another cool day, but it gets better. >> it does. >> sun comes out. >> once the sun is out i think all is well, even if it's a little cold out there. i do want to set the parents up for a win today, i know it's thursday, we have one more day ahead of this workweek ahead. if you're wondering about your school day forecast, in san jose we are in the 40s right now, we will stay in the 40s through the 9:00 a.m. hour. as you're getting ready to head out and take the kids to school expect a lot of clear skies, cooler to chilly temperatures, the temperatures do remain a little bit chilly around the time that we read out for recess in the 50s so i would say definitely pack some nice warm clothing for them. by the time you pick them up towards 1:00, 2:00, 3:00 in the afternoon it will be nice and mild, in the 60s, great day to head to the park maybe after you pick them up from school. we do have a couple changes on the way for the weekend but first there is a new crash in san jose mike wants to tell you about. >> that's right because this involves an overturned vehicle, folks. overall the speed sensors are looking great around the bay, that slowing has started over in hayward getting over toward that

san mateo bridge south out of san leandro and then west across 92. that's a typical pattern. same thing for 101, a little build north 87 but the crash is north 101 as you're approaching the off ramp there, reports of a vehicle that flipped over off of its wheels, i don't know if it completely flipped over. we will find out about any lanes blocked. right now consider the fast lane blocked because that was the initial report but we don't see a lot of slowing down here, we see it over towards tully and that's a traditional pattern as well as the south way and 87. over toward the east bay and over through the tri-valley area, no problem for 238 out of the castro valley area, 880 slows a bit forward the san mateo bridge and where the backup forms about 25 minutes from highway 4 to the backup at the bay bridge. back to you. breaking news for you this morning, former "today" show anchor matt lauer just issued a response after he was fired wednesday over allegations of

sexual misconduct. those claims made by nbc employee. >> bob redell is in our newsroom, he has been monitoring the "today" show which has been airing on the east coast. anything new? >> good morning, it was over two hours ago that matt lauer sent this statement to his colleagues which has read by savannah guthrie at the beginning of this morning's edition of the "today" show. >> our top story is once again about our former colleague, matt lauer. >> and in, fact, we just moments ago received a statement from matt and let me read it to you. there are no words to express my sorrow and regret for the pain i have caused others by words and actions. to the people i have hurt, i am truly sorry. as i am writing this, i realize the depth of the damage and disappointment i have left behind at home and at nbc. some of what is being said about me is untrue or mischaracterized, but there is enough truth in these stories to make me feel embarrassed and ashamed. i regret that my shame is now shared by the people i cherish

dearly. repairing the damage will take a lot of time and soul searching and i'm committed to beginning that effort. it is now my full-time job. the last two days have forced into he to take a very hard look at my own troubling flaws. it's been humbling. i am blessed to be surrounded by people i love. i thank them for their patience and grace. that's a statement from matt that just came in within the last minute or two. >> in another development nbc news is reporting that two more accusers have come forward since news broke of lauer's termination, the misconduct alleged in the original complaint began at the 2014 olympic games in sochi, russia, and continued after. the lawyer for the accuser had this to pay in part, i'm awed by the courage my client showed to raise a complaint and to do so without making any demands other than to ask the company to do the right thing. variety magazine published a report laying out a pattern of

alleged sexual misconduct by lauer, including exposing himself to a woman in his office and inviting women to his hotel room by covering the olympics. three unnamed women tell variety they were sexually harassed, their account variety says corroborated by friends and colleague. the magazine also reports that self women said they made complaints to executives at nbc which were ignored. variety magazine based its reporting on a two-month investigation with dozens of interviews with current and former staff. nbc news issued a response saying, we can say unequivocally that prior to monday night current nbc news management was never made aware of any complaints about matt lauer's conduct. megyn kelly just started her hour of the "today" show, we expect her to comment on the lauer firing, we will bring that to you assuming she says something within the next half hour. >> no doubt she will. thank you very much. our coverage continues online as well where you can read nbc's full statement on our website along with a statement from the lawyer of the woman who came forward.

