfall department as just offshore, not light rain showers like we've seen for most of the day in the south bay, but coninvestigati showers and thunderstorms that will move in right around

midnight. the future cast, heaviest rain we've seen in the last 24 hours coming in at midnight. you see the bow shape there, indicating some gusty winds try, from about 12:00 a.m. to 3:00 a.m. you'll notice the wind speeds ramping up. 20 to 30 miles per hour after midnight. so the question is how much of this will carry through the rest of your monday morning compute and monday work week forecast? the answer in our hour-by-hour outset coming up. it has been a dangerous weekend on the road. unsafe speed and bald tires appear to be the cause of this deadly accident in marin avenue. the van's roof ripped off. the driver was ejected and that van ended up landing on top of the man. he was pronounced dead at the scene. in addition to driving too fast, a preliminarily investigation shows the van likely hydroplaned because the tires were worn out.

>> we just want to remind people during these rainy conditions to slow down, you know, give yourself a nice safe cushion between vehicles. use your headlights. when your headlights are on, activate your windshield wipers. >> there was a huge backup there, but all lanes of 101 reopened shortly before noon. another deadly accident. on i-80 in emeryville. just before 10:00 this morning. a green pickup lost control, spun out, came to a stop blocking a lane and the chp says a white car traveling too fast for the conditions slammed into the that pickup. a passenger is in the car was killed while three other people were taken to the hospital. now an update to our top story from last night. a man has been arrested in the fatal hit-and-run that left four people dead in san pablo. that as the chp is operating under what's called a maximum enforcement period. nbc bay area ancer hasan rode along with chp officers tonight.

>> reporter: the driver in saturday night's deadly hit-and-run arrested after he was involved in another hit-and-run with a parked car hours later. >> the witness identified the driver. saw him exit the vehicle and leave. he relayed that information to the contra-costa sheriff's department. >> from sacramento, was allegedly driving drunk when he hit another car and fled the scene. four others were killed and six injured in the five-car accident. it shut down west bound i-80. lowell was apparently driving on a suspended license. >> hi, ow okay? >> reporter: chp officer charlotte brennan is taking place in the chp's maximum enforcement period. they see a speak in impaired driving around the holiday. >> we already have impaired drivers, distracted drivers and reckless drivers, but with higher levels of traffic traveling, of course those numbers increase.

>> reporter: officer brennan spends most of the day patrolling the highway in an area that sees a lot of accidents. most of the drunk drivers are ages 21 to 24. the goal of the extra enforcement period, to keep people safe. >> we try to have as many officers on the road to ensure that maximum enforcement so s. provided. >> another big issue, pete not wearing their seat belts. in martinez, aneser hasan, nbc bay area news. >> you can keep track of the storm with our free nbc bay area app. click on the weather tab to get a detailed forecast for your neighborhood. new tonight, on the run no more. the second inmate who escaped from the palo alto courthouse earlier this month is back behind bars. u.s. marshal's arrested john bivins today in san leandro after he and another inmate bolted from a courthouse in a brazen escape. joining us live in san leandro with the details on that. >> reporter: kerry, i'm at the

fair mont inn and this is where it all went down. the inmate was holed up in room 204. u.s. marshals staked out the place all night long and made their move first thing this morning. isabel bridgeford boek up this morning to an unexpected sight in san leandro. >> when i came out of the room at 8:00, there were a whole load of cops out here. >> reporter: they were here to arrest 47-year-old john bivins. nearly three weeks ago bivins and 46-year-old tramel mcclough were being held without bail after robbing a verizon store. they were leaving a palo alto courtroom when they managed to get away, hopping in a waiting getaway car and elaborate escape. they then jump flood a van a few blocks away and vanished. mcclough was captured last tuesday at a walmart in stockton. investigators say bivins was there, but despite being shot at by police, bivins got away after trying to run over a deputy u.s.

