we made it to wednesday morning. taking a live look outside overlooking san jose. i saw blossoms on the trees yesterday. a little worried about those. it feels like spring, but we're not. maybe we will get another frost, we'll see. good morning. thanks for joining us, i'm laura garcia. >> and i'm marcus washington. let's go to the expert when it comes to the weather around here, kari hall, meteorologist. another warm day, but a little cool today. >> it does start out cool but does warm up as we go throughout the day. we see that happening very quickly as we go through late morning into early afternoon. here is a live look outside in san francisco with an all clear start and we are now at 53 degrees there, 50 in san jose and 47 in livermore. 40 in napa this morning. we are going to see those highs there up to 80 degrees, upper

70s across much of the bay area once again and we may see some more records set. we will talk about that and what's ahead for the rest of the week. mike, you're starting out with a look at a wide view of the bay area. that's right. there may be a closure, we will zoom in over toward the east bay, we show the green all over the bay, the wide look shows a great drive. there was a lot more slowing just a few minutes ago heading up highway 13 toward moraga avenue, there is an overnight closure in place possibly until 5:00 but they usually clear it about now. i will let you know if chp tells us about any other problems. the maze shows typical showing toward the caldecott. no problems over toward the bay bridge with no back up why just yet. it's very early. there's breaking news that we're covering out of oakland this morning. this is new video just into our newsroom of a deadly shooting in the fruitvale district. they found a man's body on chapman street west of 880 near

29th avenue. the street is still shut down. police say the victim is a 20-year-old man but that's all they're saying so far. no word on a suspect identity or even a motive. we will continue to follow this breaking story, bring you the latest information as soon as we get it. happening today, those looking to challenge santa clara county judge aaron persky in the june recall election can begin collecting signatures. >> candidates have until march 22nd to submit those signatures. yesterday santa clara county supervisors agreed to allow a recall measure for the june 5th ballot. there has been a swift backlash after he sentenced brock turner to six months in county jail for sexually assaulting a woman on stanford's campus in 2015. recall supporters say the punishment was too lenient. >> the voters will have an opportunity to weigh in on judge persky's pattern of bias in favor of privileged perpetrators of violence against women.

>> this judge did what other judges, i believe, would have done, i certainly would have done, which is to grant him probation and give him some time in jail. that's a lawful sentence and absolutely appropriate given the facts of this case. >> that was retired judge cordell, she supports persky. this is the first judicial recall in california in nearly 90 years. a case of animal abuse posted on social media. a puppy is safe this morning after several teenagers came to its rescue. the teenager who allegedly threw the dog is facing animal abuse charges. >> reporter: we are at the hollister animal shelter where little bella here is still recovering, doctors say she was allegedly thrown to the ground by her owner multiple times who was caught because he posted it on snapchat. police say three teenagers went to authorities claiming they saw video of an old classmate abusing bella, the 15-year-old suspect lives in hollister now,

he was identified by school employees, arrested last week. the dog was taken away. >> we were able to remove her at this time before any further injuries she could sustain. >> reporter: police say the snapchat video shows the five pound maltese a puppy of just eight months old, being thrown to the ground. police sayló witnesses saw at least two other videos of the boy allegedly abusing bella. >> what somebody's mental thought process to take advantage of someone or something that cannot defend themselves. >> by the way she was thrown she could have had some substantial injuries, so we were really pleased to hear that she was given a clean bill of health. >> reporter: the 15-year-old faces a felony animal cruelty charge. >> if anybody even thinks that there's people they know committing acts like this they should reach out to us. >> reporter: bella will stay at the shelter until the case is resolved or a judge resides otherwise, happy to be in loving hands. ian cole, "today in the bay."

when an undocumented immigrant accused of killing an nfl player in a dui crash is expected in an indiana court today. trump using the trial to call for more border security. indiana place say manuel orrego-zavala crashed into an uber car killing edwin jackson who was a passenger and the uber driver. the suspect has a record here in the bay area with two dui charges in san mateo county. he has also been deported twice. while president trump is going after the suspect's undocumented status the nfl player's family is not. >> we are very christian people and edwin was an all inclusive young man so that would not be their vehicle us. >> orrego-zavala is facing murder charges. to taiwan, the search for survivors continues after yesterday's 6.4 magnitude quake. this tilted building you see

there is a military hospital where many are believed to be trapped inside. so far at least four people have died and dozens are still unaccounted for. the epicenter was 100 miles south oflq taiwan's capital taii and the previous quake struck nearby on sunday. now to south korea. nbc's coverage of the 2018 winter olympics begins tomorrow night with the opening ceremony on friday. check this out, athletes are hitting the ice already. you're looking at u.s. short track speed skaters, they're practicing. here is someone you will want to watch. mamai baney is the first african-american black skater to make it to the short track. she moved to virginia with her father when she was six years old. stay with nbc bay area for full coverage of the olympics. garvin thomas is already in south korea to bring you live coverage. he will be joining us live from pyeongchang in just 30 minutes. >> we will take a look at what he will be talking about.

