some people are just getting home. >> a little traffic we saw on the road. are they going or coming, i'm not sure. >> a lot of people were out fl. maybe, just maybe, they were going to work. >> we were. >> we are starting out this new year with cool temperatures and also a little bit of light, patchy fog, hazy conditions. temperatures generally in the 40s. i have been watching the viz zibility. look at san martin dropped to .25 mile. dense fog in the county. temperatures today reaching the low to mid-60s. another nice one and i'm tracking some rain. i'll have a look at that in the forecast, coming up in six minutes. >> thank you, kari. happening today, the start of 2018 means recreational marijuana is officially legal here in the golden state and dozens of pot shops are, today, licensed to start selling marijuana throughout california as of one minute ago.

>> "today in the bay's" pete suratos is live in berkeley with a handful of shops opening. i know they have that first transaction moments ago. people are really trying to get in behind you. >> reporter: yes, yes. the first transaction just taking place. my photographer is showing you the first two people that purchased recreational marijuana. you are looking at that man there. he is the first person to have that transaction for recreational marijuana here in berkeley. of course, it's one of a handful of dispensaries selling recreational marijuana in the bay area. a big day for these dispensaries. a happy moment for them. i want to show you the city we are going to see those dispensaries, selling recreational marijuana, they include san jose, santa cruz, oakland, richmond and berkeley on the list. there's more dispensaries in san francisco. they are going to be selling

recreational marijuana. i spoke to people who have been in line since 4:00 a.m. here is what they are saying about that. >> part of the reason there's so few permits is with the difficulty of staying within the regulations. so, they wanted to make sure the people who are getting into it would set a positive example and be a good example to follow. >> reporter: important information you need to know. you need to be 21 years or older to purchase recreational marijuana. you can purchase up to an ounce and grow six plants at home. driving high is a dui. chp posting the fines across the bay area to remind folks of that. also, no public smoking, similar to tobacco. you can't smoke anywhere or drive while smoking. local government regulations. it's a small number of permits

as of today. it's a busy day here. folks with the first transaction will have more from the group in the next half hour. live in berkeley, pete suratos, for "today in the bay." >> thank you very much, pete. >> looks like black friday. as you said, green monday. >> that's for sure. >> we want to help you navigate the pot laws. we have a special section on our website called in the weed. go to www.nbcbayarea.com to read more about recreational marijuana. no one is hurt after this car crashed into a convenience store. you can see from the video here, the front of the store is destroyed. the crash happened at 10:30 at the 7-eleven in san leandro. we don't know yet what led to the crash. we are asking, though, overnight, the fire department posted pictures adding that being support.

crews had to install that beam because the crash compromised the building structural integrity. police were out in full force overnight. oakland chp tweeting this photo saying we don't care if you drive a lamborghini. if you don't have your license plate attached, you can be pulled over. where do you attach it to a lamborghini. this year, with the new marijuana law, police are reminding people you can get a dui for driving while high. looking live at the bay bridge toll plaza, some folks may be driving home from their overnight parties. dui arrests are up. chp tells us they arrested nearly 1,000 california drivers for driving under the influence. new this morning, san francisco police say it looks like a stabbing victim will live. sfpd tenderloin unit says that

happened at ellis street. a few blocks away from union square. police say the victim's injuries appeared to be life threatening. now the victim is in stable condition. police are asking anyone with information to come forward. a deadly police shooting in redwood city. saturday afternoon, officers responded to a call about a man with a gun near the atm. police say they tried to convince that man to surrender. instead, he pulled out a gun and fired at officers. officers returned fire as the man was killed. his identity has not been released. police did say they know him and he had a history of police contact since he was eight years old. bart will start requiring all passengers to carry proof of payment. right now, a fare inspection team is training and expected to roll out the new rules. once they start patrolling the

train stations in that area, there will be a one month warning period for everyone. after that, if you are caught not paying your fare, you will get a $75 ticket. more than that fare will be. fines for minors will be $55. >> that's a lot of money for kids z. time is winding down to take a spontaneous trip to muir woods. the reservation system starts in two weeks. parking and shutting reservations will be required. the parking fee is eight bucks and will go up every two years. the shuttle fee is three bucks. large crowds and traffic congestion led them to require those preregistration spots. you will be able to register online. happening today, a flooding concern for parts of the bay area. our weather team says we could see extreme high and low tides, also known as king tides today and tomorrow. kari tells us, low tides will happen in the afternoon to late evening hours.

