welker. hey, good morning. >> reporter: good morning, hoda and savannah. officials here at the white house are trying to keep the focus on the first state of the union address. mr. trump will aim to strike a note of unify even as the russia probe is sparking all-out partisan warfare. this morning, the president plans to address a union sharply divided as republicans escalate a multipronged attack against the department of justice and fbi. overnight, the house intelligence committee voting along party lines to release a controversial and classified memo which purportedly accuses senior fbi officials of misconduct. republicans say it shows the russia probe was tainted from the start. now it's up to the president to decide whether to release the memo to the public. a senior administration official says the memo will be reviewed first. >> well, they want the see what's in it and there are national security concerns, it's

a classified document and the president will make that call. >> reporter: democrats blasted the memo saying it cherry picks facts in an attempt to discredit the investigation and they slammed republicans for voting against the release of an opposing memo written by democrats. >> this committee voted to put the president's personal interests perhaps their own political interests above the national interests. >> reporter: it capped a day of drama after andrew mccabe announced he is stepping down. friends and co-workers tell nbc news mccabe left on his own. but they say two big factors played a role in his decision to live. the justice department will issue a report expected to strongly criticize how the fbi handled the clinton e-mail investigation including mccabe's role and the sustained criticism of mccabe by president trump on twitter and in person. including the night the president fired james comey.

nbc news has learned the president fumed when he watched comey who is in l.a. board a government plane back to washington. according to multiple sources familiar with the matter, the president called mccabe to complain. and then suggested to mccabe that he ask his wife how it feels to be a loser. mccabe's ran for state senate in virginia and lost. and james comey said in part, special agent andrew mccabe stood tall when small people were trying to tear down an institution we all depend on. the white house insisted the president had nothing to do with mccabe's departure. as for the state of the i don't know on -- state of the union address, he will touch on the jobs and economy, infrastructure reform, immigration reform and national security. the first lady will be in attendance with 15 guests as is tradition.

all of the president's children will be there with the exception of his youngest son barron. savannah? >> thank you. we are now joined by sarah huckabee sanders. good to see you. >> good morning, great to be here. thanks for having me on. >> let's talk about the state of the union address. the president is coming into his first state of the union with a rip roaring economy, low unemployment. the wind at his back in terms of the economy. and yet, his own personal approval ratings are at record lows. does he look at this as an opportunity to kind of build that back up, to try to unite the country. what will he say? >> absolutely. look, the president will talk about a number of things tonight. certainly the economy will be front and center. we have had a historic year. record breaking moments throughout the year. in large part due to the president's leadership on deregulation. and a huge capstone at the end of the year with the tax cuts and the jobs act which we have seen have immediate impact with

several hundred companies stepping forward and giving pay raises, bonuses because of that tax cut and that tax reform package. you're going to see a big focus on national security. this has been something that the president has talked about for a long time. for the first time in years, we are seeing massive impacts on isis and they're on the run and major progress has been made on that front. the president made that a big part of his administration. you will see a focus on that. immigration, the president laid out the framework that is a bipartisan deal that brings both republicans and democrats to the table and gives everybody something of what they wanted most. >> so sarah -- >> the first attempt we have to seen to deliver on this topic and on this issue in a real chance to make some big reform and we're excited to see that take place. >> so lots to talk about at the state of the union and behind the scenes as well.

andrew mccabe abruptly resigned yesterday earlier than expected. the president has made no secret of the fact that he does not care for andrew mccabe. you said that he wasn't part of the decision process. was he happy to see andrew mccabe go? >> look, i haven't asked him specifically about that, but he certainly has voiced some frustrations with some of the actions by the deputy director, but the bigger issue is the president has full and complete confidence in fbi director wray and he has left these decisions to him and i would refer you to them for specifics. right now, and certainly top of mind for this president isn't about deputy director mccabe but about the state of the union, it's about bringing the country together, setting an optimistic vision tonight and you will see the president's heart in this speech. i think you will see the patriotsism of this country. and i think it will be an

