we will have some warmer temperatures by this afternoon in the upper 60s in the south bay. mike has more information on that crash in sf. that's right. we are looking at highway 101. let's look at the entire bay right now, you see a smooth drive. we are looking at 101 southbound, the cesar chavez off ramp, it does sound that the minivan involved in a crash is affecting just the off ramp and not the freeway itself. it may be on city streets because it sounds like san francisco police are assisting with that issue over there. no major injuries reported, but we will track that to give you any updates. we are following this area highlighted in the orangish color here, that's where the road weather index says it's tougher to see and the fog readings show about a half mile visibility in some parts of the north bay. now to a develop story all new this morning, authorities in the east bay are investigating a car wreck after a late night shooting in richmond. that crash happened at the san pablo avenue off ramp on interstate 80.

>> pete suratos is there with what we discovered overnight. pete? >> reporter: good morning to you, laura and marcus. we're working to get more details from chp oakland as well as the contra costa sheriff's department which are handling this investigation, but at least from the scene on san pablo avenue i can tell you that the scene is clear, won't affect any traffic in the area. there are reports of a shooting in richmond with at least that driver crashing their car just off the off ramp off of 80 west. we will show you video from this scene. this is from roughly around 11:00 p.m. so the scene has cleared for quite some time, but information that we're getting or our crews got from officers on the scene is that apparently the shooting happened just after 11:00 p.m., it's unclear if that shooting happened on the freeway but that convertible, that crash just off the off ramp off of 80 west and san pablo avenue. we do know that the victim was transported to a president who, do not know the extent of the injuries or if the shooting actually took place on the

freeway, but we know that's where the car ended up. we can report at least this morning that the contra costa sheriff's department is handling this investigation. we will continue to reach out to them. of course, if you have any information from them we will bring that to you in the next hour. live in richmond, pete suratos for "today in the bay." 5:02 on your tuesday morning. to our other top story of the morning, we are just hours away from president trump's first state of the union address. a live look at washington, d.c. this morning where the president will lay out his plan for the nation tonight. but it comes as more scandal is rocking washington and the white house. first, deputy director of the fbi andrew mccabe has resigned after weeks of attacks by the president and the house intelligence committee has voted to release a memo alleging abuses by the fbi in connection with a russia investigation. plus there is also talk on capitol hill of passing a bill to pro expect special counsel robert mueller from being fired by president trump.

edward lawrence is live on capitol hill. edward, it is shaping up to be a pivotal week for president trump. >> reporter: laura, you could say that pretty much every week of this presidency. there is a lot going on here today ahead of the state of the union address. now, republicans will use that memo that you mentioned there to say that the wire taps of the trump campaign that started the russia investigation were politically motivated. >> it's a big speech. >> reporter: president trump critical of the russia investigation is getting what he has been pushing for for weeks, deputy fbi director andrew mccabe stepped aside effective immediately. >> i can tell you none of this decision was made by that of the white house and any specifics i would refer you to the fbi. >> reporter: the president previously tweeted that mccabe worked with a bias against him and for hillary clinton, pointing out that mccabe's wife's election bid received hundreds of thousands of dollars from a close friend of clinton. mccabe planned to retire in march with full benefits, now he

is taking a terminal leave to reach that retirement date. >> my supposition is that christopher wray saw something other than presidential tweets that wray saw something that said i need to push andy to the side. >> reporter: adding fuel to the flames the house intel committee voted to release a classified memo written by house gone staffers that is believed to allege fbi misconduct in the investigation into the trump campaign, including surveillance of former trump campaign adviser carter page. >> i certainly haven't seen any abuse of the investigative process by the fbi for the department of justice. what i have seen instead is a deliberate attempt from the very beginning of this investigation to distract attention from the russia probe. >> reporter: democrats say the memo reflects only part of the story and will be taken out of context. edward lawrence, nbc news, washington. >> as we mentioned, tonight is president trump's first state of the union. oakland representative barbara lee and southern california's

counties. here are the spots in alameda, marin, sonoma and solano counties. the report comes from the american road and transportation builders association. it says that nationwide there are 174 million daily crossings on over -- 54,000 structurally deficient bridges. happening today in san jose, live look at city hall where city leaders are expected to decide to move the christopher columbus statue. it has been a fixture in san jose since the 1950s but it has recently come under fire with some advocates saying columbus' actions led to genocide of native americans. not only do they want the statue removed from city hall, they don't want it anywhere. >> the history, the legacy of christopher columbus is a history of slavery, rape, genocide, colonization. so there are lots and lots of groups who have suffered because of those legacies. >> the city is looking at moving that statue to san jose's

