you are getting the kids z ready to head to school, if you notice by 10:00, 11:00 a.m., more clouds around lunch hour. as you take them up, san francisco is expected to top out at 60 degrees. it will be a great friday, great first day of december. let's check in with mike. he's going to start off in the south bay traffic area. >> over the last half hour, we saw the traffic start to ramp up here in san jose, north 101 north of 680/280 interchange, traffic is going smoother than it has been. show you on the map. seeing the sensors slower here where the camera is. extending up to oakland road. that is the typical pattern monday through friday. we'll see how strong that commute is in the next 20 minutes. that's the first burst. after 6:30, we see that south bay build on. i'm guessing the heaviest traffic by 7:30. the peninsula hasn't built yet.

a nice, easy drive on hayward southbound. this one stretch of slow drive shows up. north 101, passing sfo. a closure for the ramp on westbound 380. looks like they are moving the crew. there must be a traffic break going on. nothing unexpected. we will track it. the metering lights are on. back to you. >> thank you very much, mike. 6:02, developing this morning, a controversial verdict in the kate steinle murder case. after 12 days of testimony, two days of closing arguments and 28 hours of deliberating, the jury of six men and six women acquitted jose garcia zarate of involuntary manslaughter as well as assault by a semiautomatic weapon. he was found guilty of legal firearms. it carries a sentence of 16 months to three years. the shooting happened in 2015 on

pier 14 in san francisco. the killing, bringing the sanctuary city policy into the national spotlight and reigniting the immigration debate. yesterday, again, when the jury found that suspect not guilty of murder. this morning the world is reacting to that verdict. president trump tweeting the kate steinle killer came back and back over the weakly protected obama border always committing crimes and being violent. yet, this info was not used in court. his exoneration is a complete travesty of justice. build the wall. >> we have team coverage. let's begin with pete suratos live at pier 14 where it all started and what is next for the defendant. pete? >> reporter: yeah, good morning to you, mauer la and marcus. a fairly lengthy statement from

immigration and customs. i'll get to that in a moment. we are here at pier 14 where kate steinle was killed in july, 2015. behind me is a poster board set up with kate steinle saying she won't be forgotten, as well as a comment about building a wall, talking about president trump's proposed border wall he proposed. we'll see if that happens. this vigil you are looking at or that video of the set up was set up or at least associated by white nationalists groups. that's what the camera crews picked up. folks were setting this up or taking part in it. they were part of some of the white nationalist groups we see here in the bay area. jose zarate is an undocumented immigrant with quite a criminal history. couple it with san francisco's sanctuary city policy, some are wondering if all this could have been prevented. let's get back to the statement

from immigration and customs enforcement that reads, in part, it is unconscionable that they continue to endanger the lives of americans with sanctuary policies. following the conclusion of this case, i.c.e. will take possession of him and remove him from the country. kate steinle's family was not at the courthouse for the deliberations, but gave a statement. her father said we are shocked. this was rendered. it was not served. i did talk to the san francisco chronicle in an interview before the verdict. here is a clip from that interview. >> i think he did shoot toward them. >> the city and federal level miserably failed in protecting kate. >> our family has not had a moment of anger, vengeance.

the jury was not told the killer of kate was a seven-time felon. the schumer/pelosi democrats to weak on crime, they will pay a price in the elections. >> it's true. they were not told he entered the country illegally, many times. that's how trials work. juries are not told of previous crimes, if they are not directly related of what you are accused of in cart. schumer and pelosi had nothing to do it with, they were not on the jury. kate steinle killer came back and back on the weakly protected obama border. there's a reminder here. there is a bill in the senate, ready to go. it's called kate's law, although the family doesn't like the name, it increases penalties on people that come back across the border many times, including if

zarate continues. >> so many people talking about it. thank you, scott. >> our coverage continues on www.nbcbayarea.com. it is a somber day for the bay area. tomorrow will mark exactly one year since the deadly ghost ship fire in oakland. 36 people were killed when that fire broke out at the warehouse as a dance party was going on. bob redell joins us live from the ghost ship warehouse with the tributes taking place for the victims this weekend. bob? >> reporter: good morning to you, laura. you recall the ghost ship warehouse behind me in oakland used to be a gathering place for a young artist and musician. it was one year ago, tomorrow night, that a number of them gathered inside this structure for an electronic music event that was not permitted. it ignited, caught fire,