incredible and powerful night. >> back to the russia investigation for a moment because let's go big picture. here's what i don't quite understand. the president has said there's no collusion, there's nothing wrong there, nothing to see here. yet one by one, he's gone after every single one of the justice department officials connected to this, whether it's his own attorney general or james comey or andrew mccabe even saying he would fire director mueller. if there's nothing to see here, why does he go after all of the justice department officials connected to the russia investigation? doesn't it at a minimum look bad? >> look, he hasn't gone after the special counsel, we have volunteered thousands upon thousands of documents. over 20 different individuals have done interviews. we have been transparent as possible -- >> but he's gone after every single person at the top of this investigation including the attorney general he appointed so i guess the question is, if there's nothing to see here and he wants to cooperate, why does he continually go after people

who are connected to the investigation and just trying to do the investigation? doesn't that make it look like he has something to hide? >> frankly, if some of these individuals were just trying to do the investigation, what they would have done it and it would have been wrapped up. time and time again, the only thing that has come out of these and every single time after interviews, after reviewing records, the on thing they that come back to is no, we haven't found anything yet. frankly, i think the people that are frustrated most isn't the president, it's the american people. they're sick and tired of being inundated with russian fever. they're focused on forward. that's what the president has been trying to do. >> would you agree had the president not fired director comey there wouldn't be a special counsel and an obstruction of justice investigation that centers around him? didn't his actions bring this upon himself? >> i think the actions of

director comeyy we've seen more and more reason he shouldn't have been the head of the fbi. it turned out he was leaking information. i think the president made the right decision. for us to go back an recreate history is simply not possible. again, i think it has been very clear time and time again there's absolutely no collusion whatsoever with the president or this administration. we're ready to move on. i know the country is ready to move on. we look forward to the special counsel wrapping this up so we can continue to focus on the great things we were doing. imagine how many more things we would have been able to do this past kwleer if everybody hadn't been so focussed on this russia -- >> that's true but -- you have to say the press focused on it because the president's tweeting about it. we'll see you tonight for the state of the union. thank you for you time.

of course nbc will have live coverage of the state of the union address. >> another major story the nation's worsening flu epidemic. hospitals are taking new steps to fight the outbreak. while it's not too late to get your flu shot. some facilities are reporting a vaks seen shortage. >> good morning. grady memorial is atlanta's biggest hospital. today this mobile e.r. used during natural disasters is opening to deal with the flood of flu patient. the regular emergency room seeing about 300 patients. one day last week doctors saw more than 500. >> reporter: this morning across the country the outbreak is not loosening its grip. the race is on to get the flu shot. >> i thought now was the time to be proactive. >> i needed to get it down. >> reporter: the cdc said there

is enough supply but shortages are being reported and the need has caused facilities to scrambled. >> we've had to order it three times. to be on the third order speaks to the demand we've had. >> reporter: hospitals taking drastic measures. this one opening an e.r. on wheels, 14 extra beds to deal with the onslaught of sick patients. in new york the governor declared a flu disaster. even though we're four months into the flu season people still have a lot of questions. what should you do within the first 24 hours of getting sick? first stay home. if you're a high risk group take anti-viral medications. >> tamiflu is a good medication. taken within the first 24 to 48 hours tamiflu can reduce your symptoms by about one to two days. >> reporter: what should you do if someone in your household is

diagnosed? sleep in separate beds, avoid touching your face and keep disinfecting. >> should pregnant women get the flu shot? >> if you're pregnant and you have not got the flu recommend you get it. >> reporter: if you have symptoms should you still get a flu shot? if you have a light cold you can be vaccinated. if you have acute illness with a fever you should not get a flu shot. >> how different is this than what you've seen? >> much higher than it has been. >> so far there have been 37 pediatric deaths. it's too early to tell how many of those children died without getting the vaccine the cdc reports previous years 80% of the kids who died didn't get the flu shot. as for this mobile e.r. grady expected to have it for at least a month. >> gabe, thank you.

