p.m. 6:00, new this morning, a deadly accident on the busy bay area freeway. lanes are finally back open, but the investigation just getting under way this morning as police try to figure out what caused the crash. plus immigration battle, the rush to come up with a new immigration plan before another government shutdown. and guess what, tax season is here, but someone might be trying to steal your tax return. the reason you will want to file as soon as possible. here is a live look outside in san jose as you get ready to head out, it's a cool one to start out, mid 40s, we will be up to 66 degrees today and after this clear and cool morning we will start to see some clouds rolling by with some peeks of sunshine and tomorrow a little bit more sunshine and warmth. let me get you out the door with a look at your school day forecast. make sure the kids have something nice and warm to wear, we will start to see some very mild temperatures by the time you pick them up from school with a little bit of sun. more on that coming up in a few minutes. mike you were saying it, loo like a smooth commute right now. >> it started out pretty tough. looking at a smooth drive right now on the peninsula and in the south bay where northbound 101 at tully there is a minor crash over at the shoulder and minor slowing has just started. that's the beginning of your commute. we had the metering lights turned on just before 5:30. the backup is there at the toll plaza. the berkeley curve does move well. the jack up is on the

straightaway the as you approach the toll plaza. slowing 680 south through pleasanton, it's above 50 for most of that stretch. a slowdown for the castro valley y and we will show you dublin 580 coming in toward the dublin interchange and still half an hour out of the altamonte pass at the dublin interchange. at 6:02 new this morning a motorcyclist is dead after that crash that blocked part of highway 101 overnight. it happened in redwood city. chp officers say at least six vehicles were involved. the crash happened just before 2:00 this morning. some southbound lanes were blocked for three and a half hours. victims a hayward man who was in his late 30s. investigators are still trying to figure out how that crash started. 6:02. to washington, d.c. this morning where republicans and democrats are talking immigration. >> negotiations will begin today to come up with a plan before another budget vote is needed. good morning, edward. >> reporter: good morning, marcus and laura. you will hear a lot about immigration over the next two weeks as congress tries to make a deal. >> president trump has given congress a deadline of february 5th for an immigration plan to come to his desk. any plan would address protecting undocumented immigrants brought to this country as children known as d.r.e.a.m.ers. >> to solve this problem we are going to have to have compromise. no one will get 100 brs of what they want but this solves the problem long-term and the president went there. >> reporter: some democrats are ready to make a deal adding the democratic base needs to get on the same page. >> i think the president did the right thing by laying out where he wants to go, where he thinks the starting point is. we've got to decide do we go large, medium or do we go small. >> reporter: the president says he wants funding for a southern border wall, changes to chain migration coming into the u.s. and an end to the visa lottery program. in exchange he says he would sign a bill giving so-called

d.r.e.a.m.ers a path to citizenship after 10 to 12 years. >> those here illegally we should not be granting a path to citizenship. that is wrong and it's inconsistent with the promises we made to the working men and women of this country. >> the bad part comes is the idea of a wall which i thought was a great idea in the 15th century when china built the great wall, not so smart today. >> reporter: a long way to go in a very short time. and democrats could force another government shutdown if there is no deal. the federal government runs out of money on february 8th again. reporting live in washington, edward lawrence. now back to you. brand-new video to show you now this morning. crews working to put out a vegetation fire, this is just after midnight. happened in san jose along santa clara street at highway 87. the fire was burning up the hill as you see here on both sides of 87. firefighters say they put out the flames in about 25 minutes.

we called the fire department to get more information. of course, we will bring that to you as soon as we get it. new this morning several people are looking for a place to stay after an apartment fire in los gatos. two apartments caught fire at the complex, this is on lark avenue. it happened around 10:00 p.m. the captain told us that the entire complex is without power. no one was hurt and no word on a cause. continuing coverage now, this morning we're learning more about one of the bay area's supermarkets under investigation for mishandling meat. the 99 ranch market in san jose was shut down last year because of a cockroach problem. county health inspectors ordered them to stop all food preparation and call pest control immediately. a bay area mother took a picture of two men dumping slabs of raw pork into shopping carts and hauling it inside the 99 ranch

market. the meat vendor says the two workers have been fired and the market says it has removed all that meat from the vendor at the store. 6:02. new this morning today is the first day that you can file your income tax and you want to act fast because before someone else tries to actually steal your returns. >> "today in the bay's" kris sanchez joins us live this morning with a warning going out about identity thieves this year. it's been such a big problem. >> reporter: you know, it was a really tough year for consumers 2017, laura and marcus, and all that identity thieves need to file a fraudulent tax return is your name, your birthday and your social security number and chances are your information is already out there on the black market. 2017 was a very huge year for major data breaches of the kind of personal information that can be used to file those fraudulent tax returns costing you your refund. equifax breach exposed the personal information of nearly half of all americans last year.