marshal and chp officer. the manager of the fairmont inn says bivins' friend checked in yesterday afternoon and u.s. marshals arrived a few hours later. the hotel manager says they turned bivins' power off, hoping he would come out, but he didn't until this morning. that's when marshals made their move. investigators say bivins resisted arrest and eventually was taken into custody. >> it's pretty crazy. it's just a crazy thing that happened, like, i would never have expected a criminal to be in my hotel tonight. >> reporter: i'm told additional charges could be filed against bivins, including escape, felon in possession of a firearm and attempted murder of a federal agent and a state peace officer. reporting live from san leandro, laura malpert, nbc bay area news. >> thank you very much, laura. now to a homicide investigation in the south bay. san jose police say it happened at a normally quiet business park. around 4:30 this morning, police got a call of a person suffering from a gun shot wound. the man was found behind a

building in the 2,100 block. he was taken to a hospital where he later died. no suspect or motives are known at this time. this is san jose's 29th homicide in 2017. there were 47 homicides in the city last year. the driver of a car that plunged into the oakland estuary today did not survive. the driver's been identified at 68-year-old paul sheerer of alameda. the oakland foirmt tweeted these pictures of that car being pull out of the water. it's not yet clear what caused that crash. still ahead at 9:00, an unexpected and dangerous deliver for an alameda home. the new details on an unusual investigation. plus, one man arrested to what he allegedly did at both local nfl games today. the high-flying incident that forced police into action. and light rain for now, but that is about to change big time

get zero down, zero deposit, zero first month's payment, and zero due at signing on select volkswagen models. now with the people first warranty. bay has triggered a federal investigation. the parcel sent to h a package delivery in the east bay has triggered a federal investigation. the parcel sent to a home in alameda exploded, injuring one person. it happened in the bay farm island community. nbc bay area christie smith has the latest on the investigation. >> reporter: neighbors near lilac and oleander avenue say they saw a large police response in their quiet neighborhood late friday afternoon. an unusual investigation now involving the u.s. postal service. >> on friday afternoon, a parcel was delivered to a resident in bay farm island in alameda, california. that parcel did detonate. at this point, it's an ongoing investigation. >> reporter: at this point, it's unclear how the device detonated.

>> there was a confirmed explosive device. >> reporter: police dispatch audio suggests a woman living at the home opened the package and it exploded. one person suffered non life-threatening injuries. neighbors say they believe a police officer lives at the home. they are not releasing any more details but several agencies are involved in the investigation. >> alameda police department and bomb squad responded, atf responded and postal inspectors responded. >> i've lived down the corner for 51 years and nothing this crazy has happened. >> reporter: investigators say incidents like this are rare. >> it's a federal offense. the violation is 18-7 c. it's a serious felony. >> reporter: parts at the scene will be sent to a crime lab near washington, d.c. to be examined, christie smith, nbc bay area news. a unique way of spreading a message during today's 49ers and

raiders game ends with a man getting arrested. santa clara police say a man flew a drone over levi stadium and the oakland coliseum to drop leaflets on to the crowd. they said something about free speech on them. the fbi, chp and local police immediately started locking for the man responsible and they found him in oakland, flying drones near an airport is not allowed and santa clara city code prohibits flying one within 500 yards of levi stadium. strong winds prevented most of the leaflets ending up in the stadium. >> defeated the whole purpose of getting those to people. our rob miee da is here. here about probably to see the heaviest rain of the last 24 hours coming in in the next three hours. coming up for the south bay, especially in san francisco as we approach midnight right now. a few light showers outside. not all that bad. winds have backed off from