international terminal or the italian bank exhibit at history park. new controversy at stanford this morning, it's surrounding a plaque that's soon to be unveiled on campus. it centers around women who -- a woman, rather, who was sexual assaulted by brock turner. now, the victim is now saying that no longer -- she no longer wants to be a part of that. the woman presented a quote from the plaque being placed near where that assault happened. the quote was her statement during the sentencing of turner, but the university sided it won't be using it for that plaque that it might upset other sexual assault victims. brock turner served three months in jail for the assault. judge aaron persky is now facing a recall election this june. a top bay area ballet is facing criminal accusations this morning. instructor viktor kabaniaev has worked with leading local ballet

companies including smuin in san francisco and diablo in walnut creek. also teaching in daly city at the westlake school for performing arts. contra costa prosecutors say he molested a girl under the age of 14. parents with children enrolled in the school are stunned. >> she loves it. the teachers she has had are great. it's a really good program as far as we know. so to hear something like this is just kind of shocking. >> investigators say the crimes occurred in the east bay and they want to know if there are any more victims. westlake school directors believe kabaniaev is being falsely accused. happening today, noise from concerts at levi stadium will take center stage at the santa clara city council meeting today. 49ers who run the stadium and the city have been on an ongoing battle over concert sur few. the city wants the show to end at 10:00 p.m. saying that noise disrupts neighbors. they are looking at video of a coldplay concert from back in october. they played welljffr past 10:00 north bay?zed leaders takinw

steps to help put an end to one of the most flood prone traffic arteries in the north bay. 101 and shoreline boulevard is one of the first places to flood during unusually high tides or heavy rain. the marin ij reports county leaders are putting together a request for funding to study why those floods happened and how to fix the problem. the deadline to file is the end of next month. also new this morning a dry winter is facing state officials to doll out smaller amounts of water. they say their customers can expect 20% of what they're asking for. california has had a disappointing winter with just a quarter of the normal snow pack in the sierra nevada. the state water project provides drinking water to more than half of california's nearly 40 million people as well as to farms. looks like it's goingp8t@ t a whileivo before we get some and bksnow, but@t try to catch up for the winter. all dry this morning, clear as well as we take a live look

outside in san jose. as we go throughout the day we start out with temperatures in the mid 40s for much of the morning, but it does quickly warm up. we will be in the mid 60s by this afternoon and mostly clear skies tonight adds we break it down for oakland, just a few degrees cooler, but still into the low 60s later today. it's going to be a nice one but we start out with already a crash now on the nimitz. >> a neurocrash on 880 at nimitz freeway in fremont, southbound 880. a lot of green all over the place, but just south of the dumbarton bridge we do have a crash at thornton moving quickly off to the shoulder. i'm tracking that as well as the car over here southbound 680 at highway 84 over on the shoulder, still trying to get someone to help fix that flat tire. no major slowing, no problems over there for the tri-valley. looking at the speeds getting over toward the bay bridge, the travel times are great, at the limit for the upper east shore freeway for oakland and 580 and interstate 80. a nice ride on the north bay as

the day will shape up. we will be at 49 degrees at 9:00 in the morning and quickly warming up. a lot of sunshine after a few clouds to start and then look at our highs today, we will be reaching into the mid 60s. it's going to be nice. we will talk about what's ahead as our dry weather continues and you may be able to make it a beach day. we will talk about that coming up in five minutes. we will go up to san francisco, i'm still tracking this crash just off highway 101, traffic flows smoothly, though, south out of san francisco. north of san francisco there's some fog registering and kari has been talking about. we will show you the rest of your commute. 5:14 right now. all new this morning the ten hottest neighborhoods for home buyers in the entire country are all in the bay area and they're mostly in the south bay. the real estate website red fin put together that report. the hottest neighborhood is the buck nal area in san jose. this site says the average home goes off the market in eight

days. the cost, usually $1.5 million. yeah, you can see there the other hottest neighborhoods on your screen. there are also spots in santa clara and sunnyvale. the report says that other hot neighborhoods are sunny side in san francisco, the blacow in fremont. red fin says this is all because of the tech workers, even highly paid one, are getting priced out of the peninsula. you might say amazon's latest creation a closer to its name sake than products like alexa and kindl. this is the new spheres complex, it's an eye popping building opening at the seattle headquarte headquarters. it is an outdoor rain forest made up of three spheres containing 40,000 plants from five continents. if you want to see it in person you will now have to be -- it will have to be right now from the outside unless you actually work in the building or you're part of an organized tour.