you will remember that uber, the tsa, whole foods and verizon and other companies had breaches, too. even the irs has had a breach. we talked about an enrolled agent with h & r block in san jose and he told us that the key to safe guarding your refund is to not procrastinate. >> if you are sitting there going, well, no one has told me that my identity has been stolen, i have no worries, it's like, well, probably someone has already stolen it, you just don't know it yet. >> reporter: [ no audio ] >> we're having trouble hearing kris. we can hear you again. you take it over. start from the beginning because now we can hear you. >> reporter: all right. well, so you can protect your tax refund and ward off that refund fraud by filing that tax return as early as possible. choose direct deposit so you won't have a check sitting in your mailbox. if the irs notifies you that it

received your tax return before you have filed it, report that immediately to the irs and also to the federal trade commission. someone files a fraudulent return on your behalf, you can get your money back but those irs investigations can take months. mr. mau told us he saw one that took two years. today is again the first day that you can e file or someone can do it on your behalf, but remember that if you have to pay and that's why you don't want to file, file now, you have until april 17th to pay this year. in redwood city, krads, "today in the bay." happening today, san mateo county firefighters want to talk about the lessons learned in helping battle recent wildfires. tonight at 7:00 the central county fire district will present its findings and explain measures being taken to protect homeowners. that meeting takes place in hillsborough. right now at 6:08 we've got mostly clear skies, clear visibility as we take a live look in emeryville.

we've seen patchy fog in spots, but here it is looking all good. it's a chilly start. here is a look at our visibility with our now down to about a quarter of a mile in napa and a half of a mile in santa rosa. we have had that fog creeping in from the sacramento valley towards the delta. watch out for that. here is a look at what we are headed for today into the mid to upper 60s. yes, this is january. we're going to be in some spots about 10 degrees above normal and it's going to stay dry over the next few days so i will talk about that and the super blue blood moon eclipse. yes, all of that happening on wednesday, that's coming up. mike starts out with the berkeley curve. you are going to sort out the super blue blood moon coming up on the eclipse and i'm talking about the berkeley curve which is in emeryville, not berkeley, it's on the oakland side of the bay bridge as well. traffic is not confusing. we also have a little slowing that starts and that's clear to see here west 580 as well as westbound 80 coming over toward

good monday morning. right now at 6:13 it's a chilly start. let's get a live look outside in san jose. we haven't had any fog here, but we've seen it in parts of the north bay. let's go to los gatos where our temperature will be at 49 degrees at 10:00. it will be a chilly start but look at later today, 66 degrees. beautiful. also comfortable. but we do need some rain.

we will talk about if there is any in the seven-day forecast. that's coming up at about 6:19. and despite a pretty smooth and lighter drive for many parts of the bay, highway 37 toe bottom of your screen slow out of vallejo and toward lakeville highway. that's not unusual for mare island. just went 33 to 34 minutes, the build is on. it's quickly approaching 6:15. take a look at this, we now know what caused this plane to land on an orange county freeway. the plane landed on the 55 freeway last night. it happened near delmar near irvine. the plane's engine had failed and the pilot managed to make an emergency landing on the freeway. luckily no one was injured but the plane backed up traffic for miles. the 24-year-old pilot said he only had a minute or two to decide what he was going to do so he just went with his gut and landed on the freeway. sonoma county leaders are reportedly considering a new measure that may shape how areas bounce back from last year's

wildfires. the press democrat reports that supervisors want to make people -- or make sure that people buying burn zone properties in unincorporated parts of the county intend to live in the homes that are built there. they are debating banning short term vacation rentals in those areas. supervisors enacted a temporary ban after the fires, that's due to expire at the end of the week. twitter says some of donald trump's biggest fans are bots. >> robotic twitter accounts retweeting whatever the president says scott mcgrew has more. >> news of this came out on friday, facebook and twitter tend to do that so we're repeating it bright and early on monday morning to make sure you heard t twitter released new numbers late friday saying russian twitter bots retweeted donald trump's tweets 470,000 times during the presidential campaign. russian bots were also fond of wikileaks, as many as three-quarters of all the twitter accounts retweeting wikileaks were bots.