it's all at nbcbayarea.com. and new this morning, bart police are telling nbc bay area they have not confirmed reports elsewhere about a stabbing outside a san bruno bart station last night. according to the initial reports a man was bleeding from his hand and that station was closed for cleaning. we just got off the phone with bart and they told us that the man did have some kind of puncture wound but that he would not indicate how it happened. the station is open again this morning. happening today, a man accused of drunk driving and killing four people in a deadly wreck in san pablo over the weekend is expected in court. in the meantime we're learning new information about another deadly crash in the east bay, another passenger in a crash in livermore last week has died. >> both cases authorities say that the drivers who caused the wrecks have had previous run-ins with the law. >> "today in the bay's" kris sanchez joins us live from livermore with what's being done to try to wrack down on these repeat offenders. good morning, kris. >> reporter: hi there. we expect that this memorial

here at the crash site in livermore will continue to grow today now that one more person has lost their life as a result of that crash, but growing louder today, the question of why that driver was behind the wheel in the first place. 26-year-old lauren davis was arrested on suspicion of drunk driving and officers that night told us they found alcohol in that vehicle. we checked her driving records and they show she was arrested for driving under the influence twice before, most recently just in may. we also checked court records for the driver who caused this crash that killed four people and injured six other people in san pablo. fred lowe has prior convictions for driving under the influence. today he will face a judge to be arraigned on charges, four counts of murder, dui and other charges as well. just yesterday i spoke with madd, mothers against drunk driving which is pushing for better enforcement of existing drunk driving laws because they

say that repeat offenders can be deadly on the roadways. >> for multiple -- first-time offenders there are crashes that do occur, but mainly we really want to track and watch those multiple offenders because they are 70% more times likely to injure or kill somebody on our roadways. >> reporter: now, i surveyed california dui laws and found that madd gives california 3.5 out of 5 stars in their rating system so right about middle of the ground. california ranks number one in insurance rate increases for dui drivers, that's one consequence, but they rank fifth in dui jail time and sixth in the severity of drivers license suspensions. but look at this, california ranks 31st in terms of prevention measures, so certainly the state could be doing better in that regard. now, in 2019 those ignition interlock pilot laws will expand statewide, right now there are several pilot programs, one of them in alameda county, but it is not meant to be a punishment

for drunk drivers, but instead as an incentive for them to get their driver's license back on a provisional basis. now, the california highway patrol did do the saturation patrols you might remember over thanksgiving you told you that they were going to be in maximum enforcement. they told us in the nine bay area counties they arrested 186 people for driving drunk. clearly, though, they didn't get to everybody. in livermore, kris sanchez, "today in the bay." >> people take the advice, do not drink and drive. thank you, kris. happening today, another day of jury deliberations in the kate steinle murder trial and there is still no clear indication of when a verdict will be reached. "today in the bay's" pete suratos joins us live from san francisco. what legal experts with saying about the case. pete? >> reporter: good morning to you, marcus. we want to point out if a per difficult is not reached today deliberations will be moved to next week since court is closed on friday, but we do know that this is the fourth full day of deliberations, remember they had

a couple half days before the holiday weekend and really, guys, there is no indication right now as far as where they are when it comes to reaching this verdict, but we do know yesterday we didn't see much activity at the hall of justice in san francisco. we have some video of the prosecution walking around, didn't see the defense attorneys walking around yesterday. prosecutors have made the argument that josé ines garcia zarate intended to kill kate steinle or at least someone walking on pier 14 back in july of 2015, but there has been no district evidence at least introduced in court and then you have the defense team claiming the shooting was accidental and that that bullet which killed steinle ricocheted off of the pier at peer 14 in san francisco before striking her in the back. our crews did speak with legal experts, criminal defense attorney mark yates about the time it's taking for the deliberations to wrap up and what it may mean or if it means anything at all. >> just wild speculation to start guessing on that, but i can say at this point i would

