morning. kind of marching closer to the weekend. >> yes, we are almost there. it's going to start out with cool weather this morning as you get ready to head out the door. all clear in the south bay and it's 40 degrees but we do have patchy fog in the north bay, temperatures in the mid 30s. today we will have temperatures reaching into the low 60s in san jose, very nice. we will talk about the rest of the year coming up in just a few minutes. mike starts out with a check on walnut creek. >> that's quite a forecast all the way to the end of the year. looking over here, a smooth drive right now, i will talk about the peninsula in just a second, but i want to shout out a small fire reported in walnut creek south 680 right at the transition with 24, the walnut creek interchange, it's on the roadway, in a grow point, sounds like someone tossed a piece of pa paper out and that caught fire. we'll track that. we are also tracking the live look at palo alto where chp and the ambulance and the fire crew all cleared over the last few minutes. it took just about 20 minutes from start to finish. these flares, the last of it

north 101 at university all clear once again. back to you. 5:00 right now and happening today the man accused of plotting a christmas day terror attack at san francisco's pier 39 will be in@q;0 federal cour today in fresno. everitt jameson is making his second court appearance, he is charged with attempt to go provide material support to a foreign terrorist organization, this after multiple communications with the fbi informant he believed was an isis leader. and this happening as the city of san francisco prepares visitors new year's eve. >>ç suratos joins us live from pier 35 with details on what the city is trying to do to keep people safe. good morning, pete. >> reporter: good morning to you, laura and marcus. for those that have been to san francisco on new year's eve they know it's going to be packed especially along the embarcadero, even here at pier 39. so you're going to an increased security presence in light of what you just mentioned, that christmas terror plot that was

washington, d.c. the president is going to meet with congressional leaders at camp david next week. he's going to lay out his legislative agenda for them including healthcare. president trump visited the west palm beach fire station, listing off accomplishments he feels he should get more credit for. >> so the country is really in terms of big, big beautiful ships that we're turning around and a lot of good things are happening. >> reporter: the president mentioned repealing the individual mandate in the affordable care act as part of the new tax bill, which required everyone to have health insurance or pay a penalty. >> the most unpopular thing which most people thought should have been unconstitutional, but we repealed it. >> reporter: many americans believe obamacare has been fully repeal repealed. it hasn't. just the part affected by the tax code. passing tax reform has had one major year-end effect, long lines for americans to prepay 2018 property taxes because the deduction will be limited to $10,000 next year. >> i probably am going to be

needing to budget a little bit better next year because i think i will be taking a hit as middle class. >> reporter: not all people believe the lower tack brackets will offset the deductions. >> i'm in the middle class. >> reporter: still the president points to strong wall street numbers as a sign of good things to come. edward lawrence, nbc news, washington. well, this certainly caught people's attention, now there's more earthquakes to talk about. after a widely felt earthquake in san jose on tuesday there were more tremors yesterday. the latest was a magnitude 2.9 southwest of hollister just after 6:30 last night. there has been a few in the bay area, largest a 3.4. the 3.9 quake that stuck on tuesday night in alum rock was felt across the bay area. a geophysicists says because it was a fairly shallow earthquake it could be widely felt. >> it's a pretty typical

earthquake for the calaveras fault which tends to produce a lot of small to moderate magnitude earthquakes. >> there were no immediate reports of injuries or damage from any of these recent quakes. >> a danville family is safe this morning after a scary burglary at their home. this happened yesterday morning at a home on savona court off of mccauley road. a woman saw that suspect enter her home and immediately fled the house with her family calling police. thanks to her quick action officers arrested that suspect before he could leave with stolen items still in his hands. tight security preparations under way in las vegas for new year's eve. the department of homeland security expecting a higher risk of terrorism and criminal activity this year. it's been three months since the shooting massacre left 58 people dead there. federal government is bringing in snipers and personnel to assist las vegas metro police. still, the police chief assures visitors that there are no current threats on new year's eve. as recreational pot becomes

legal, could end up in some of your food. >> chef an investors have been teaming up to offer an eye boggling array of marijuana infused food rand beverages. the marijuana enthuse yasts can expect to see vegan and gluten free choices, pot-laced snacks and dishes like cannabis rubbed steaks and marijuana infused tac tacos. it is predicted marijuana edible could top $100 million in sales next year. now that christmas is over they are saying it's time to get rid of the tree. no better way than the annual tree chipping ceremony. it's going on today in southern san francisco city hall. city officials will be on hand to push some of those dead or dying trees through the giant wood chipper. they are also announcing the official dates of curb side tree collection. you have to pay attention to that, sometimes in the suburbs you've got to cut them down. >> it's true. >> got to find my neighbors' saw. >> it's so easy to cut down my artificial tree, just pull it