trapping many inside. all of the 36 people who did not get out died of smoke inhilation. the city of oakland was criticized for not having shut the place down in spite of previous visited and other officials. two people, the master tenant and creator of the space have been charged with involuntary manslaughter. they pled not guilty. the mayor of oakland said leaders learned lessons and are improving residents safety. they touted software that ties housing, fire and police and zoning to make it easier to track and fix housing. starting later this morning, the chapel of times in oakland will open its doors for 24 hours straight, all weekend long, so people have a safe place to commemorate what happened. tonig tonight, they will light candles and ghost ship fire, we'll never

suspended due to unpaid tickets. that disproportionately affects poor people who simply don't have the money. a live look outside at the coliseum in oakland where it seems like more and more change may be in the air. oakland as are the only current sports tenant not locked into a new home. they brainstorm new possibilities for the coliseum site. a deal is far from degree sealed and they may settle on staying where they are. another meeting is planned for february. 6:16. the stock markets open at new all-time highs this morning. >> what a day yesterday. the dow opening above 24,000 for the first time in history. scott? >> good morning. it probably will not stay there. we should see money come off the table. the tax bill will run into trouble. the dow closed 224,272 up 331

buildings. the microclimate highs, no major changes thanks to the high pressure. san jose, expect a high of 65. my pea tas, 52. san jose, a high of 66. the east bay, similar conditions as well. walnut creek, a high of 65. along the peninsula, breezy to windy conditions. expect seeing strong swells. be careful if you are heading to the beach. never turn your back to a wave. embarcadero, 65. north bay climbing into the 60s. over the next seven days, a quick check of what to expect. the low pressure system is going to kick off the north cloudy conditions with a chance of rain to the north. breezy conditions stick around. sunday and monday, you notice, we start seeing a top out into the 50s. not just for san francisco, but also inland areas. before we dry out nicely for next week. this weekend is working in our favor, especially if you have

story. scott? >> this is just breaking. this is enormous, charging the former u.s. national security adviser, michael flynn with making false statements. he is expected in court at 7:30 our time. an hour from now, here you see michael flynn at the republican national convention. he would later become the national security adviser for just a couple of days. he and his son had been under investigation by robert mueller, the specific prosecutor for quite some time now. now, we are learning that not only has michael flynn, the national security adviser, the former national security adviser been charged with lying to the fbi, it is our understanding that he will plead guilty in the court today, which would seem to indicate to us, marcus and laura, that we are talking about a plea deal and we are talking about cooperation. obviously, that's speculation. it would appear to be that is

house cited in letting him go. given the potential exposure, the questions about whether he accepted money from the russians, all the other questions about being unregistered agent for a foreign country, this is probably the least the mueller team could have brought against him and signals he agreed to cooperate. >> whether he's talking to them. there have been signal that is perhaps that's what's going on. >> this is a negotiated plea. this is a plea agreement. this is the kind of court document filed when someone agrees to plead guilty. you can be sure lawyers didn't say he would plead guilty. this is a sign he's going to

cooperate with them and who knows what sort of additional information they will get from him. i think it's a signal to other people that mueller is investigating that if you deal with us, if you agree to cooperate, we'll go easier on you. >> absolutely. pete, stand by as we bring in kristen welker, who has been covering these issues. as pete laid out so well, kristin, it appears michael flynn is cooperating with federal prosecutors. if he has flipped and is going to help them with their case, the question arises, who might he be fingering next? >> reporter: the concerns are he might be getting closer to president trump. that is the concern within the administration and among some of the closest allies to the president. this is what we know, savannah. the president's former national security adviser, michael flynn is expected to plead guilty for

making false satements. flynn willfully and knowingly made false statements in 2017 days after president trump's inauguration. this comes after nbc news reported that the pressure had been intensifying around flynn in recent weeks. investigators gathered enough evidence to bring charges in their investigation of flynn. it comes after lawyers for flynn notified the president's legal team that flynn would no longer share information with them as they had been doing regularly. as you have been discussing, that's a potential sign flynn is cooperating with investigators. flynn is under scrutiny for work involving russia and turkey and fired 24 days on the job. savannah? >> that's right. a senior campaign official and close adviser to the president. we will follow this and have more updates. for now, we return moemost of y