she says those high tides are set for the morning hours today and tomorrow. whether officials say entrances and exits to coves and beaches could be blocked. there are organized walks if you want. at 9:30 a.m. a group is meeting at fruit veil bridge park. in san francisco, a group is hosting a walk at china camp state park, which is not in san francisco, it is in san rafael. happening today, the 129th annual rose parade. a few hours remain before the fun begins. some people ringing in the new year there. >> thousands of folks spent the night on the parade route seeking the best spots. that's where they spent the night. >> feels a little like the wild, wild west out here. you have to come and stake your

claim and make sure nobody steals it. >> up front on the line. if a flower falls off, you run up and grab it. >> there is no credible threat of violence. law enforcement officials say they are stepping up their presence. this year, more than 200 members of the homestead high school marching band are in the rose parade. >> we are live with a closer look at this all-star band. they may not think it is a huge deal because they are pretty well known. >> reporter: no stranger to the national stage. good morning to you, kris and marcus. the homestead high school marching band based out of cupertino, they performed during super bowl 50 at levi stadium and the macy's day thanksgiving parade. they will be able to add the rose bowl parade. it's a huge accolade.

the band seen her practicing here in cupertino. they are in pasadena this morning for the once in a lifetime opportunity. the band had to apply. it included a portfolio of the competition and video of the band performing making right hand turn. that might sound odd, but that's a crucial requirement because many of the tv cameras are positioned on a corner in downtown pasadena where the floats and bands make those turns. they want it to look right for the television audience. the theme, "making a difference." >> we focus on that and try to integrate our students to be more involved in the community. it's been great. we have been able to do so much more. it opens opportunities. it's been a great year. >> reporter: keeping with that theme of making a difference, the homestead high marching band

will be performing or already did at a local children's hospital in southern california. they performed at disney and the rose bowl parade, which starts at 8:00. coverage on nbc bay area. the you are watching, you can find them, they are act number 74 in the lineup in the parade. live in cupertino, bob redell, "today in the bay." >> thank you, bob. right now at 6:11, we start out this morning with a cool start and as we take a live look outside in san francisco, light, patchy fog. hazy out there. we will have another spare the air day. unhealthy air quality for the bay and the coast and inland areas and east bay and the santa clara valley. we have had our temperatures in the mostly low to mid-40s starting out. if you are getting ready go out there for hiking, enjoying time with family, it's going to be 40 degrees in the south bay. 49 degrees at 10:00. i think the middle of the day will be the best time at 1:00.

happy new year. we are coming up on 6:15. as you get started this morning, it will be a nice, cool start. let's check out palo alto's temperature trend. we'll be in the low 40s at 8:00. noontime temperature, 60 degrees. a hazy sunshine, but a very mild day. we have rain in the forecast. i'll have a look at that coming up in five minutes. >> thank you, kari. a tragic story out of colorado this morning, where a crime played out some 45 times in 2017. it is a law enforcement officer shot dead in the line of duty. this time, it happened in a denver suburb. five deputies were shot new year's morning after responding to a 911 call about a noise disturbance. two civilians were caught in the cross fire. the harrowing moments were caught on one of the deputy's

radios as steve patterson shows us. >> shots fired! shots fired! >> reporter: a deadly shootout in an ambush. >> we have one deputy down. all of us have been hit at least once. >> reporter: deputies responded to a disturbance call in a suburb outside denver. >> boom, boom, boom. >> reporter: police say the gunman opened fire at the responding officers after barricading himself in a bedroom. in the end, he shot seven, five deputies and two civilians, killing one deputy. >> all of them were shot very, very quickly. it was more of an ambush-type of attack on our officers. he knew we were coming. >> reporter: police warning residents to shelter in place and stay away from walls and windows. deputies returned gunfire, killing the suspect. the deputy killed 29-year-old zachary paetsch ir, a father of