apart. >> no wood chippers in your house. >> no. we're going to have a great day for taking down those christmas decorations and getting all of the lights off the house, whatever you have to do today, it's going to be in the mid 60s in east san jose, we will also have low 60s in parts of the east bay, concord, walnut creek, low 60s there, 60 in oakland and 58 degrees in daly city. san francisco up to 57 degrees in ingleside and the marina district, and sonoma, we are up to 61. 64 in santa rosa after this very chilly start. i will break down the temperature trend for fremont coming up in about four minutes. mike gets you out the door with a couple issues. palo alto and walnut creek both cleared and once they both cleared, kari, we made that commute great again. looking over here to a nice smooth flow of traffic, green sensors around the bay. we have present right here still a little fog for the north bay, just like we have had the last couple days.

it's very cold up there, so be careful, mist or fog, there is a potential for a thin sheet of black ice up in the north bay. the speed sensors don't show any issues getting over toward the bay bridge. very clear. we're hoping this continues all morning but of course i have my eyes on things. 5:09. coming up, say good-bye to the cubical. the new technology that could be replacing desks and keyboards. plus the mad rush to pay property taxes before the new tax law kicks in, but you might want to hear what the irs is saying before you attempt to pay that bill.

up. the markets continue their bull run but there is a lot of confusion about property taxes for the new year. >> landon dowdy joins us live from cnbc headquarters to break it down for us. good morning, landon. >> hi there, marcus and laura. good morning. wall street looks set to add to yesterday's modest gains, the dow is on pace for a sixth straight positive week, also poised for a nine-month winning streak which would be the longest stretch since 1959. investors get data today on unemployment and manufacturing. the dow rising 28 points yesterday to 24,774. the nasdaq up 3 to 6,939. home openers have been rushing to pay their 2018 property taxes early to take advantage of a deduction that's being scaled back under the new u.s. tax law. the irs says property taxes that haven't been assessed before 2018 will not be deductible on 2017 tax returns. many towns don't have their full 2018 property tax bills ready.

the new law caps the amount that you can deduct in state and local income, sales and property taxes at $10,000. now, that would limit and would disproportionately affect homeowners in high tax states such as new york and california, san francisco and los angeles counties are currently not allowing property tax pre payments. and starbucks is debuting a new drink, the black and white mocha has white and dark chocolate espresso with cream and a stripe of chocolate sequins down the middle. it will only be available until the end of next week. >> a short term. chocolate sequins. nice. apple is facing at least nine class action lawsuits over purposely slowing down older iphones. the suit claims the company fraudulently hid from consumers the practice of slowing down the performance of certain iphones. apple says software updates make

your phone operate nor slowly to offset the problem of aging batteries. as batteries get older they don't hold their charge as well. the lawsuit also claims that this is apple's way of forcing users to buy new iphones. it could be the first san jose based company has been given the green light to try to make it happen. they got approval to begin manufacturing and selling wireless power chargers in the u.s. the power cast based out of pennsylvania also got the go ahead from the fcc. the technology converts wireless signals into electricity to charge phones, tablets and other small gadgets. it works a little like wifi does. the devices just have to be in the vicinity rather than plugged in. >> pretty cool. bay area fans of international superstar shakira will have to wait a little longer -- a lot longer some way say. the singer is postponing her concerts at sap in san jose in september. she was supposed to perform

there in february. last month shakira took to social media and pushed back the dates of the tour. apparently she's recovering from a vocal cord injury. her stop at the sap in september will be her only tour stop, actually, in the bay area. so those hips don't lie. >> what do you think of this, is this the future of the office. employes working at a peninsula company are using high top goggles instead of their desktops. >> san mateo startup meta is removing computer monitors. taking their place are ar head sets. how it works is instead of clicking a mouse and you grab the air and move anything. the website to a sticky note, even a 3-d brain. it's different from virtual reality which completely covers your field of vision. are kind of phone monkeys hunched over their rectangles. we are all guilty of it. but i felt like there was something better. >> meta is already working with nike sneaker designers. now to the deep, deep freeze. more snow continues to pile up in the lake effect felt areas like this video right here, you can see, this is in erie, pennsylvania. nearly six feet of snow has already been dumped. in some parts of the northeast they are expected to experience temperatures colder than antarctica and siberia. some perspective for you, parts of erie hit a low of negative 10 degrees yesterday. in the coming days temperatures in concord, new hampshire, are expected to reach as low as negative 11 degrees. >> concord, new hampshire, not concord, california. >> i was like, wait? >> not our concord. revelers in times square