>> also on this busy tuesday morning the hype for sbt 52 is heating up. the official opening was last night. the philadelphia eagles and new england patriots met with reporters. tom brady spoke out not just as a football star, but also as a father. >> so this all started last week when a boston radio host lobbed a crude insult at brady's 5-year-old daughter. the man was quick to come to his daughter's defense. >> reporter: just days before the super bowl tom brady is stepping into a fight off the field and defending his daughter. >> my daughter or any child they certainly don't deserve that. >> reporter: the reigning super bowl mvp lashing out monday after a radio host lobbed an insult aimed at brady's 5-year-old daughter. >> i thought the first scene was so staged where brady is in the

kitchen. his kid is being an annoying little piss ant. >> bra >> i've tried to come on the show for many years and show you guys a lot of respect. i've always tried to come on and, you know, do a good job for you guys, so you know, it's very disappointing when you hear that. >> reporter: brady has regularly called into the show over the years, and just last week, weei and the patriots announced a multi-year extension of their partnership, highlighting weekly features headlined by brady and coach bill belichick. but following the comments about his daughter, brady's future participation could be in doubt. >> i'll obviously evaluate whether i want to come on this show again. so i really don't have much to say this morning. >> reporter: according to the station, alex reemer has been indefinitely suspended, saying in a statement they are embarrassed by the comments. we deeply regret what happened and offer our sincerest

apologies to tom brady, his daughter, and his family as well as the new england patriots organization. neither reemer more to the patriots are commenting. but at a press conference monday, brady told reporters he hopes reemer wouldn't lose his job. >> i just said i certainly hope the guy's not fired. i would hate for that to happen. >> reporter: the controversy comes as patriots prepare to face off against the eagles this sunday. >> what's up, patriot nation? yeah! >> reporter: will mvp tom brady rallying fans outside gillette stadium. >> we got one more to go. we love you. patriots out! >> also at that news conference, brady said parents would probably react the way, saying everyone is protective of their children. >> yeah, the fact he said he didn't want the guy fired was generous. >> just be kind. >> exactly. most parents would be like, what?

all right. thank you. al is here for a look at the forecast. >> that's right. we have some snow out here in the northeast on into new england. this is the scene in suffolk county. nothing too horrible. in fact, some spots where it's coming down a little heavier, it is sticking, but for example, much of the new york city area, not so much of a problem. but you can see we still had that snow hanging out. more snow back to the west. so we have winter weather at vise ris back through western new york, down to the mountains of west virginia and into tennessee and kentucky. we're also looking at this snow pushing away. so the steady snow will end here in new york in the next hour or so. by boston, it'll be one to two. another weak system comes across this afternoon. when all is said and done, an inch or two. maybe heavier snow along down east maine. gusty winds through the plains. fire danger shifts from the southwest into texas. we're also look at those snow showers here in the northeast. beautiful weather through the gulf coast. we'll get to your local forecast

you want a piece of me? good, i'm delicious. creamy, delicious, 100% real cheese. mini babybel. authorities in the east bay are a very good morning to you, it is 7:26. i'm laura garcia. authorities in the east bay are investigating a late night shooting that led to a crash just off interstate 80 in richmond. you can see the car t crashed not far from san pablo avenue off ramp. deputies confirmed that the driver was shot and in the hospital, but they are not saying if the shooting happened on the freeway or if the victim was shot somewhere else and crashed after getting on to the freeway. authorities have not provided any update on the condition of the victim or possible motive but we will continue to check for you. want to check in with meteorologist kari hall with a look at our forecast. >> it's a chilly start. we have had some patchy dense fog in the north bay as we get a live look outside in san rafael we can see some fog drifting across 101.

visibility in santa rosa down to a quarter of a mile. you do need to allow extra time to get to work. look at what we will see later on today, highs in the upper 60s, a lot more sunshine than yesterday. it's going to be a really nice one and we will continue on with some above normal temperatures over the next few days. but a lot of sunshine, dry weather even into the weekend, into early next week. inland areas will be as warm as 70 degrees by the end of the week and low 70s for the weekend. let's get an update on the commute from mike. we are looking at a standard pattern for a tuesday, really kicking in for the south bay and also hayward. 880 south past both of those bridges there. looking at no major problems. train number 1 should have made its way back in toward the station so we will take you back over here toward the slower drive in towards san francisco and getting south down towards cesar chavez. that crash there, that is moving to the shoulder, still slow off the skyway down toward the 280 split. in the northbound direction that driss tracts folks as well. standard pattern across the san

