vehicle that went off the track between hayward, south hayward, i should say, and union city that damaged the track, what we're told recently, and will demand repair work. trains are single tracking through that section. where is that? that's right here. union city, south hayward here. it's right through this stretch. now the folks heading to the dublin/plesbles dublin/bless pleasanton line. the delay will occur and right now b.a.r.t. says for the morning commute. we don't know how long that repair work will take or if the vehicle it still on the track. we have roadways moving well but they're getting more crowded as some folks from this area have to hit the roads and get car-pool buddies. consider that this morning. kari, you're tracking a nice cool start to the day. and no fog this morning

unlike yesterday. only a few light patches of it across the bay area, so that's good news. more people get out to drive this morning and we do have some cool temperatures. we may be setting record highs in a couple spots in the bay area. san jose, the forecast high temperature today is 72 degrees. but that's also our record. that's been set since 1982. in concord we may set a new record, forecast of 73. and our record is 70 in an arre san jose apartment complex. we have brand new video into our newsroom overnight - showing the scene. this happened at the willow creek apartment complex - near fruitdale avenue and southwest expressway. police say a man allegedly pointed a gun at a family inside the complex ... then fled into a unit. s-j-p-d says a 3-hour standoff followed ... ending

trump after the state of the union caught on a hot mike promising to release a classified memo. republicans wrote that memo. they claim it shows the fbi is biased against the president and used information democrats paid for to spy on the trump campaign aide. >> designed to distract and undermine the special counsel. >> reporter: the fbi calls the memo incomplete and misleading saying, quote, we have grave concerns about material omissions of fact that fundamentally impact the memo's accuracy. the top democrat on the house intelligence committee claimed republicans made material changes and what the white house is now reviewing is not what they approve. two sources tell nbc fbi director christopher wray and deputy attorney general rod rosenstein went to the white house monday to urge them not to release it. five more fbi officials followed up tuesday. >> it will be released pretty quick, i think, and the whole

i think a lot of folks perk up their ears when you say car-light. >> reporter: that's right. good morning to you, kris. el camino real a very busy intersection. not right now but when the morning commute picks up. the idea of the car-light project, the city hopes, will give more options when it comes to transportation. at least that's what the planning commission is considering in proposal. what is the project? as i mentioned, it wants to promote alternative modes of transportation by giving caltrain passes and bicycles for residents and car-pool services for those folks living in this proposed unit. they'll try to provide monthly stipend up to $100 for services like uber and lyft and trying to appeal to the missing middle. those workers who make too much to qualify for below market rate housing but are affluent enough to afford market rate housing. this is in line with folks in palo alto in a recent survey for

many candidates for san e francisco mayor wereig pepperedn with questions about the elect homeless issue and also rising rent.e five of the eight candidates in the upcoming special election a spoke at the town square including former interim mayor london breed.them p they have been paying closer attention to their local races. >> considering what's going on in the world, i think we all have to show up as much as possible and come to these kinds of forums and do our job as citizens and vote. >> the special election to replace the late mayor ed lee is in june. more details now, we know how much money the memorial candidates wracked up so far. money. supervisor jane kim reports about $100,000. former supervisor angela alioto says she has about $66,000. the recent mauling death of four miniature horses at the zoo is raising new questions about security there. a pack of dogs attacked the horses and a donkey in two separate incidents. the zoo only announced the maulings this week. the dogs have been captured. according to "the mercury news" only one guard has patrolled the park. 5:08. a man accused of impersonating a police officer and sexually assaulting a woman is behind bars. police believe he may have other victims. his name is stanley friesen. authorities arrested him in tracy. the alleged crime, though, happened in milpitas. police say he met a woman at the bay month inn for what she thought was a date. they say it quickly turned into

something sinister. >> the gentleman said he was a police officer. he produced a badge and had a firearm, fearing for her safety and thinking she might get arrested agreed to go along with the sexual act. >> afterward the woman called police because she thought he might be a police impersonator. social media played a big role in this brief relationship. they met through a dating app. his text with the victim eventually led to his arrest. the search is on for the driver of a jeep cherokee police say hit an officer and kept going. that officer initially tried to pull that driver over yesterday morning. instead that driver ran into the officer and then got away. that officer is expected to be okay. a computer program designed to track the conduct of oakland's police officers is apparently not yet working as planned. more than a decade ago the department first agreed to create a computer program designed to track things like police pursuits and how often