two who joined the department seven months ago. >> a sad day. >> reporter: the sheriff visibly shaken. >> we are deeply saddened by the loss of zachary. when i sat with his wife and held her hand, i could see in her eyes, her life was over. >> reporter: residents in law enforcement showing their support as parish was taken from the hospital to the morgue in a somber procession. all of the injured deputies are in stable condition. among them, deputy jeff, son of a nearby boulder county sheriff recovering after emergency surgery. >> it is a tragic day we will feel for a long time. >> reporter: mourning the loss of one of their own. >> that was keith patterson from outside denver. others were treated for non-life threatening injuries. this is the first day of the

year and the first day of new taxes. >> the irs trying to figure what that means. >> that's right. the new tax law takes effect today. it was finalized 13 days ago. the irs has had 13 days to figure out what the law says. keep in mind, 6 of those 13 days were weekends or federal holidays. if you are not sure what the new tax law is today, neither is the irs. during the christmas break, we saw taxpayers all over the united states line up to pay their property tax early in order to save money. taxes like property and state tax will be less deductible and that starts today. that brings up an interesting political point. washington assures americans they are getting a tax cut. every person in every line lined up during the christmas holiday were trying to avoid higher taxes. none of the people you see here think they are getting a tax cut. the stock markets are closed today, looking back at 2017, it

was the second best run up for the index in the last ten years. roku was the best ipo of 2017. as for what's ahead for 2018, there are indicators we are been getting. you are leaning in, right? it's all bitcoin. no. it shows things may slow down. it's a flatten of the yield curve. we just can't predict. we couldn't predict 2017. that was so strange. it's hard to say what will happen. >> it defies conventional wisdom. >> it does. we said it wouldn't be up, but it is up. thank you, scott. good luck in 2018. this is a new one for you this morning. literally a new one. one bay area couple is celebrating a new addition. their boy born at 12:02 a.m. at ucsf mission bay. he is 6 pounds 10 ounces and no

name yet. he is the first baby of the new year and has some impressive parents. the mom, samantha powell is a psychiatrist. dad, martin do ming ez is a cardiologist. >> do you think that baby is going to be a night owl? >> i came in early. >> a lot of sleepless nights for the new year. congratulations to them. we are going to all be celebrating today our nice weather and the new year and it stays fairly dry for the next couple of days. we are going to have patchy fog and mist and drizzle in spots. as we take a live look outside in san francisco, been watching the air quality for you. it's going to be most unhealthy today. we are going to gradually start to see the air quality improving to good by the end of the week. today, in the north bay, the bay and the coast, inland east bay, we will have unhealthy air

quality. that means no wood burning. if you have breathing problems, limit your time outside. we will have king tides. those coastal areas may have minor flooding. the way the moon and the earth is aligned right now, it brings water levels up really high and down really low. that's what we call king tides. the highest tide will be at 9:13 in ocean beach and up to over seven feet. we'll have king tides again tomorrow, but during the middle of the day, the bay will be low. as we check out the high temperatures today, the highs reach the mid-60s. we have the seven day forecast at the bottom of the screen. upper 50s for the peninsula and san francisco up to 61 degrees in the mission district. the north bay, 60 degrees in santa rosa. if you are going out hiking today, it's in the south bay. going to be a nice one. a lot of sunshine with mild weather. i'll have a look at today's

livermore woman who paid for a product she never got. >> you guessed it, our response team helped her out. chris chmura has more on the story. >> judith bought an ultrasonic product online that is designed to help relieve pain. it sounds like it only created some. she paid 100 bucks but the product never arrived. judith called the company, dms supply, in texas. it told her the item was back ordered. later, dms told judith, it was having computer problems and that was causing another delay. then dms said they shipped the item. she never received it. she called and canceled. they told her a refund check, you know the end of this, was in the mail. but she never received that check. after months of getting nowhere on her own, judith reached out to us for help. we contacted dms and they finally shipped judith the