not at all be surprised that they have been out as long as they have. i wouldn't have expected it sooner. >> you wouldn't be surprised if it goes into next week, either? >> i wouldn't. i could easily see that happening. it could be tomorrow of course. >> reporter: now, zarate faces a murder charge and two weapons related charges. the way it's going to work is we will get a 30 minute notice the media, that is, if a verdict is reached later today but those jury deliberations are set to begin this morning at 9:00 a.m. we are live in san francisco, pete suratos for "today in the bay." palo alto leaders are considering several new projects to boost safety along the caltrain crossing. the four crossings run directly through caltrain tracks with no underpass or overpass. city council members met yesterday to consider two new studies on on diverting cars, bikes and pedestrians but the palo alto weekly reports leaders say the major sticking point is coming up with the funding to

cover the construction costs. good morning, it is 6:10. as you head out the door it will be chilly but eventually will warm up. seasonal temperatures across the bay area. let's take a look at your microclimate highs for today, san jose will be topping out at about 66 degrees, milpitas 63, morgan hill 66, the east bay can expect to see mostly clear conditions. we might get a couple high clouds into the early afternoon. concord 65, wall news creek 66, oakland 62. for the peninsula we will be climbing into the upper 50s and lower 60s, san mateo a high of 62, san francisco expect similar conditions, really just a great thursday is expected ahead with a whole lot of sunshine, but i know mike is tracking a few crashes this morning. >> that's right. not just one here and there, we have a number that are on the grid, i will call it a couple. the traffic flow the volume holding a little lighter than a typical thursday at this time. north 101 at euro buena that

there and to bay point. thanks so much, vianey and mike. this is quarter after 6:00. a follow-up this morning, a leaders in two peninsula cities now reportedly asks santa clara county for more time to examine the planned expansion for stanford university. stanford wants to add thousands of new housing units and 3 million square feet of academic space by the year 2035. lead ersz in both cities want an additional 60 days to review an environmental impact report. stanford calls the request unwarranted. surge pricing could become part of every parking meter in san francisco. a vote is scheduled for this coming tuesday that we told you about this before, the proposal, each of the city's 30,000 meters could be subject to hourly rates that vary depending on demand. officials say the goal is to increase the availability of coveted city parking spaces. business and tech news in morning, american airline scrambling to fix an issue that could leave thousands of flights

without pilots in the middle of the december holiday travel season. >> for that and at rest of our news before the bell we go live to landon dowdy at cnbc world headquarters. good morning, landon? marcus and laura, good morning to you both. wall street could be set for another mixed trading session today, the dow closed at a record high on continued optimism that congress will pass tax reform. the nasdaq had its worst day in three months on a big selloff of tech stocks like facebook, apple and amazon. you want to look for economic data on unemployment, income and end sping and manufacturing. the dow rose 103 points to 23,940, the nasdaq fell 87 to 6824. one major airline may find itself on santa's naughty list, american airlines is scrambling to find enough pilots for thousands of flights during the two weeks surrounding christmas. a computer glitch allowed too many crews to take time off. american will try to avoid canceling flights by playing overtime and using reserve

>> we will all join you. >> a small crowd at your house. >> i have a small little audience. >> i will sing a selection or two. >> there you go. see, the party is getting better. >> your temperatures right now are in the 30s and the 40s, very appropriate for some hot chocolate. look at napa at 36 degrees, walnut creek also 36 degrees and san jose and san francisco a little bit more mild, san francisco sitting at about 48 degrees this morning and a lot of clear skies, but we are getting reports of a low visibility in some areas in the north bay, particularly near napa, the santa rosa area, visibility mild down to around five miles. it's not too dense but if you are driving you may encounter a patchy area so be careful, slow is down and then the fog should clear out by the afternoon. once all of that fog clears out we will make way for a very seasonable afternoon. temperatures will climb once again into those 60s.

