embraced the affordable care act like no other and has become the nation's role model for environmental change policies on everything from auto emission toss frack flag. it's basra, though, bacerra who has used the system to stop or slow down trump policies that he views as harmful to california much like the republican texas attorney general plagued president obama during his years. there is a lot going on. what cases stand out to you? >> most of the cases, kira, are fairly new. remember, it's only a year that the administration has been in office and are in their earliest stages of judicial findings by the district court but they have powerful implications. a couple leading stories to date, daca, the deferred action on childhood arrivals program initiated by president obama in 2012. california won the first round in district court allowing daca residents to renew temporary status applications on the grounds that the march 5th end
7:48 am
date violates their due process. the trump administration of course has appealed to the court of appeals, but it's going to be a while. how about sanctuary cities. california won a case in district court preventing the federal government from eliminating funds to cities and counties that do not proactively engage in federal immigration enforcement. >> okay. so daca and sanctuary cities those are both obviously immigration-related issues. certainly important to many californians like you mentioned, a million immigrants undocumented and otherwise here in our state, but what other issues seem important to you in terms of being important to california? >> they're a panoply, we could go forever. here is a few cases other than immigration important to californians. contraception. california won a case in district court that prevented the trump administration from allowing corporations to suspend birth control benefits on the grounds of a religious or moral
7:49 am
objections. how about transgender military ban? california sued, the trump administration to prevent a ban on transgender people from joining the military. several federal judges have ruled against the trump administration along with california and the plan is dead. methane emissions. that's the gas. the u.s. district court in california stopped the trump administration from dismantling an obama rule that had tightened the conditions of releasing harmful methane gas into the environment. we could go on and on, but these are just a few areas where california suits have either prevented trump administration changes or halted them all together pending appeals to higher courts. >> wow. so that's quite the collection of diverse cases as you said. i would imagine it hasn't endeared california political leaders to the trump administration that they've been able to stop some of his progre progress. >> true that. >> true that. >> true that. do you know what, although the trump administration, you have
7:50 am
to give them their due here, they were quick to bring in fema to help after the terrible tires in northern california and there's something else to remember, the fact remains that in our three tiered federal court system some of these early rulings may be reversed higher up on the judicial ladder. look, if nothing else the state has shown its willingness to aggressively hold the trump administration accountable for rule and policy changes viewed by most elected officials here and public opinion as well as bad for california. you know, to that end with the 2018 congressional elections now clearly in view, the trump administration and local republican elected leaders are going to have to tread carefully with these attempts to implement controversial new policies down the road. ki kira, controversial policies just like elections have consequences and so to that end it's going to be very interesting to see how these
7:51 am
things impact these congressional elections right here in california where we have the largest number of vulnerable republican incumbents. >> absolutely. and across the country we've seen a lot of them already saying they are not going to run again. interesting to see and as always i wish we had more time. larry gerston, as always, thanks. still ahead on "today in the bay," at 7:51, a rare weather scene caught on camera. the natural phenomenon sweeping across california. we're not expecting any of that. no rain in sight. we're tracking sunshine. i will have a look at your temperatures for today, plus a look ahead at your workweek coming up in just a bit.
7:54 am
good morning. it is 7:54. it's off to a lovely start on this sunday across the bay area. our temperatures on the cool side, but not very cold compared to what we've seen. now, south bay right now 44 degrees, the peninsula at 51, tri-valley 46 degrees and look at the north bay, still trying to warm up at 37 degrees. san francisco 47. plenty of sunshine, though, to go around and that's exactly what we are tracking for today. comfortable weather. look at that 24 hour temperature change. half-moon bay about 18 degrees warmer at this hour than we were yesterday. santa cruz 7 degrees warmer. sunnyvale 11 degrees warmer and we are expecting above seasonal highs. look at your hour by hour forecast, we've got a little bit of a chilly start in the north bay, we are expecting to see
7:55 am
increasing high clouds but that's not going to arrive until later. monday at about 2:30 in the morning, so tomorrow morning you might catch a couple clouds in the forecast. it is going to be a combination of sun and clouds as we head into monday, but we are not expecting any range from this. we're expecting that rain to stick off to the north, the only thing that we are going to see in the bay area is going to be some more clouds out there. your microclimate highs for today, this is what i was talking about when i mentioned above seasonal temperatures. oakland a high of 62, san francisco also at about 62 degrees, san jose 64, santa cruz 70 degrees. i'm heading out there today to santa cruz, my first time going to we will see how it goes. napa 65 degrees, santa rosa 64. if you look at your outlook, a little haze is expected through the afternoon but that will eventually burn off. look at gorgeous squaw creek lake tahoe, 18 degrees right now. it is very cold and this is a great weekend to head up there, especially today because we are not expecting any snowfall for
7:56 am
today which means the road reasons are probably a lot better if you're planning to head out there. snow pack, northern is at about 27%, statewide only 30% so we have had a bit of a warmer season this year and this last winter storm did bring a good amount of snowfall but now with this high pressure building in you may want to head out there now because this is probably going to melt off some of that snow that fell recently. we have that ridge of high pressure as we head into thursday. there is a storm system sitting off near the portland area, but that is going to stay off to the north, not expecting any rain from that, which means we will be missing out on a couple of inches of possible rain from that. over the next seven days look at how gorgeous this week is going to be. monday into tuesday we see cloud cover, tuesday looks like it's going to be the warmest day of the week for san francisco. inland spots 65 degrees on tuesday and then as we head into wednesday and thursday the only thing that's going to be flip-flopping a little bit is going to be periods of sunshine, then we will get some cloud
7:57 am
cover but at least the temperatures will remain consistent with the 60s through the weekend ahead and then just long range and i mean long range models, it looks like we've got another possible chance of rain, but that's not until february. so we'll see. >> not until next month. >> yeah, not until like next week. >> not until three days from now. >> that's the long range. >> it's nice to see all that sunshine. i know we need the rain, but it's nice to get a break. while you're here, a rare weather event for california, you are looking at a water spout over land. it forms in eureka at the woodley island arena in humboldt county. this is video from the national weather service. they say because the water spout moved on to land that technically made it a tornado in california. >> that's what makes it rare, that it moved over land. water spouts are common, but over land. pretty neat video. >> pretty neat, huh? thanks for making us a part of your morning.
7:58 am
8:00 am
this sunday, the president, the special counsel and the russia investigation. president trump tries to fire bob mueller, but his white house counsel refuses. democrats react. >> we've seen these persistent attacks to try to undermine the credibility and that, to me, is unacceptable. >> what it does do is show intent, and it's not surprising. >> this is how republicans sounded last year. >> that would be a major mistake. >> but this week. >> i'm here for a hearing and i don't have anything to comment on. >> and president trump denies all of it. >> fake news, folks. fake news. >> at issue now, will republicans move to protect mueller or the president? plus, immigration