officers use their guns. a court appointed monitor recently told a judge the $6 million program so far is plagued by bugs and data collection errors. and it's also coming in way over budget. the judge scheduled another hearing for tomorrow. happening today, we will find out how much progress we've made in the sierra snowpack. the department of water resources will conduct its second snow survey of the season. this is the first survey taken on january 3rd and it shows virtually, as you see right there, no snow. today's survey is expected to have better results. kari, certainly hoping so. a lot of people want to have some fun. >> unfortunately, there's no more snow in the forecast for a while. we'll be watching that as we look at what's happening in san francisco this morning. mostly clear skies and a cool start. as we look at our high temperatures for today in san jose, we'll be up to 72 degrees. 70 in milpitas. for the east bay, 73 degrees in walnut creek.

oakland, 67 degrees and 66 today in half moon bay. san francisco, upper 60s. and the north bay today, some low 70s. mike, what's happening out there on the roads? >> the roads and the rails. the roads are moving well. you see the green sensors, no problem. that red over here with my name means there's something that's not good going. that means there's an issue for the b.a.r.t. system. track damage, maintenance. that does cause a problem between union city and hayward. fortunately there's only one line, fremont and warm springs line. that is the one affected right now. the dublin/pleasanton line is not delayed but you will have a problem traveling in towards san francisco and the richmond line. meanwhile, roadways are moving well, catch the trains north of there. look at the roadways to the bay bridge are not an issue but a backup forming in the cash lanes. we'll check fastrak next.

caught. that man walking off with luggage last wednesday that included that unicycle. investigators say he set up right next to the luggage conveyor belt and walked off with the bags. behind the red panda acrobat. it has just landed on a flight from denver. the neighbors say she's back on the road with a borrowed unicycle but wants her regular one back. >> i can't imagine it has resale value. it has personal and professional value. >> come on, give her the unicycle back. >> teams around the nation are doing their part to get the word out about the missing unicycle. one school is even offering a $2,000 reward. >> wow. it's 5:16.

matter activists to face off in houston. both sides thought the other side started it but really it was the russians who started it. facebook says people are spending less time on the platform as well and it's okay with that. facebook campus here. facebook says it's trying to make the experience better. fewer viral videos, more baby pictures. that's causing people to spend less time on the site. facebook has tried to get rid of some of the news articles and that's affecting us as well. it's trying to get back to its basics. >> we do like the baby pictures. thank you. jimmy fallon thinks he knows who is going to win the super bowl. the annual puppy prediction relies on which food a majority of the dogs pick. this year they predict, let's see, let them out. well, they're going to predict that the patriots win. fallon has been doing this bit since 2013. we went back through overnight to see how accurate this has

oakland. 52 in san francisco. the seven-day forecast is up at the bottom of the screen and a lot of 70s there and, yes, this is february 1st, and we are talking about 70-degree temperatures along the coast. also along the north bay and for those inland valleys reaching into the low 70s, san jose, 72 degrees which is our record high temperature for today. if you will be able to relax and go to the beach today, half moon bay will see those highs up to -- we're starting out at 50 degrees and then seeing the highs in the upper 60s and even 70 degrees. we've seen some clouds starting to move in but no rain with those clouds. we'll have a partly cloudy day. an area of high pressure that causes the air to sink will bring in more dry weather and a lot of clear skies over the next several days as our temperatures once again warm up into the upper 60s and low 70s and for the inland areas expect highs in the mid-70s by the end of the

weekend. we will have a lot more sunshine and dry weather in the rest of the forecast with some cool mornings and warm afternoons. we still don't have any rain. mike, you're still saying b.a.r.t. is the biggest issue. >> it's the biggest red flag. behind me is the red flag. major delays on the warm springs line. early morning track damage. we've been tracking this with overnight maintenance, one of the vehicles derailed over there between union city and south hayward and that damaged the tracks. the only set of tracks available south of 238 and heading over between 92 and 84. vta up to ac transit will take you north past that incident and you can jump on b.a.r.t. north of that portion here. now look at the roadways. they're all relatively smooth and we show a nice drive.

