really warm temperatures and still no rain in today's forecast. so as we head out the door no need for the umbrella, just the sunglasses. we are seeing some all clear skies right now in san jose, throughout the day we will go from 50 degrees to 75 degrees at 4:00 today. we will talk some more about those numbers coming up, but, mike, you are looking at the approach to the bay bridge. >> i was watching some flashing lights. there are a couple of sets of lights remaining. they are over off to the shoulder. this is 580 and 80 merge over toward the bay bridge toll plaza. the approach that's what was going on, but never slowing showing up here on on our speed sensors for our maps. coming off the of the berkeley curve and heading over toward the bay bridge, that's the one. there's the bay bridge backup, the metering lights not yet on, but you saw the backup for the cash lanes. we will check on that in a few minutes. eastbound getting out of the city there is a disabled vehicle reported coming down toward treasure island. we will check on that status once the bridge crew arrives, the rest of the bay an easy

light drive. developing story in the south bay. this morning we're finding out even more information on a wild chain of events in san jose that ended with the shooting of a woman. this all came to an end in west san jose just one mile away from downtown campbell. >> "today in the bay's" pete suratos joins us live where it all happened. pete, do we know how it all started? >> reporter: good morning, what we're learning this morning is that it was apparently a frantic sequence of events that led to that shooting but it happened in this area near eden avenue and d cadillac drive in san jose. san jose police are still looking for a shooter at this time. let's take you back to when this all happened. let's show you scene video from saturday night. these new details we are getting are according to the san jose mercury news, they're saying there was that sequence of events leading up to the shooting and there was a female victim driving with a male passenger and the two of them were apparently being chased by a motorist. that female victim eventually crashes into a tree and moments later a person walks up to that

fire wreck and fires several shots into the car. there was that male passenger in there, like i mentioned, that person was able to run away and that shooter fired shots at him as well. he was not hit, but he later spoke with police about this incident and helping them with that investigation. but the female victim had at least one gunshot wound and san jose police tell the paper she is on life support recovering from those injuries. police have not released any information on a possible motive or a description of the suspect. we're hoping to get more information from police at some point this morning, but it is a residential neighborhood that we're talking about where this shooting took place. of course, if you have any information to help out with this investigation, contact san jose police. we're live in san jose, pete suratos, for today in the bay. at 5:02, happening this morning, caltrans crews will reportedly lead a sweep of homeless people, this is in an area underneath connecting freeways in the south bay. the mercury news reports this morning a relatively recent tent city is growing near phillip

avenue in san jose. nearly 100 people may be living in tents underneath the tarps. homeless advocates promise to protest today's sweep. it is 5:03. new this morning san francisco has reportedly reached a legal settlement with a firefighter whose identity was leaked in connection with the death in the 2013 asiana airlines crash. a live look at sfo where the crash happened. examiner reports attorneys for the firefighter argued one teenage crash victim died after being struck by two emergency vehicles responding to the crash. that girl had been ejected from the plane and was covered in firefighting foam. since then investigators have concluded the girl was likely already dead, but the suit accused the fire department of scapegoating and retaliation in leaking the name of one of the vehicle drivers. the city has tentatively agreed to settle that case for $250,000, citing the uncertainty in proceeding with litigation.

developing this morning, investigators are zeroing in on the cause of yesterday's deadly train crash when an amtrak collided with a freight train in south carolina. they now believe a locked track switch diverted the amtrak on to the sidetrack where that freight train was parked. the engineer and conductor both died. more than 100 passengers were injured. some of those passengers later talked about the crash after taking buses to their destination in florida. >> woke up to a real loud boom at about 3:00 a.m. and i just returned to the bathroom and just curled up to go back to sleep and next thing you know i was bouncing off chairs and chairs were flying, cell phones, laptops. >> investigators still don't know why the track switch was locked. they plan to be back at the scene this morning. more details now, overnight we looked closer into recent rail-related deaths, the ntsb says last year there were 173 fatalities involving people on board trains, that included