could face the coldest celebration in more than 50 years. they are predicting 11 degrees at midnight, it will probably if the temperature reaches those levels it would be tying for the second coldest record that was set back in 1962. so hope you are cuddling up to somebody you like. >> you will be with a lot of people. >> i know, everybody is like sardines. >> those people who get out there for the times square watching the ball drop, they are out there all day long. >> it's always the>bx ] coldes of the year on new year's eve. >> of course. i'm so glad we don't have that. >> the only thing we may be dealing with on new year's eve is a little bit of some fog and some low clouds and for san francisco that's a big deal because we have the fireworks, so i will be monitoring that for you. let me get you out the door right now, it's 34 degrees in the tri-valley, usually one of the cooler spots there with clear skies, it's 40 degrees in the south bay and 39 degrees right now on the left side of the screen looking live in the

east bay. san francisco, 46 degrees, and seven-day forecast is also it up at the bottom of the screen. let's check out our high temperatures today, very nice once again, we will be up to 59 degrees in san francisco, palo alto 61 degrees and 60 today in oakland. we will see also some very nice weather. now, if you are lucky enough to go to heavenly this weekend our temperatures there will be in the upper 50s by tomorrow and then some lower 50s for the rest of the weekend. looks pretty much clear, but an update on the sierra snow pack. now, we are looking at some of those snow levels only at about 24% of normal for the northern sierra and then around lake tahoe it's about 33% of normal. the statewide average is only 28% of where we should be. so big deal, especially as we are going into what's supposed to be our wettest months of the year. and then as we look at the bay area and what's coming down the pike as we end out the year and

move into the new year, finally a significant chance of rain and there will be some snow in the sierra as well, but that does not come until next wednesday. so we will still have some dry weather over the next several days. new year's day looks good, more clouds moving in, san francisco reaching into the upper 50s. we will be ringing in the new year with temperatures in the mid 40s there and inland areas down into the lower 40s in some spots. more clouds and, look at that, finally some showers. i will be tracking all of that for you. mike is still saying there is some light traffic right now. >> light traffic now and likely through the end of the year, the beginning of next, we will see how things go. right now, today, great, green all over the bay, nothing really slowing you down, even the altamonte pass. we will talk about travel times in a second. a little fog in the north bay hasn't been a problem for the last couple days, this morning still no problems reported by chp. the rails show a smooth flow of

a lot of people leave their hearts in this famous city by the bay, san francisco. taking a live look outside, it's also the place where a lot of new year's revelers will be headed. we will have more on that coming up in just a little bit. your safety could be a big concern. 5:30 right now. good morning, thanks for joining us, i'm laura garcia. >> and i'm marcus washington. right now we want to get a look at your microclimate forecast. meteorologist kari hall has been tracking everything, cold start to the morning but things will change. >> it will be a really nice day, but we do start out with temperatures just above freezing in parts of the north bay and interior valleys. right now only 34 degrees in livermore and san jose 40 degrees. some mid 40s for san francisco. as we take a look at our high temperatures it's going to be into the low 60s, ever green starts out at 41 degrees in san jose, now it is going to be slightly above normal as we go through the day, but a lot of

sunshine in this forecast. we will talk about what's ahead for new year's eve and your weekend forecast in about seven minutes. mike is tracking changes at the bay bridge. we have had a dramatic change to the build over here. on the right side we have five cars now instead of eight, so it's actually a little bit better. some folks are darting over to the lanes to the far right. we do see a little build to the volume, but nothing dramatic. we will show you the map. there are no metering lights right now on the bay bridge. no metering lights and no slowing around moths of the bay. a disabled vehicle getting on to 87 coming out of downtown around the taylor on ramp but it hasn't been a problem as far as the freeway slow of traffic. we will track the south bay build as it happens. very light now around the bay. new this morning, dramatic rescue overnight in the santa cruz mountains as a group of joyriders come to the rescue of a trapped man who fell off a

trail. >> "today in the bay's" anser hassan is live in los gatos with more on this heroic tale. >> reporter: good morning, marcus and laura. talk about luck, this man fell from a ten foot drop, broke his leg, he didn't have his cellphone to call 911. he had to use his flashlight to stop a passing car. fire rescue crews say if they didn't stop chances are they wouldn't have even known about this fall. here is what we know, this all happened about three hours ago, a group of friends home from college for the holidays were out for a ride on hicks road when they noticed a flashing light on the fwaguadalupe reservoir. they began yelling across the water to find out it was a homeless man who had fallen and broken his leg. the 40-year-old man didn't have a cellphone so his only way to signal for help was using his flashlight. rescue crews say the man was stuck for about two hours out in the dark, in the cold weather.

