breathalyzer to see if you are working or driving under the influence. pete suratos joins us with a closer look at the technology and how it could save lives. good morning, pete. >> good morning to you, laura. with the legalization of recreational marijuana, a lot of cities are coming up with rules on how to deal wit. we were talking about the technology. a marijuana breathalyzer. it's supposed to detect someone impaired while driving or showing up to work. that's by a company out of oakland. we'll show you a picture of that. it supposedly will measure the active ingredient in marijuana. the ceo of the company came up with the idea after years as on e.r. doctor. the issue for law enforcement is how can you tell if someone is still under the influence of pot? a blood test doesn't give you an accurate picture.

it doesn't stay in your system for days, neither does the smell of pot. thc shows up in your breath, that means you smoked within the last couple hours and more than likely, you are impaired. >> that's why it hasn't been done before. it's a huge technological obstacle to overcome. we measure a few particles of thc. >> the company is testing the third and final version expected to hit the market next year. a device is expected to sell anywhere between $500 and $1,000. the ceo is being called every day from law enforcement agencies and employers interested in purchasing the product. pete suratos for "today in the bay." >> a lot of money to be made there. thank you very much. developing this morning, a drugstore robbery suspect is in serious condition after an armed

security guard stepped in to stop him in the act of the crime. you can take a look at it here. this is at that walgreen store in downtown san jose. a little after 8:00 p.m., a man approached and opened fire. the guard is cooperating with investigators and has not been charged. have you seen this woman? morgan hill police say she snatched a woman's purse right off her shopping cart. happened near the safeway on eastbound avenue. the suspect then spent $3,000 at a rite aid and $2,000 at target within an hour. if you have seen her, you are urged to contact police. developing twist this morning. a stunning twist to a story we covered yesterday when a driver shot and killed himself in richmond. we have learned the driver was a nine-year veteran of the san

francisco police department. a richmond police officer made the stop. the officer was approaching the vehicle when the driver ended his life. late last night, police confirmed it was an unidentified off duty san francisco police officer stopped in connection with an ongoing investigation. details this morning in an inmate escape. we covered the story extensively for you. it sparked a three week manhunt in november. this morning, palo alto online published new information on the escape plan. the two men orchestrated the plan using a jailhouse phone. one used another inmate's phone code, allegedly discussing the positioning of two get away vehicles with his girlfriend. they are due back in court in january to enter their pleas. the accomplices have also been arrested. caught on camera, a dangerous side show in oakland over the weekend with a new

twist. you saw the cars spinning out of control as hundreds of people were watching. this time, the illegal spectacle had a laser show that blinded some of the officers and people driving near there. california highway patrol calling it a troubling trend filled with deadly consequences. >> the laser causes partial blindness. they could go out of control if they can't see. >> if you are caught flashing laze zers in into sky, you could face felony charges. >> police arrested five people. a developing story out of washington this morning. that's where that horrifying amtrak train derailed, right there, as you can see. this happened near seattle. the accident sent several rail cars down. hundreds are being treated. meanwhile, investigators are

trying to piece together how this happened. "today in the bay" is live at the scene of the crash with what we are learning about the investigation this morning. good morning, kirk. >> reporter: good morning to you. we have new information about the speed of the train at the time of the crash. investigators from ntsb are here and trying to figure out why. >> is everybody okay? >> i'm figuring that out. we have cars everywhere, on to the highway. >> reporter: an amtrak train on the service to portland derailed 40 miles south of seattle. several cars crashed into the busy interstate 5 freeway, in the middle of monday morning rush hour and smashed a semitruck and several other cars. now, the investigation is focusing on the speed of the train and the condition of the track. >> preliminary indications are that the train was traveling at

80 miles per hour in a 30-mile-per-hour track. >> reporter: it was supposed to be a day of celebration. more than 80 passengers and crew were on board for the first day of faster service, including a reporter for nbc's affiliate, king 5, who got off before the disaster. >> many going to work, heading to the office or home for the holidays. >> everybody comes in going, oh, that's not going happen. here we are. that's exactly what happened. >> reporter: the $180 million project is in the target of critics raising concerns about safety. that debate may now be ignited. meanwhile, the investigation continues as they try to find the other black box and determine the condition of the track. later today, investigators from ntsb are hoping to speak to members of the crew. they are hoping to learn more information about exactly what might have caused the crash. live in dupont, washington, i'm

kirk hawkins. back to you. >> certainly a something a lot of people are interested in. it is 5:08. can you make it out? that's capitol hill. the house is set to hold the final vote on the tax reform bill. the senate would vote soon after. they hope to send the legislation to president trump's desk as soon as tomorrow. the bill cuts the corporate tax rate to 21%. it does away with popular deduction for taxpayers who itemize. it eliminates the obamacare mandate which requires all americans to buy health insurance. protesters rallied on monday. lawmakers are split. >> we'll be judged not by how y'all report, but how people feel. >> raise middle class taxes, pay for corporate tax cuts. surely we can do better than this. >> by the way, the government