earlier in the day. the blustery conditions at the football game this afternoon. not too bad. san jose still mild. 61 degrees. 57 into dublin and san francisco 60 degrees. into the north bay, san rafael, already seen more than an inch of rain so far today and could see another 1/3 of an inch of rain coming down a little bit later on tonight. as we show you the radar view, light showers here. moisture over the santa cruz mountains to lift out some rain drops. same story in the hills east of san jose. cool air loft, increasing vertical motion is a good recipe for seeing some isolated thunder. look the future cast, lighting up like a christmas tree from midnight to 2:00 a.m. very good soakings until about 3:00 a.m. if you have an early morning commute, could still be affected by the showers. by 7:00 a.m., things are starting to dry out and by

woman inappropriate while taking that photo. >> the ethics investigation ought to go forward. >> there ought to be first a thorough investigation. let's see the results of that before we make any determination. >> reporter: franken intends to return to work this week. nbc news. down but not out, the ranking democrat has stepped down. congressman john conyers announced today he's leaving the committee but he is not resigning from office after an allegation of sexual misconduct. the 88-year-old conyers still denies he fired an employee for refusing to offer sexual favors and looks forward to vindicating himself. the announcement comes after days of internal pressure for conyers to step aside, particularly from house minority leader nancy pelosi. >> we are strengthened by due process. just because someone is accused, was it one accusation, is there two? john conyers is an icon in our

country. >> conyers settled a sexual harassment case brought by a former staffer in 2015. the michigan representative is the longest-serving member of congress. a follow-up now to the legal shutdown over who will head the consumer protection financial bureau. the deputy director filed a lawsuit to block president trump's choice of a new director. english, the temporary director was appointed to the position by the outgoing head suing the president over his appointment of mick mulvaney. while in congress, mulvaney voted to kill the bureau altogether. now it's not clear who is going to be leading the bureau. tomorrow, english or mulvaney. under the law that created the agency, english should lead but the president argues a different federal law makes mulvaney the rightful head. happening now, evacuations are underway near an active volcano in eastern indonesia. the mount agung volcano has been hurling ash and smoke miles into the air. authorities fear a major

eruption could happen at any moment. more than 400 flights into and out of bali have been cancelled, affecting nearly 60,000 people. it last erupted in 1963 and killed more than 1,000 people. survivors of the las vegas mass shooting came together for a dinner last night to share their stories. about 120 people made it to the potluck dinner in henderson, nevada. for some of them, this was the first time back out in public since the mass shooting that killed 58 people and wounded more than 500. many were grateful to share a meal and work together to heal. >> when i start putting this together, it really helped. a lot of people have moved on and don't realize that we're still struggling. we're still healing. we're still -- we're not there yet. >> organizers say it's the first of several gatherings planned for survivors. >> one of the best-known names in massage is the subject of a scathing expose zai. a "buzzfeed" investigation found more than 180 women have been

reported being sexual assaulted at massage envy. former clients say the billion-dollar company mishandled their reports of sexual assault and a spokesperson for the chain tells us tonight the incidents occurred over a span of 15 years and 125 million massages, but one incident is too many. the company is now evaluating how to strengthen its policies. in october, the nbc bay area investigative unit first revealed that some certified massage therapists in california who have a series of complaints and even arrests are allowed to continue practicing and the regulating service does not disclose that information. see the investigation at nbcbayarea.com. just search "massage." >> the u.s. navy has been called in to help find a missing argentine submarine. the subis called the "san juan." it's been missing for 11 days in the south atlantic. a u.s. navy plane and an underwater rescue craft are

being used to try to locate it. officials fear there was an explosion involving that sub. at most, the crew had a ten-day oxygen supply. the searchers are not giving up. still ahead on this special edition of nbc bay area news. a victim's brother speaks out after we traced a stolen gun to his loved one's murder. >> we investigate stolen guns across the country and trace them to the crimes where they're used and the communities they affect. and relatively calm conditions right now in san rafael after already an inch of rain has fallen. look at the satellite and radar view, shows you we're going to be dealing with possibly more thunderstorms overnight.

