good sunday morning to you. it is christmas eve, 7:00. taking a live look at christmas in the park in san jose. another chilly morning, but not as cold as we have seen. maybe it's an early christmas present. thanks for joining us, i'm kira klapper. vianey arana has a look at the microclimate forecast for us. >> we have been talking about the possibility of rain. it is warmer out there. we are not seeing below freezing temperatures. >> which is nice. >> yeah, it's very nice. we are seeing some 30s in the north bay, but here are pictures of san francisco, looking beautiful. you may notice, we may have high clouds moving in today. it may keep the overcast skies.

right now, the temperatures, oakland, 43 degrees. hayward, 46. palo alto, 42. santa rosa, the coldest at 39 degrees. we have those high clouds keeping us nice and warm. that kept the overnight lows not as cold. it's warmed them up nicely. we have five degrees warmer than we were yesterday. livermore, six degrees warmer. santa rosa, four degrees warmer than yesterday. yesterday, we woke up to 35. today, we are waking up to 39 degrees. we have a couple changes you want to hear about in terms of your christmas day forecast and a spare the air alert is in place for today, which means no wood burning. >> no cozy fires. good to know. thanks. new this morning, a night out at a bar turns deadly in solano county. police need your help finding the shooter. it happened before 11:45. police found a 38-year-old man

shot and killed in a parking lot on york street. they are not releasing his identity. a second man and woman were found shot inside dunphy's tavern. call the police if you have information related to this crime. a quiet south bay community is on edge after a gunfight inside a crowded bowling alley bar. thom jensen shows us, it was a shocking incident in the safe city of socupertino. >> reporter: it's not a call dispatchers usually take from callers in cupertino. >> a couple bullets. active shooter. >> reporter: at least one active shooter at the homestead ball. it was 10:30 friday night as a small rap concert came to a close. one man was shot and a santa clara county sheriff's spokesman told nbc bay area, it was a

gunfight. at least two men were shooting at each other. >> it's always -- >> reporter: tom goes to the restaurant next to it and says this does not happen in cupertino. >> it's a concern. i i'm surprised why. >> reporter: men who seemed to know the rappers started name calling. then the gunfight broke out inside the bar here, maybe 15 shots fired. >> shooters in there. there were a lot of gunshots. >> reporter: the sheriff's department isn't going that far, but admits there were at least two shooters. he came here to see the rap artist. guards check people when they arrived. they wonder how the gunmen got inside with loaded handguns. thom jensen, nbc bay area news. at san francisco's pier 39,

tourists and locals gathered after a man planned a christmas day attack at the popular spot. a 26-year-old would have used guns and explosives to maximize the victim count. the former marine's plot was foiled by an undercover fbi agent. yesterday, there were extra patrols out. some visitors admitted to being shaken by the news. not enough to change their holiday plans. >> i actually work at the hotel nearest 9/11. i have a continue on spirit. we weren't going to change our plans. >> absolutely not. i mean, like, this is the safest place in the world. i'm really enjoying. i'm very happy they brought us here. >> the fbi says there are no additional known threats to san francisco. now to an oakland mechanic

who survived a shooting earlier this month thanks to his dog, who died in another shooting this weekend. he parked his rv in oak larnd on friday night. 9:30, the dog was inside the av and martinez was outside when he got into an argument with someone who shot and killed him. the shooter is on the loose. you may recall seeing the first story on nbc bay area on december 4th. he was parked in a different location in oakland when someone told him to move his rv, he was shot in the hand, but his dog jumped in to save him. she was shot twice in the face and survived. she is now with relatives of martinez. state officials say the thomas fire burning in ventura county is the largest fire in our state's history. it started 20 days ago and torched more than 270,000 acres. get this, it's more than double

the size of san jose and nine times the size of san francisco. the fire is still burning. it is 65% contained. until now, the 2003 cedar fire in san diego county was the state's largest. a memorial service for a southern california firefighter killed while battling that fire. hundreds gathered to remember corey iverson who was 30 years old. he died from burns and smoke inhilation last week. yesterday, firefighters paid tribute to the fallen firefighter, his wife and daughter. there's been an outpouring of help for that family. >> we have had tens of thousands of people reach out to our organization with offers of help and financial assistance from the family. it will allow me to sleep very well knowing that ashley and the kids are well taken care of.

