i it is 4:30 and it is friday morning and looking live at dublin this morning, where maybe some of the folks have their windshield wipers on, and if they don't now, they will a little bit later on. thank you so much for joining us on this friday. >> and marcus washington. and coming in with a shock of how warm it s. >> yes, and this is ahead of the cold front so we will start to feel some warmerer temperatures rt starting tout day and it is humid out there as the rain approacheses the bay a area. we are seeing the wet weather in the north bay and san francisco and moving into the peninsula as well. as we are getting a closer look, we can see the scattered showers covering most of marin county

and sonoma kocounty and that is dipping to the south with spotty activity as we go throughout the the day. we will talk about what to expect as we go into the weekend in a moment. we will have an early look at the roads. >> early look indeed. we are starting out the friday morning as far as the traffic goes. look at this the traffic map, no major or minor accidents to report at this hour. looking at the bay bridge, yesterday i did not see the metering lam arep turned on once, so we are aiming for round two, but i do see some slowing. but sometimes that is going to happen when a car tries the go over, but right now no lights on at the bay bridge. >> always good to be the glass half full. today, sentencing in the steinley case. >> yes, there are was a conviction on the firearm charge and so today, we want to see what to expect to have happen. good morning pete.

>> yes, good morning, can kris and marcus, the case continues here behind the hall of justice at at 9:30 a.m., and when we will see if the judge grants a new trial for the weapons charge which is a a case that is garnerering attention because of the undocumented status and deported many times for criminal act, but he was convicted of the murder of kate steinle on pier 14, but at the time the jury decided that he was not guilty of the firearm that was transitory, because it was held briefly, but not u enough to u call it possession. and the prosecution says it is bogus. and speaking with the nbc legal analysts say that it is likely

that the weapons possession conviction will stay unchanged, but expects the arguments of the jury instructions to continue. >> i think that there is a real possibility that there was an instructional error in this case, and based on that a new trial might be granted and more likely the new trial would be denied, but it lays a groundwork for a strong appeal. >> reporter: the maximum sentence he can face is three years, and he likely fulfilled that already given the time served, but the sentencing is going to be taking place here at 9:30 a.m. i'm pete seratas at the bay. and late last night san jose police say they the arrested the man that you can see there in the surveillance video. we have been telling you about t

good morning. here are the business headlines. the dow closing above 25,000 for first time, and a little bit more than a month after crossing the 24,000 mark. the traders say while it is a psychological milestone, it holds no fun damtsal importance. as to the watch list today, it is all about the job market, and the december jobs report is out before the opening bell, and it is expected to show that the hiring kept up at a brisk pace last month but at a slightly lower rate than november. the dow rising 152 points yesterday to 125,075 and the nasdaq adding 12. ap and meanwhile, apple has announced that all mac devices are exposed to flaws that could lead to hackers. they say that the most recent update protecting them from meltdown and don't slow down the performance of the device, and it does not affect the apple

4:44 right now and looking live at freemont where it is likely going to be very much warmer than you have been expecting after the the last couple of days. i walked out without a jacket and i did not realize it until i got to work. what am i doing? >> yes, in the morning and how long since that happened? it is because we have a cold front approaching, and as the cold front is going to approach, we will have a surge of warm air feeding into the that and that is what is helping to trig ser some scattered showers this morning. not all of us are seeing the rain as of yet, and most of it over the north bay and san francisco with light showers. we will start to see the radar filling in as we go into the late morning hours, but if you have an early start, and about to head out of the door, you are looking good except for marin county and sonoma county where the rain is has already started and the temperatures are very warm. look at that. 61 degrees. and you know that a lot of the spots around the bay hit the low

70s, well, it is not going to be as warm today. it is going to be still mild with highs in the mid-60s for san jose and livermore m. the north bay, it is going be cool, because we will have the rain all day off and on. so as you are getting dressed this morning, you want to prepare pfor the rain, and make sure that you grab a rain jacket and good idea to make sure that you have that umbrella, and then we will start to see the temperatures dipping as we are going into the evening with the breezy wind, but as we are going through the day, we are looking at the showers mostly over the north bay and hit or miss activity and maybe a while before we see the rain moving into san jose and won't be until the afternoon hour, and once we start to sweep to the south, we will have clearing for the north bay and with the estimated rainfall total in addition to what we have gotten, close to the half an inch of rain in napa and then a quarter of an inch of rain in parts of the east bay.

in san jose, looking at only about 0.04, and so very light of rain for the south bay. after these showers move out, we will have a very nice dry weekend, buttal cool. highs in the mid-60s in san francisco. another storm system is approaching on monday that is going to bring in some rain for monday, tuesday and wednesday and then drying out thursday. but there is more rain in the forecast. so some of the drivers heading out, they may have to deal with slick roads. >> yes, they will. and we have warned you since we saw the rain to get the tires checked and the windshield wipers, but over the bay area, you can see not a lot are going on, but the troubled area of 580 expecting the early morning dre lays due to not one but two crashes. one ahead of the altamont pass and one at altamont pass at carol road. with one is on the shoulder

woman in the back seat. he picked her up after she had been drinking. he is being held on bond. and a police at roen nert park are saying that noah holland took a garage opener of an unlocked car and then entered the home on francis circle, and he went to the bedroom where an 8-year-old girl was asleep and took off his clothing and sexually assaulted her. the neighbors there are shaken by what happened. >> they are always running around on the scooters and the bi bikes, and so we would not really expectt that, but people are sick. >> a crucial tip helped to track him down, because the girl screamed and alerted her mother, and he left, but he left his personal belongings behind in the process. this morning concord police are asking for your help to identify this woman.

they say that martha javier is tied to a murder and arson investigation where she intentionally set a motor home on fire, and man was critically injured. and new policies on marijuana enforcement in counties including san francisco don't appear to be changing course. yesterday attorney general jeff sessions rescinded the opu bau ma administration policies calling for leniency on recreational marijuana, and san francisco says they plan to continue to roll out new city regulati regulations expected to take effect monday. and lettuce is making national headlines. it could be weeks before the officials pinpoint the outbreak of the outbreak. they say that romaine lettuce is to blame. three people have been sickened

rafael picture, and quite a bit of green there in the north bay. most of this is going to be dipping to the south, so as we are looking outside to san jose, it is dry. the temperature is 58 and heading up to 64 today. with the rain to the north, the road s will stay dry in the south bay for a little bit longer, but the scattered showers start to spread all over the bay area this afternoon with the breezy wind, but it clears out by tomorrow. so as we are making the weekend plan, it is going to be clearing out for tomorrow, and we will talk more about it as we get an early look of the roads. >> we are at the top of the 5:00 hour, and the overall bay area, yes, along 580 that trouble spot some delays. this is the commute behind not one, but two crashes here along eastbound 580 and the second is along the side of carol road, but behind that, some regular early morning buildup and nothing too bad to