that's the good news. we'll take that shot again that you showed at the top. i'll explain it to folks. you see tesla, that's where the factory is. behind them that's that warm spring station. folks are waiting here. they're also waiting further north over at the fremont station where our own bob redell is joining us. what do you have out there? >> reporter: b.a.r.t. is telling commuters to expect major delays on the warm springs line here in the east bay. we're at the fremont station. this is because you can hear right now they're putting an announcement overhead. this is because this morning around 3:20 they had a maintenance pickup trucks on the line doing some maintenance work when it derailed. this is near the south hayward station. it damaged the third line. they have to repair that. that line is shut down between south hayward and union city and as a result they're going to have to single track people heading into san francisco, heading from fremont, warm springs, up into the city and

families of the other students lost and their friends here at liberty high school. we can tell you, and this is according to the east bay times, this was the fourth death here this year and also the school district has taken measures to sanitize the school. we don't know if the latest was from the flu but it was illness related. 97 people have died so far in california. we go through the california department of public health data this morning, a very steep incline in flu related deaths in california. not only california but across the nation. 23 deaths just in the last week here in the state according to the last weekly report that came out. the state designating this as a widespread outbreak. here is what you really need to know as it is a bad one.

this also from the public health department here from an audio cast, a press briefing, children under 5 are at the greatest risk but especially older people and anyone with respiratory or heart problems. state medical professionals also said at the same time to not share silverware or drinking vessels with anyone especially if you know the other person is sick. keep your hands clean and away from your hands and eyes and do not go to school or back to work for at least 24 hours after your fever passes if you do get the flu. the cdc says it will get results back from testing to see just how effective the flu vaccination has been this year. also the flu season lasts until may so it is not too late to get vaccinated.

we have reached out to the school district and hope to hear more from them about their response for this flu season. thom jensen, "today in the bay." >> such a tough time for teenagers. already life is so stressful. thank you very much, thom. a mural painted by actor james franco is no longer up at his alma mater. it is erasing contributions following allegations of sexual misconduct. the principal ordered the mural to be painted over this week. we talked with franco's former journalism teacher there. >> i support the principal. she had to take down the mural because she was responding to the community which is important but i think he has not been given an opportunity to defend himself. >> we did try to reach the principal for comment but we haven't heard back. happening now, right now, police say in the south bay they're looking for more victims this morning.

a popular soccer coach is accused of sexual assault. the morgan hill police say this man sexually assaulted a minor he met while coaching. he coached at oak grove, live oak high school in morgan hill and south valley junior high in gilroy and worked as a lyft driver. they say it happened at a home in morgan hill. happening today uc students and members of the largest uc workers union are planning several different rallies. they are protesting pay inequality. one rally is set for the campus. the other set for berkeley. we did reach out for comment. when they respond we'll let you know. 5:37. fremont's new emergency alert system goes online. we first told you about this last week. other cities already use the system. it allows police and fire departments to send target alerts to land lines, cell

phones, and e-mail addresses. the big benefit to this is people who send the alerts can do it from a single interface. good news for people traveling, mike. >> we're not going to send that alert for this but it does affect fremont as well. this is the warm springs line from b.a.r.t. and that's where really the focus of the morning commute is as far as delays. major delay for the warm springs line. bob redell reported folks between warm springs heading up to or from south hayward station or union city will be delayed. single tracking between union city and south hayward because of damage done on the track over here we don't see any problems on the roads. that's where the track damage is and where they're single tracking between union city and south hayward. we'll continue to follow this and the backup at the bay bridge which has been slow to fill in for the cash lanes.

a lot of commuters may be looking forward to the weekend. >> not only b.a.r.t. riders but everybody at this point. we know it's super bowl weekend. there are a lot of parties going on. and you'll be able to have your party outside, maybe an outdoor projector or something. a look at your saturday forecast. we'll be in the upper 60s. a lot of sunshine. 70 degrees by the bay. and on saturday inland, 74 degrees. that's like today's weather. it continues over the next several days and sunday's forecast also looks beautiful with some upper 60s for the coast and low 70s for the interior valleys. if you're going to be kicking off your weekend celebrating in oakland for the lunar new year festival happening at the asian cultural center in the upper 50s during the morning but look at how much those temperatures warm up for the day into the low 70s. and it's going to be nice and comfortable. also very nice in santa cruz with some low 70s and mostly

happening today state marijuana leaders will clear some of the haze surrounding recreational marijuana rules and regulations in california. the new california bureau of cannabis patrol is hosting a workshop today in oakland. it's one of our local workshops now. it will help people make sense, new licensing requirements, representatives of the state department of health, the food and agriculture department and the tax department along with local agencies will be there to answer questions as well. today's meeting is from 10:00 a.m. to 1:00 at the oakland marriott city center on broadway. for more information go to the bureau of cannabis patrol at nbc bay area, of course. and i have more details now. i've been working with that bureau to get licensing numbers for the bay area. here they are for santa clara county. there are seven licensed retailers for san jose. this is recreational.