been charged with a crime and vehemently denies the allegation. in 1993, a connecticut state attorney says probable cause exists to prosecute allen, but he decided not to initiate a prosecution. >> i believe dylan. i believe you, dylan. >> reporter: over the past several weeks a number of stars have voiced their support for dylan farrow. greta gerwig tells the new york times he s she regrets working allen. saying if i known then if i had known now, i would not have worked with him. i would have not acted in the film, i won't work with him again. two others, the star of the forthcoming film "a rainy day in new york" say they're donating their paycheck. the film reportedly could be a casualty for the controversy. amazon the distributor tells nbc news we haven't announced a release date for this filament.

actor alec baldwin who worked with allen three times defending him, comparing far trow a -- comparing farrow to a character in "to kill a mockingbird" who makes a false claim of rape. writing in a now deleted tweet, one of the most effective things dylan farrow has in her arsenal is the persistence of emotion like "mayella in" to kill a mockingbird "but i need more than that before i destroy someone." i need a lot more. baldwin declined further comment to us. he appears to have deleted his twitter account. in a statement to "today" overnight a spokesperson for allen did not address the allegation directly but instead said that allen's new film is not finished and that the distributors will plan the release once it's done. until then, savannah and hoda, the focus is on post production and not the release date itself. >> all right, kate, thank you very much. we'll switch gears, head over to mr. roker. you're talking about a super blue blood moon.

>> a lunar trifecta, ladies and gentlemen. what makes it a supermoon, the moon is at paragy closest to earth and then we have the second full moon in the calendar month. the first one was on january 1st. then the blood moon is during a total eclipse of the moon light from the earth's atmosphere gives it a reddish look. it should begin at 6:45 tomorrow morning and then in totality by 7:51. and then it starts to end at 9:07. we are looking at partial eclipse along the eastern third of the country. some totality for minneapolis and houston and what about sky conditions? well, poor viewing in the northwest. southwest, starry night, looks good. cloudy skies around upper mid west and the moon is going to be low on the horizon but still pretty cool.

the president now has five days to decide whether to release that memo. that dispute comes as deputy fbi director andrew mccabe announced he was stepping down earlier than expected. the reason, those close to him say an upcoming inspector general report is expected to sharply criticize the fbi's handling of the clinton e-mail probe and the other factor, fatigue, after the president has publicly and privately criticized him. this morning on "today," savannah asked press secretary sarah huckabee sanders about the president's apparent penchant for attacking law enforcement officials. >> if there's nothing to see here and he wants to cooperate why does he continually go after people who are connected to the investigation and just trying to do the investigation? i mean, doesn't it look like he has something to hide? >> some of those -- frankly, if some of these individuals were just trying to do the investigation they would have done it and it would have been wrapped up. time and time again, the only thing that's coming out of these in every single time after interviews and after reviewing records the only thing they come back to is that, no, we haven't found anything.

>> gastroenterologist. >> everybody. it was a mystery. and we thought, well, there are late bloomers. we decided to do a full genetic scan. the results came in last september while i was with u.s. troops in south korea when the convoy pulled over. so i called the doctor and he said, we found something and it's very, very severe. it's life long, not treatable. i was in a state of shock. i got back in this convoy like shaking. it was the worst day of my life. >> henry, with a serious genetic disorder. for boys, it's very rare and for now, untreatable. i called you and i said we have the result, and i said, it's not good. it's not just delay, it means life long, permanent, untreatable physical and intellectual impairment.