it is 6:30. take a look out the window over san jose. the sun is not up yet, but the new year is six hours and 30 minutes old. it's good to have you with us. i'm kris sanchez in for laura garcia. >> i'm marcus washington. we want to go to meteorologist, kari hall. you talked about the king tides and the possible flooding. >> the king tides will cause coastal flooding and be true for the bay as well. we are going to have those temperatures today starting out in the low to mid-40s. as you get ready to head out, watch the water levels as the temperatures warm up into the low to mid-60s. it will be a nice one and we will have rain in the forecast

this week for a change. we'll talk about all those changes, including the king tides and a spare the air day coming up in a few minutes. >> thank you very much, kari. happening today, 2018 marks the beginning of a new era in california. recreational marijuana is now officially legal. >> pete suratos is live in berkeley at a pot shop that opened doors 30 minutes ago. you caught the first sale. pete? >> reporter: good morning to you, kris and marcus. we were right here when the first transaction took place. the berkeley mayor said, this is high times for the city and the economy. you can see folks are lining up to per chas recreational marijuana. this is one of the dispensaries in the area. not every dispensary is able to sell recreational marijuana. you have video of the first transaction, when it took place. a big moment for the city, really for folks that are behind the sales of recreational marijuana.

i want to show you some of the cities that have dispensaries. you can see on the screen, san jose, santa cruz, oakland and the east bay again and richmond and here in berkeley. noticeably absent on the list is san francisco, at least for now, when it comes to having dispensaries, selling recreational marijuana. folks were in line as early as 4:00 a.m. we spoke to some of those people. >> to me, it's the most exciting time in california's history. you know, we have been living in the shadows and the black market. now we can be proud to be a part of a regular industry. >> freedom. even though there are certain restrictions that come with it, you can't just do this anywhere. but, the biggest word here is freedom. people are allowed to be people, actually able to be responsible adults and consume one of the

safest known medicines on the planet. >> reporter: as far as information, you need to be 21 years or older in order to purchase recreational marijuana. you can have up to an ounce of marijuana and grow up to six plants at home. driving high is a dui. chp is posting across the bay area. a number of them as you are driving in. no public smoking. you can't just smoke anywhere. local government regulations, local cities as far as how they are going to regulate this, hence the number of permits as of january 1st. back out here live, people purchasing recreational marijuana. i spoke to a representative who said they average 600 customers a day. you are expecting that number to double today and serve well over 1,000 customers. live in berkeley, pete suratos,

"today in the bay." >> thank you very much, pete. now that recreational marijuana is legal, veterinarians are warning pet owners about pot poisoning. a woman says her dog ate something laced with pot found perhaps on a walk and the situation quickly turned frightening. >> a puddle of urine on the floor, which is atypical for her. she also seemed very wobbly. the doctor came out and said we induced the vomiting and the room reeked of pot. >> the dog is okay, as you can see there. vets say if you plan to partake, keep your stash out of reach of dogs and cats. at least that vet that we talked with said marijuana toxicity in animals, well, they expect it is going to be a big issue in the new year. 6:34 right now. happening today, california's minimum wage goes up. there are different salary requirements depending on where

you live. statewide, minimum wage is $11 per hour, if they have 26 or more employees. oakland, $13.23 on haur and sunnyvale, $13.50 and san jose, $15 per hour. happening today, it may cost you more to use bpa. fares are increasing 25 cents to $2.25 a ride. if you are a kid, youth fares are dropping 75 cents to a buck. the transit agency will start offering free, two-hour transfers for certain customers. trains will run longer and more frequently between mountainview and winchester. happening today, floats are in place as thousands brazen the chilly temperatures. this year, more than 200 members of the homestead high school marching band will perform.