let's take you on a tour of the bay area. 66 degrees expected for san jose, los gatos at 63, as we head over toward the east bay, concord 65, danville 67. along the peninsula expect upper 50s, lower 60s, half-moon bay a high of 60 degrees, san francisco will be climbing to about 60 degrees for the embarcadero, mission at 61, and look at santa rosa, a high of 64. one thing is for sure, though, we are expecting very calm conditions today and then these calm conditions will carry over at least through friday which on friday we do have a couple of changes on the way, it looks like a system is sitting off to the north that could bring a couple changes you may want to pay attention to if you're heading out on saturday. let's check in with mike. i got some changes you will like as you're heading through hayward. hold off just a little bit because we want to give adjustments for the sensors. over here we are adjust to go an easy flow, a little build north

101 in san jose, but that earlier crash did clear. the better news for hayward is that crash at 92 has cleared and you already see those sensors start to improve. slow down through san leandro south 880 toward the 92 interchange, all lanes just cleared in the last couple of minutes and that actually last couple of seconds and that's better news if you're headed toward the san mateo bridge. two video ex in the middle of the roadway westbound highway 4 at bailey, a couple cars got into a crash there as you're traveling westbound and that will add more slowing through bay point out of pittsburg and antioch. by the time you get toward the bay bridge a pretty good drive down the east shore freeway. as you get toll the toll plaza you do have the backup because the metering lights are on. there is the oakland side. coming up next on "today in the bay" the reason toys "r" us are tulg a product off their shelves just as the holiday shopping season wraps up. we have handled several complaints about leather

in a florida courtroom to 6:25. happening today an accused serial killer in florida is due in court today. tampa police say 24-year-old howell donaldson allegedly killed four people randomly all within a seven block radius. they arrested him on tuesday after a tip from a mcdonald's coworker, he will be charged with four counts of first degree murder. new this morning an alarming recall to tell you about, a risk of mold exposure has toys "r" us taking 6,000 clay craft kits off shelves. the recall involves totally me clay craft kits sold at toys "r" us and babies r us. mold can be present in the clay and pose the risk of respiratory and other infections. toys "r" us has received three reports of mold in the clay but no injuries so far have been reported. san francisco leaders are trying to get ahead of the curve when it comes to testing of delivery robots.

new law may be a few steps away, a supervisors committee approved a permit plan for any company testing out robots. pedestrian safety advocates argue such devices may pose safety issues. the new rules will ban robots from going over three miles an hour and testing will only be allowed in certain areas, a full vote is scheduled for next month. coming up next on "today in the bay," another option for walkers and bikers on the peninsula, the new overpass opening today that will make one bay area city more accessible. bob tease oncam. matt lauer has publicly responded to his being fired from the "today" show, what he wrote to his colleagues coming up in a live report.

50s. another thing to keep in mind, i know it's clear in san francisco but right now our fog radar is showing a little bit of fog in napa, the santa rosa area, we are catching some of that fog, visibility in miles is about five miles in napa, san carlos also seeing fog early on, it was similar to yesterday, yesterday some areas had patchy fog, but the majority of the bay area is nice and clear. the temperature trend for santa clara is showing a climb into the 50s just around the time you head out and you get hungry for lunch. 55 degrees around 10:00 a.m. and it will climb into the 60s, santa clara will climb into a high of about 66, two degrees warmer than what we've been seeing all week long, but a lot of sunshine, mike. that's right. i like the crisp air. i also like this, a pretty crisp commute. look at all the green around the bay. the south bay is slowing a lot more of the slower sent torse. we saw 85 show slowing from 101 up towards saratoga. 87 into downtown and 101 here