and you -- >> yeah, i just said no, no, no, no, no. >> unfortunately, the more we learned about it, the worse the news got. doctors have told us henry will likely never walk, talk, dress himself or have the mental capacity beyond a toddler. and that health problems are likely coming as well. >> kids with this mutation tend to have epilepsy or seizures of some kind. >> but he's generally quite happy. but it could be a darker road ahead. the doctors have said that it could get rigid. it's a corridor i don't want to go down. no matter what's coming, we want henry to know he's loved. he gives back what we put in and more. play has a purpose. we try to keep him moving,

hoping every tiny crawl makes his muscles stronger. good job, good job. every moment can help develop a skill. even lunch. to get him a little bit of that dexterity. he has physiotherapy daily, and hospital visits twice a week to stimulate his senses. >> basically, i'm his manager for that. and cheerleader. it gives me purpose. it's important. and i see it helping him. >> but this story may have a happy ending. for henry and many other children. because there is hope that henry holds the key to a treatment. a lot depends on the work being done by dr. hoda doingby at the duncan newt at the texas children's hospital. >> henry's mutation is unique in the world, but because it's unique is what makes it so valuable. sometimes when the rarest thing you can learn the most.

>> dr. zogby's lab has collected henry's cells. the goal is to find a way to boost a protein that is essential for brain function. >> so we're using henry's cells to monitor the level of the protein. >> reporter: dr. zogby said if she can boost the protein safety it would be a breakthrough for henry and many children. >> we know today there are hundreds of genes that can cause autism or intellectual disability or complex psychiatric disorders. using henry's cells to study rhett's syndrome, once successful it can be applied to any of those diseases. >> while we wait for scientific progress, we try to make henry's life as normal as possible. >> it's hard. sometimes i really have to get myself up. i don't want to see a 9-month-old -- it's easy to get lost in this. >> but there are also moments of joy and togetherness. it's made our relationship stronger, actually.

little bit before you came on here and mary, you're doing -- both of you are just pouring your whole hearts and everything into this boy. but it must have been hard to think about like coming out publicly and talking about it because it's so raw. >> it's painful and very personal. but we appreciate being able to do it. and hopefully like you said it's lonely. other people maybe will see this and feel less alone and we will too. you know, and what they're doing at the texas children's hospital is really amazing and it gives us hope. it gets us through every day. >> can we talk about that for a minute because i love in the piece, you said, but wait a minute, this story may have a happy ending. so what are you looking for, what are you hoping for? >> so his mutation is potentially one of a kind. the doctors said it's first one in existence. and while that's obviously very challenging and difficult for us and certainly for him, in that rarity there may be the key to his own treatment and a treatment to many others.

so what dr. zogby is trying to do is figure out a way to boost this protein that he doesn't have enough of. if she can figure out how to do that safely, it could be applied to a whole host of other genetic disorders so it could be at the end of the day he has a key to helping himself and potentially many others. but look, we have to get there first. they're working on the research. they're hard at work right now. that's what we're driving for. >> when you talk about henry, he is happy. a little smile. he's such a good boy. what you guys have been doing and the therapy, it's helping. >> it is helping. our milestones are not necessarily milestones. we call them inch stones. so he doesn't -- you know, it's slow, but there is progress. and he works really hard and we have fun. we make it fun. >> where do you guys -- lastly, where do you find your strength? i'm looking at two people and i know -- i can see how strong you are. where does it come from? >> from henry.

san jose leaders today may decide the fate of what )s become a controversial symbol downtown: good morning. it's 8:26. i'm marcus washington. leaders may decide the fate of what's to become of a controversial symbol. the chr christopher columbus statue inside city hall. recently, it's come under fire with some critics trying to -- or tying this to the spanish explorer, the deaths and oppression of native americans. opponents are calling for the statue to be removed entirely. but council members are talking about moving it perhaps to san jose's airport international terminal or the italian bank exhibit at history park. for your commute, mike says we're tying up some of those accidents. >> we're recovering. we're looking at the map and we see a smooth flow of traffic. the south bay does have a good view of traffic flowing.

we )re getting new information good morning. it's 8:56. i'm marcus washington. we're getting new information on that late-night shooting that led to a crash just off interstate 80 in the east bay. that car, which crashed not far from san pablo avenue off ramp in richmond. about an hour ago, chp confirmed with us that the driver was not shot on the freeway, confirming that the driver was shot before merging on to the freeway. the car crashed at the bottom of san pablo avenue exit. so far, there's no update on the