lunar eclipse forecast for wednesday. i will talk about all of that. as we start out we are going to have a cool morning and then look at our highs today, up to 65 degrees in napa and ukiah, as well as oakland and palo alto. in san jose 66 degrees and then as we get out the door heading out for oakland it's going to be in the mid 40s, mostly cloudy and then some upper 50s by the time you go pick them up from school. we are seeing these clouds because we do have a storm system that's just to the north of us producing some rain across seattle and portland and that will stay there as we will stay mostly dry and these clouds are going to start to lift as we head towards wednesday and it will be right in time for this super blue blood moon eclipse. say that ten times fast. that's happening right before sunrise on wednesday, it's called a blue moon because it's the second full moon of the month and it will be a blood moon because when that lunar eclipse starts to happen the moon will turn a reddish hue. it will be something cool to

check out, it will also be bright. as we go through the rest of the week nothing but sunshine in this forecast. highs in the mid to upper 60s, even some low 70s toward the end of the week. i will keep you up to date on that. i'm watching as far as issues on the chp report, we have some slowing over here, the tri-valley and over in hayward, but that's a typical area. lighter than typical for 6:20 on a monday. in san jose that's the one we will call out northbound 101 at tully. the crash is off the road but there is a pole that's down as a result of this crash as well and i don't know if it's a light pole or power pole. we are waiting to find out more information from chp. so far it sounds like lanes are clear and we just have that slowing because of the distraction, i guess, really, that's about it. as we look toward mass transit systems vta through the south bay uninterrupted by the crash, ac transit, muni, even bart looking great, no delays reported. the bay bridge we do have the

tracking this weather. it really is a forecast to smile about this week. >> this makes it easier to get out of bed on a monday morning. you know it's going to be a gorgeous day. we do have clouds that will be rolling by as we get a live look in san jose, let's go to campbell, it's going to be 46 degrees at 8:00 and look at how warm it's going to be as the day goes along reaching into the mid 60s and, yes, this is the end of january. as we get a look at our forecast today up to 62 degrees in antioch, santa rosa 64 degrees, 64 in san francisco and in palo alto 65 degrees. it gets even warmer as this week goes along, we will talk about that weekend forecast about seven minutes. mike has some slowing now in san jose. 101, approaching the crash, i told you a light pole was taken out, but the things are looking great around the bay. north 101 more slowing approaching tully. a light pole was taken out, turns out they said light pole, but a couple vehicles have hit it so that may be sticking out into the slow lane.

that has you slowing as you approach tully. and 87 the build starting north of curtner and capital expressway. we will track the san jose and south bay silicon valley commute. meanwhile southbound 880 at winton avenue a crash is on the shoulder but a big rig is involved so that may be more of a distraction. we will track hayward down toward the san mateo bridge. have you seen this yet this morning, mike? the search is on this morning for a driver who hit a richmond police officer during this crazy sideshow, they were spinning out of control, someone shooting into the air. this is posted on instagram. it was one of two dangerous sideshows over the weekend. "today in the bay's" pete suratos joins us live outside the richmond police department so explain what actually happened to that officer. is he okay? >> reporter: yeah, good morning to you, laura. we know that that officer with the richmond police department is an eight-year veteran and still recovering from that sideshow from the injuries from that sideshow.

we know that he has some serious injuries, but right now police are still looking for the driver who caused all of this. let's show you the video from instagram, you can see where this sideshow was taking place in richmond. you see the driver doing doughnuts as that's all taking place. according to richmond police they're saying it happened near marina bay parkway and regatta boulevard. officers were sent to the scene and that injured officer was hit by one of the cars causing him to slide on to the hood of the car before landing in the middle of the roadway as that car drove off. it's the location of that sideshow and its proximity to the police department that has neighbors talking. >> it's really residential, never hear anything so close to the police department, it really kind of gave a sense of security that this wouldn't happen but unfortunately it looks like it does. >> you could hear the noise, it was just crazy. >> reporter: crazy is a good way to sum it up. i want to point out four

sideshows all together took place in the east bay this weekend and there was one in oakland where a man was arrested for shining a laser at a chp helicopter that was on the scene. back to this richmond case, we know several cars were impounded as a result of that sideshow. not much information on the possible suspect outside of the fact that the driver may have been driving a black sedan. if you have any information to help with this case, contact richmond police. live in richmond, spooepete sur for "today in the bay." happening today the man charged with driving a stolen truck and causing a crash that killed two little antioch girls will be back in court. 23-year-old noe saucedo is charged with two counts of murder. he will appear before a judge in martinez this afternoon. this video is from his first court appearance last week. saucedo is being charged -- or he was being chased by sheriff's deputies at the time of that crash earlier this month. sisters lenexy and camila