temperatures in the 30s and bleeding from his leg. one of the guys from the group says the man was in so much pain it was hard for had him to even talk, his pants soaked in blood. he immediately called 911, they stayed on the line until rescue crews were able to arrive on scene. >> i mean, i just immediately told him that like this guy has a broken leg and where we were, after that she had already sent units out and was just asking me questions about his like condition, like what's broken, where on the leg, is he bleeding, different things like that. just trying to maintain some sort of contact with him. >> reporter: now, the battalion chief says this was a very complicated rescue because they had to pull him out and then move him to the other side of the reservoir. the man is said to be in stable condition and currently being treated. reporting live, anser hassan, "today in the bay." >> thank you very much. it is 5:33. developing story in the south bay right now, san jose police trying to figure out who shot and killed a man. victim found last night on van

winkle lane near the intersection of capitol expressway and story road. police say they were called up to the scene and found the victim suffering from at least one gunshot wound. he died shortly thereafter. we spoke to one witness who didn't want us to show her face, but she says she's worried about her nephew who was out for a walk at the time of the shooting. >> we were just eating and then we had seen all these cops just driving through here and so we all came outside and then we were trying to call my nephew to see if it's him because he walks down through that way. >> police have not released any information on the suspects. 5:34 right now. a new video this morning of the cleanup on a busy mountain view intersection after a deadly crash involving a charter bus an motorcycle. that crash happened around 6:00 last night and as you can see right there the cleanup went well into the night. all lanes are now open. no word exactly what happened, but that crash happened near google's headquarters at shoreline boulevard and blim

aught u. out street. the motorcyclist was killed. we spoke with a woman driving right behind the bus. >> i immediately called 911, told them what i had seen, where he was on the road. as i was ont3ñs the phone with people started swarming over to him to try to assist him, try to move him. the bus is operate loop transportation at the time of that crash, the driver was the only person on board. continuing coverage this morning of the hayward chp officer who was killed in the line of duty. a public memorial service is being planned for saturday for officer andrew camilleri. it will be held at the christian life sent it err in stockton. it starts at 8:30 on saturday morning. we are now hearing from a family member of that officer. his sister sharing her feelings on social media yesterday saying, quote, andrew is my brother. he was a loving father to his wife and three kids, a great brother, son, uncle, friend, cousin and much more.

family, friends and colleagues attended a special bell ringing ceremony yesterday to honor officer camilleri. his partner who was in that patrol car with him when he was hit by a suspected dui driver was also there. here is the acting chp commissioner. >> andrew camilleri epitomizes what a chp officer should always be, a dedicated and selfless public servant. >> a donation site has been set up for the officer's family. we've posted the link on our website nbcbayarea.com. we are learning the name of a man killed last week in a crash involving a fedex truck. this is video of that crash on interstate 880 in oakland. 24-year-old gonzalo chavez jr. of oakland was driving a sedan involved in that crash, overturned along with the fedex semi. the driver of the semi survived, but was injured. the cause of that deadly crash

we've been talking about for the last couple days, the maps around the bay show speed sensors at the limit, green all over the place. light holiday traffic continues usually between christmas and new year's. top of your screen still only 14 minutes to the bay bridge toll plaza where there is no backup now for those lanes approaching the cash takers. we are looking over toward dublin, westbound 580 shows an easy drive as well. cars close to the limit or actually at the limit -- well, close because they might be a little above the limit. >> it's almost here, the weekend. it's another holiday one. >> a lot of people going to parties, whatever you have planned this weekend or just hanging out at home, spending time with family, it's going to be a great one. you can also get in some shopping this saturday, a lot of sales going on, and i think that's what i will be doing. 60 degrees by the coast and 65 degrees inland. on new year's eve our high

temperatures reaching into the low 60s for the inland valleys, morning temperatures still cool, but we will have more clouds and those clouds may get lower. we could have some fog in time for the fireworks on new year's eve in san francisco. if you're watching it from one of those viewing points around pier 39 or fisherman's wharf, treasure island also a great spot, too. in san jose christmas in the park will do a countdown to the new year as well. we will see partly cloudy skies and temperatures in the mid 50s to start, cooling down to about 49 degrees around midnight. make sure you wear a nice warm coat there. if you will be spending the weekend in santa cruz it will be in the upper 60s. friday will be the warmer day and then some slightly cooler temperatures in time for the rest of the weekend with mostly sunny skies. muir woods will have a guided hike early in the morning on sunday, that may be a nice way to which can off your new year's eve. up to 60 degrees throughout the day.