it's all at nbcbayarea.com. alaska airlines is taking action after mark zuckerberg's sister says that she was harassed on a flight. overnight the company sent us a statement saying we have launched a full investigation and from revoked the accused passenger's traveler privileges pending the outcome of that investigation. the company says that it has contacted randy zuckerberg who first posted a letter about the incident on facebook. she writes in part a man sitting next to her began making inappropriate and sexual remarks. she said she asked flight attendants to help but they brushed it aside and told her to go to the back of the plane if she feels uncomfortable. one of the inmates who escaped from a palo alto courthouse will go before a judge in san jose today. police caught john bivins last week at a san leandro hotel. he and another inmate had been on the run since a coordinated escape earlier this month. men are from east palo alto and

were originally arrested for robbing a sunnyvale verizon store. a san francisco police officer continues his recovery from a traumatic brain injury. this happened in the line of duty. last night hundreds of people attended a fundraiser. officers from the tenderloin station sent him a video message. he was on his bike last month when he was -- when a fleeing suspect's car hit him. officers say the department thinking about him every day. >> it is a daily reminder when i go into that my friend is not there. i walk past his locker every day and it's not easy. >> we are here, you know, trying to support him, he's in a different place fighting for his life and this is the least that we can do. >> there's also a go fund me page set up to help the family. smart train riders will now reportedly have a little more room on some of the busiest runs. the press democrat reports the north bay's new train line is adding an extra car to the four

busiest round trips every day. that means trains will run with three cars instead of two. happening today, the next step in a new connection for cyclists and walkers in east palo alto. crews will break ground on a highway 101 overpass. it starts at clark avenue in east bay shore, it will be clearer than this, this will end at newell road. these are renderings of the project provided by the city. officials say they expect that work to finish up in 2019. all right. we're looking at pretty clear drive around the bay, you guys, a couple of key spots to watch, though, the build of course for the south bay, you see the slowing for 85 and 87 but 101 the tougher drive coming from blossom hill, the scene of an earlier crash where three vehicles were on the shoulder, they may be moving vehicles but still a distraction and a lot of slowly toward capitol expressway. the rest of the south bay moving pretty well. looking at the slowest drive in the east bay at least in this section, it's hayward, south 880 from 238 down forward 92, it's

let's get right to it. for the coast a high of 59 for the bay, a slight chance of rain in the forecast, mainly a lot of cloud cover, same thing for inland areas, 62 expected for saturday. that storm system looks like it will stay off to the far north, ukiah and all those areas have a slight chance of seeing rain. as that system clears out on sunday it will leave behind a lot of sunshine but also with that front we are expecting a cooldown in the temperatures, our highs will only top out in the 50s, coast 59 degrees, bay 58, inland 59. when i talk about inland spots i mean concord, even oakland areas also a little bit further inland in some areas. as we head out to santa cruz if you have plans to head to the beach, i still think it's a little too cold for the beach especially because we've been seeing the freezy to windy conditions. tomorrow morning we will top out at about 50 degrees early on and climb into the 60s. as we head into saturday very cloudy all day long along the coast, breezy conditions also

nearly a half hour after a rollover crash. it happened just before 1:00 a.m. on northbound 101 near capitol expressway. the car ended up on its roof but the chp says the driver suffered only minor injuries. at the same time the driver now facing a dui charge. happening now, lava from bali's mt. agung volcano quickly formed its own path in the village located five miles from that volcano. all the residents have left for a safer place. bali's airport has since reopened after wind blew away from ash. newly released body camera video shows how hectic things became during a summer protest in arizona against president trum trump. >> you can see it there. that protest took place august 22nd in phoenix. police have now released about 30 hours of footage after the

francisco climbing with a high of 62 degrees, san jose mid 60s as well and looking at the future cast i know it's thursday and we have been tracking that storm system that was sitting off to the north and it still s if we look at the timeline saturday at about 6:00 a.m. the first thing that's going to make its appearance that cloud cover. expect to see a lot of cloud cover, we have that system sitting off to the pacific north. as we fast forward through that timeline at about 12:00, 1:00 we start seeing the showers moving in and where you see this white purple hue color that's a lot of snow that is expected, a good amount, as a matter of fact. the majority of the rain the models are showing it keeping north of the golden gate bridge so the south bay not really expecting rain. santa cruz mountains not expecting a lot of rain, maybe even no rain at all. slight chance for the north bay, the main impact is going to be that cloud cover. as we head into sunday we do still keep a little bit of clouds where we clear out. this is a shot of tahoe olympic