runs out of money on friday. congress has to overt a government shutdown this week. new this morning, word that the fbi warned candidate donald trump russia may try to spy. the warning came in the summer of 2016 after he became the official republican nominee. government officials tell nbc news senior fbi officials gave that warning during an intelligence briefing. hillary clinton received a similar briefing. officials urged the candidates to alert the fbi about suspicious activity by foreign adversaries. this is relevant because the special counsel is now looking into whether the trump campaign had improper contact with russia. it is 5:10 now. keeping it local, the parking is said to be getting so bad, city leaders will have a pilot program to improve things. they will look at attendance to

the garage. they will leave their cars with the attendance that put cars in designated aisles. they are talking of surge pricing in the busiest downtown areas. right now, at 5:11, a live look outside in san jose. another chilly start. we have had these really cold mornings, mild afternoons. as we look at the temperature now, 41 degrees, clear and calm. also, looking at the high temperatures, very warm later today. we'll start to see clouds rolling in ahead of the next chance of rain. i'll talk about that and the timing and how much, coming up in a few minutes. mike, you have a possible traffic break? >> it might be over as we talk about it but i will mention it bauds we don't have a lot of problems. this is westbound at 580 toward 150. it's an earlier crash. they moved a car from the center divide. no slowing and no back ups.

it's 5:15. as you get ready to head out, a live look outside. a look out 101. it's getting more crowded out there. let's go to campbell. 42 degrees at 9:00, then seeing those temperatures make it to the mid-60s today but more clouds in the mix. rain later on tonight. we'll talk about that and what's ahead for the weekend coming up in a few minutes. look at the travel times for the tri-valley. no, look at them. this is very light, especially for this time on a tuesday. a great drive, so far. we expect end of year tapering for the commute. we'll talk about other traffic coming up. happening today, santa rosa city council will consider new rules to stop landlords. the press reports the landlords are kicking people out to cash

in on huge rental demand following the north bay wildfire. they will consider an immediate ban while the state of emergency remains in place. stock markets will open at all new time highs this morning. >> this, as the house is close to passing tax cuts. scott mcgrew? >> the tax cuts are particularly good for corporations and the rich. you are seeing that in the markets. the dow closed for a record high on monday. twitter was up enormously as the san francisco company kicked the alt right and white extremists off their account. president trump tweeted facts in the economy have a long way to go after the tax cut bill is totally understood and appreciated. enjoy and create many beautiful jobs. meantime, the fed has started to fight some of the growth we are seeing in the markets and in the economy. remember, it raised rates. says it's going to raise them

again. president trump will probably turn against the fed. fed governors think they are hitting the brakes too fast. neel warned hikes could push the economy into a recession. facebook says it received far more government requests for user data in the first half of 2017 than the last half of 2016. it's up 27% or 44,000 users. facebook is allowed to tell how many government requests they got. not much more beyond that. we don't know what to do with these numbers other than the government is interested in facebook use zers. can't give you much beyond that. take a look at this video. a fun way to pass the time

forecast, it is pouping up. three microclimates. 35 degrees, 40 in the peninsula and 41 in the south bay. we are starting out with slightly cooler temperatures than yesterday at this time. in some spots, we are dipping below freezing, then it's going to be another warm day, warmer than where we should be for the end of december. morgan hill, a high of 63 degrees. 60 in milpitas and 64 in danville. oakland, up to 57 degrees for the high temperature. more breezy. half-moon bay, 57 degrees and 56 degrees on the embarcadero north bay reaching up to 59 degrees. it's going to be cooler than it has been, thanks to the cloud cover ahead of the next storm system now producing rain well to the north of us. this is such a quick moving system, it's going to be one and done as we go into late tonight. the clouds moving in. by the middle of the day, it's mostly cloudy. a few light showers possible later on tonight.

the main event, that round of rain moves into the north bay around 10:00 or 11:00 tonight and then pockets of heavy rain for a little while. it clears out by sunrise tomorrow morning. we are mostly looking at a tenth inch of rain. there may be slightly higher amounts in some spots. for the scierra, snow. only at a quarter of the normal amount of snowfall we get for this time. statewide average of 34%. looks good to see that snow and also a little bit of rain. then we dry out as we head closer to christmas and really chilly temperatures on the way. mike, now you are starting to see no major slowing? >> nothing major. we are done. a look at the roadway, what we expect in the morning, a light drive early. this crash at 150, off west 580 that cleared off the shoulder.