on south of the coliseum coming up. new this morning a tesla crashing in the santa cruz mountains overnight plunging ten feet from the ground. it happened on old santa cruz highway south of the cal fire station over briggs creek. when emergency crews found the car it was still in gear. firefighters had to cut the door off to shut off the car. investigators say the driver was suspension of driving under the influence. scary moments for more than two dozen people as they had to be evacuated from a ferry on a frigid night in the waters off of new york city. we've been talking about how cold it is there in the northeast. that ferry hit a sand bar wednesday night and got stuck for hours. no injuries were reported. all 27 passengers were pulled off the boat by about 10:30 and taken to land by a fire department boat. this is the second stranding in a month for the city's newly expanded ferry service. last month more than 100 passengers were rescued from a ferry that ran aground off lower

manhattan. new details in a santa rosa stabbing case. newly released mugshot of the suspect. he is accused of stabbing another man at lola's market and restaurant in santa rosa last thursday night. the two men were sitting at different tables when the suspect stabbed the victim in the neck and then left. the victim was taken to the hospital with life-threatening injuries but he is now in stable condition. police believe the attack was unprovoked. bart is rolling into 2018 with a lot of new changes. first of all, children and teenagers under 18 will now get 50% off their rides, but you must get a clipper card to get the benefit. all fares are going up about 3%. minimum fares increasing to $2 for adults, $1 for youth and 75 cents for seniors and disabled riders. 50 cents will be added to fares if you use those paper tickets. bart wants to go paperless. there is no extra charge on the clipper cards. be prepared to show proof of

payment, bart will be checking for that on all its trains. caltrans is sounding the alarm about climate change. governor brown asked the department to take a look at what climate change will do to state roads and what it will mean for drivers. the first segment of the report is on the bay area, it looks at rising sea levels, storm surges, wildfires and changing rain patterns. in the first half of the year alone a string of storms created road problems that totaled more than $250 million in repairs. caltrans plans to use that information from the study to plan, design and operate our state roads in the future. the legalization of recreational marijuana begins statewide on monday. marijuana possession will still be prohibited at eight border patrol check points in california. marijuana is still illegal under federal law. as for border patrols they are

to start with, some low 40s right there in the middle of the screen. let's take a live look outside at the san mateo bridge for the peninsula it is 42 degrees and then as we check out some of those colder temperatures in the east bay and the north bay, now in the 30s and mostly clear skies, although we have had to watch out for patchy fog in the north bay, there may also be icy spots on the roads. as we get a look at the seven-day forecast it does show we will have a few more days of dry weather. we may each morning start out with patchy fog, we're seeing that in santa rosa where the visibility has dropped down to a quarter of a mile. you can't see that far ahead of your head lights. clear visibility is ten miles, that's what we are seeing elsewhere. napa visibility about four miles. light fog there, getting dense in a few patchy spots. after all that clears out all of that sunshine will make for a beautiful day, warm temperatures reaching into the low to mid 60s inland today. as we start out with cold

republican candidate roy moore still refuses to concede and now filing a lawsuit. unofficial results show jones defeated moore by about 1.5%. new this morning, we have heard -- as we head into the new year, rather, there are some promising health stories to watch. experts advancements in target breast cancer treatment. these drugs attack specific paths in cancer cells and are already on the market for ovarian cancer. there are hopes that the fda will approve them for the use of breast cancer in 2018. studies show the treatment have extended patients lives without their cancer worsening. there will be more focus on super bugs in antibiotic resistant infections in the new year. the cdc says they plan to unveil a containment plan in april outlining how they detect and respond to those infections. about 2 million americans get sick with antibiotic resistant infections each year. 23,000 of those people die.

a southern california couple facing felony charges after police say they used a drone to deal drugs. the two were arrested in riverside last week after an undercover police investigation. police just released information on the arrest. investigators say the couple was dealing drugs out of their home in riverside. they started surveillance and observed a drone flying out of the backyard and to a public parking lot nearby where it would drop a package. police and neighbors say it's a new step forward in drug dealing technology. >> i believe this is the first time we've seen anything like this in our city. >> yeah, it would fly real high in the air and then if over to the church where he will drop in front of a house or down the street. >> the pair is charged with three counts of possession for drugs for sale as well as child endangerment and possession of drug parent fern i can't. the powerball jackpot is up