valley, not sure why it's in black and while. i want to show you our snow forecast. we still have a couple inches in store kirkwood, south lake tahoe, 3 to 6 inches, maybe a little more for the higher elevation areas. all in all our snow picture look fairly decent for anybody looking to head out there. the next seven days we have a trough that's going to drop our temperatures, then we keep a calm weather pattern for the next several days. next week it might be a good idea to wash those cars, right, mike? >> that's right. we're looking over toward the south bay and the rest of the bay moves well. the south bay has more slowly. i will talk about that in a second but we do have a new crash, a second crash over the last 40 minutes in hayward. i was worried about that because it was going to cause more slowing, i think they cleared it quickly before chp got there. there's recovery from san leandro down toward the san mateo bridge. west 92 does see more traffic. 101 as well as 87 look at those

here are the top stories on today 6:55 this morning. welcome back. here are the top stories on "today in the bay." breaking news we've been following this morning, former "today" show anchor matt lauer has issued a response after he was fired yesterday over allegations of sexual misconduct. claims made by an nbc employee. in had a statement he said in mart, quote, there are no words to express my sorrow and regret for the pain i have caused others by words and actions. in the meantime in another development, nbc news is reporting that two more accusers have come forward since news broke of lauer's termination. "today" show host savannah guthrie will read the entire statement from matt lauer and have the latest developments in the case coming up on the "today" show in less than five minutes. a man accused of drunk driving and killing four people in a deadly wreck in san pablo is due in court today.

that crashed happened over the thanksgiving holiday weekend. fred lowe is charged with four counts of murder. he crashed his mercedes into another car on interstate 80 near san pablo dam road on saturday. there was only one person who survived the crash. his father, brother, uncle a and cousin were killed. the suspect is facing dui and felony hit and run charges. live to livermore where another person has died after a thanksgiving car crash. you are looking at the scene of the crash, alex has garcia sustained injuries in that crash. lauren davis was drunk when she lost control of her car on stanley boulevard. garcia was ejected out of that car. another passenger was also killed. the driver had two prior dui arrests but they were reduced to

reckless driving charges. bart police are looking into a possible stabbing outside the san bruno bart station. a man was seen pleading from his hand. bart police told us that the man did have some kind of puncture wound but would not tell them how it happened. the station is back open this morning. a live look from the hall of justice in san francisco where we are now entering another day of jury deliberations in the kate steinle murder trial. still not clear when a verdict will be reached. prosecution was seen briefly yesterday but there wasn't a lot of activity at the hall of justice. that could mean no questions or requests from jurors so far. prosecutors say josé ines garcia zarate intended to kill kate steinle or someone walking on pier 14 back in 2015, but the defense says it was an accident and the bullet ricocheted off the pier before hitting steinle in the back. one of the two inmates who escaped from a palo alto courthouse is due in san jose court today. john bivins was captured at a

hotel in san leandro. he and another inmate escaped earlier this month. they were spotted in stockton shortly after where one was arrested but bivins got away. the men are from east palo alto and had originally been arrested for robbing a verizon store at gunpoint. palo alto leaders are considering several new projects to boost safety along four caltrain crossings. the four crossings run directly through caltrain tracks with no underpass or overpass. city council members considered it studies on diverting cars, bikes and pedestrians. leaders say the major sticking point is coming up with the funding to cover construction costs. coming up next on the "today" show, how u.s. ambassador nikki haley is responding to the north korean crisis. the nation kree leases video of this week's missile launch. >> strong words from her. now to el bakraoui on wall street from the dow jones industrial just rose more than 100 points breaking above that 24,000 park for the very first