bay at 5:24 this morning, nonviolent offenders may soon be released from jail without having to pay bail. santa county leaders will introduce a no cost program for defendants who cannot afford bail cost. it is funded thanks to a grant from the mcarthur foundation. the plan is needed to cut population numbers in the county jail system. happening today, city workers in east palo alto are

asking the city council to extend parking bans for rvs. a portion of weeks street has become a popular parking lot. they tell the paper people in the rvs are responsible for 6,000 gallons of human waste dumped down the city drain. ahead of the winter rain, they are worried because the street is overflowed. holiday traffic impacts people who don't travel. a software company put together traffic near l.a.x. and shows how forautoslowdowns extend as people head to the airport. the busiest travel day down in l.a. will be december 23rd. 5:25 right now. on a night honoring a one-time warrior nemesis and l.a. laker great, the warriors kind of spoiled the party. >> los angeles celebrated kobe

clear it from san leandro. looks like it's gone. back to you. >> thank you, mike. people are fighting plans to temporarily move a nonprofit for the homeless. >> the proposal means moving it to a shopping center near the heart of walnut creek. bob redell joins us live saying the city council will take up the issue at a meeting tonight. good morning, bob. >> reporter: gulf of mexico ood you, laura and marcus. they have permission to move into the strip mall behind me. a number of people live in the apartments who are not happy about that decision. they have forced the city of walnut creek to consider their appeal. if you take a look here, someone has posted purple leaflets throughout the area urging neighbors to show up at tonight's meeting to fight back.

a background, it is a nonprofit that provides services for people who are homeless. senior citizens are on the brink of moving on the street. residents are worried homeless people will start loitering in their neighborhood and lead to an increase in trash and property crime. we spoke to the director. they only serve 19 homeless people. that sounds significantly from the 77 they used to serve. their lease with the strip mall would require they abide by certain rules and regulations to protect the neighborhood. here is a woman who lives in the apartment next door. >> so hard to afford living here. i talked to a lot of people. they are people who can't make ends meet, you know. bad things happen in people's lives. we have to help them. if you ignore it, they won't go away. it's not going to go away.

>> reporter: we reached out to residents against the move. one woman told us she prefer they did not move to the location. the appeals is open to the public tonight at 6:00. reporting live in walnut creek, bob redell, "today in the bay." >> thanks so much for that update. we have a follow up for you now. pittsburgh giving the green light to a network of cameras. there's been more than 100 freeway shootings. police and other agencies will use the cameras license plate readers and microphones to track suspects. they will be installed on highway 4 and i-80. they are investing $3 million to enhance that system. berkeley leaders may repeal the ordinance allowing police to use pepper spray. they approved that ordinance. they overturned a ban dating back two decades.

since that time, they have raised concerns about the health effects. a man was arrested for exposing himself. he is a transient, a woman claims he exposed himself near stevens creek trail and middlefield road. he matches the description of a man who did the same thing earlier this week. in that case, the woman said he sexually battered her and exposed himself. four teenagers have been arrested for firing flairs in several homes over the weekend. police used surveillance to track down the suspects. they say it's a serious situation. >> i'm glad they made arrests. it's dangerous. it's a long ways from egging and stuff like that. >> one of the things that came up is whether it was done intentionally to start fires in the neighborhood or if it was just kids being kids. either way, regardless of the

intent, the outcome could have been bad. >> all four suspects were booked into juvenile hall. 5:35. palo alto school leaders will launch a new effort to bridge the education gap for minority students. tonight board members will discuss what the district calls an updated equity plan. they suggest the number of african-americans and students in special education are unusually high. the new effort speaks to reverse trends that left them behind. the fight continues to keep local schools from shutting down in san jose. the oak brook school district held another meeting last night and parents showed up in droves. they expect to close up to five schools because of reduced funding. the high cost of living in san jose for low school attendance says consolidating schools makes sense. the final decision is expected

next month. it is 5:35. the new year means cheaper rides on bart. bart tweeted video, you must be under 18 to qualify and you have to get a youth clipper card. discounts begin january 1th. head to twitter to get the details on how to sign up. a popular aquatic park remains closed after two swimmers were attacked by sea lions. it is off limits until thursday. some swimmers are not heeding the warning and going into the water any way. last week, two swimmers were bitten by sea lions. they are expected to be okay. park rangers spotted three young male sea lions. a dog stolen at knife point in san francisco back home safe this morning. >> workers at a new leaf florist says a man came into the shop

saturday afternoon demanding money. he pulled out a knife and told an employee he wanted the cash. they said there was none. he thought the suspect was going to take the computer, but instead, he grabbed the dog. >> first reaction was to chase him, but then he had a knife. >> police searched that area for the dog napper and sydney, but came up empty handed. several hours later, someone saw sydney wandering alone and called the number on his tag. >> good he had his id tag on. we are tracking speed sensors and looking at a smooth drive. look at the green other than a new crash that popped up seconds ago near the dublin interchange. i'll track that down with chp. we are tracking this down. reports of one lane blocked. a crash near treasure island exit off westbound 80. that's the commute on the bay