we can expect to see cloud cover into the afternoon. all in all, the dry weather pattern that has been keeping us sunny is very much in place aside from that low pressure system that we are tracking as we head into saturday. we are not really expecting major changes today. today should be of no surprise and how beautiful we are expecting friday to shape up. let's check in with mike. >> friday slows light traffic in the morning. we are looking at a couple key spots. overall, the trends are typical for san jose and hayward for the san mateo bridge. this is recovering, north 101 out of burling game. overnight, the closure from 101 to westbound 380 cleared. move equipment and that had an impact recovering with a two to three minute delay. meanwhile, on the opposite side of the bay, the nimitz, slows for the san mateo.

lengthy statement by immigration and customs. i'll get to that in a moment. pier 14 where kate steinle was killed in 2015. you see this memorial set up. the candles and roses set up here. the poster board with the picture of kate steinle that says rest in peace. she won't be forgotten as well as a comment about building a border wall in reference to president trump's plan to build a border wall. our crews were here last nilgt. we'll show some of that video of people here setting up this mor j morial. i want to point out, folk that is may have organized this are associated with the white nationalist groups, the alt right groups we have seen here. there could be people here participating or putting together that memorial that aren't associated with them. when it comes to zarate, he is an undocumented immigrant, as you mentioned. when you couple it with the

sanctuary city policies, there is questioning if it could be presented. we got a statement from immigration customs. i want to read a portion of it. san francisco refusing to honor i.c.e. defenders is a threat to public safety. this tragedy could have been prevented if they turned the alien over to i.c.e. instead of releasing them to the street. it is unconscionable they continue to endanger the lives of americans, ignoring the harm inflicted on constituents. following the conclusion of this case, i.c.e. will work to take custody of zarate and ultimately remove him from the country. i did get a chance to speak with a legal expert about the steinle family. here is what he had to say. >> in fact, right now, technically, he is being held in jail in violation of his own civil rights. he served more than his maximum

sentence on the charge he stands convicted. there is recourse for the steinle family and for people like the attorney general and the president who, apparently, think this was an injustice. that is a civil rights prosecution in federal court. if the trump administration thinks an injustice is done, put its money where the mouth is, call the county of northern california and say, we want you to look into prosecuting him. >> reporter: take you back out here live to the memorial at pier 14 where kate steinle was shot and killed back in july of 2015. it was an emotional time for the family. they were not at the jury deliberations but they released a statement saying they were shocked and saddened. justice was rendered, but not served. we'll hear more in the days and weeks ahead. pete suratos for "today in the bay."

he is facing allegations of sexual misconduct by three women who have come forward. variety reported on accusations from three women. >> none of them have been identified, so the number of accusers, so far, is between three and six. questions have been raised about whether nbc news executives knew of the complaints prior to monday evening. several executives said they didn't know of complaints and the network responded saying, unequivocally, no current management knew of the accusations. >> coverage continues at 7:00 a.m. on "today in the bay." eastbound lanes of highway 4 were closed for major construction work. here is what the area looked like before. crews are turning that intersection into a proper highway interchange to help traffic flow. this is what it will look like once its finished. work has been going on for months. the 42 million dollar project is expected to be finished in 2019.

the video was posted on facebook. look there. the door opens and a passenger flies out. it happened in the district. all the details we know right now. the passenger that flew out of that car appears to be injured, screaming in pain, the driver hopped out, carried the man in the car and drove off. if you have information as to who these people are, san francisco want you to call them. we are continuing to follow breaking news on this friday morning out of washington. special counsel, robert mueller is charging former u.s. national security adviser, michael flynn with allegedly making false statements to the fbi. >> scott mcgrew, we can only speculate the mood in the white house. >> it's got to be cold sweat. michael flynn was one of president trump's closest advisers. this is the indictment right here. these two pages, alone, would be big news. bigger news, flynn will be in

court this morning and it's our understanding, he's going to plead guilty. that almost certainly means flynn made a deal with the special counsel, robert mueller. to be specific, he's charged about lying about what happened when he, flynn, met with the russians. there are two charges here. one, flynn lied when he said he did not ask the russian ambassador to refrain from reacting to president trump's sanctions. they asked him to play cool. he praised the russians for not reacting. that's count one. count two, flynn is accused of lying about asking the russian ambassador from delaying a vote in the u.n. we are going to continue to watch this on the "today" show. we'll break into regular programming as flynn comes into court. we cannot not mention this problem for the republicans pushing for tax cuts this morning.

