44 in palo alto. the high temperatures today, look at that, 67 in san jose. it's going to be a nice one. we'll talk about your last weekend of 2017 coming up in a few minutes. mike, already tracking a crash in fremont? >> yeah, kari, it's been there for a while. the truck scale, southbound, see how populated the nimitz is? it's south of this camera shot. it's right around warren. folks know it as mission. it's around that area. it's been on the shoulder quite some time. when i passed through the area, chp was just arriving. the crash had been there 24 minutes before that. no slowing there. we'll check on the bay bridge approach. back to you. >> thank you. breaking news out of east san jose where police activity is shutting down part of a neighborhood between i-60 and alum rock avenue.

>> that's where we find "today in the bay"'s anser hassan. have you been able to find out what is happening out there? >> reporter: good morning. no updates as this is early in the investigation. behind me, it is still a very active scene. this is south sunset avenue in east san antonio in the residential area. csi arrived a short while ago and police parameter has been expanded. we did get reports one victim may have been shot. we don't know the condition and don't know if there was a fatal shooting. we know it happened before midnight. a dozen police vehicles have been out here since then. it has been described as a rough part of town, but the rest of the neighborhood seems quiet. no information on a suspect or victims at this time. we found that san jose homicides are down. last year, 47, more than 30 this year. there's been a decrease, but

we'll continue to monitor the situation and bring you the latest on air and online. anser hassan, "today in the bay." >> thank you so much for that update. we have more breaking news this morning. details on a horrific apartment fire in new york city where 12 people were killed. >> tragic. we are getting an idea of the victims. three were children, ages 1, 2 and 7 years old. one was a victim of 63 years old. the fire broke out about 7:00 at bronx apartment building. new york mayor, bill de blasio calls it the worst fire the city has seen in a long time. >> there are family that is have been torn apart. this is the worst fire tragedy we have seen in this city in at least a quarter century. >> more than a dozen people were hurt. the apartment building is 25 units and crews are going through it very carefully,

looking for clues and victims. the cause of the fire is unknown. new this morning, a man is hurt after a vehicle fire in the south bay. san jose firefighters arrived to the scene to see that vehicle on fire. this was rogered avenue. the fire quickly put out by firefighters. investigators say it appears that man was living in the vehicle. he was taken to the hospital with second degree burns on his hands. the cause of the fire is under investigation. the search for suspects continues in a drug smuggling ring in san mateo county. mail laced with methamphetamine was being sent to the maple creek correctional center which is the women's jail. a number of letters had been dipped in liquefied meth. a man was arrested and five inmates facing charges. drugs worth thousands of dollars

were seized. a christmas day death being investigated as suspicious. christmas morning, they found a transient woman with a serious head injury. police say medical investigators have not been able to determine the cause of her head injury. that's why they are calling the death suspicious. >> we now know the crash that killed a motorcyclist near google headquarters did involve a google bus. officers say before 6:00, a man riding a motorcycle collided with a bus at shoreline and plymouth street. an officer hit and killed by a suspected drunk driver on christmas eve will be laid to rest tomorrow. it will be held at the christian

life center in stockton. the suspected drunk driver is in custody. chp officers worried about impaired drivers. the first check point since officer camilleri was killed. officers tell us the recent death of a fellow officer is certainly on their mind. >> we have no problem finding officers ready, willing and able to enforce the dui. the loss of officer camilleri is on their mind. >> 917 people were arrested for dui. that is up from 621 during the same time last year. however, fatal crashes, so far, are down this year compared to last year. a developing story. security is tightened around san francisco as the city prepares for new year's eve. we are hearing security at major landmarks are foiling the terror

plot at pier 39. the golden great patrol says its jumped a third. 36-person unit patrols by foot and car. apple is now apologizing for slowing down older iphones. >> they are offering to replace older batteries for $29, dropping the price from $80. this comes after nine lawsuits have been filed. they admit slowing down older phones to save batteries. they were never told about the slowdown or told to purchase batteries. >> i think people are going to be concerned about the reason that the phone slowed down in the first place. >> not cool. i'm glad they are addressing it but giving this option to get a better battery. i might not have done it if i knew my phone was working like

dowdy live at cnbc. wall street could start the final trading day of 2017 in the reds. markets soraed yesterday with the dow closing at a record high. the dow is on pace for the best year since 2013. the best performing sector, tech. the dow rising 63 points to 24,837, the nasdaq up ten to 6950. copying facebook for once. the messaging app has a year in review feature of videos and pictures taken in 2017. snap chat is working on a tool to share stories outside of the app. a fast food chain is looking to take advantage of the start of california legalizing marijuana for recreational use. jack-in-the box will sell a merry munchies meal in january.