good tcjmorning, i'm eric chemy, here are today's tomorrow business headlines. we could be in for another wild ride in the markets today, stock seekers are pointing to a sharply lower opening this morning following the dow ricochetting a range of 1,000 points. it's the first time the dow has ever fallen or risen by 500 points in the same session. the dow, nasdaq and&ñ1/l s&p 50e monday. the markets have been oversr9.ñ amid concerns about rising inflation and interest 4 !rates. buyers returned in search of beaten down bargain stocks. the dow closing up 567 points t 24,912 the nasdaq jumping 148 to 7 #,115. toys "r" us says store closing sales will begin today at7n%f "r" us and babies r us locations

across the country. the liquidation sales are expected to be completed by april 15th. originally they planned to close 182 stores but has taken a dozen off the list as they were able to negotiate betting leasing terms with their landlords. chipotle continues to regain the trust of customers following a series of food safety issues in 2015. the chain says it's making signs to improve its reputation, this includes a training center for employees to improve hospitality and speed of service. they will also add a second make line to boost the number of orders they can handle and plans to launch a customer loyalty program this summer. back to you. >> you have to get sick somewhere it's hard to go back. >> big time. since we're talking about food, what do you think about lady doritos? >> interesting. >> they're not happening. that's the latest word from the snack maker pepsico. this week pepsi ceo announced her company is working on snacks for women because, quote, women

it's been all clear as you get ready to head out the door. here is a live look outside in san jose and we have had some cool mornings and here is what to expect. right now it's 50 degrees but look at that high, we're heading up to 77 today, going to be a chilly morning, we're keeping those skies clear and another day near record high temperatures once again and by tomorrow we will be a touch cooler, only a degree or two in some spots. as we look at where we're headed for today, going to see the high up to 74 degrees in milpitas and 77 in los gatos. in walnut creek today 76 degrees, oakland 76. 73 degrees in daly city and san francisco in the mid to upper 70s once again mission district 77 and 82 today in santa rosa. so how do you dress for this kind of weather? you do need layers starting out in the morning with cool temperatures, but maybe a hat will keep your head warm in the morning and give you some shade in the afternoon and also short

sleeves a good option. we still have the strong area of high pressure that is not budging at all and it's steering those storm systems to the north of us and then off towards the east. so we are still going to have this kind of weather pattern kicking in for the rest of the week and even into early next week. so we see no rain in the seven-day forecast, temperatures go from the mid 70s today to some slightly cooler once we get those gusty winds heading into the weekend, but unfortunately those gusty winds will also increase our fire danger. that's something we will have to watch, especially for saturday and sunday. mike, what does it look like as you head through the nimitz. we will look at 880, the live look shows an easy drive but you have a lot of company. northbound with those taillights heading up from the coliseum and south down towards san leandro, that's where we will jump on to our maps and show you i'm tracking a report of an issue, some sort of roadway hazard, all chp says is whatever it is it's

hard to see as you pass by south 880 at marina boulevard. no slowing over the last few minutes, no collisions with whatever is in the roadway so just watch that, be careful over there. the police activity we're tracking the investigation on chapman just off of 29th, the off ramp and on ramp are open, no slowing shows up there. a new issue a disabled vehicle south 680 around the walnut creek interchange. i will let you know if it causes a problem. a smooth drive all the way across the bay. no delays for any of theses rails and that's good stuff and a quick look at the north bay shows you san rafael we have a good flow of traffic from novato down to the golden gate bridge. tonight on nbc bay area news at 11:00 we have a bizarre story involving a dead woman, her trust account, credit cards and a discounted hardware store. >> >> good morning, this all

contra costa county water officials will discuss the planned expansion of the loss vsqueros reservoir. they had add more storage capacity to meet the water needs of 1.5 million people. the public meeting is planned for later this month. now to an nbc bay area exclusive, a surprise attack on the freeway. >> a woman's windshield was shattered on her drive home, now police are trying to find the person responsible. the woman was driving on i-80 in fairfield when a man through a metal pipe with a rope attached to it. she had this to say to the man who damaged her car and put her life in danger >> why would you do that? why would you intentionally try to cause an accident or hurt someone by throwing something on to the freeway? >> take a look at this, you can actually see the man who threw the object on the side of the freeway. police are looking for him and

as of now no arrests have been made. new this morning, the hepatitis outbreak in santa cruz county is officially over. that's according to health officials. the outbreak began in april. in total more than 75 people were infected and one person even died. the virus spreads through contaminated food and water and can affect your liver. a similar outbreak occurred in san diego last year. coming up on "today in the bay," nbc bay area responds. >> a car passes a 125 point inspection and later breaks down. i'm consumer investigator chris chmura, nbc bay area responds next. but first happening now, sacramento elementary school hopes to reopen for class tomorrow. officials had to shut down st. mary's school after the flu and other illnesses hit the faculty and students very hard. at least 11 teachers and other staff members were suffering from flu-like symptoms. plus heavy snowfall causing

major travel delays in the north half of france and paris, up to six inches fell on that region. hundreds of people had to spend the night trapped in their vehicles after city workers couldn't clear the roads in time. dozens of flights have also been delayed.

team to step in. here is consumer investigator chris chmura. good morning. emily bought a used 2007 mercedes from carmax. after just 1,100 miles it broke down and cost almost $500 to fix the ignition coil, just two weeks later she says another breakdown, in that case a mechanic recommended immediate transmission work that would cost $2,000. emily complained to carmax and she singled outbhdñ its 125 poi quality inspection, which she says helped persuade her to buy that mercedes. it passed that inspection. emily questioned how could that have happened. well, carmax told her to bring the car in for a look. here is theáything, the car wouldn't start. so for the next four months emily's mercedes sat in her driveway while she tried to get carmax to come out and help. that is when she called us. when we contacted carmax it