freight passengers and commuter rail lines. as the recent amtrak-related deaths one person died last week when a charter train crashed into a garbage truck in virginia. three people died in december when an amtrak derailed outside of tacoma, washington. a live look at capitol hill 6c expecting another busy day in washington, d.c. expect to hear the word memo a lot again today. friday republicans released that memo alleging the fbi abusing its authority and playing politics. democrats say that's not true at all. democrats have their own memo on the russia investigation. today they will push for a vote to release the memo which they say paints a more accurate picture of why the fbi was monitoring a trump campaign aide. >> it's a point by point refutation of the basically propaganda talking points in the republican memo. >> this may not be the end of memos from the house intelligence committee. the republican chairman says he

has more information to release, including a look at how the state department may have been involved. 5:05. looking live in philadelphia this morning where it's possible some fans are still celebrating the city's first super bowl title ever. in true philly fashion some people got rowdy in the streets overnight. a group of fans came crashing down when an awning collapsed at the ritz carol ton. no serious injuries here. the other fans were caught on camera burning tom brady's jersey, some just hugged. >> what are you feeling right now, man? >> i can't believe it. >> yeah, the love. >> city of brotherly love. finally. it's a dream come true. >> you saw that, brotherly love. the love there. officials say that most fans remained peaceful but still others climbed on to the top of light poles and vehicles, some fans even toppled traffic lights in celebration. well, the celebrations come after the eagles won their first

keep students off of their mobile devices without actually taking them away. "today in the bay's" bob redell is live outside of san lorenzo high school with this innovative approach. good morning, bob. >> reporter: good morning. san lorenzo high still allows their students to bring their smart phones to campus, even allows them to keep them on their person throughout their classes with one caveat, at the start of every day at 8:00 they must insert their cells into these green pouches and shut them until around 310 nick in the afternoon, that's one the school unlocks the pouches. a san francisco company called yonder created the pouches specifically to curb cellphone use. the principal says ever since her 1,400 students art started yondering up she has seen the number of students sent to her

office for classroom disruptions decreased by 50%. teachers are spending less time dealing with cellphone distractions and in the classroom and you can see the students are actually more social in spite of the social media lockdown. >> transformative. it is absolutely changed our entire school climate and culture. students talk to me in the halls now, they have to talk to each other. a substitute teacher noticed better posture because they are not looking down at their phones in the hallways during class. >> people won't interact with each other. >> i have a lot of class time back. we go through every assignment way faster than we did in previous years. things i have done for years now take 10, 15 minutes fewer to complete the assignment. >> our grades have been getting better, significantly changed. to a's and b's, used to be c's and d's and stuff like that. i'm never worried about it now. >> magical.

the dow plunged a beastly amount on friday, the nasdaq fell 144. embattled bank wells fargo will dismiss four board members. the san francisco bank has had problem after problem. the biggest is that account scandal where tellers signed up more than a million customers for accounts they didn't want and in many cases didn't even know they had. the fed has also restricted the way wells fargo can loan money. this is in many ways the harshest punishment we've seen against wells fargo so far. that became mow uber trial gets under way today. a recall for engineer is accused of taking the automated cars secrets with him over to you be autoer. became mow is the google owned car company, has had great success in automated cars and uber is trying to catch up. elon musk says his company spacex will launch the falcon heavy rocket tomorrow morning. it's three falcon rockets

we know it's early february and we should be seeing temperatures around 60 degrees. we're well above that. we will talk more about that in a few minutes and look ahead to the weekend. mike has an update on what's happening on the dumbarton bridge. >> westbound 84, the dumbarton bridge, an 18 minute drive time, went from yellow to orange, we just got a slower read on the average speeds across towards the peninsula, towards the facebook side. that is because of a disabled vehicle. apparently a crew didn't get out there. they said most of the activity now pushed off of the roadway on to one of the express ways, probably bay front expressway over towards facebook adding more congestion on the peninsula side. we should see a better speed across highway 84, 92 picks up the volume as does the rest of the bay. over toward the bay bridge we do have the backup and the metering lights, you would expect that as well. it's 5:32. happening today, it is a hotly contested issue at school districts across the bay area. one that could change your morning routine. tonight south bay students will