none in campbell, cupertino, milpitas, santa clara, north sunnyvale, and there are no license delivery services for reb recreational pot. 5:46 right now. this morning leaders at covered california say they will work through friday to help people make insurance selections for 2018. the deadline was yesterday, wednesday. "the sacramento bee" reports thousands of californians who started applications before the deadline will be able to complete them. the leaders hope people will stop waiting until the last minute to get this done. 36 hours. it was 36 hours ago that president trump was calling for americans to come together. >> scott mcgrew, that changed this morning. this morning. i want to take you way back in history to tuesday when the president delivered his state of the union address. i'm reading right from his script. tonight i'm extending an open

hand to work with members of both parties, democrats and republicans. but this morning he tweeted, march 5th is rapidly approaching and the democrats are doing nothing about daca. they resist, they blame, they complain, they object struck and they do nothing. later the president would then tweet he got the best ratings of any president for a state of the union speech ever. we have to talk about that memo, right, the one devin nunez wrote. the white house got a copy. the white house wants the thing released. from what we hear this memo accuses the fbi of underhanded techniques while investigating one of the men on trump's campaign, carter page, and his relationship to russia. nunez's counterpart adam schiff says the memo nunez wrote and the memo he sent to the white house for approval are not the same memo. the white house didn't see the real deal. political pundits say that memo will help the president convince

at most bay area theaters. it's inspired by the san jose home owned by heiress sarah winchester. as you probably know being a native, she designed the mansion to keep evil spirits away after her husband and son die. some of the scenes were actually filmed here in san jose. >> it's going to be a nice one to get out and see. >> never built a home theater. they have to build one and show that movie there. >> that would be so much fun. certainly the weather is not going to keep anyone away. oh, no. it's going to be a great weekend. you can't blame the weather for not doing anything this weekend. we're going to have an awesome one, but it does start out cool. and i am talking about the potential of setting some new records today. as we get a look at san francisco, let's get a look at our highs and what our record is. 72 degrees in 1982. concord may set a record.

the forecast is 72. the record is 70 degrees. 2005 was a very hot year on this date. but san francisco, oakland, santa rosa will be very close. i don't think today we will set a record high. so as you're getting dressed this morning, it's a cool start. later on today you'll be able to wear some short sleeves and your nice shoes without having to worry about them getting wet or anything like that. our morning commute in the south bay starts out cool 47 degrees at 7:00. but quickly warming temperatures through the day. you'll be able to open up the windows and let in some of the fresh air and, unfortunately, as you get a look at the seven-day forecast, no rain because of high pressure blocking those storm systems from moving into the bay area. so it looks like as we go through even the middle of next week in the mid to upper 60s for san francisco and some mid-70s for the inland areas. as we head over to mike you were saying the roads are looking great.

>> our sky ranger in either the maintenance vehicle because this is the area between south hayward and union city where the track is damaged. this is why b.a.r.t. trains cannot run on both tracks for the area. the single tracking and that track damage will have to be repaired. if this is a vehicle that did the damage as it became derailed and it looks like it did, they're going to have to clear the vehicle as well. let's look at the map and show you where this is. the commute for drivers, great. no problem. the problem for b.a.r.t. is for the warm springs line heading to or from that union city station in south hayward, along the stretch. that's where the track damage is. we're seeing more folks on the roadway but driving is still an option. if you go north of there, on the dublin/pleasanton line are not affected. we'll take one live shot here. the oakland station where i have seen trains come in and out right on time, no problem.

she joins us now. she reported inappropriate behavior three years before he allegedly molested another student. >> reporter: leslie says the alleged abuse didn't have to happen because her parents warned the school about the teacher. he shoud her with affection, kisses, gifts. she told her parents and they reported it to the school. school leaders failed to investigate and allowed the teacher to stay. another student we're identifying as jane doe says three years later that same teacher sexually abused her on an overnight school trip. >> not only complicit but 100% responsible for the abuse. >> reporter: presentation high leaders say no one recalls the letter from leslie's parents and that they regret any graduate of presentation felt unsafe because of anything they perceived the