>> bob redell is live in cupertino with a closer look at how the all-stars are coping with the theme. bob? >> reporter: good morning and happy new year to you, kris and marcus. yes, the students here at homestead high and the marching band based out of cupertino will enter the national stage, again. in about 90 minutes from now, they will march down the streets of pasadena in the rose bowl parade. we caught up with the band as they were practicing here on campus in cupertino. the band director says the students were celebrating new year's eve at 9:00 pacific as the ball dropped in times square with a lights out bedtime of 9:30. he wants to make sure students are well rested for a once in a lifetime opportunity this morning. >> the trade off is going to be worth it once we see the crowds and energy. it's really the biggest audience a high school marching band can perform. there's no other parade that can match this except the macy's

>> her mom works@web department. awesome kid. kicking off the new year in style. >> a fireworks display, in case you missed it. here is a taste. people from around the world gathered along the embarcadero to ring in the new year with that kind of spectacular drama. we talked to a family from chicago who enjoyed it and the beautiful weather. >> we are near chicago. not too cold, not like subzero at home. >> it's like summer for them. we may think it's chilly. they mobilized hundreds of officers and there were no major incidents. now, to the new york area, you can see there, a lot of people excited to ring in the new year there. that clean up is under way right now. today, following sunday night's new year's eve celebration, more

than a million people braved the bone-chilling temperatures out there to see the world famous ball drop in times square. dangerously cold temperatures led to some cancellations across the country. the windchill factor felt like one below zero. >> here is how the rest of the world rang in the new year. this is dubai as the ball dropped there. hong kong, zeeland. hungary hungary, look how they did it. making a splash. north korea put up an extravagant show. in australia, sydney harbor was a colorful display to celebrate the legalization of same-sex marriage. if you can't get enough of the new year's eve fireworks or slept through them, we have a slide show on our website. you can find it on our web page, www.nbcbayarea.com. maybe you are telling the kids new year's starts at 10:00 a.m.

you can do that, right, kari? >> we did that. champaign and apple juice. >> i felt like i didn't miss toochl. the fireworks woke me up. i'm like, what? 12:00, i have two more hours to sleep. >> you may be catching up on some sleep this weekend as we take a look at the weekend forecast. we are going to have some great weather. rain midweek, by saturday, it's going to mostly clear out. it's going to be in the upper 50s and low 60s. by sunday, expect those high temperatures in the upper 50s from the coast to the bay to inland areas. if you are going to hit the roads this weekend, if you are heading down to l.a., it is up to 70 degrees on friday. saturday, 68 degrees. also 68 degrees on sunday. a great weekend to go to yosemite. there will be a slight chance of snow flurries saturday night and sunday. by sunday afternoon, we are up

happy new year. it is 6:44. starting out with a few clouds rolling over the south bay and that is what we will see until late morning when all that clears out. here is a live look out there now. the temperature trend for downtown san jose will be at 43 degrees at 8:00. a cool start, noontime temperature, 58 degrees. a few clouds in the mix, but it's going to be a nice day. we'll take a look ahead to rain in the forecast. we'll talk about king tides and also our spare the air day. that's coming up in five minutes. >> thanks, kari.

happening now, as we have been showing you all morning, rose day preparations are going on right now. >> tony is there. what is the weather going to be like and are folks excited? >> reporter: folks are extremely excited. i want to give you a sense of how many people are out here. take a look up and down colorado boulevard. there are now about five or ten deep on each side of the street. the parade is set to start at 8:00 this morning. some of these folks have been out here for hours. some of them coming yesterday. hey, happy new year, folks. >> happy new year. >> reporter: when did you get out here? 3:00 yesterday afternoon? okay, you know i have to go over here and talk to oklahoma fans because the game is between oklahoma and georgia bulldogs. good morning. welcome. how excited are you? >> pretty excited. we drove from montana.