weigh in on school start times. "today in the bay's" kris sanchez joins us live in san jose with what's being debated. good morning, kris. >> reporter: good morning. this is a conversation that a lot of families have with their teenagers whether or not they got enough sleep. some teenagers here at the san jose union tied school district will make their case tonight for a later start to the school day so that they can get more rest. now, those students will make their case at a -- before a big audience at the san jose unified town hall meeting that's tonight for the whole district. the american academy of pediatrics recommends that middle and high school students start school no earlier than 8:30 in the morning. though i dug up a 2014 cdc study that revealed that the vast majority of secondary schools in the nation all start before that. 93% of high schoolers, 183% of middle schoolers start their day long before 8:30. as the students here at san jose

unified make their case to the district and parents they do have skriens on their side. i did research and found that teens need eight to ten hours a night of sleep according to the american academy of sleep medicine. and that teens get sleepier later in the night and so they need to sleep later in the morning. you can blame puberty for that, among other things. sleepy teens are more likely to be overweight, under active, have symptoms of depression and are likely to self-harm. also they have poor school performance. i want you to join the conversation on facebook and on twitter. i want to know what you think about starting the school day later in order to get kids a little bit more sleep. and i want to know how much your teens get to sleep. you can join that conversation on facebook, also put it up on twitter in case you're there. in san jose, kris sanchez, "today in the bay." >> our teen, not a lot of sleep. thanks, kris. new this morning, support services will be available for students and staff at an east bay high school. today after a student died over

the weekend. according to the east bay times that student at freedom high school in oakley died. the student and school hasn't said how the school died, but counselors will be available for grieving students and staff. there have been several deaths at schools in east contra costa in recent months. last week we told you about how four students have died so far this school year at liberty high school in brentwood. all those super bowl parties have the chp very busy overnight. nbc bay area went on a ride along, an alleged drunk driver was pulled over just 15 minutes into that ride. while we're still waiting for arrest numbers from last night we do know more than 300 dui arrests were made in the last two weeks alone. that's about 40 more arrests than the same time last year. if you drive during the commute hours you probably noticed this one, let's just say not everyone in the carpool lane is legally supposed to be there. so now transportation leaders are reportedly trying to come up with new ways to cut down on carpool cheats.

the ig -- or ij, rather, cites that mtc reports this morning indicating one in five carpool lane drivers is going solo against the law. mtc leaders are holding a meeting to figure out how new technology might be used as a deterrent. live to the richmond-san rafael bridge, you're going to notice some signs popping up on that span later today. the signs will tell drivers when it's okay to use the new third lane on the lower deck. the lane is nearly complete and it's expected to open in april. in fact, take a look at this video, when the lane is operational commuters will see a green arrow, it means you're good to use the lane, the red x that would appear means you can't, the testing of the signals starts today. leaders in alameda will reportedly debate a controversial strategy they believe can cut down on the number of car thefts. tomorrow city council members will consider a plan to add a dozen license plate readers, the devices would scan each and every car going to and from

oakland. that plan would cost about a half a million dollars. privacy advocates fear the data could end up in the wrong hands. happening today in san francisco, a group of restaurant workers fight for their tips. they plan to deliver some 300,000 comments to the department of labor's office in the city. they're protesting against the trump administration's proposal to give employers more control over workers tips and distribute them as they like. under an obama era rule employers are blocked from collecting tips. the public comment period for the new proposal ends today. if you look back in history we know that palo alto is home to the first children's museum west of the mississippi. today talks of rebuilding it moves forward. the city council will discuss plans to redesign the junior knew seem and zoo on middle field road tonight. the proposed construction project includes a new museum, education building and outdoor zoo. the museum has been around since 1934 and animals were added some 30 years later. there are now more than 50

species living at the zoo. i will be honest, even though i know about the museum i actually haven't been there. i always talk about going because they had a lego show that i really can't to get to. over here moving well, green around the south bay. we do have a delay across that dumbarton bridge, i was wrong, earlier reports said they pushed a lot of activity off to bay front expressway but there are still two lanes blocked, only three across that westbound direction for the dumbarton bridge. we just saw some of that slowing clearing, maybe they addressed that. i will get the update. the san mateo bridge picking up more volume. also 237 coming on the westbound direction, westbound 580 there is a crash along lake shore. tracking that, looking for a possible slowdown over toward the maze. we just have those metering lights lights on at the bay bridge of course we would expect that. a lot of people coming off of a nice weekend hopefully, i'm sure they are thinking about the next one coming up.

