it is 4:30 on this friday morning. good morning to you. looking here, a live look at the san mateo bridge. it's slow this morning. good morning, thanks for joining us. i'm marcus washington. >> i'm laura garcia. >> the cars are trembling a little bit. shivering. >> it's a cold start. >> 30s and 40s, like we have been seeing all week long. if you are waking upright now, in the south bay, 42 degrees. the peninsula, 43 degrees. the tri-valley and the north bay have been waking up to 30s. 36 degrees, it's pretty cold. the north bay, 36 degrees and san francisco, a little warmer at 48.

yes, that temperature trend does show a climb. you can already see hazy skies in parts of san francisco. we have that cloud cover rolling in because we are tracking a system as we head into the weekend. i'll break down if it's going to bring rain or maybe it's not, coming up in a few minutes. >> it's cool out there. during the rain, they wave off the road crews. when it's cold, they are out there working in the cold. that sign indicating slowing. that traffic is jamming up. that means a traffic break is going on closer to 23rd. they will clear it quickly. it will be a five minute delay from the coliseum as this back up forms to the north. we'll start to clear and the sensors adjust. by the time they change, things will clear up. a smooth drive for the bay. there are road crews out there. watch for the cones. remember, folks are out there and it's colder than it is in your car. back to you. >> thanks, mike. 4:31.

continuing coverage on what many will calling a shocking verdict. this morning, more reaction after jurors came back with a not guilty verdict in the kate steinle case. president trump tweeted, the kate steinle killer came back and back over the weakly protected obama border. this info was not used in court. his exoneration is a tragedy of justice. >> "today in the bay's" pete suratos is live at pier 14 where steinle was killed. this verdict, very controversial, like the case itself. what's next? >> reporter: good morning to you, marcus and laura. a very controversial verdict. not guilty was handed down in the verdict. we are standing down at pier 14 where steinle was killed in 2014. we'll show you this vigil set up by those who were not happy with the verdict.

we see where the picture of kate steinle says rest in peace. that's in reference to president trump's proposed plan to build a border wall in response to these issues. when you cut to zarate's immigrant status, san francisco's so-called sanctuary city policy, it has created a debate over whether it could have been prevented. i want to reed a statement about the issue. san francisco's policy of refusing to honor i.c.e. detainers is a threat to public safety. the tragedy could have been prevented if san francisco turned it over to i.c.e. as we requested instead of releasing him to the streets. it is unconscionable they do that. following the conclusion of this case, i.c.e. will work to take custody and remove him from the

country. we did speak with a legal expert about this to get a better idea of what will happen next for zarate. >> right now, technically, he is being held in jail in violation of his own civil rights. he served more than his maximum sentence on the charge which he stands convicted. there is recourse for the steinle family and the attorney general and the president who think this is an injustice. that is a civil rights prosecution in federal court. if the trump administration thinks that an injustice was done here, simply put its money where its mouth is. call the u.s. attorney for the northern district of california and say we want you to look into prosecuting mr. ga see ya zarate. >> the candles set up here at pier 14. a vigil set up after the verdict was sent down, a not guilty

dangerous and reckless driver in san francisco. antics were caught on camera. take a look. video was posted on facebook. according to the post, it happened in the district. that's all the details we know right now. the car was spinning doughnuts and a man came flying out of the passenger seat. he appears to be injured, screaming in pain. the driver hops out and carries him to the car. if you have information on who it may be, call san francisco police. happening today, a chance for people with outstanding warrants to avoid spending time in jail. this begins the one month long operation called, second chance. misdemeanor and criminal warrants can self-surrender, no matter what the bill is. they will get a court date and walk out. it ends december 31st. today is world aids day.

i'll look that up oun online. >> on this friday. >> i saw that on christmas in the park, they sell hot chocolate. as it gets colder at night, you are going to want it. the temperatures are still in the 30s and 40s in some spots. yes, for the most part, 43 degrees in the peninsula. tri-valley, 36 degrees. south bay, 42. nice and chilly out there. look at san francisco. 48 degrees. the north bay in the 30s. 36 degrees. now, we can expect to keep mostly clear skies. if i show you doppler radar, you can see that system sitting off the coast and we can see it but it looks like it's going to change in terms of the impact it's expected to bring this weekend. we have been monitoring a chance of rain and cloud cover. you can actually see it approach. it looks like it's headed mainly toward the oregon area, very far north. as far as our rain chances go, look at the future cast in a

bit. talk about today's overall highs. 60 degrees is the high in san francisco. oakland, 52. antioch, 64. c concord a high of 67. saturday at 1:00 a.m., you are going to notice that crossover, especially the north bay. lunch, the storm system makes the arrival to the north. as we zoom out, the low pressure city. but, it looks like we might get a chance of seeing sprinkles early on sunday morning. that storm system is going to the north, mainly on saturday. if you look at 5:00 a.m. sunday, look at the coastline. san francisco, half-moon bay has a shot of seeing a couple showers here and there. south lake tahoe and kirkwood, they are expecting snow this weekend. for now, the biggest impact is going to be some cloud cover. let's check in with mike for a look at the traffic. looks like there's slowing in oakland. >> because the construction crews are working in that very

cold weather. that one lane is closed. this is high street where things start to slow around the bend and north, the top of the shot, you can see flashing lights and then clear. it's just this one stretch right now. there was another patch north of there between 23rd and 29th. that's why we see that slowing here on the sensors. that's the only slowing we see of concern. it adds about five minutes on to your dry from san leandro. a nice easy drive. it's friday. the early morning commute shouldn't be a problem. these tracks are moving well. no delays out of the capital corridor. back to you. survivors of the north bay fires were told the government clean up of properties would be done at no charge.

homeowners have to prepare for other nightmares as they begin to rebuild. >> vicky nguyen learns what residents paid for cost more time and money later. >> good morning. at issue, how safe are the foundations underneath the home that is burned? the state says they are toxic and unsound. that's why they are taking out the foundations for anyone who opted into the government debris removal plan. it will cost homeowners extra time and money to rebuild. we spoke with two homeowners. one kept his foundation. the home passed safety inspections and he moved in this summer. the other, they took out the foundation. that led to a costly fight with his insurance company. he's only now starting to rebuild. we sat down with the engineer who developed the plan. he says there are exceptions to the rule, but he's confident

credit for a cell phone trade in and never got it. >> he contacted the response team and got it. chris chmura has the story. >> he says he switched his cell phone plan to t-mobile. when he did, the carrier promised him $1200 in credit as he upgraded the family's three cell phones. so, he did. he bought three new iphones, trading in the old one. t-mobile said the credit would be applied to his account over 24 months. that didn't happen. he says he called t-mobile and was told he didn't qualify for the credit. instead, he was offered a credit of $100. at this point, he threw in the towel and reached out to us for help. we contacted t-mobile. they issued that $1200 credit, which is good news. we asked the company what happened. they wouldn't provide details