it's a half serving of curly fries, three crispy chicken strips and a small drink for the price of $4.20. a jack-in-the box executive says we are about welcoming all guests, no matter what they are craving or while they are craving it. >> california is known as a pretty healthy state. i wonder if things are going to change because people are getting the munchies. >> not so much here. >> stay healthy, landon. how much are you all willing to spend to ring in the new year? according to wallet hub, 80% of americans spend less than $200 a year on new year's eve. 49% say they plan to ring in 2018 at home, unlike the revelers from new year's past. 20% will celebrate at a friend's house. >> there you go. >> i'll be at home.

weather. gilroy, 70 degrees today and 65 degrees in milpitas. the seven day forecast is up at the bottom of the screen. we are looking at more mid to upper 60s today for the east bay. oakland, 61 degrees. 60 degrees in san mateo. daly city, 60 degrees and 60 in the mission district. getting dressed this morning, it is a very chilly start. we need the layers, again. a coat, but light long sleeves will be comfortable later on today. we look ahead to the forecast and chance of rain. an area of low pressure that will be kind of out there in the pacific. these are not the kind of lows we like because it's hard to forecast exactly when it's going to move in and kind of wobbles and rolls in when it wants to. it looks like a warmer storm. this could create some heavy rain for the sierra and the bay area. if it does move in, we are looking at the time frame between late tuesday and

thursday of next week. in the near term, it stays dry for your new year's eve weekend. inland mostly dry, temperatures reaching mid-60s over the next few days. i'll have more on the rain. mike gets us out the door with a look at what's happening on the bay bridge. >> we had activity here, it just cleared. it lasted a few minutes. it was all flashing lights and discussions going on over here with chp. that's just cleared from the parking lot. not even a distraction anymore toward the toll plaza. the maps will show you an easy drive on the approach. you see all these green sensors. no fog registering in the north bay as we have had this week. things are great in toward san francisco. a smooth, easy drive. we have the crash on the shoulder. 880 at warren where anser hassan

is between 680 and 101, but not affecting the off ramp. back to you guys. >> thanks, mike. with the new year comes legalized recreational marijuana. it won't be available to the majority of cities in california. so far, 40 resale licenses for stores have been given. 150 applications are pending. this means they won't be ready by the first. they have been given in the bay area, santa cruz. there are many cities that have blocked pot shops, for now. beginning to learn more about how this pot industry works. >> not all of it is good. there are growing concerns about the marijuana black market. the high taxes of pot sales are fueling an already massive black market for pot. it is estimated california produces eight times more pot

than is consumed in the state. that will likely be sold in other states. >> not a group of people growing marijuana for recreational use for themselves. >> or with a medical card? >> no. this is typical of organized crime. >> law enforcement say rates like these in fresno county will continue after legalization because illegal growers are still cashing in. home security deliveries or home deliveries are posing a new security risk. thieves in disguise are getting inside buildings and condos. >> we have the report from san francisco where some of the victims are now starting to look out. >> reporter: lots of people living in multi-unit buildings get deliveries. thieves figured out it is easy to hit the buzzer, tell someone they have a delivery and get buzzed in. >> make sure you are either down there to greet them or know you

are expecting them. >> reporter: people living in apartments and condos in san francisco are being cautious after getting ripped off by delivery person impersonators. police search for a mancariing a box, trying to get into a secure building. >> i came up there. >> reporter: david says impersonators don't need a uniform. they buzz a resident, announce they have a delivery and are buzzed into a lobby full of opportunities. >> they are stealing our packages. they did that a month ago. it was probably the same thing. this isn't the first time somebody pretended to get into a building. >> reporter: they say it's a common occurrence and change their cover. >> posing as grub hub delivery people just to get into the building. >> reporter: thieves are