stephen stock teamed up with our other nbc stations and for the first time traced those thousands of stolen guns across the u.s. >> we analyzed records covering almost a half million stolen and recovered guns coming from across the united states. no one has ever done this kind of tracing of missing pieces on this scale publicly before. because of this effort, we now have a better idea where these guns come from and where they end up. >> it's something that i'll never forget, that i'll never stop thinking about. >> dylan's brother rory was murdered in 2012 during a south bay crime spree involving a stolen gun. >> emotionally, you know, for my parents, it was completely devastating. >> reporter: dylan and his brother rory grew up in campbell. dylan served in the air force in iraq and carried a gun with him constantly. >> i would say that rory's death caught me more off guard than any roadside bomb in iraq could. >> reporter: yet he can't understand how guns continue to

be left out in the open in the u.s. for thieves to steal. >> there is almost no talk about it. >> reporter: no talk about a stolen glock model 23 handgun taken from riverside county in 2010 and two years later used in a crime spree that left a san jose police officer wounded and dylan's brother rory dead. >> i don't worry that more families like mine will suffer, i know more families like mine will suffer. >> reporter: to get a sense of how widespread this problem of stolen guns is. nbc bay area and more than a dozen nbc stations across the country teamed up with the nonprofit organization the trace to find out how stolen guns circulate around the u.s. >> i was numb. >> reporter: dylan's family is just one of 63 different california families we found in our data whose loved ones have been killed since 2010 in crimes involving a stolen gun. >> i know other families are going through what i'm going through. >> reporter: we obtained records

from more than 1,000 law enforcement agencies in 36 different states plus the district of columbia. nearly 850,000 gun records in all. while the fbi says 2 million guns have been stolen or lost in the last ten years, our data is incomplete because some agencies, including san francisco, oakland and los angeles' police departments all refused to share their records with us. even so, this data for the first time publicly shows how often stolen guns travel around the country from region to region and later show up connected to other crimes. >> the word is out. these guys are going after the guns. >> reporter: kevin o'keefe is chief of operational intelligence for the u.s. bureau of alcohol, tobacco, firearms and explosives in washington, d.c. >> the numbers and the trends we're see indicate that this not going away. noticeable increases in the last several years. >> reporter: the data we complied shows networks of stolen guns that travel throughout the country fueling other crimes. for example, guns stolen during a series of brazen robberies in

the carolinas and near the atlanta area were later connected to crimes in syracuse new york, nashville, and chicago. atf is the only federal agency responsible for tracing guns used in crimes. >> these are all boxes that have been received. >> reporter: they do it all here at the atf's national trace center in martensburg, west virginia. where the program manager gave us a rare behind the scenes tour. >> there simply is not national raj industry or database of gun ownership in america. we're only responding to requests for guns recovered in crime to try to identify the first retail purchaser. >> reporter: our data shows thousands of guns travel long distances. we found guns stolen from taco ma, washington, ended up in crimes in san jose and san diego. guns symptom from santa clara county and oakland were later connect to crimes in baltimore, maryland. >> these guns move very quickly so it could be from a matter of days to sometimes 15, 20 years

later. these guns are still being recovered in crime. guns are not perishable. they don't wear out and disappear. >> reporter: we found more than 23,000 stolen guns nationally that were later connected to other crimes, including at least 1,500 serious violent crimes such as murder, rape, robbery and assault and battery. >> not so much surprise me as it does alarm me. it seems to be a growing trend. >> no one wants to see firearms stolen from anybody. >> reporter: larry keene is senior vice president for government and public affairs for the national shooting sports foundation, a trade association that supports proposed legislation to increase criminal penalties for people who steal guns. >> we think that sends a strong deterrent message to the criminals that are out there that might be thinking about this. >> reporter: keene says gun owners should secure their firearms but stopped short of saying they bear some legal responsibility for any crimes later committed with their stolen guns. >> it's important to keep in mind that, you know, they're the victim of a crime. but we encourage people when their guns are not in use that they should be secured and made