cardoza were struck and they were in that truck that saucedo -- that saucedo struck. they did not survive. live pictures from san jose state this morning. take a look at what's going on there. classes will go on as planned after a water main break. you see what happened there. crews say a pipe broke near two residence halls last night sending a cascade of water into the area surrounding san carlos and ninth street. it took more than three hours to shut off the water. at one point campus police had to stop students from crossing through the water. >> definitely did not expect to come back to this. i wasn't here when this blew b you it's a mess. >> repair crews are supposed to work at least through the morning. the school says the damage is relatively minor and the problem has not impacted water service. in the east bay another water main break caused this destruction in hayward. including a sinkhole. the main burst yesterday morning sending water and mud down highland near mission boulevard.

firefighters put in sandbags in front of homes to try to sri vent possible flooding. two cars had to be removed from the sinkhole itself. serial stowaway is reportedly at it again. marilyn hartman who has earned that nickname over the past few years after boarding numerous planes without a ticket. she has been arrested again. take a look there. she was taken into custody early yesterday morning after being spotted in o'hare airport in chicago. a couple days ago a judge ordered her to stay away from all chicago airports after she was arrested for boarding a flight from chicago to london earlier this month. hartman has been arrested before forrñ sfo and san jose without a ticket. new details on a homicide investigation this weekend near a san jose school. police are saying it began with a fight. it happened late saturday night on san siemian way here the daniel eron school. officers responded before midnight and found a man suffering from serious injuries.

paramedics rushed him to the hospital where he later died. investigators say they don't know what led up to the fight and no suspects have been arrested. the victim's name also has not within released. happening today contra costa county a new place opens up for kids in foster care to visit with their loved ones. the location confidential, but it's not just a visitation center, it will provide family-focused treatment services. 1,100 children go through the foster care system in contra costa county each year. on average many spend nearly a year and a half in the system. overnight we investigated the numbers from all bay area counties. according to kidsdata.org in solano county kids stay in foster care more more than 19 months, highest in the region. san mateo is the lowest with ten months. a man is behind bars accused of attacking a bart station agent. it happened at oakland's lake merit station. the man damaged pay phones and

sprayed a fire extinguisher at the station agent. the suspect was taken to the john george psychiatric pavilion for an evaluation. the agent was not injured. the incident comes in the middle of a bart fare crackdown. another three people were detained for failing to pay for their trips on friday. commuters who take the bus from pacifica and half-moon bay to daly city's bart station may want to attend one of two meetings this week. sam trans wants public feedback on improving and expanding bus service and -- service to and fwl from the coast. the first of those meetings takes place tomorrow need at the ted addick community center in half-moon bay. right now your drive to and from half-moon bay is just mine, it's the ride on bart that has a bit of a delay, ten minute delay cited by bart out of the mission station heading over toward the east bay. in general those trains may be delayed through the station. i don't know what the equipment

problem is but it's not unusual and they usually have it cleared up quickly. getting across the bay from san francisco to oakland across the bay bridge you are just fine, it's the slowing down the upper east shore and backup at the bay bridge toll plaza. slow up the incline but no surprises. the walnut creek interchange for southbound 680 and westbound 24 coming through lafayette and the area is looking like a nice drive for the tri-valley. a new crash over at south 880 at winton not presenting much of an issue. san jose this crash northbound 101 shows slowing toward tully where the light pole has been knocked down on the side of the road. as far as i know it's on the shoulder. waiting for chp to get more information. monday morning, yay. >> great weekend. >> we had such nice weather this past weekend, it was nice and sunny. how about warmer weather. it was beautiful. it's going to feel a little bit more like spring here in the bay area. look at these temperatures, upper 60s for the coast and the

bay, inland areas 70 degrees, more of the same on sunday with some mostly sunny skies. hopefully whatever you have planned you will be outside, maybe go to lake shasta, it will be in the mid 60s all week long and a lot of sunshine. we don't get that a lot of the time in january. 70 degree temperatures on the beach. monterey is really going to be a popular spot. 72 degrees on saturday and sunday 70 degrees. if you are going to the sierra, now is a good time because we do still have a fairly decent snow pack, but as we continue on with our dry stretch of weather it is going to be melting and you won't have any issues getting there because we are not going to see any snow this week. we will be in the mid 50s in kirkwood for this weekend, skiing in 50 degree temperatures, i guess that will be cool. we will talk about today's temperature trend for san jose. what to expect. that's coming up in about three minutes. it is 6:39 right now. coming up next on "today in the