uncovered some key findings about the north bay wildfires. to see our reporting going to nbcbayarea.com/investigations. happening today, the aging vallco mall in cupertino is heading towards a major makeover. food city leaders will start looking at future plans for the mall. menlo park based company sand hill bought that mall a few years ago. according to reports the company wants to build a 15 block mixed use development with retail and housing. also being planned, creating the largest rooftop park. 5:44. new this morning the fleet of new trucks will start appearing in santa clara county, but the goal of these trucks is to rescue fresh healthy foods from going into the trash. trucks are part of a new program by the county to collect and redistribute already prepared food from businesses and universities straight to communities in need. not only is the county providing transportation, but it's also taking liability, clearing the way for businesses to participate. santa clara convention center is one of those businesses.

anything that was put in front of him so long as it was bipartisan and this deal is bipartisan. it was put together by senators john mccain, christopher kuhns. mccain one of the most powerful senators. we expect the pair will introduce the text of the bill today and it will include a path to citizenship. the daca deadline is in march but the government runs out of money again midnight thursday night. if the deal goes forward we expect congress will once again pass a continuing resolution, moving that shutdown deadline forward to a later date. meanwhile, reaction to the friday release of the nunez memo continues. this is the memo that fox news said would be the biggest scandal in american history. turned out to be somewhat unimpressive. it did succeed, though, in questioning the legitimacy of the fbi among conservatives.

the memo was written by republicans on the house intelligence committee and republicans who have a majority on that committee voted to release it and the white house approved. the democrats on the committee, mean while, led by adam schiff have their own memo but they are not allowed to show it to anybody. president trump doesn't want that memo released. president trump this morning tweeting about little adam schiff calling the congressman a liar along with the former head of the fbi and the former head of national intelligence. republicans onb! the intelligen committee assured americans the release of the memo had nothing to do with the mueller investigation into the white house, but it took the president less than 24 hours to seize on it. over the weekend he tweeted this, this memo totally indicates trump in the probe. so we will watch for that daca bill today and update it when we see it. you can always check me on on twitter, i'm @scottmcgrew. the time now 5:47.

weather as we were going to lead into the drought. so as we get a look at what's happening this morning as you're getting dressed it's a day for a jacket to start and then maybe a dress for the afternoon because it's going to be reaching into the 70s, feeling more like spring around the bay area and as we get a look at what's happening across the region still a lot of clouds just to the north of us. this has been here and producing some rain for the pacific northwest, for us high pressure blocks it and keeps it dry even as we go throughout the week. here is the rest of the weekend, our trend as it will get a touch cooler as we start to get a little bit of a reversal of the wind and that will help bring in an on-shore flow, bring down our temperatures along the coast in the low 60s and some low 70s for the inland areas, but it's going to be a very warm start to this week. mike, you have a big delay across the dumbarton bridge. look at the number behind me. we expect to see slowing across the bay bridge now, the metering lights are on so it's a wait to get there and show up the incline. the dumbarton bridge that's the

tough drive, almost 25 minutes longer than we would expect at this time of morning, getting across highway 84. 92, the san mateo bridge, that is a smoother drive. look at the difference in the sensors. also, though, we are looking at what is actually probably feels much worse than it looks on this map, you are probably jammed just after you pass the toll plaza all the way up to the high-rise. the good news is the tow truck is in route, the bad news it's been in route for 25 minutes. 237 is also a good alternate for you westbound through silicon valley in toward milpitas and sunnyvale. no problems for the south bay. over toward the bay bridge we do have slowing for westbound 580, that crash at lake shore and another around 14th both causing a slower drive. the nimitz is your best drive heading north and the backup at the bay bridge what you would expect. coming up, next season in full swing. what most americans are planning to do with their tax refund. but first happening now, a developing story out of china. eight people are dead after gas