amazon it moving into the healthcare business as well. >> that's right. scott mcgrew, brand-new news this morning. >> billionaire warren buffett, the guy who spilled the means, he says berkshire hathaway is teaming up with amazon and jpmorgan chase to create a new healthcare company. he said they will not worry about profits. now, the announcements very vague but healthcare stocks are down this morning on news that they may have a new competitor. big news out of facebook as well.c2'(t&ho the company earlier announced it would get rid of news articles in your news feed and facebook says that so you see more baby pictures, but many suspect it was facebook's latest attempt to combat fake news by just getting rid of all the news. in a facebook posting ceo mark zuckerberg now says the company has changed its mind and will include local news on your facebook feed. he said people consistently tell us they want more local news on facebook, local news helps us understand the issues that

matter in our communities and affect our lives. give some of the credit this morning to audrey cooper on the right, she is the editor and chief at the "san francisco chronicle" and immediately sounded the alarm when facebook first said it would get rid of news in the news feed. the chicago sun times this morning says it will not run movie reviews written by its movie critic richard roper pending an investigation. this is roper, he does tv and youtube videos as well. "the new york times" investigation into a service that sold twitter followers named roper as one of its customers. so he has been suspended while the sun times investigates that allegation. as you know there is a tremendous amount of pressure on journalists including us to generate twitter followers. when we talk about our twitter feed all the time. >> right. >> his twitter is not growing so it's hard for us to get new twitter followers except for those who are already on twitter @scottmcgrew and there's pressure to get them.

feel much more comfortable than yesterday. we are heading up to 68 degrees in san jose.é"ñ the east bay, 67 in danville and oakland today looking at a high of 62. 68 degrees in redwood city and look at half-moon bay, 68 degrees there and 63 degrees on the embarcadero for that high this afternoon. looking at some mid to upper 60s for the north bay. so if you're planning to go to santa cruz today it's going to reach into the low # 0s and why not if you have the day off, maybe just enjoy some time out there in the sunshine. it's going to reach our high temperature -- we will reach our high temperature right at about 3:00 this afternoon. we will have more warm days in the forecast and for san francisco some mid 60s into the end of the week. this weekend also looking really nice and morning temperatures in the upper 40s to low 50s. inland areas will have several days of 70 degree temperatures, but, boy, do we need some rain, hopefully we see it after this

saturday. two earlier deaths happened this month. in the latest incident a 71-year-old berkeley man died, the other two deaths involved men from oakland and castro valley. all three were over 50. one bay area snorkeling expert advises beginners to breathe shallow whenever a snorkel fills with water. >> sort of a big breath in, you gently breathe in and you will hear the bubbles through the water, get air and pop the water out of the snorkel and now you can take a regular deep breath. >> two of the bay area victims were wearing full face snorkeling masked modeled after a scuba diving mask. it was 29 years ago the 13-year-old eileen beth mistel off left her school to walk to her walk to his ice skating lesson and was never seen again. tonight there will be a candlelight walk in her honor.

jose, you can see right there the lights twinkling in the night, but it's really day, but it's still dark, dark and early. good morning and thank you so much for joining us, i'm marcus washington. >> and i'm laura garcia. also cold when you walk out the door. >> it is. >> wakes you up. kari has a look at our forecast. >> a day for a nice warm jacket, but later on today you will be taking it off, it's going to warm up quite a bit. as we take a live look outside in san jose, oh, my banner is covering up the moon, but we will be watching the moon tomorrow morning as we get ready for an eclipse and it's all clear now, hopefully that will hold for tomorrow as well. our temperatures are really cold in the north bay as you get ready to head out the door, only 38 degrees in napa, but 48 degrees in palo alto and 51 degrees in san francisco. as we go into the day it's going to be really nice and comfortable, especially for this time of year. running 10 to 11 degrees above normal and we will have more well above normal temperatures heading into the weekend. i will talk about that.