that's stunning. that's nice. if you are going to head out there this weekend, they are expecting more snowfall. you may have to kind of, you know, plan the drive accordingly. look how gorgeous this is. this is a december 1st shot. we are waking up to very winter-like, you know, overnight, early morning temperatures. 43 degrees for the south bay. chilly for the peninsula. 43. the tri-valley, 36 degrees. 34 degrees for the north bay. san francisco at 49 and the east bay, 43. we are actually expecting colder overnight temperatures into next week. more 30s expected next week. the overall today highs will be fairly mild, comfortable. san jose, a high of 55. antioch, 64. santa rosa, 61. san francisco, a high of 60 degrees. we are not expecting major changes into tonight, but as we head into tomorrow, monitoring the low pressure. if you look at the one, i'm going to take you through the time line. we see the arrival of the low pressure system.

it looks like it is going to stay fairly to the north. the oregon area. however, the far north area like santa rosa and north of the golden gate may get light showers into the saturday evening hours with less chance as we head into sunday. now, we see the chance of a couple showers, if yo notice, we have penty of snow. it's going to shape us out for a comfortable pattern ahead. breezy to windy conditions. then the temperatures are climbing into the 50s for inland areas. let's get a last look at traffic with mike. >> right before the end of the show, wanted to show you, we have a slowdown on the peninsula as folks make their way over. recovery north of there past sfo. the south bay, a typical build. an earlier crash. the walnut creek interchange recovers after the crash. there's the east shore freeway. not bad.

6:55 on your friday morning. welcome back to you. here are the top stories we are covering on "today in the bay." >> breaking news, former trump national security adviser, michael flynn charged with making false statements with the fbi. he's expected to plead in federal court. he is going to plead guilty. he was fired a month after being appointed national security adviser. he was one of the first to be scrutinized by special counsel robert mueller as to the probe in the presidential election. the "today" show will have more coming up in five minutes. now, to a live look at pier 14 in san francisco where a vigil has been set up for kate steinle. a self-described white nationalist group is behind it. a jury acquitted zarate of the

most serious charges he faced for the shooting death on the pier. i.c.e. will work to remove him from the country. our legal analysts says they could continue the legal fight if they choose. president trump reacting to the verdict on twitter a few hours ago saying, quote, the kate steinle killer came back and back over the weakly protected obama border, always committing crimes and being violent. this info was not used in court. it is a travesty of justice, build the wall. he later tweeted, quote, the jury was not told the killer was a seven-time felon. democrats will pay a price in the 2018 and 2020 elections. it is important to note, juries are not often told of the crimes. a live look at the sight of

where the ghost ship fire took place. it marks a year since the tragic fire took place. commemorations are taking place over the weekend for the victims of the ghost ship fire. one will take place near the sight of the fire. it starts at 4:00 p.m. tomorrow. oakland chapel is hosting a memorial today through monday and holding services. students from alta vista are home sick because of a stomach bug. the principal is sending a letter saying a number of fifth graders were out because of the bug. the number of students out sick was higher than normal. the school is working with the county health department to stop it from spreading. they have symptoms of vomiting, diarrhea and fever. they are asking parents to keep their kids home 48 hours after the symptoms clear. hand washing is very effective in stopping the spread. at least nine people are dead after an attack at a

university in pakistan. it happened in northwest pakistan. at least 35 students were injured, some critically. authorities say there were fewer students on campus than usual. taliban is believed to be responsible. trouble for muni's new train. the train is out of service after a finger nail was caught in the door. the doors are supposed to automatically open if anything gets stuck in the door. muni is investigating. a portion of highway 4 will close tonight. there is going to be major construction going on in eastbound lanes of highway 4 in brickwood. crews are working on the highway interchange to help traffic flow. the $42 million project is expected to be finished in 2019. the freeway's closure goes from 11:00 tonight until tomorrow morning at 6:00. >> all right.
