the third since a crash in washington state last december. nbc's jennifer johnson gives us more details. >> reporter: a horrific scene near cayce, south carolina. the mangled wreckage of amtrak train 91 and a csx freight train. the trains collided just after 2:30 a.m. when most passengers were asleep, killing engineer michael kempf and the conductor. >> threw us across the room like you would not believe. >> reporter: sources tell nbc news that just before the crash all csx signals were off line. csx gave verbal approval for the amtrak to proceed down a set of tracks, but the track switch was in the wrong position, sending the amtrak directly into the parked freight train. >> key to this investigation is learning why that switch was lined that way. the expectation, of course, is that the amtrak would be cleared and would be operating straight down like this. >> reporter: most of the 139

passengers traveling from new york to florida were taken to hospitals. most with nonthreatening injuries. >> we should have had a lot more casualties, but we didn't. >> reporter: emergency workers say removing so many injured was a monumental task. >> we were able to get all 116 patients to the local hospital in a very timely manner. >> reporter: this is the second amtrak crash in less than a week. on wednesday a train carrying dozens of republican members of congress heading to a retreat in west virginia hit a truck, killing the truck's passenger. jennifer johnson, nbc news, washington. to washington now where gop intel chairman nunes' memo over on the russia investigation continues to make waves. former cia director john brennan is accusing nunes of overstepping his own position. and abusing his own pour. >> it really underscores how party san mr. nunes has been. he has abused the office of the chairmanship. i don't say that lightly. over the past year he has

demonstrated he's engaged in these tactics purely to defend and try to make -- >> brought up any legitimate issue? >> he put out publicly one side in a cherrypicked memo. >> brennan's tough words as republicans cheer on the memo's release arguing the proves the special counsel's investigation into russian election meddling cannot be trusted. >> there is a little sweet revenge in it for me and probably the family in the sense that if they wouldn't have done this, this stuff would be going on. this would be going on at the highest levels of government. they would be continuing to do it to my father, trying to undermine his actions. imagine how it effective he can be given the year he's had without this cloud over his head. i want them to come to a conclusion already. you've been looking for two years, come up with nothing, other than their own nefarious actions and their own collusions. >> the president echoed those comments tweeting this memo totally vindicates trump in probe but the russian witch hunt

goes on and on. no collusion and no obstruction. still those republicans who say otherwise. here was congressman trey gowdy who had a hand in writing that gop memo. >> i actually don't think it has any impact on the russia probe for this reason. >> the memo has no impact on the russia probe? >> not to me it doesn't. i was pretty integrally involved in the drafting of it. >> this comes as democrats push congress and the president to accept their own competing memo, demanding it be released to the public as they accuse republicans of waging an opposition campaign against a russia investigation and the fbi. and we're learning new details regarding carter pain. republicans allege the fbi ob stained a fisa warrant to track mr. page using the uncorroborated and controversial steele dossier, however now we're learning through "the wall street journal" that carter page was on the radar of u.s. counterintelligence since at least 2013. and now there's this, "time" magazine reports it has obtained a letter from august of 2013 in

which page apparently touted being an informal adviser to the kremlin. times says page writes, over the past half year i've had the privilege to serve as an informal adviser to the staff of the kremlin in preparation for their presidency at the g-20 summit next month where energy issues will be a prominent point on the agenda. carter page is not charged with any crime and denies any wrongdoing. for all the noise the memo has created devin nunes says there is more to come. >> this completes just the fisa abuse portion of our investigation. we are in the middle of what i call phase two of our investigation, which involves other departments, specifically the state department and some of the involvement that they had in this. >> also out of washington today, incoming federal reserve chairman jerome powell will be sworn in taking the reigns from janet yellen who departs her position. yellen is revealing how she really feels about her single

term at the helm of the fed. >> it has common for people to be reappointed by presidents of the opposite party. i made clear i would be willing to serve another term, and so, yes, i do feel a sense of disappointment. now to the tsa, found a record 3,957 guns in carry-on bags at airport checkpoints last year. well that's nearly 17% increase in the previous year. the weapons found, 84% were loaded and confiscated at more than half of 440 airports across the country. hartsfield jackson atlanta national airport was the top offender with 245 weapons. one aviation security expert says many of the top ten offenders are in states where concealed carry is common. the tsa could impose penalties up to over $13,000 for each weapon found. let's get a check of our monday forecast and how we're doing throughout the week. here's nbc meteorologist bill karins. >> good morning, francis.

over the weekend we had a lot more rain in the pacific northwest. still dealing with problems on a few of the risk es and finally that storm system has moved out of the region and now mostly drying out. few showers. now we're watching the snow over montana into the northern plains and still have the winter storm warnings for northern portions of montana and a few spots in wyoming and some of the snow later today pushing into iowa and towards chicago. not a huge ordeal. mostly about 1 to 3 inches, especially in iowa. for today's forecast, still kind of cloudy in the pacific northwest, 49 degrees and in l.a., also to phoenix, we continue with our warm weather and dry weather and no end in sight to that, talk about warm, temperatures continue to be well above average in many areas of the

morning? >> hi, good monday. wall street could see more red arrows at the open following friday's massive sell-off. both asia and european markets are down today. the dow suffered its worst point drop friday since the uk's brexit vote in 2016 and sixth worst ever, behind the sell-off, friday better than expected jobs report pushed up bond prices, the yield on the ten-year treasury note hit a four-year high and investors jitsry about interest rates worried they may be rising too fast. nbc says a technical malfunction the cause of a noticeable blackout. it went to black for about 30 seconds at the start of the commercial break. ads went for $5 million, but nbc says the glitch didn't cost anything suggesting that it intended to air a promo for a show or for the olympics. and some iphone x owners discovered an unusual bug in their device preventing them from doing the most basic task, answering phone calls.

when the sale of marijuana became legal at the start of the year there was something else in the law that didn't much attention. it allowed people convicted of nonviolent marijuana crimes to apply to have their records wiped clean. authorities in san francisco and san diego are doing that automatically. nbc nbc's matt bradley has more. >> a lot of atwork. >> reporter: for the gallery owner rodney hampton, marijuana legalization means personal vindication. in 1991, rodney spent just 22 hours in jail for selling weed. a misdemeanor mistake that's haunted him for decades. >> it's horrific and now i'm able to change it, it's even better. >> reporter: now rodney's record and thousands of others in the
