the fallout from the controversial memo exposing fbi surveillance practices in the russia investigation. many republicans say it shows bias. democrats calling the memo a sham and outrage. we have nbc's correspondent kelly o'donnell near the president's home in florida. >> reporter: now the memo is out, the battle of shaping the view of the fbi and the president. republicans have evidence of law enforcement bias. democrats counter the information is unfair and incomplete. the big unknown, will the president take any action. new promises this weekend that top justice department official rod rosenstein will not hear the president say you're fired. three white house officials tell nbc news there have been no considerations or discussions about removing rosenstein who oversees special counsel robert mueller's russia probe. president trump was not so

clear. >> do you have confidence? >> you figure that one out. >> reporter: rosenstein is among the senior justice department and fbi officials named in the controversial memo declassified by the president friday. >> a lot of people should be ashamed of themselves and worse than that. >> reporter: written by house intelligence committee, republicans allege the officials abuse power to obtain secret surveillance of a campaign aide carter page, of they suspect of being a russian spy. gop lawmakers say officials used evidence, the dossier. >> they took the dossier and dressed it up like legit intelligence. not telling the court it was paid for by the clinton campaign. >> reporter: the court approved continued surveillance because the spying produced legitimate information. nbc news learned that four judges on separate occasions reviewed requests before

approving additional snooping. reaction was viseral. john mccain labelled it an attack on the fbi that served putin's interests. fired fbi director james comey said that's it? calling it dishonest and misleading. trump's fbi director chris wray saying it was of grave concern and delivered a message of encouragement to fbi employees. talk is cheap. the work you do is what will endure. i'm determined to defend integrity and professionalism every day. democrats accuse the president and allies of cherry picking information in a bid to undercut the special counsel. >> this is a charade. >> reporter: speaking out for the first time is devin nunes, the house chairman, denying coordination with the white house. >> how about with trump's lawyers? >> no. >> reporter: democrats want their own summary released

publicly. nunes blocked that this week, but says it is still possible. >> hard to say. i don't know yet. i have only read through it once. we have to go through and scrub it again. >> reporter: the white house says it is willing to work with the committee to declassify the memo written by democrats. that will take time meaning republicans get a big head start telling their narrative of what happened. the committee is also prepared to move on to what they call phase two investigating the state department and any role it may have played in the russia investigation. sheinelle. >> kelly, thank you. matthew miller was the spokesperson for the judgstice department from 2011 and 2015. gentlemen, good morning. >> good morning. >> matt, let's start with you. republican house members say this is proof of bias in the upper ranks of the fbi. does this memo prove that and if not, what does this memo tell

you? >> it doesn't prove that. the case that republicans clearly want to make with this memo is that the investigation started under a cloud. the surveillance started under a cloud. the court was not aware of the bias. the memo by omits the key facts doesn't prove the case. it does state that the investigation started with bias and into the investigation of carter page, but the investigation actually started months earlier when the fbi found evidence from intelligence sources overseas that george papadopoulos was collaborating with russian officials in a way that brought him and brought the campaign under suspicion. i don't think that is what the republicans were trying to prove. i think the big question going forward is what does this mean for the mueller investigation? from the substantive point of view, i don't think it means much. from the political point of view, does this give the president the political space to move on mueller and rosenstein

in the way he wants. >> matt, quickly. another piece as kelly mentioned. the gop memo was released over the objections of the fbi. we are learning a top fbi agent is resigning over what he says are relentless attacks on the bureau. how damaging is the memo in the law enforcement and intelligence community? >> it is damaging to the morale to see the president overrule the fbi director when the fbi director said the memo would be damaging. two, it is damaging to the effectiveness of law enforcement who will have people all over the country that don't trust law enforcement is doing work free of political bias. three, it is damaging to the willingness of intelligence sources to cooperate with u.s. officials and law enforcement. if you are a foreign service agent or are whistleblower and you are looking to come forward and look at the treatment of

ste steele, it would give you pause. >> the prevailing thought in washington is the memo is created to give the president cover to remove deputy attorney general rod rosenstein who oversees the russian investigation. or possibly robert mueller. did the memo provide that cover? >> i don't know that the memo will provide enough evidence or cover for the president to actually fire mueller which we know from reporting he has been wanting to do for some time or fire the deputy attorney general who he wants to see removed. there is no question the memo was politically motivated. it is something the president has been aware of and encouraging of. the president wanted the memo released before he read it. >> finally, phil, democrats calling on devin nunes to step down from the chairmanship. ryan dismissed those calls says the democrats are playing politics.