the oval office. the united states foolishly gave pakistan $33 billion over the last 15 years and they have given us lies and deceits. they give safe haven to the terrorists we hunt in afghanistan with little help, then the keyword, no more. now, we send pakistan money to support the government stability. pakistan is a nuclear power. this has been american policy for more than a decade. president trump tweeted this morning, no more. this policy changes. today is the first day of the new tax law the president signed before christmas. that's gimpb the irs and taxpayers a couple days to figure out what it means before it takes affect today. speaker of the house, paul ryan, says the next priority is to cut entitlement programs like medicare, medicare, welfare because the deficit is too big. this comes 12 days after the house passed that tax cut, which

spare the air day. no wood burning for the bay and the coast is going to be most unhealthy. for the inland, parts of the east bay and santa clara valley. the seven day forecast is on the bottom of the screen. check out the forecast for the next several days, the first week of 2018. we begin with king tides. that means the way that the earth and the moon are aligned, it creates extremely high tides and extremely low tides for those coastal areas and the inner bay. there may be flooding. the highest tide, 9:13 this morning. it will be a little higher tomorrow morning at 10:02 a.m. now, as we look at the high temperatures today, reaching the low to mid-60s, overall, really nice. as you get dressed this morning, start out with something nice and warm like a light jacket or a warm coat. later today, you can take that off with light long sleeves. you will be comfortable with the highs in 60s.

you cannot complain about this weather. the high temperatures for the rest of the country today, a big push of arctic air, dropping those temperatures down and we get those high temperatures for parts of the southeast. they are only going to be in the 30s today. as we look at the forecast and what's ahead for the rest of the week, we have rain coming in. new year, new weather pattern. that will bring in rain starting out late wednesday into thursday. another push of rain on friday. the weekend, at this point, looks dry. rainfall totals over a quarter inch of rain. over an inch for the north bay. it will improve the air quality and the temperatures in san francisco reaching the upper 50s and low 60s. inland areas will also have a couple days of dry weather and the rain moving in on wednesday. i'll have another quick look at the forecast coming up later. >> thank you, kari. coming up next, a quick look at the top stories here on "today in the bay," including a mangled mess in the east bay.

how a car ended up in a liquor store joovernight. hundreds of cars destroyed after an overnight parking garage fire. witnesses say cars seemed to explode every couple seconds when the fire was at the peak. the winds threatened horses at a nearby stable, but they are okay. they blamed an accidental fire ignited the chain reaction. on our website, you can read about a scare in texas ahead of new year's eve activities. police arrested a man with guns and ammo inside his houston hotel room. we are back in two minutes with more news. in the bay--

happening today.. a new yearea 6:56. well col back. here are the top stories on "today in the bay." >> happening today, a new year means new laws. recreational marijuana is legal in california. we are looking live at one berkeley marijuana dispensary opening their doors for the first time. the state's bureau control says the agency has been working through the weekend to process as many licenses as possible. officials plan on issuing more licenses today. several marijuana businesses are expected to hold ribbon cutting ceremonies this morning. several other new laws go into effect in california today. employers can no longer ask about prior salary information.

applicants can request the pay scale for the position they applied for. bus passengers are required to use seatbelts if they are available. drivers cannot be cited for parking at a broken meter. minimum wage goes up to $11 an hour. we have a list of all the new laws going into effect today on our website, www.nbcbayarea.com. all new this morning, no one is hurt after this car crash into a convenience store in the east bay. you can see from the brand-new video, the store front is destroyed. the crash happened around 10:30 at a 7-eleven in san leandro. we don't know what led to the crash. the fire department posted pictures of firefighters adding a support beam. they say crews had to install that timber because the crash compromised the buildings structural integrity. the bay area kicking off the new year in style. for once, fog did not cover

audiotape the fireworks display. take a look at it on your screen. people gathered at the embarcadero to ring in the new year. san francisco police mobilized hundreds of officers and set up public distress displays. there were no major incidents. happening today, the 129th annual rose bowl parade. this is a look from our southern california station as they watch the prep. we talked to a reporter down there. some folks started waiting along colorado boulevard at 3:00 yesterday. they were looking for the best spot. authorities said there is no credible threat of violence prior to the parade. law enforcement officials are stepping up their presence. ♪
