thanks for joining us on this busy tuesday morning. >> busy out west. everything is happening. hollywood, the oscar nominations. >> yes, indeed. >> that is. >> breaking news out west. >> yeah, absolutely. we will have more on the nominations in a minute. the powerful earthquake in the pacific that prompted tsunami watches for the west coast overnight. al has been following it all for us this morning. hey, al. good morning. >> good morning, guys. let me tell you, a lot of folks had a rude awakening in alaska. take a look. this from kodiak, alaska, as people started to evacuate as sirens sounded. people were worried about tsunamis after a 7.9 earthquake caused mass panic. luckily folks didn't have much to worry about later on, but as you can see, we start to see these evacuations, folks lined up trying to get to higher ground as a 7.9 earthquake struck. now the location of this was about 300 miles -- i should say

about 175 southeast of kodiak. its depth, 12 miles. the good news is, again, because of the geologic formation off the alaskan coast, that kind of impedes the formation of tsunamis, but that did not stop the u.s. geological survey from issuing tsunami warnings from all of the coast of alaska and the british columbian coast and then watches all the way down the california coast. they had some tidal rises, guys, of about half a foot. the tsunami or the earthquake in japan caused massive problems along the west coast. >> signs of relief. let's focus on this. the nomination for the 90th annual academy award in beverly hills. the big word of the morning could be surprise. there were a lot of surprises.

procedures when the envelope is handed over. back to you. >> thank you so much. there is another major story this morning. the government shutdown coming to an end for now. president trump signing a bill late last night that temporarily funds the government and paves the way for a new fight over immigration. nbc national correspondent peter alexander is at the white house with all of that. hey, peter. good morning. >> hey, hoda. good morning. that shutdown lasting a grand total of 69 hours. as you said, president trump overnight signed that bill that restores the funding to the government. the president claiming victory dismissing the democrats for caving and this morning tweeting a lot more like a color commentator at a sporting event than the president involved in these negotiations. he writes, nobody knows for sure that the republicans and democrats will be able to reach a deal on daca by february 8th but everyone will be trying. >> reporter: this morning with federal employees returning to work, the feud over the government shutdown has cooled, but the fight over immigration's heating up.

>> now comes the test, the real test as to whether we can get this done. >> democrats united in their push to protect those younger, undocumented immigrants, or d.r.e.a.m.ers, but divided over whether they buckled by backing down trusting mitch mcconnell's openness to an immigration vote next month. >> i think they're caving. you know, democrats are pretty good at articulating values but a little weak on defending them. >> reporter: among the holdouts who voted against the senate bill that ended the stalemate, several possible 2020 contenders including kirsten gillibrand insisting i want to see the government reopen as much as anyone, but this bill fails to fix the moral issue we must solve. the president in a statement saying that he's pleased that democrats in congress have come to their senses but democrats have accused the president of not playing an active role in the negotiations. >> the great deal making president sat on the sidelines. >> what the president did

clearly worked. the vote just came in 81-18. >> reporter: but the president's position on helping d.r.e.a.m.ers is less clear. >> we have said that we would support a permanent solution for those in the daca program. >> legal status versus pathway to citizenship or does it not matter to the president? >> i think that's part of the negotiation process. >> reporter: president trump behind closed doors monday huddling with senate republicans, then a pair of senate democrats. the clock already ticking, just 16 days till the next budget deadline with another potential shutdown looming. and this afternoon we'll see president trump on camera for the first time since the shutdown had started. with it now over, president trump is still planning to travel to davos for what's called the global economic forum. he leaves tomorrow night. hoda and savannah. >> but, peter, it sounds like we could be right back here in less than three weeks potentially? i mean, is there any sign that the sides have changed at all, that there's any budging? >> reporter: no, savannah, i think you're exactly right. what this really comes down to

is is there a way to find a bipartisan solution to immigration. based ond my conversations with sources on the hill, republicans, they want to resolve this, specifically on the senate side. more than 80% of americans support dreamers being allowed to stay in the u.s. and it appears that we now perhaps most importantly have the contours of a real centrist coalition in the senate. here's a picture of susan collins and democrat joe manchin toasting yesterday. there's a couple dozen, 30 forming this sort of centrist group. here's your sticking group. does that same type of coalition exist in the house and where does the president stand? hoda and savannah, back to you? >> we'll be watching. thank you. new developments in the sex abuse scandal rocking u.s.a. gymnastics as more accusers speak out at the sentencing of former team doctor larry nassar. key members are stepping down. craig melvin is here on it rchltsz ladies, good morning to you.