office. it's putting him at odds with the trump administration. we have a breakdown of the governor's executive order. >> reporter: among the 151 orders are two. >> they were immigrants who were scheduled to be placed on a plane, departed for a country they left when they were children on monday. the governor granted a pardon. >> reporter: that means they can appeal the immigration status to retain a green card. they were nonviolent offenders. an attorney represents them. >> affirming they believe in compassion and second chances by contrast of the fear and hate coming from the white house. >> reporter: among those still in prison is oakland resident

welcome back to you. here is a live look outside embarcadero on this christmas eve. cloudy skies. vianey arana will be along in a bit with your christmas eve forecast and let us know when we can expect rain. a 17-year-old from the nashville area is the reason why apple is facing a lot of fury from devoted customers. the teen discovered the company slows down older iphones. tyler barney says he noticed the problem when he got a new iphone and it was working faster than

his brother's older model. he replaced the older phone's battery with the new one and wouldn't you know, the phone sped up. >> i ran some tests with the old battery and the new battery. the old battery was half as fast as the new battery. >> apple acknowledged it does, in fact, slow down older phones to save the battery from dying and the phone shutting off. some users say apple is forcing us all to buy newer models. the company is facing a lawsuit, by the way. tyler says the point wasn't to bust apple, just to help people out. he is still an apple fan. we have all had our year to shop. many people are packing in sorts of last minute christmas gifts. many malls had last minute sales and hours to accommodate the procrastinators. anser hassan has more from san francisco's union square. >> reporter: we know santa has a

[ applause ] >> that is navy officer roberto. he found out he was coming home for christmas only on friday. so, he wanted to surprise his two sons. his wife played along, taking the family to a restaurant in san bruno for lunch. the boys were unaware dad was waiting in the kitchen. when dad delivered the food to the table, it was an

it's still cold in lake tahoe. 30 degrees up there. definitely a nice christmas eve shot here. we have trees. we have the snow. i am tracking a system that might bring snow flurries on christmas day for lake tahoe. they are fairly on the warmer side compared to 20s and 30s. peninsula at 44 degrees. the south way, a nice 46 and san francisco looking overcast at 47 degrees. we have a couple high clouds there. that's actually helping keep those temperatures on the warmer side of things, especially for the overnight hours. we have that kind of ridge of high pressure over the bay area. because of that, it is trapping a lot of pollutants, which means, yes, the spare the air alert is in place. the north bay and east bay peninsula, unhealthy air quality which means no wood burning. it is illegal. that means no fireplaces tonight. repla replace it with candles instead of the firewood.

today's overall highs are comfortable, similar to yesterday. concord, one or two degrees on the warmer side at 57 degrees. antioch, 56. napa, 56 and san jose, 59 degrees. we top out in the upper 50s. let's talk about the possibility of seeing rain. we have the time bar up here. the cold front is expected to move toward the east. it's a very weak storm system right now, which is why we were saying it's a very light chance. if you look, the far north bay is going to get the chance of light showers, which means the rest of the bay area is expected to be dry on christmas and christmas day. the time line is christmas eve tonight, still around 11:00, 12:00 to early saturday or monday morning. we have some of the sierra snow, but oregon is going to take the majority of that. if you are in lake tahoe, a possibility of snow flurries. i don't think tonight is going to be the best in terms of

travel. a long range outlook, once the storm system passes to the east, we stee ridge of high pressure dominate in the forecast. then, it looks like another weak system to the north. for the most part, that high pressure is going to warm us up in terms of temperatures above seasonal conditions. we have those early morning showers to the north tuesday and wednesday so the last week of december for san francisco and inland areas will start to warm up nicely into those mid to upper 60s inland. we are going end kind of the month of december, 2017, on a dryer rain. 2018, we will recover for january. back to you. >> thanks. it is 7:21. still ahead on "today in the bay" -- ♪ >> christmas carolling probably like you have never seen before. the bay area community where they put a unique twist on the

"today in the bay's" joe rosato jr. takes us to a neighborhood where carolling gets a twist. >> reporter: it wouldn't be the holidays without colorful lights and a few songs. there's nothing traditional about this neighborhood. waterfront property doesn't mean it's near the bay, here, the houses are on it. >> like no other place in the world. >> reporter: even an unconventional neighborhood appreciates conventional holiday cheer. ♪ >> it started on a whim. >> reporter: every holiday season, for about the last decade, floating home residents

safest place in the world. i'm enjoying. i'm very happy i brought us here. >> the fbi says there are no additional known threats to san francisco. new details this morning on an explosive report that concerns inflammatory comments president trump made in an oval office meeting. nbc white house correspondent, kelly o'donnell explains. >> reporter: the president's fire over immigration. >> we are going to get the wall we need it. >> reporter: long frustrated by congress and the court rejecting his policy, including a travel ban. >> we don't know who they are, where they come from. >> reporter: that backdrop is context for a provocative report in the new york times that describes a volatile oval office meetingics months ago where the president and officials engaged in a heated engagement over how many visas the state department