the nfc be an underdog at home for both the playoff games and win those, especially the afc championship game, in fashion. now they are coming into the game with the same underdog mentality. that can carry you a long way. >> if you are a betting man, which you are not, who would you bet on? >> i'm not making predictions. if there is a way neither team could win, i'm still angry about not getting in. so i wouldn't want either of them to win. no, you know, i think new new england probably has an advantage just from the standpoint of they're experienced. these guys have been in the game and understand the process by which you get to this point. the start of this game is always interesting. it seems like it's a heavyweight fight where both sides are kind of feeling each other out. >> sure. >> and so i think the team that can start fast certainly has an advantage. >> we just heard from justin timberlake in the spot saying

his kid will never play football. i know your kids play flag football. do you have reservations about tackle football when they're old enough? >> when they are old enough, i think it is fine if that is what they want to do. i will not push them toward that. i want them to be their own men. i think there is an appropriate age when you look at studies and brain development and which stage it is appropriate. i think it is middle school. you know, that's every parents' preference. i love the game of football. i think it teaches so many great life lessons. it's america's gait game for that reason. and i'm still playing it. i've been playing it my whole life. it was my childhood dream. i love the game of football, but i do think there's an appropriate age before you put pads on a kid. >> thanks for stopping by. 39 years old. how many more seasons have you got? >> we'll take it one at a time.

we're going to see temperatures across the entire bay area. look at the temperatures we're waking up to this morning. 40s, 50s and even 60s on the map. livermore already at 60 degrees, and it's not even 6:00 a.m. hayward now, 50 degrees and san jose 54. and half moon bay. the temperature trend into the afternoon, you can see how quickly we're expecting to warm up, reaching the 70s by 1:00. you're also going to notice we've got a pretty high humidity out there. so it is going to be sunny, but also humid along the coastline, as well. and, yes, that temperature trend in palo alto also looking equally beautiful by 1:00, also in the 70s. i'll talk about when we can expect to see rain, if any, coming up at 7:00 a.m. >> that's a tease. i'm just enjoying the sunshine while we have it.

thanks. we have a paid surveillance video that is over when police officers can fire guns. you may find this video disturbing. but everyone did survive. here, two men are breaking into a car, parked asan francisco. undercover officers recognized the car as being part of other auto burglaries. as the thieves try to get away, an officer tackles one of them. the driver of the get-away car there backs over his friend and the officer. other officers draw their guns, order the driver to stop, but he backs over the pair again, and speeds away. police eventually arrested all three suspects for attempted homicide. but no shots were fired. >> the officers did show great restraint in not having that type of force, even though this is a very deadly situation. >> while the police department called it restraint, the police officers association calls the use of force policy dangerous, and is demanding change, saying in a statement, quote, it is

surveillance video renewing the debate over when police officers can fire their guns. you may find this video disturbing, but everyone did survive. here two men are breaking into a car, parked along alamo square park in san francisco, undercover officers recognized the get away car as being connected to other auto thefts. as thieves try to get away, an officer tackles one of them, and the driver backs over his friend and the officer. officers draw their guns, order the driver to stop, but instead he backs over the pair again and speeds away. police eventually arrested all three suspects for attempted homicide, but no shots were fired. >> the officers did show great restraint in not having that type of force, even though this is a very deadly situation. >> well, while the police department calls it restraint, the police officers association calls the fspd's use of force policy dangerous, and is demanding change, saying in a statement, quote, it is outrageous that the policy

>> so tomorrow before the game there is that f-16 flyover during the national anthem. yesterday i had the honor and privilege to ride along with my friends from the air force as they practiced. for this mission, this mild-mannered correspondent had to change. into someone right out of "top gun." i got paired up with the f-16 viper demo team who show off their skills in air shows all across the country. first, i had to gear up. >> this is going to wrap around your waist. we put on the g-suit which looks like a girdle for your legs. it's specifically designed to manage blood flow when flying at extreme speed so, you don't pass out. then the parachute harness, helmet, mask and my very own name tag. oh, yeah. next, some training notes and briefing from the pilot, major john waters.