mike, you are tracking a new crash in the east bay. >> that banner was just doing a preview of the eclipse tomorrow. in the east bay a couple issues southbound 880 around thornton, that crash got to the shoulder, i'm just tracking it as it is on the incident report. here a little slowing getting up toward 238 and 880, that's your commute direction out of the castro valley y, a rarp is reported in that area. everything got over to the shoulder quickly there as well. no delays toward the bay bridge but we do have a backup near the bay bridge as well. the palo alto school board expected to weigh in on a proposed expansion at stanford. >> new this morning we're getting a closer look at what this project could mean for the city. "today in the bay's" kris sanchez is live at stanford with the impact of this proposal and, kris, what do we expect today? >> reporter: we expect to see palo alto kwlun if i had school district will weigh in, but it

is really just one of the nine jurisdictions that wants to have a say in what is stanford university's sprawling nearly 17 years permit for development here in palo alto. i want to show you the area we are talking about. take a look here, the area in green is the area of proposed development, the area below the black line in the middle is open space that is protected, but only until the year 2025. stanford proposes 2.3 million square feet of academic street, 3100 units of had a housing for students, staff and faculty. although this is just one permit by the county, it would cover all projects through the year 2035. public comment ends on this on friday. so as you might imagine palo alto unified and a lot of other folks have continues about the impact of stanford's proposed growth. tonight the palo alto unified board will finalize its

recommendations to the county, they are likely to include construction of a new elementary school on the stanford campus and more on campus housing to mitigate the impact of that kind of growth. palo alto city council finalized their recommendations on monday. these are just two of the jurisdictions bracing for impact, but the santa clara county board of supervisors is the only one with the power to approve or deny that development permit, so we talked with supervisor joe simitian. >> as i hear from folks they're saying we want the university to flourish but we also want to make sure that the traffic and housing doesn't get worse, that our schools are adequately planned for. these are understandable community concerns and that's part of the job in the coming months. >> reporter: the palo alto unified board meeting is at 6:30 tonight at the board -- at the district headquarters. i've been going through that 28-page environmental impact report from which the public comment period ends on friday. i know that's a lot of reading

for a lot of you who are just waking up so i did post it in my twitter feed, i will put it on facebook in case you want to take a look as you're having your lunch at your desk today. kris sanchez, "today in the bay." >> thank you, kris. today san jose police chief is expected to give more details on an officer-involved shooting in east san jose. that shooting happened around 3:30 yesterday afternoon on feller avenue near story road. according to police the suspect a woman who has not been identified was armed with a shotgun. this is video from that scene from nbc bay area sky ranger. yo+6 there. she was arrested and taken by ambulance to a local hospital with nonlife-threatening injuries. more details for you now, the street has seen police violence in the past, anthony nunez was shot and killed by san jose police officers on that same street in 2016. the officers were cleared in that shooting but the family has filed a wrongful death lawsuit against san jose. the woman accused in a drunk

driving accident that seriously injured a chp officer is headed back to court. investigators say tammy walker drove into the center divide on highway 4 earlier this month triggering a chain reaction crash that pinned a chp motorcycle officer under a truck. walker is accused of driving under the influence with a suspended license. the officer broke both his legs, but is now recovering. two teenagers are in trouble this morning for hitting a richmond police officer with a car during a sideshow over the weekend and someone caught it on camera, but i want to warn you the video is a bit disturbing to watch. in this instagram video you can see the officer getting hit by a black sedan as he was trying to break up a sideshow in richmond. it happened early sunday morning near marina bay parkway and regatta boulevard. the driver, juan vargas and his passenger genesis castaneda were arrested yesterday. vargas is facing attempted murder charges, the officer has been released from the hospital and is recovering at home. we have new details this

morning about the life inside a southern california home where parents allegedly shackled and tortured their 13 kids. the oldest boy attended a california college for years, but apparently never told anyone about his life at home. his mother regularly drove her older son to classes then waited outside the classroom for him. the college said that he made the honor roll twice. trauma professionals say the young man's reluctance to discuss conditions at home is understandable. the parents have pleaded not guilty to torture and other charges. happening today in sonoma county local and federal officials are holding a town hall meeting on recovering and rebuilding, officials from fema, the state office of emergency services and the army corps of engineers will be there. it starts at 6:00 tonight at the sonoma veterans memorial hall. in fire ravaged sonoma county coffey park is slowly rising from the ashes. one house is rebuilt, but others not so fortunate because there's not enough labor around. a major builder is actually

backing out, they couldn't secure enough labor to move forward with building 75 homes. a custom home builder weighed in on whether labor concerns here are legitimate. >> it would be a legitimate concern if the expectations were to rebuild maybe 4,000 homes in two years. >> that's the problem, they actually have 5,000 homes to build in two years and right now that's how long home insurers are required to cover the homeowne homeowners. theres a bill in sacramento to make it three years. if you still have your christmas tree up no judgment here, but we want to pass along some information for you. especially for those who are in san jose. you can get a chance to get that tree picked up and recycled but that time is running out. that deadline is february 2nd that's this friday all you have to do is get that free to the curb. the city turns those trees into mulch or renewable energy. mike, i hope you have yours up. >> up and out the door. >> we got the tree out the door and then had to sweep up all the