larry nassar's sentencing hearing following guilty pleas of criminal sexual conduct charges is now in its second week. so far 124 accusers of the former team doctor for u.s.a. gymnastics and michigan state university have detailed the abuse they endured and now three high ranking members of u.s.a. gymnastics have resigned amid new questions this morning about how this scandal was handled. >> i know now who you really are. a child molester and a master manipulator. >> reporter: larry nassar's victims taking aim. >> my hate towards you is uncontrollable. larry nassar, i hate you. >> 15-year-old emma ann miller speaking out in week two of nassar's sentencing hearing. >> i am possibly the last child he will ever assault. >> reporter: miller says she saunas saar for treatment a week before michigan state university suspended him in 2016 and that the school was still charging her for appointments with nassar. >> my mom is still getting

billed for appointments where i was sexually assaulted. >> reporter: an msu spokesman telling nbc news that former patients will no longer be billed. all of this while the university deals with the fallout of what they knew and when. nbc news reporting at least a dozen people over two decades linked to michigan state were allegedly notified of nassar's behavior. in a letter to the michigan attorney general, the school's lead attorney writing, the evidence will show that no msu official believed that nassar committed sexual abuse prior to newspaper reports in the summer of 2016. the university not the only institution under fire. >> u.s.a. gymnastics cares deeply for all of our athletes. >> reporter: the board of directors chairman paul perella and the vice chairman and treasurer resigning amid an onslaught of criticism for the handling of the scandal. the president of u.s.a.

gymnastics saying in a statement in part, quote, we believe this step will allow us to more effectively move forward in implementing change within our organization. >> knowing that u.s.a. gymnastics has failed their athletes so terribly disappoints me and makes me so incredibly angry. >> reporter: it comes as olympic gold medalist shaun johnson east released a stinging video monday going after the organization. >> i think gymnastics is the best sport in the entire world, but if i had a daughter right now, i wouldn't put her in it until we protect these little girls as human beings instead of protect them and -- as gymnasts just to make sure they win gold medals, we aren't going to make any progress that is meaningful. >> so far this morning no response from u.s.a. gymnastics

good tuesday morning. i'm meteorologist kari hall. i am loving this view this morning, as you can see the fog rolling across parts of the bay bridge, but that also means you have to be careful if you are about to head out the door. we've seen visibility reduced down to about a quarter of a mile and that's what's happening in the south county and also in parts of the north bay. after the fog clears we will get some sunshine, highs reaching into the mid to upper 50s. will be returning tomorrow with highs in the low 50s and the scattered showers continue through thursday. >> al, thank you so much. coming up, missouri's governor fighting back amid new calls for him to resign over an admitted affair. we're going to hear from him. nbc news investigates the fda's role in the opioid crisis. one senator calling it criminal. this morning, the agency's new head responds. first this, is "today" on nbc. first this, is "today" on nbc.

with meteorologist kari hall. >> and we've seen patches of fog around the bay area. with he can see it in this view over san francisco. once the fog clears out we will get sunshine today, but we're dealing with low visibility in some spots down to a quarter of a mile and for san martin you can't see anything. so be careful driving to work this morning. our high temperatures today heading up to 59 degrees in san jose and 57 degrees in concord and oakland. we will see that rain returning tomorrow, we will be tracking that, make sure you keep checking back in for updates. let's see how the roads are moving in oakland with mike. >> very slowly. overall the map looks pretty standard but we zoom in 880 both directions are just jammed approaching just north of high stre street. chp about two minutes ago gave us the update they've cleared lanes on the southbound side so i have to update this map. lanes are not blocked anymore, but traffic still jammed up both directions 580 is a much better route through oakland. of course, we have the backup at the bay bridge toll plaza. that's nothing unusual, but slow