bridge to san francisco. you can see the slowing sensors. the bridge crew is busy trying to get out. the back up, near the toll plaza is starting to build. the metering lights turned on five minutes later than they often are. this tuesday morning shows a lighter build around the bay as you would expect. a smooth drive down the east shore freeway. eastbound 24 away from the bridge into walnut creek. here are the travel times down the east shore freeway. a smooth, easy 16 minutes. look at the top of the screen, an easy drive. the back up is there. >> i like that. >> let's not slow down for the weekend. >> tuesday. i woke up this morning, i'm like, all right, monday is done. we are making progress. i's going to be cool this weekend as well. the high temperatures for the coast up to 56 degrees. it's going to be really cold during those morning hours. at least we will get sunshine on

victim and another man. so far, no arrest in the case. thirngs are getting back to normal after atlanta's power outage. we are not expecting cancellations of flights here in the bay area. if you are flying out. check your flight status before heading to the bay area airports. sunday, a fire knocked out power at hartsfield-jackson international airport. a boost in knocking down fires in southern california. it took two weeks but firefighters reached a milestone battling the thomas fire. it's 50% containment. full containment is two weeks away. it's burned 271,000 acres. it's 2,000 less than the largest wildfire on record in california history. new this morning, a stint of

how californians feel about the tax reform bill as it gets closer to becoming law. 51% of california voters oppose the tax bill, 30% support it. most believe the cuts won't help them, saying they feel corporations and super rich will benefit. 17% think it will be good for california. 52% say it will be bad for the state. the president says the tax bill is not well understood. >> we presume he means by the general public, scott mcgrew. >> some senators say they haven't read it, either. the poll of california is what we are seeing nationally. slight majority against it. a majority think it will raise their taxes. the house will vote on the finalized bill at 11:00 a.m. our time today. it should slide through the house. after that, the senate will take it up. we have house today, senate likely tomorrow. we'll see.

it's going to be much closer in the senate. the senate vote. in fact, vice president pence is sticking around town just to make sure in case he needs to break a tie. john mccain is not participating. he has gone home to arizona for christmas after spending time in the hospital. bob corker, a senator who is worried about deficits is a recent yes. you may have seen the controversy he flipped to a yes after a new rule in the tax bill benefited him financially. corker, to his defense said he didn't know that line was in there because he hadn't read the bill. the joint committee says tax cuts will add less than 1$1.5 trillion to the deficit over ten years. we'll be watching everything. i'm interested in what you think. find me on twitter. >> thank you, scott. today is the last day for an important holiday food give away. san jose sacred heart community service is providing more than

then it moves to the south bay. tomorrow morning, clear and cooler with breezy winds. during that time, we are looking at mostly a tenth inch of rain, maybe higher for spots, especially in the north bay, closer to .2 inch of rain. temperatures mid-50s on thursday. we stay in the 50s through next week. morning temperatures 30s and 40s. we may have widespread freeze in the valleys. mike, now checking on a crash at the bay bridge. >> kari, seconds ago, we got it cleared from chp, i did not have time. no longer work on you guys? looking at a crash that just cleared westbound 80 and the slowing. that's good news. the back up at the bay bridge toll plaza will not clear. the metering lights back at the normal pace. all three vehicles, including big rigs are off to the

deported to mexico 15 years ago is getting an early christmas 5:54 right now. a military veteran deported to mexico is getting an early christmas present. he will be allowed to return to the u.s. >> they uncovered hundreds of military veterans after serving honorably. they committed a crime after serving in the military and being honorably discharged. after the story aired, governor brown granted clemency. one of those veterans marco chavez, who came to the u.s. as an infant and served in the marines was told he would be allowed to return to the u.s. before christmas. an nbc exclusive. two women accusing russell similar molls of sexual misconduct. nearly a dozen women have accused simmons of inappropriate behavior. he is accused of rape.

overnight. so, we will still have a dry day and temperatures above normal, reaching the mid-60s for san jose, 57 in oakland and 58 degrees in san francisco. north bay going to see those clouds rolling in early with that rain as early as tonight. most of us, though, not seeing that rain until early tomorrow morning. we will talk about the timing. another look at the forecast is coming up at 6:09. mike has two new crashes to report. >> that's right, kari. we'll stay with the maps. we have a smooth flow of traffic starting to build. we have a crash in the east bay. southbound 880, approaching 92, the slowing is blocked. traffic is starting to back up with the build out of hayward. a traditional pattern. a lighter flow around the bay. that is unusual that formed in the last few. no slowing on the sensors here. the second crash we are talking about, southbound 17. it's smooth there as well.