pine needles. over here no trees in the roadway throughout the bay, that's the good news. we have had scattered incidents over on the tri-valley east bay, pretty much all of them have cleared up. over here north 238 shows a little slowing. there was a crash over on the shoulder with no injuries, it's between a motorcycle and a honda fit. if it was a larger touring bike it could be close to the weight of that honda fit so maybe it was kind of, well, a matched collision there, no major injuries, just a fender-bender from what i understand. a smooth drive toward the bay bridge. fog in the north bay registers on our road weather index. a look at the golden gate bridge shows you the drive in towards san francisco still very clear, very easy for folks on 101. >> we are moving along this week here. monday is behind us, already tuesday. the weekend slightly in sight. >> it's in sight. it's always within sight. and it's going to be a great weekend. we've had warmer weather starting to move into the bay area, as we head towards saturday it's going to be nice and sunny, temperatures reaching

it's 5:43 on this tuesday morning. time to get up and get moving and don't forget a jacket before you head out. here is a live look outside in san jose. as we do start out with cool temperatures, let's go to willow glep, good morning, our temperatures will be at 45 degrees at 9:00. now, normally for the end of january we are at 59 degrees, but today by 3:00 we are at 65 and more sun than yesterday. we are going to have a lot more sunshine in this forecast and i will talk more about that coming up at about 5:49. here is a nice look at your travel times, tri-valley not so bad. there is a crash over on 205. i will talk about that briefly. it might effect folks getting out of our area.

happening today vallejo school leaders will hold a special meeting to debate a plan to cut $8 million from the budget. board members are grappling with cutting more than 30 teaching jobs, but the district leaders do believe that some or all of those may result in the normal attrition. administrative cuts are being considered. tonight's meeting takes place at 7:00. our continued coverage of recreational pot use. sales expected to be more than $7 billion. by 2021 that number is8 to jump to more than $20 billion according to the state treasurer. all that money is usually dealt in cash since pot is illegal under federal law. so what do you do with all that cash? state treasurer john chang is looking to create a public bank for the pot industry. last year he created a panel of stakeholders to deal with the cannabis banking problem.

california could become the first state to require public universities to offer medication for abortion. the state senate passed the bill on monday. currently no uc or cal state campus offers abortion services at their health centers. they offer -- they refer students, rather, to outside providers. a group of donors wants to pay millions to train staff and inn stall equipment. if the bill passes the requirements would begin in 2022 provided the donors come through with the money. four democratic candidates for governor will take questions in san francisco, specifically questions related to abortion and reproductive rights. a pro choice group is hosting that forum at 6:00 at the soma arts center. we looked up some of the latest pollnof numbers showing where support for all the candidate stand. l.a. times released the numbers in november. gavin newsom has 31% support, antonio sri rag is a has 21%.

association holds a panel today to talk about creating a new welcome center and ferry landing for alcatraz. it will be located along the embarcadero. that's all happening today at 12:30. the search is on for a sacramento church deacon and father who has been missing for five days. joe hendricks has not been seen since last thursday when he dropped off his wife for work in sacramento. he was supposed to pick her up later that day but he never showed up. his family hasn't heard from him since and he missed church on sunday where he serves as a key don. police found his car parked in front of a home on thursday, but they don't believe he has any connection to the homeowners. officers impounded the car and found his two phones, laptop and tablets inside. the family says this is out of character. >> i just can't see him walking away from his property like that. i feel like something -- something is wrong. >> the family filed a missing person's report on sunday. they say he works as an energy

specialist and often meets with clients at their homes so it's not out of the ordinary for him to go into an unfamiliar neighborhood, but they still don't know why his car ended up where it did. doctors are pleading with people to get the flu shot as the deadly flu emergency sweeps the country. there is increasingly high demand for the vaccine at pharmacies right now. shortages have been reported in some spots but the cdc says there is enough supply to go around. the cdc says it's especially important for pregnant women to get the flu shot. health experts say two-thirds of pregnant women have not died from the vaccine. the doctors say it's not too late to get the flu shot and it will not make you sick. >> when you get the flu shot you might actually feel a little under the weather, body aches, low grade fevers, arm soreness, that's because your immune system is starting to get activated to fight the flu. >> the state health department