and the dea have come under fire. but some believe the food and drug administration could have and should have stopped it from becoming a national health crisis. we begin with the two words west virginia senator joe manchin uses to sum up the fda's regulation of opioids. >> absolutely criminal. >> reporter: stinging criticism also comes from a top doctor in the field, andrew coldny. >> this may be the best example in history of a regulation failure leading to a ka ta catastrophe. >> reporter: could the fda have stopped this? >> i don't know if we could have stopped it. a lot of people didn't do what they needed to do in the past or we wouldn't be in the situation we're in right now. >> reporter: the problem started back in 1995, when the fda approved oxycontin, allowing it

to be promoted as safe and effective for chronic pain, like back problems. >> fda failed to insist there was adequate before allowing the marketing. >> the rate of pain patients that are treated by doctor is less than 1%. >> reporter: oxycontin's manufacturer said that when it promoted the drug as less add t addictive as other painkillers, they knew it wasn't true. by the time the company paid a fine in 2007, a staggering number of americans were hooked, some on the road to heroin. he lays some of the blame on how cozy the fda has been with drug companies over the years. >> this is a revolving door problem. >> reporter: he points to big phar pharma's influence in decisionmaking, including a meeting in 2002, where many of the experts the agency brought in to advise them had ties to

the industry. >> they could have changed the rules so we wouldn't get a steady stream of new opioids hitting the market, each one pouring fuel on a fire. >> reporter: as the opioid epidemic ravaged the country, in 2014, the fda approved another powerful opioid called zohydro. this time, over the objections of a panel of experts, who strovoted 11-2 against it. >> why did the fda continue to allow more of the opiate drugs on the market. >> reporter: opioid painkillers were flooding his state. >> they were everywhere. 1 community had 9 million pills coming into it. >> reporter: determined to tighten controls on prescriptions, he headed to the fda. >> i go up and i testified before their advisory committee, should have been a shlam-dunk,

right? >> reporter: it wasn't. it took a year for the fda to take action. and a year after that for a policy to be in effect. the following year, a billion less pills were described. >> there is no bona fide justifiable reason to allow this to linger on. >> reporter: the fda told nbc, it did take action over the years like strengthening labels. but dr. gottlieb said his actions will go further. when he was nominated, some said he had too many ties to the agency he's regular lating. since dr. gottlieb has took over, the fda has gotten one opioid off of the market, after raising concerns of risk of abuse. >> i don't think this will be a five-year effort. but it will take a year, maybe two to get to the optimal place

good morning. right now it's 7:56. we walk out the door, we have had low clouds and fog in parts of the bay area with a chilly start. as we look at our high temperatures today, though, it's going to be a nice one with mostly sunny skies, highs in the mid to upper 50s. even a few spots reaching the lower 60s inland. as we go into the day tomorrow the rain returns for the afternoon starting out in the north bay, and working its way south as we go into the afternoon to evening hours, with some rounds of heavy rain possible along with some gusty winds. we will be tracking this along with some off and on rain throughout the day on thursday before some cool air rolls in and some drier conditions ahead for the weekend. we are going to see a high on friday up to 51 degrees with some mid 50s by the end of the weekend. inland areas will also see the rounds of rain tomorrow as well as thursday, but then some mostly clear skies for saturday and sunday. let's get an update on the

a powerful 7-point-9 good morning. it's 8:26. i'm marcus washington. a powerful 7.9 earthquake early this morning in alaska triggered a brief tsunami along the california coast. that tsunami watch has now been called off. but people in san francisco are still being advised to stay away from the coastline during the next nine hours or so as a precaution. the quake prompted a tsunami warning in kodiak, alaska, where lines of cars, where people evacuated to higher ground. that quake also briefly cautioned concerns in santa cruz harbor. that's where a tsunami in 2011 caused extensive damage. now look being at your commute this morning. it's a tough time in the east bay. >> an early crash over here in