granted to people from alf, haiti and nigeria. according to "the new york times," some, but not all of the unnamed sources say the president used derisive language referring to those from haiti with having aids and people from nigeria going back to huts. the senior staff in the meeting deny the outrageous claims and call the paper's decision to publish sad and telling. on twitter, the president tried to steer attention back to his claims, a bias against him at the fbi tauting andrew mccabe. racing the clock to retire with full benefits, 90 days to go. wow, fbi lawyer, james baker reassigned. they say baker was moved out of the fbi's general counsel office and new director, christopher

wray assembles his own team. >> the trump administration is considering a plan to reduce illegal immigration by separating parents from children while being detained. the rational is for proper punishment. it will stop people from trying to enter the country in the first place. >> dissuade parents from trusting themselves and children, smugglers. they are heartless and treat human beings like merchandise. >> ripping a child from a mother's arms is never a compassionate act. no policy is going to deter a mother asking to save her child's life. >> advocates of the enforcement say it's a necessary step, but immigrant rights groups say it's cruel. palestinians are making last minute preparations in the city of beth helehem ahead of christ.

there are posters denouncing the decision by president donald trump who recognized jerusalem as the capital of israel. they pledged the move by trump would not stop people in bethlehem from enjoying christmas. >> the people that really are people -- and continue the operation. we are looking for freedom for our dignity. >> palestinians have been clashing with israeli troops since trump made his announcement on december 6th. ten palestinians have been killed and dozens more wounded, so far, in the fallout. a shake up at the miss america organization. ceo sam haskell resigned yesterday in the wake of the scandal involving vulgar language and fat shaming of former winners. the "huffington post" released

the e-mails thursday. they have not been verified by nbc. in the e-mails, they describe the sex life and the looks of former winners in vulgar terms. haskell issued a statement apologizing, writing that the e-mails were stolen by former employees and conveniently edited. a former contestant said it was on ongoing problem. >> i wasn't shocked, but i was validated. i mean, for the longest time, i have tried to explain to people around me that this is happening. >> the miss america organization promises it will investigate the, quote, inappropriate communications and how those e-mails were leaked. >> it is 7:38. still ahead on "today in the bay," the warriors hoping to continue their winning streak. last night, they faced a team that always gives them a little trouble. nbc sports bay area is up next with sports. thanks fallon.

there is much more ahead on today in the bay. i'm fallon smith at the xfinity sports desk. the warriors streak isn't making it to christmas. it was snapped after their worst performance of the season. a couple puppets in the holiday spirit. highlight of the day, green comes up with this. that leads to this. it's beautiful. pay attention. alley-oop to jordan bell. finished with seven points and ten rebounds. it was not the warriors night. goldsen state couldn't find the flow. three three-pointers. they were 3 for 27 from beyond the arc. they were just 38% from the field. third quarter, clay missed a three, gets the ball back.

airport. there's moderate air quality right now. it's not great. it's not expected to delay flights, but we are under another spare the air alert today so no fireplace nor wood burning on this christmas eve. but, for people leaving the bay area, it's a last minute push to get going for christmas. winter storms have 35 million people under advisories right now. rain, ice and snow coating thousands of miles from the northeast to the rockies. for those who have to get on airplanes, a rash of delays, especially in the major airport of the northeast. maya has been watching the travel impact from the busiest airport in the world, atlanta, and brings us the latest. >> reporter: from the curb, to the counter to the cockpit. the final push for holiday travel is on. >> much easier than expected, so, it hasn't been a bad morning so far. >> reporter: tsa is staffed up.

fedex flights. packages and people. looking for an on-time arrival. >> that was maya rodriguez reporting. the fedex deliveries may be frozen thanks to winter weather. the company issued a statement about the potential of delivery slowdowns saying strong storms disrupted flights and sorting at the memphis hub. it will not affect the drivers making ground deliveries. some of us might be in luck. a consumer alert as the last minute frenzy hits the home stretch. a warning about a certain kind of high-tech toy, very popular these days that experts say could allow hackers to spy on your kid. ron allen has more. >> reporter: a renewed alert for consumer advocates about hot tech toys that sound so smart. >> i promise not to tell anyone. it's just between you and me.

>> reporter: cautioning, hackers may be able to listen in, too. infiltrating your network to steal data from your kids. >> research has shown a lot of toys have no security whatsoever, allowing hackers to take control of the toy and listen in on children's conversations and interact with them. >> reporter: toys and gadgets connected to the internet with wi-fi or bluetooth with cameras, microphones and gps tracking. the fbi is cautioning, information such as the child's name, school, likes and dislikes and activities may be disclosed through normal conversation with the toy. a complaint has been filed with fcc, connective toys like, my friend kayla" haven't had incidents. they maintain control over the data they collect. experts warn parents to do their