morning as strong winds and higher temperatures are in the forecast. this is new video showing a small brush fire broke out overnight in malibu. it is now under control this morning. people nearby were evacuated, but they are now back home. temperatures could be in the 80s today, so fire danger is very high. yesterday nearly 80 mile per hour winds were recorded in the hills of ventura county where the massive thomas fire burned last month. later today california's insurance commissioner dave jones is scheduled to visit an aria in montecito destroyed by the massive mudslides. jones is supposed to talk about the measures being taken to help homeowners recover. his tour of the area is set to get under way at 10:30 this morning. happening today a new state bill is being introduced to protect nursing mothers at work. current law gives women break time for lactation, unless it, quote, seriously disrupts work. employers need to provide a room besides a restroom, if not they could pace $100 penalty for each

violation. the new proposed bill would also require access to a sink and refrigerator. employers can apply for an exemption from not allowing lactation breaks. happening today congress takes up a bill to better protect young athletes from abuse. today the house will vote on new requirements for amateur sports groups recognized by the u.s. olympic committee. the group will have to report sexual abuse claims to police. it will prohibit athletes under the anyone of 18 from being alone with an adduct who is not their parent or guardian. the move comes in response to the sentencing of former usa gymnastics dr. larry nassar accused of abusing more than 150 women and girls. scott mcgrew joins us now. there's pressure on congress to protect robert mueller. >> donald trump's white house insists there is no plan to fire mueller despite reports trump

ordered the firing last june only to be talked out of it by his lawyers. over the weekend republican senator lindsey graham made it plain, trump must not fire the man investigating him. >> i see no evidence that president donald trump wants to fire mr. mueller now. i don't know what happened back last year, but it's pretty clear to me that everybody in the white house knows it would be the end of president donald trump's presidency if he fired mr. mueller. i think we are in a good spot with mr. mueller. >> trump does have the power to fire mueller, there's pressure on congress to change the rules to prevent it. all of washington watching this situation in russia where pro democracy protests broke out over the weekend. president trump has tweeted in support of pro democracy protests in iran, but has yet to do so for pro dem tracy protests in russia. today by the way is the deadline for president trump to levee sanctions against russia for its interference in our election. he is required to do so. congress wrote the sanctions into law, he signed it,

can e file your income taxes. saw several big data breaches last year which means a crook may have enough of your information to file as you and claim your refund. experts say the best defense is to actually file early. we posted more advice including what to do if someone does file your return before you. it's all on our website and apps. new this morning fire investigators are trying to figure out what caused this small brush fire in the south bay. the fire broke out just after midnight in san jose. this was along the santa clara street and highway 87 area. that fire was burning off the hill on both sides of 87. firefighters say they put out those flames in about 25 minutes. several people are without a home this morning after an apartment fire in los gatos. two apartments call fire at a complex on lark avenue. firefighters were on the scene overnight. no one was hurt and no cause on what caused the fire.

bay area firefighters are hoping to learn from the recent wildfires across california. tonight the central county fire district in san mateo county will talk about the fires and explain measures being taken to protect homeowners. we are learning more about the bay area supermarket under investigation for mishandling meat. we were the first to tell you about a bay area mother who took a picture of two men dumping slabs of raw pork into shopping carts and hauling them inside the ranch 99 -- or the 99 ranch market in san jose. the meat vendor says the two workers have been fired. the market says it removed all the meat from that vendor at the store and now we've learned the store was shut down last year because of a cockroach problem. health inspectors found the pests throughout the kitchen in november andered odd the business to stop all food preparation and call pest control immediately. looking live at the richmond police department, that's where the search continues for whoever

ran over an officer during a sideshow near police headquarte headquarters. this was on sunday. the officer has broken bones, cuts and road rash. police say that that driver hit him as he was waving the cars to stop. police say that -- they say that they know that that driver was in a black sedan. this was one of four sideshows in the east bay this weekend. the man charged with driving a stolen truck and causing a crash that killed two antioch girls is due in court for a plea hearing. 23-year-old noe saucedo is charged with two counts of murder. this is video from his first court appearance last week. investigators say a sheriff's deputy was chasing saucedo when he crashed into a truck. two little girls inside that truck were killed. a live look at san jose state this morning where classes will go on as planned today. this comes after a water main break yesterday which sent water gushing across campus. now, crews say a pipe broke near two resident halls and sending that water into the area around
